Good afternoon Ms***, I am responding to a complaint that was received today at AD Meyers UniformsThe complaint is dated Thursday 06/8/with a reference ID *** The complaint was in regards to the shipping time for a pair of boots (Reebok Stealth 8" Boots SKU ***) Mr***
placed his order (***) on 5/25/At the time of placing his order, he would have received a notice listed within his "shopping cart" that the boots in question were back ordered and not in our current warehouse inventoryAt that point his boots would need to be ordered and delivered by our boot vendorThe turn around time on ordering and receiving boots from our vendor averages between 7-days, if the vendor has the boot available in inventoryOnce the boot arrives in our warehouse, we then begin our processingIn this specific case, we received the boots from the vendor on June 8th, and his boots were processed and shipped on June 9thFedEx tracking # ***All of this occurred within a holiday window (Memorial Day) that would adversely affect processing and delivery timeWe here at AD Meyers try to be as up front and as transparent as we can to keep our customer's notified of their order statusUnfortunately in Mr***'s case, he placed several orders for assorted back ordered boots, which he would cancel all within weeks*** Ordered 5/complaint file 6/- days (business days), shipped on 10th business day *** Ordered 5/canceled 5/- days (business days) *** Ordered 5/canceled due to being discontinued 5/- Days (business days) All of these orders, when combined with the notification in his "shopping cart" of the items being back ordered along with the stated processing time of back ordered items listed on the website ***Mr***'s complaints of waiting weeks for orders still listed as processing and his stated expectation of his orders' turn around time listed in this complaint, would seem to be inaccurate and invalid when taken into account with the information available to himWe value each and every one of our BOP customers not only because of their business but because they risk their lives each day to protect our nationIt was a pleasure to serve Mr*** and I hope that the information provided can resolve this casePlease feel free to respond at your earliest convenienceAnd I can provide documentation for all of the listed orders with order and cancellation dates upon requestThank You Warehouse Manager

I am rejecting this response because: I do not agreePlease provide me a copy of this signed contractBecause I don't remember traveling across country to sign any documentsI also do not remember uploading a SDS "secure digital signature" to your siteWhat your company has is a terms of use policyI believe due to the lack of competently maintaining your companies customer accounts you are liable for returning my moneyIf you believe that to be a disputable claim please take a look at the random plus and minuses from my account that make little to no senseI do not have a line of credit with your company so no consumer credit regulation applies hereYes you are not a bank so you cannot hold my money and quote consumer credit regulatory statutes

Priority Toyota They left me a message earlier last week stating they sent Kea check for half the amount and another message asking me to come by for programing my radioWhen the time came to get the months free subscription radio programmed they are now saying they never came to a solution or agreed to I will be paying for this after it was advertised and promised by several of their staff members and management. They have no desire to follow advertisement laws or do the right thing. *** ***

We have reached out to the customerHe has stated that he would like to add a warranty to his deal and then he will provide us with proofs for registrationWe are willing to oblige ** *** and add the warranty FIRST and then he will provide the proofs after he receives confirmation that the
warranty will cover any repairs he may need.

As Mr*** stated yes his vehicle has been here Since OctoberWe explained to Mr*** with the extent of damage he WOULD run out of rental and this vehicle would be here quite some timeHe understood and chose to keep the vehicle here to have repairs done.We did not get the approval to start
repairs until November 14thWe were waiting on insurance to see if vehicle was repairable, or if it going to TotalParts were ordered and Mr *** was updated that we should have the frame rails end of next weekHowever on November 21st we only received of the special order Frame railsThe 2nd frame rail did not come in until Jan 27th of the following week. We have kept Mr *** updated through out the repairs process to the best of our ability as he statedYes several updates were the same as this is a very large repair which included removing the motor, extensive frame damage, and parts delaysWe are looking for a completion date to have repairs complete on or no before Jan 10thWe want Mr *** to have his vehicle back but we must make sure everything is correct including a good test driveI spoke to Mr *** on Thursday Jan 4th explaining where we are at and that we were getting very close to having completedWe apologize for the issues this has caused Mr ***, but we explained he would run out of rental and it would take some time to complete repairs

We will reimburse the $as well as provide the warranty and add it to your finance as requestedWe are doing everything you have asked for and are requesting

