We have emailed the client, asking for the best times to discuss any additional questions that he might have, so that we can accommodate his schedule. Pending his response, and confirmed receipt of refund, we believe that we will successfully resolve this complaint.

complete his petition. We determined that the documentation that we still needed to move forward was limited to the rolling documents that need to be updated each time we cross into a new month. We further gathered some new information about his debt profile and made some decisions about how he can best be helped through the bankruptcy process. The client is now satisfied with his result and he remains a client moving forward.

me that she could not speak to me at that moment and asked for a call back at 3:00 that day.  I agreed and called her back at 3:05 p.m.  There was no answer and no voicemail option.  I called again at 3:39 p.m. that same day.  Again, there was no answer and no voicemail option.The following day, on 5/10/16, I called her again at 2:38 p.m.  Once again, there was no answer and no option for voicemail.  I then sent the following email: Dear [redacted]     I called you yesterday morning and you asked me to call you back at 3:00 EDT.  I called you back at that time and there was no answer and no option for voicemail.  I called again a half hour later and, again, there was no answer and no voicemail option.  I called you a third time today and once again, there was no answer and no voicemail option.  I have been trying to reach you to resolve the complaint that made against our business with the Revdex.com.  Unless you call me back, there is nothing that I can do to help you.  Please call me at my number listed below at your earliest availability.     Thank you and have a great day![redacted]Managing Associate for Enhanced ServicesUpRight LawThe next day I still had not received a telephone call or email from the client, so I called again at 2:49 p.m.  This time, someone answered the phone and immediately hung up without saying anything.  I called back again immediately in hopes that the person who hung up did so by mistake, but this time the call went unanswered and there was no option for voicemail.  As of this date, 5/20/16, I still have not received any communication from this client by telephone, email or otherwise.To address the former client's original complaint, this former client has misstated the facts and the representations made by UpRight Law.  First, it was never said and it would never be said that UpRight Law will not acknowledge anyone until their fees are paid in full.  In truth, such a statement doesn't even make sense since taking payment from a client requires that we first acknowledge that they are in fact clients.  Second, it is simply not the case that UpRight Law does not work on cases until the fees are paid in full.  UpRight Law begins work on files at the moment the client signs up.  It is true that clients have to pay their fees in full to get the cases filed and complete the process of filing for bankruptcy, but there is an enormous amount of work done on the files prior to filing and that work begins at the moment the client retains this firm.  Third, this particular client never asked anyone at UpRight Law for a refund or even communicated that she would like to discontinue our services.  The last time that this client ever contacted UpRight Law was 11/18/15.  That call was not a cancellation request.  And finally, of the 13 payments this client scheduled, only 2 of them cleared.  The only reason that this case was not filed as scheduled was that the client failed to pay her fees.Since this former client is entirely unwilling to communicate with me and has failed to pay her fees, there is nothing that we can do to help her.  However, my door remains open to her if she decides to do the necessary work to get herself out of debt and on to the fresh start she was looking for when she asked us for our help.  We wish her the best of luck in the future.

concerns. Included in our core values is "Making Clients Love Us" and I take great care to ensure we do everything we can to meet that goal. My first and only communication with this client came on August 26th, the same day that this complaint was filed. I have tried to contact him many times since then to resolve this matter, to no avail. Earlier today I sent this email:

At UpRight Law we feel that our client relationships are among our highest priorities. We strive to cultivate an open, honest and professional environment wherein we can service or clients' needs with great care and a high degree of quality. To that end, I am trying to contact you so that we cam work together to solve your concerns.
On August 26, 2015 a member of my staff spoke with you regarding your cancellation request and request for a refund. That staff member communicated to me that you were unhappy with the refund policy that you agreed to when you asked for our help with your financial situation. On that same day, I called you and spoke with you about that refund policy. I also explained that we begin work on the files at the time the client agrees to hire UpRight Law to address the clients' debt concerns. At the end of that conversation, we agreed that I would complete a full accounting of all work that had been completed on your file and send it to you. You can find that accounting attached here.
Later that same day, before I had an opportunity to follow-through with our agreement, you lodged a complaint with the Revdex.com. In that complaint you alleged that we have not responded to an email that you sent on July 17, 2015 despite the fact that you spoke with multiple members of our staff, including me, that same day. Since that time, I have called you multiple times in an attempt to resolve this matter, including a call this morning.
At this point, I have to respond to the Revdex.com complaint. When a complaint is filed with the Revdex.com we have 14 days to respond. Today is the 14th day since your complaint. My response will include this email.
I am still willing to work with you to come to a resolution of this matter, but I need you to call me back.

