It is the deliberate, misleading business practices of your company which created theses concerns and led me to engage the Revdex.com on my behalf.Your company cannot be trusted with the sales of your vehicles, therefore; I don't trust them to adequately address the issues without an intermediary.Quoting the EPA, stating the vehicle is safe and can be resold, does nothing to address my concerns. If Nitrogen Oxides (NOx) are regulated, it's because when they are present in large amounts, it's considered incredibly unsafe. My vehicle exceeds the regulations by 40 times the legal amount.This also has a significant impact on the value of the vehicle. The global stigma attached to my vehicle makes it far less valuable.Besides, selling my vehicle under these circumstances isn't ethical, which brings us back to my original request to have it repurchased by your company. level. At this time, Volkswagen is not offering an incentive nationally due to the Takata airbag recall. The National Highway Traffic Safety Administration (“NHTSA”) has instituted a Coordinated Remedy Program (the “Program”) to replace Takata airbags according to a schedule that reflects NHTSA’s own determination of the relative risks facing drivers. The Program requires manufacturers to adhere to the recall schedule that NHTSA developed in accordance with its own risk assessments of airbag rupture. (See U.S. Department of Transportation Expands and Accelerates Takata Air Bag Inflator Recall To Protect American Drivers and Passengers, NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION (May 4, 2016).) According to NHTSA, “[t]his recall schedule ensures the inflators will be recalled and replaced before they become dangerous, giving vehicle owners sufficient time to have them replaced before they pose a danger to vehicle occupants.” (Id. at 1 (emphasis added).) NHTSA has mandated that “replacement inflators will be made available to the highest-risk vehicles first,” and determined that it will take “6 to 25 years” of “service life” before any of the Takata airbag inflators will “pose an unreasonable risk to safety.” (See May 3, 2015 NHTSA Amendment to Nov. 3, 2015 Consent Order ¶ 8.) While the repair history of your client’s vehicle does not meet state or federal requirements for a repurchase or replacement, please know that we are working closely with the manufacturer to secure the necessary parts, tools and defining the procedure(s) to rectify this issue. I am rejecting this response because: Volkswagon Group of America continues to reject warranty claim based on my vehicle not having a Misfueling Guard installed on the vehicle even though I never received a service notification to have a Misfueling Guard installed. I am not a laywer, but your the assumptions that I recieved this service notice is just as good as my assumption you did not mail it to me.If this is not the reason for denial of my claim? Please provide specific reasons for the denial of my claim and not this broad and liberal view that VW is taking on how it administers this warranty. Including the repairs already done on the vehicle and the HPFS that needs to be done, repair cost for this vehicle will exceed approx. $13,000 which is over half the purchase price of the vehicle and the vehicle is just over 5 years old. I had many options available when choosing a high mileage vehicle when I decided to give a VW Jetta TDI a try save money, this has not been the case. I urge you to reconsider your position.

I am rejecting this response because:1. I have received 2 separate letters that list my Vin Number for my 2013 Volkswagen ** first letter was sent in February 2016 and another in April 2016. The Safety Recall [redacted]- [redacted] Driver Frontal Airbag [redacted]: [redacted]. The letter states clearly that the notice is referencing my vehicle : Vin [redacted]. The also references that [redacted] has reported that the frontal airbag inflator could potentially rupture if the vehicle is involved in a crash where the the airbag are designed to deploy. In the event of the inflator rupture, metal fragments could pass throught the airbag cushion material, which may result in serious injury or death to vehicle occupants. The is recall is conducted as a precautionary measure. The letter also goes on to say that the replacement parts are not available at present time. 2. I checked on the recall/service lookup and it list the my vehicle vin number to be included in the recall under the www.vw.com. I also contacted the customer CARE and spoke with Vicki on 6/29/16, who verified that my 2013 Volkswagen ** Sport is indeed on recall. She gave me a Case Number [redacted] to document the call. I was told at the time of the call that no current ETA on the repair was given by [redacted] to when the parts would be available. That such response by Volkswagen is unacceptable and unsatisfactory, especially since the recall affects my safety. The lack of effort on Volkswagen to repair / replace the airbag listed in the safety recall [redacted] is unreasonable. I understand that the parts are essential for the repair but we are into five months where no date is even available to estimate when that the repair will take place, meanwhile I am faced to drive a vehicle that compromises my safety in the event of an accident. Volkswagen is on notice that I DO NOT FEEL SAFE in my vehicle until the repair is made. Make no mistake that I will be in pursuit of legal action if this matter does not resolve to my satisfaction. It would be in the best interest to resolve this matter immediately with repair. Sending out recall letters does not remove Volkswagen from liability from the [redacted] Airbag mess, especially if they are expecting them to provide the parts. Honestly how does one know that the repair parts provided by [redacted] are going to be appropriate and sufficient?3. I will not be accepting ANY other response from Volkswagen unless it involves the repair Safety Recall [redacted]- [redacted] Driver Frontal Airbag that applies to my vehicle [redacted]. I suggest another review of my vehicle will locate this IMPORTANT SAFETY RECALL.
