2015 regarding Viridian Energy.  In the complaint Customer states he is dissatisfied with his natural gas rates, he was not notified of variable rate changes, and he is awaiting confirmation of service cancellation.Viridian Energy records reflect Customer enrolled online on February 2, 2015 and selected a variable rate plan.  Customer selected a variable rate plan.  As per the terms of the agreement, variable rates may fluctuate from month-to-month based on market conditions and company operating factors, and are best for consumers seeking the flexibility to cancel at any time.  Viridian Energy strives to offer customers affordable energy, but does not guarantee savings.  Viridian Energy does encourage customers seeking price certainty and protection from market volatility to select a fixed rate product.  Additionally, variable rate customers are not notified of rate increases or decreases.  Fluctuations in the rate are inherent in a variable rate product. Customer called Viridian Energy on May 5, 2015 and requested to cancel service.  A drop request was immediately submitted to the utility.   The utility confirmed a service end date of July 23, 2015. I sincerely hope this provide a meaningful response to the complaint; however, if you have any questions, please do not hesitate to contact me by email at [redacted].Sincerely,[redacted]Compliance Coordinator

is in response to the complaint that [redacted] (“Customer”) filed with the Revdex.com on August 18, 2014.  The Customer’s complaint states that: 1) Customer did not authorize enrollment with Viridian Energy; and 2) Customer wants to return to [redacted]’s Standard Offer Service for his electricity supply.
Customer’s electricity and natural gas accounts were enrolled with Viridian Energy on April 19, 2014.  On May 5, 2014, Customer contacted Viridian Energy and requested cancellation of his natural gas account.  Viridian immediately submitted this cancellation request to Customer’s utility.  Customer has different account numbers for his natural gas and electricity accounts; both accounts numbers must be provided in order to process cancellations for both accounts.  Customer’s electricity account was not cancelled during Customer’s May 5, 2014 contact with Viridian’s Customer Care Department, because only the natural gas account number was provided.  In response to Customer’s complaint, Viridian Energy submitted a cancellation request for his electricity account today (confirmation # [redacted]93293195).  Customer will return to [redacted]’s Standard Offer Service in one to two billing cycles, as determined by Customer’s meter reading date and [redacted]’s switching timeline.

I am rejecting this response because: I still do not agree with this just because they say they sent me a welcome letter does not mean that I got one. I receive bills from [redacted] by using the internet and the bills do not say Viridian on them we have to down load a file to see that they are our carrier. The fact that I had an account set up by some one that I did not know and had to put a block on my account because of this is not right. Also I did contact [redacted] in November to try to fix the problem when I did find out that the reason my bills were so high is because I was with a Carrier that I knew nothing about. I will not change back to Viridian and the fact that they know that this was an issue if they were a understanding business and that they had someone working for them that set up an account for someone that did not authorize the set up this should mean something.  Sincerely,Ricky Gagno

