Please give me a call back at your convenience so we can resolve your complaint.There are a few things about your complaint that I think we need to address. First, I understand that you feel as though the fees for filing a bankruptcy are high as compared to your financial situation. That being said, the fees for your case were made abundantly clear from the outset of your representation and you signed your contract knowing all of the fees involved in the representation. Also, when you call another attorney who is hoping for your business, it stands to reason that such attorney would likely tell you that he or she is willing to do the case for less money because of that fact that any such attorney would like you to hire him or her rather than your current attorneys. It is also a complete falsehood that UpRight Law has a class action lawsuit pending. No such lawsuit has been filed or even threatened. Whoever told you that was either mistaken or lying. Lastly, I know that you believe the firm did not do any work on your behalf, but that is simply untrue. The firm uses the information that you provided to us during your intake to build out your case file, which requires work. The New York-licensed attorney from our office with whom you spoke was one of the many individuals who completed that work.Please give me a call back at your convenience so we can discuss this matter. of that, having a client feel as though her needs are not being attended to is unacceptable in our practice.  Unfortunately, this client has not yet had an opportunity to contact me back.  In my last communication with her, I wrote the following:Dear Ms[redacted]     I am a managing

I am the Managing Attorney at UpRight Law for Enhanced Service.  When I found out about this complaint, I began the process of looking into this client's concerns.  I then called the client and explained the following information to her.When a person is in an active bankruptcy, a group of...

laws that are collectively referred to as the "Automatic Stay" take effect that prevent creditors from engaging in collections activities against the client.  In this case, the client filed her bankruptcy a little more than a year ago and her case is moving forward successfully.  Since she filed under chapter 13, the protections of the automatic stay remain in effect for a number of years while her case continues to move forward to discharge.  While we understand and empathize with the client regarding her frustrations, we cannot force another company to provide the customer service that she would prefer.  The reason for that is that her mortgagor, in this case Wells Fargo, is concerned that if they send regular monthly mortgage statements, they will violate the automatic stay and a law firm like ours may come back and sue them for the violation.I have prepared and will be sanding a letter today to Wells Fargo to give them our expressed written consent for regular statements to be sent to the client.  If Wells Fargo decides that they will not comply with this request, I cannot force them to do so.  It is possible that clients in this situation will have to remember to pay their mortgage without regular monthly mortgage statements.  While this could be frustrating for this client, the laws are there to protect them from ongoing creditor harassment after a bankruptcy has been filed.  The laws are not set up to quell general customer service issues with a difficult creditor.  They are there to protect consumers from from ongoing collections activities after the Court has stepped in to administer and reorganize debts.We are very happy that we have been able to help this client along with her successful case and we will continue to work diligently with this client to see her case through to discharge.

documents that were necessary for properly preparing the bankruptcy petition. After a very short conversation about the remaining documents, the client was able to provide them and we finished the preparation of his petition. The client's case is now filed and the client has achieved the result that he was seeking.

I am the managing attorney at UpRight Law for enhanced service.  Immediately upon receiving this complaint, I contacted the client and reviewed her file with her.When any client hires UpRight Law, we begin working on that case immediately so we have the ability to prepare and file a petition in...

a timely fashion and get the client's file with one of our local attorneys to determine if there are any issues that may arise based on the information the client gives us in the intake.  Doing this requires a great deal of time, skill and knowledge of the practice area.  Since that time and effort cannot be returned to our firm in the event a client changes his or her mind, we make very clear to clients in the verbal retainer and the written contract for representation that any refund will be limited to an amount that the firm has not already earned at the time the client changes his or her mind.In this case, the client hired UpRight Law approximately 3 months prior to changing her mind.  During that time an enormous amount of work went into preparing her case for filing and she spoke with numerous attorneys on several occasions.  The value of the work completed was well in excess of $1,000.00 and she only paid $358.00.  Her complaint also states that she was denied a refund, but that is flatly untrue.  A voice message was left for this client today before this complaint was written asking the client to call back so we could discuss the process of closing out her file and determine a refund amount.  Rather than return that call, this client opted to go directly to the Revdex.com.  This was an especially unfortunate decision since our firm makes every conceivable effort to resolve all complaints prior to seeking outside mediation or consultation.Even in the face of all of these circumstances, UpRight Law remained steadfast to it's commitment to excellence and this former client and I were able to come to an agreement within mere minutes of speaking with one another.  We wish her the best of luck in all of her future endeavors and we will be here for her should she decide to move forward with her bankruptcy at a future date.

I am rejecting this response because: I was charged for fictions amounts. When I spoke to client services they were not helpful at all and rather then escalating the call they gave me excuses. These charges misconstrued because I canceled services with this third party provider. It’s wrongful and unethical to charge me more for administrative services then the actual lawyer which they provided.

upon her availability.Since I have not yet been able to reach her, I cannot verify the information in her complaint at this time.  That being said, if our firm made a mistake in processing a payment, that payment will be refunded completely with our most sincere apologies.  We also apologize for not having an individual immediately available to speak with her.  We understand that leaving a voicemail and waiting for a return call can be frustrating and we staff the firm with many people to service our clients' needs.  Sometimes, when all of those people are on the phone with other clients, a voicemail option is necessary to ensure no one goes without the ability to communicate with us.  As soon as she has the opportunity to return the voicemail that I left for her, I'm confident that we will be able to resolve this matter without delay.