Please have customer return and see me(Bobby B*** - Service Director) I will do my best to make sure that the radio and oil light are repaired

time you took to relay this informationWe have completed our research and wanted to provide you with our findings.In your inquiry you stated the following:• A week before closing the underwriter tells us they need more documents• After providing the documents the closing date was moved to July 28th• FGMC waited until a day before closing to tell us we could request a letter from our landlord to show our rental payment history• In order to extend the loan another days we were required to pay $to HUD without telling us if they would give us the loan• It had been two full months since we had put in our offer on the house• I have no other debt other than about $5,in medical bills which is not supposed to be used according to FHA guidelines• My rental history shows no late payments• As the demands piled up, and the refusals of First Guaranty to accept any of our documents (despite it was exactly what they were asking for) my fiancé and I thought this was because we are homosexual• I feel that First Guaranty deliberate left out information setting us up to fail on fulfilling loan requirements within the allotted time frameBased upon our research, please find our response below:You stated, a week before closing the underwriter tells us they need more documentsThe file had not been cleared to close and had not been scheduled for closing at this time.You stated, after providing the documents the closing date was moved to July 28thThe file was not cleared to close and the underwriting process had not been completedThe loan had not yet been scheduled for closing.You stated, FGMC waited until a day before closing to tell us we could request a letter from our landlord to show our rental payment historyDuring the underwriting process the information provided must be reviewed and determined if the documents provided complete or fill the requirement neededThe documents provided had to be reviewed and it was then determined that the rental payments were not made from a personal checking account but rather with cash and money ordersAs the underwriter was not aware that the payments were made by money order prior to the review we were not able to advise what additional documentation was needed.You stated, in order to extend the loan another days we were required to pay $to HUD without telling us if they would give us the loanWe are required to follow all regulations and requirements set forth in accordance with HUD (Housing and Urban Development) throughout the loan origination process.You stated, it had been two full months since we had put in our offer on the houseOur records indicate that the loan was originated through a broker, *** ** *** (***)FGMC received the first application dated June 8, 2017, and started the fileWe attempted to contact the broker three times, to request the required documents to process the loan.We received no response from the broker and were not able to accept the loan application as the wholesale loan submission form was missingThe Wholesale Submission Form, is required by FGMC and must be signed by the Broker including a list of all fees to be charged to the applicant and the completed Mortgage Loan Originator Certification.As this was not received from the Broker in the required timeframe the loan was not processed.On June 9, we received a newly submitted package from the broker and began reviewing the documents received (***).You stated, I have no other debt other than about $5,in medical bills which is not supposed to be used according to FHA guidelinesThe borrower has medical collections on their credit report which are not required to be considered in the borrower’s debt to income ratios, however, per HUD HB 4000.1s manual underwriting guidelines require the documentation reasons for approving a mortgage with any type of collection accounts.For manually underwritten loans, the lender must determine if collection accounts were a result of:• The borrowers disregard for financial obligations• The borrower’s inability to manage debt• Or extenuating circumstancesThere was limited credit, all cash payments to a private landlord and missing one recent month payment on rent; not able to utilize private Verification of Rent (VOR) without proof of payment, rent was made by money order paymentsDue to these listed items we were not able to provide an approval on the loan.You stated, my rental history shows no late paymentsWe were not able to confirm the March rental payment with the information providedAs this payment was not able to be documented the loan was denied on August 10, The denial letter was mailed to the mailing address of the borrower on the same day.You stated, as the demands piled up, and the refusals of First Guaranty to accept any of our documents (despite it was exactly what they were asking for) my fiancé and I thought this was because we are homosexualWe have completed our research and determined that no discrimination has occurredFGMC complies with all fair lending laws and regulations and does not discriminate against any credit applicant on the basis of race, color, religion, national origin, marital status, age (providing the applicant is of legal age and has the capacity to enter into a binding legal contract), sex, disability, familial status, receipt of public assistance, or if the individual has exercised in good faith any right under the Consumer Credit Protection Act, or on any other prohibited basisFGMC also prohibits discrimination against any credit applicant on the basis of sexual orientation or gender identityIt is FGMC’s goal to provide consumers with equal access to credit.You stated, I feel that First Guaranty deliberate left out information setting us up to fail on fulfilling loan requirements within the allotted time frameThis loan was being underwritten through our relationship with our broker, *** ** ***FGMC did not have direct contact with the borrowerIt is the responsibility of the broker to provide the requested information to the borrower timely and submit for review to FGMCWe found no error occurred during the loan processAll documents were reviewed and decisioned within the required timeframe.Thank you for taking the time to share your concerns and experiences with usIf you have any questions or need additional information, please contact me at *** Monday through Friday 8:am to 5:pm Eastern.Sincerely, Alice F