and received on March 16, 2015 regarding Viridian Energy.  Customer’s complaint states that he did not realize savings by signing up with Viridian Energy.  As with any variable rate plan product, Viridian Energy’s Variable Rate plan may fluctuate from month-to-month based on a variety of factors including market conditions and company operating factors. Customer was presented with the Terms & Conditions regarding a Variable Rate product, both at the time of enrollment and in his Welcome Packet after his enrollment.  Although Viridian Energy strives to offer customers affordable green energy, Viridian energy does not guarantee savings as compared to another natural gas product.  In any given month, Viridian Energy’s rates may be higher or lower than the rates offered by another company.Customer enrolled in a Variable Rate and was properly charged for a variable rate therefore refund is not due. Viridian Energy is committed to compliance and customer satisfaction. response to the complaint that [redacted] (“Customer”) filed with the Revdex.com on October 16, 2014.  The Customer’s complaint states that: 1) Customer believed that she would save money by signing up with Viridian; 2) Customer believes that Viridian Energy is a scam; 3) Customer’s charges with Viridian were greater than if she had chosen to receive her electricity supply from a municipal aggregation; 4) Customer is upset that it takes 1-2 billing cycles to transition to her supplier of choice; 5) Customer would like [redacted]’s rate to be reflected next to the supplier rate on her bill; 6) Customer would like a refund.
Viridian Energy markets to [redacted] customers through its network of independent contractors known as Viridian [redacted].  Viridian Associate #[redacted], [redacted], who appears to be Customer’s relative, referred Customer’s account to Viridian. Customer’s referring Associate, [redacted], recently severed his relationship with Viridian Energy on September 30, 2014.  
Customer chose to enroll in Viridian Energy’s Variable Rate plan.  Viridian offers both Variable Rate and Fixed Rate plans.  Variable Rates may fluctuate from month-to-month based on market conditions and company operating factors, and are best for consumers seeking the flexibility to cancel at any time and the ability to take advantage of short-term price fluctuations.  Fixed Rates remain set for the agreed-upon term and are best for consumers seeking price-certainty.  Viridian encourages customers seeking price-certainty and protection from market volatility to select a Fixed Rate product.  
First, Customer’s complaint states that she believed that she would save money by signing up with Viridian. Viridian Energy strives to offer customers affordable green energy, but does not guarantee savings as compared to another electricity product. The prices of the utility’s standard offer service, as well as the prices of competitors are constantly fluctuating.  In any given month, Viridian Energy’s rates may be higher or lower than the rates offered by another company.  While Viridian Energy may be able to document savings to the utility’s standard offer at a particular snapshot in time, it cannot offer a general guarantee of savings.   It is also important to note that Viridian Energy offers premium renewable energy products.  For example, Viridian Energy’s [redacted] electricity product provides customers with 50% more renewable energy than state minimum standards.  As a result, a direct comparison between Viridian Energy’s electricity product and the electricity product offered by Customer’s utility cannot be made.
Customer’s complaint states that she believes that Viridian Energy is a scam.  It is not.  Viridian Energy provides a legitimate business opportunity to independent contractors to earn residual commissions for referring customers.  This business opportunity may not be a fit for all individuals as success is largely determined by the time and effort that one puts in.  
Next, Customer’s complaint states that Customer’s charges with Viridian were greater than if she had chosen to receive her electricity supply from a municipal aggregation.  Viridian Energy does not guarantee savings as the electricity product offered by another supplier. In addition, it is unlikely that Customer’s municipal aggregation is offering energy with 50% more renewable energy than [redacted] minimum standards.  Customer is free to select an electricity supply that makes the most sense for her, and could cancel with Viridian at any time.  
Customer’s complaint also states that she is upset that it takes 1-2 billing cycles to transition to her supplier of choice.  It generally takes one to two billing cycles to begin service with Viridian Energy and one to two billing cycles to end service with Viridian Energy.  This is due to the fact that the utility cannot add or remove a supplier during a billing cycle.  Viridian Energy does not have any control over this process as it is entirely determined by Customer’s utility and her individual meter read schedule.  
Customer’s complaint states that Customer would like [redacted]’s rate to be reflected next to the supplier rate on her bill.  Viridian participates in consolidated billing with [redacted], which means that [redacted] prints Viridian’s supply charges on its bill along with [redacted]’s delivery charges.  As it is [redacted]’s bill, [redacted] is responsible for designing the format and any price comparisons.  Viridian Energy does not have any control over how [redacted] designs its bills.
Finally, Customer’s complaint states that she would like a refund.  Customer has been appropriately charged for the Variable Rate that she selected.  As a resolution for customer dissatisfaction, Viridian can offer the Customer a one-time courtesy credit of $50 in conjunction with enrolling in a Fixed Rate.  This credit is offered for customer satisfaction purposes and is not meant to compensate customers for selecting a Variable Rate plan.  
Customer also mentions that she has a business account with Viridian Energy.  Our records indicate that Customer has not taken action regarding this account.  Customer also enrolled her business account in a Variable Rate.  Viridian Energy would be happy to assist Customer with any action that she wishes to take on her business account.