Attached to that email was a full accounting of the file showing the many hours of work that we already put into the file. Still, if this client decides that he is interested in resolving this matter, I would very much like to find an agreement and my door is open to him.

This client contacted me back today. He has not yet reviewed the accounting that I sent to him. I offered to send him another copy to an email of his choosing. He indicated that he does not currently have access to email. I offered to send him a paper copy and he indicated that he would rather wait to discuss it with his wife and call me back at another time. I will be happy to discuss the accounting or any other concerns he has when he returns the call.

I am a managing attorney at UpRight Law.  Upon receiving this complaint, I immediately reached out to this client and we discussed his case.  This former client had originally discussed the possibility of filing a bankruptcy under Chapter 7 of the bankruptcy code.  Almost immediately...

thereafter, the attorney that was assigned to his case discovered an asset that would make filing this case under Chapter 7 risky for his ability to retain that asset.  That attorney spoke with the client about that problem and send him a contract for filing the case under Chapter 13.  The client and the attorney must have left that conversation with different understandings of the client's intention, because this firm has only extended contracts to move forward under Chapter 13.  In our conversation today, I explained to him why a Chapter 7 would not allow him to accomplish his bankruptcy goals.  The client understood and he thanked me for the explanation and time.  We resolved this matter on the phone and this firm wishes him the best of luck in all of his future endeavors.

Unfortunately we cannot resolve these via Revdex.com complaints and email exchanges. I have provided my direct contact number several times for Mr. S[redacted] to contact me. a number of things in this complaint that are important to clear up and understand.When an individual files for bankruptcy, all creditors known by the client and communicated to the attorney are included on the petition.  This happens by notification of the court at the time of the filing.  Cases are filed when the client pays the fees for the filing.  Until then, the law firm can contact those creditors who seek verification of representation, but no law firm can completely stop creditor calls until the case is filed.  This is because the creditors are required to follow the order of the court, not the request of the law firm.Secondly, there is no such thing a debtor's prison in the United States.  A person cannot be prosecuted criminally for owing money to another person and being unable to pay.  A person can be prosecuted for a variety of fraud charges for issuing bad checks, but that is not usually done unless the client repeatedly issues fraudulent checks or issues them for amounts far in excess of the balance of the account.  The district attorneys exercise their discretion to determine whether the client's behavior was criminally fraudulent or merely mistaken.  If the behavior was criminally fraudulent, then filing for bankruptcy will not make that person's crimes suddenly become non-criminal.We are a bankruptcy law firm.  We do not practice criminal law and we do not provide advice to clients regarding criminal charges or represent them in criminal actions.Next, when we are hired by any client we begin the work of preparing a bankruptcy case for them.  For some of that work, the client will be on the phone with the attorney or in the office with the attorney.  For most of that work, especially in the early stages of preparation, the work will be performed by the attorneys and the non-attorney staff outside the immediate view of the client.  This client spoke with 2 attorneys and a number of non-attorney staff members wherein they spent hours accumulating information from the client and preparing the case file.Additionally, our firm has licensed attorneys in every state in this country.  They practice in bankruptcy law every day and provide the highest level of legal representation and advice.  This client's legal issues were in no way caused or exacerbated by any lack of knowledge from UpRight Law.My line remains open to this client and if she decides to contact me, I will be happy to help her resolve her financial problems.
