My reason for declining their response is because they are lying that my case was filed due to the fact I never submitted the documents they needed to file and during my consultation I was told that I could get a refund if I changed my mind to proceed with my caseAlso, I was not rude to the staff, but I was upset that they were offering me $for no service rendered

I've received great support and understanding from everyone The lawyer provided for me contracted me immediately and assured me that I could contact him at any time if I had any issues or questions

I was extremely skeptical that this was even a real law firm at firstThouvht it was either a scam or just a third party correspondence company but it turned out to be the best n most legit company and a real firmThey handled everything from the start and even took care of a creditor harassment case that arose during the course of my filingVery professional and easy to work with and makes filing bankruptcy not feel so shameful and affordable to boot

I am the managing attorney at UpRight Law for our Enhanced Services Department When I was notified of this complaint, I reached out to this former client to speak with him about his concerns Unfortunately, I have not yet reached him and he has not yet contacted me
back.UpRight Law begins the process of working on cases from the moment we are retained by each client Every client is told this verbally at the time they retain UpRight Law and a contract for services is sent to every client which also explains this It is true that the cases are not completed and filed with the Court until the clients finish their payment plans and this is also explained to every client at multiple times throughout the process including at the time the client hires UpRight We further explain that if a client changes his or her mind and decides not to move forward, any refund will be determined by the amount of work that was already done on the file and the client agrees to rates of billing for that workEverything that UpRight Law agreed to do was done for this client The client retained UpRight Law, UpRight Law began working on the file, the client asked to cancel services, and a full accounting of services was prepared and provided to the client UpRight Law had an attorney contact the client and explain the accounting of services to him and he understood that since he had not completed his obligation to pay for his bankruptcy and UpRight Law had completed more that $1,worth of work on his file, no refund was dueThere is no half-way with bankruptcy This client complains that he did not realize any benefit for having paid $ We do not dispute this To gain the benefits of filing for bankruptcy, any client must finish their bankruptcy This client had not even paid half of his fees when he canceled services He did not finish providing the information and documentation required to file his case Providing some information, documentation and paying part of the fees will not get any client a discharge in any Court in this countryIf this former client would like to discuss this further or would like to make me aware of any special circumstances, I would be more than happy to work with him However, no law firm can refund money to clients that was paid for work which has already been completed

I am the managing attorney at UpRight Law for Enhanced Service. When I was informed of the frustrations of these clients I looked into the reasons for any delays or concerns that the clients had. After reviewing the file, I contacted them. Servicing our clients needs is our top
priority and, as such, I felt it necessary to begin that conversation with an apology for the delays they have experienced. Due to the need to have an attorney assigned to each case who is licensed in the same district as the client, when one of our attorneys move out of the district, it can take some time to get the case reassigned to a different attorney and this is precisely what happened here. I explained that to these clients and they were very understanding. I gave them my direct contact information so that they can reach me at any time in the future. I also made sure that the case is on track and moving quickly toward filing. These clients remain clients and we are very happy to be able to help them meet their financial goals

The people I spoke with were very professional and caringThey understood why I called them and were non judgmental in their responsesThey made me feel comfortable which I so appreciated

I am so lucky to have found a bankruptcy firm that is willing to help me get my credit back in order I have had contact from the attorney that will be handling my case and she seems really nice

After this client rejected this response, we were able to talk. I apologized to her for what she felt were lapses in communication and our failings in customer service. We discussed all of the matters that raised and we were able to come to a resolution. We are very pleased that we were able to help her all of her eligible debt and get her started on her path to financial wellness. We wish her all the best of luck in her future endeavors

highest priorityPart of this is establishing what can and cannot be done in the bankruptcy courtsWhen we tell a client what we can accomplish through the bankruptcy process, we are using the information that the client gives to us to establish the possibilities available to that clientIn this case, the client severely underestimated his income during the intake process, leading us to believe this client would be eligible to file under chapter When we learned this was not the case, we immediately informed him of this fact and provided him with a number of other options that he could pursueHe ultimately decided to pursue one of the options that we discussed and he is now satisfied with the result he obtained from UpRight Law

I am the managing attorney at UpRight Law for Enhanced Service We have been trying to contact this client since her cancellation request to go over closing out her file Unfortunately, she refuses to speak to us and acknowledges as much in her complaintShe submitted her
cancellation request on 4/4/ So far, we have tried to contact her twelve times She makes it clear in her complaint that she is not speaking to us because she believes our attempts at contact to be collection attempts In reality, we are trying to contact her to close out this file Since this is a law firm and she hired us to do legal work, we need to gain informed consent to close the file down and stop that legal work Immediately upon receiving her voicemail we stopped her payment plan, so she has not and will not pay UpRight Law for the work we performed at her request Her complaint states that she was intoxicated at the time she hired UpRight Law and made her first partial payment, but we had no way of knowing that and we began working on her file based on her expressed wishes.I would be willing to solve this issue for this client if she becomes willing to talk to us

I am a managing attorney at UpRight Law Unfortunately, I have not yet reached this client to discuss her complaint Since the time to respond to this complaint will expire on Sunday of the Thanksgiving holiday weekend, I am submitting this response in anticipation of being unable to
speak with her before the timeline expires. Without having spoken to this client, I am going to reframe from addressing the specifics of her complaint That being said, the amount any client is offered as a refund is the full amount that client paid, less the value of the work that was put into the case prior to the cancellation I will address that more fully with this former client when I reach her I’m confident that we will be able to quickly resolve this matter when we speak

I am the Managing Attorney at UpRight Law for Enhanced Service. When I found out about this complaint, I began the process of looking into this client's concerns. I then called the client and explained the following information to herWhen a person is in an active
bankruptcy, a group of laws that are collectively referred to as the "Automatic Stay" take effect that prevent creditors from engaging in collections activities against the client. In this case, the client filed her bankruptcy a little more than a year ago and her case is moving forward successfully. Since she filed under chapter 13, the protections of the automatic stay remain in effect for a number of years while her case continues to move forward to discharge. While we understand and empathize with the client regarding her frustrations, we cannot force another company to provide the customer service that she would prefer. The reason for that is that her mortgagor, in this case Wells Fargo, is concerned that if they send regular monthly mortgage statements, they will violate the automatic stay and a law firm like ours may come back and sue them for the violation.I have prepared and will be sanding a letter today to Wells Fargo to give them our expressed written consent for regular statements to be sent to the client. If Wells Fargo decides that they will not comply with this request, I cannot force them to do so. It is possible that clients in this situation will have to remember to pay their mortgage without regular monthly mortgage statements. While this could be frustrating for this client, the laws are there to protect them from ongoing creditor harassment after a bankruptcy has been filed. The laws are not set up to quell general customer service issues with a difficult creditor. They are there to protect consumers from from ongoing collections activities after the Court has stepped in to administer and reorganize debtsWe are very happy that we have been able to help this client along with her successful case and we will continue to work diligently with this client to see her case through to discharge

It's really helpful and thoughtful, not everyone have thousands of dollars to toss aroundA lot of us live pay check to pay check and that's meThis has really helped me accomplish my goal without going brokeLove it

I am the Managing Attorney at UpRight Law for Enhanced Service. When I was notified about this complaint, I contacted the client and addressed her concerns. The attorney in the UpRight Law network who was covering this area decided to pursue another career path and we have not yet found
another attorney to cover this area. We're terribly sorry for the inconvenience for this client and we wish that we were able to service her case. Unfortunately, we have not hired a suitable replacement yet. As such, we are refunding her all of the money that she paid. I gave her my personal contact information to use if she should ever find herself in need of help in the future and we wish her all the best of luck in her upcoming endeavors