and received on March 19, 2015 against Viridian Energy.  Customer’s complaint states that: 1) different electric suppliers have been soliciting in his neighborhood and requesting to view his electric bill; 2) without his knowledge he had enrolled with a different electric supplier; 3) door to door sales representatives fail to provide him with information regarding his new plans or even make him aware of what changes are being made; 4) he wants to ensure that Viridian did not charge him an early termination fee (“ETF”), and 5) Customer is requesting to be added to the do not call list.Viridian Energy markets to [redacted] consumers through a door to door marketing program.  All sales agents are affiliated with a third-party marketer that markets exclusively for Viridian Energy in the state of [redacted].  Customer’s complaint states that different electric suppliers have been soliciting in his neighborhood and requesting to view his electric bill.  Viridian Energy cannot address complaints that Customer has against other suppliers marketing in his neighborhood.Customer’s complaint states that he was changed to a different electric supplier without his knowledge.  Viridian Energy’s records show that on January 21, 2015 Customer enrolled in a twenty-four (24) month fixed rate plan.  Customer did have knowledge of his enrollment as he confirmed his intent to enroll by completing a third-party verification call (“TPV”).  During the TPV Customer stated clearly that he was the one authorized to make decisions on the account and provided all of the necessary enrollment information.  Next, Customer’s complaint states that door to door sales representatives fail to provide him with information regarding his new plans or even make him aware of what changes are being made.  Again, while Viridian cannot address complaints that Customer has against other suppliers, upon enrollment with Viridian Energy Customer was sent a welcome letter [ATTACHMENT A] which included a statement of the agreed rate and plan with the Terms and Conditions.  It is important to note that after Customer received the welcome package, he had a second opportunity to rescind his agreement with Viridian Energy.Customer’s complaint states that he does not want to be subject to an ETF of $150.  Viridian Energy’s ETF for a 24-month contract is $50 not $150.  The TPV that Customer completed clearly explains Viridian Energy’s ETF and rescission policy.  Customer had the right to rescind his enrollment without any penalties or fees within (3) three calendar days after the enrollment.  On January 30, 2015 a drop request was submitted and the utility provided a service end date of February 27, 2015. Customer request cancellation after the rescission period, therefore he did not fulfill his contract and he will be subject to $50 early termination fee.  Finally, Customer requested to be added to the do not call list.  We have honored Customer’s request and added phone numbers linked to Customer’s account to its internal do not call list. Viridian Energy is committed to compliance and customer satisfaction. I have been a Viridian Energy customer for almost 4 years.
I have been very happy with the product and have saved money over that time.
I like knowing that I an contributing to a greener planet by using their energy supply while saving some money at the same time.
I recommend that a customer sign up for their fixed rate option because the variable rate fluctuates up and down and it is better to lock in for a fixed 1 -3 years so you do not have to worry about sky rocketing energy prices.

I would greatly appreciate a copy of the agreement you have on file and how we are to be provided with the variable rate and its changes. Where do we find this information so that we know what the proper rate should be or should have been each month? Please advise. The current billing from [redacted] shows your firm is charging 0.1699, well over the current [redacted] rate.

Re: [redacted], Case # [redacted]Dear Ms. [redacted]:On February 18, 2015 [redacted] (“Customer”) filed a complaint with the Revdex.com and on March 2, 2015 Viridian Energy (“Viridian”) responded to Customer’s complaint.  On March 12, 2015 Customer filed a rebuttal that states: 1) There were five consecutive months where Customer’s Variable Rate did not change; 2) Customer does not feel that she has transparency into how Viridian sets its Variable Rate; and 3) Customer requests an adjustments to last year’s monthly charges.  First, Customer’s rebuttal states that there were five consecutive months where Customer’s Variable Rate did not change.  Please understand that enrollment in a Variable Rate does not guarantee that the rate will change, it only indicates that the rate is subject to change based on a variety of factors.  Although, a Variable Rates may fluctuate from month-to month, it is also possible that the Variable Rates may remain steady for a period of time.  For example, the 2013-2014 [redacted] caused an extreme increase in the market price of electricity, and rather than passing this cost through to Variable Rate customers during the span of one month, it spread out the cost over the span of several months.Next, Customer’s rebuttal states that Customer does not feel that she has transparency into how Viridian sets its Variable Rty service to the customer.  There are several factors that determine Viridian’s Variable Rate, including market conditions and company operations.  For customers that are looking to independently calculate the applicable monthly variable rate, Viridian offers its Term Free Index Rate product.  The publically available index allows consumers to independently calculate their variable rate.     Finally, in Customer’s rebuttal she requests an adjustment to last year’s monthly charges.  Customer enrolled in a Variable Rate and was properly charged for a Variable Rate.  As a result, a refund is not due.I sincerely hope this meaningfully responds to the above complaint.  If you have any questions, please do not hesitate to contact me by email at [redacted].Warmest Regards,[redacted]Compliance Specialist
