The Complainant has been contacted and a settlement agreement has been reached The check has been issued, and we consider this matter closed

Our file reflect that a message was left with the insured customer regarding total loss but that we did not get a return call We will reach out again to Mr [redacted] at the number provided to resolve his total loss claim Thank you bringing this matter to our attention and we apologize if his calls have not been routed to the correct handling adjuster

We received first notice of a theft loss from the Complainant on May 2, The handling adjuster immediately began his investigation, and later our Special Investigation Unit became involved A forensic specialist was also enlisted to assist with the investigation, and his inspection of the Complainant's vehicle resulted in a determination that there was no forcible entry to gain access to the vehicle, and the vehicle was last driven with a properly programmed key Given that the Complainant had said in an interview that she had two sets of keys both of which were accounted for, Founders Insurance Company denied coverage based on two exclusions in the policy issued to her These exclusions preclude coverage if there was no forcible entry, if the keys were left within the vehicle, and if evidence indicates the ignition wiring was not altered or changed to allow the operation of the automobile without keys Our file reflects that the adjuster did return calls to the Complainant throughout the process, sometimes only able to leave messages and other times speaking with her When a decision was made to deny coverage, a denial letter was sent to her

Please be advised that the unrelated prior damage does factor in to the overall value of the vehicle As previously explained, the base value of the vehicle was $however there was $in unrelated damage Founders Insurance Company has extended a settlement offer of $in an attempt to resolve this matter and our position remains the same Our settlement offer is still available to the complainant should he choose to accept

The Complainant is a third party claimant pursuing a claim against our Insured's policy His vehicle was deemed a total loss as a result of an accident with our Insured His vehicle is a [redacted] with 158,miles on it, and it has over $1,in unrelated, prior damage We obtained a based value on the vehicle of $1,773, which means the vehicle has a negative value Despite this, an offer was made to the Complainant to settle his claim in the amount of $200, which he rejected The offer remains open to him if he wishes to reconsider

Complaint: [redacted] I am rejecting this response because:We were finally contacted by Founders Insurance, and they did make an offer on the vehicle of $ Our insurance company had also sent a claims adjuster weeks ago, and they valued the car at $950, nearly times what Founders offered As with the dozens of other complaints about the company, it seems that Founders Insurance is painfully slow in processing claims, expecting the claimant to take an absurdly low offer after waiting for weeks on end for a resolution In my case, the supervisor I spoke too specifically said she was happy that my insurance company would give me a better settlement They assume that I'll take the substantially higher payment from my reputable and trustworthy insurance company rather than fight this pathetic excuse for a business and risk weeks or months of further dispute Pathetic Sincerely, [redacted] ***

Mr [redacted] vehicle was inspected on May 13, Founders received the estimate on 5/13/and on 5/17/(business days later) the Founders Staff appraiser determined that the vehicle was a possible total loss and needed a re-inspectionThe re-inspection was completed on 5/25/and Mr*** was advised that his vehicle was a total loss on 5/26/Founders handled the claim in an expeditious manner

Please be advised that the complainant in this matter is not our consumer but rather a third party claimant pursuing damages against our insured's policy for insuranceUpon our notice of this loss, the handling adjuster immediately began an investigation into this matter Please be advised that our inspection of the complainant’s vehicle revealed that the damages exceeded the value Accordingly, the vehicle was deemed a total loss Upon completion of our investigation into coverage for this loss, the complainant’s file was referred to our Total Loss Department where the actual cash value of the vehicle would be obtained and discussions of settlement would take placeOn March 31, the handling adjuster spoke with the Complainant who advised that the file was now with the Total Loss Department and that upon completion of our valuation, she would be contacted regarding settlementWhile completing our evaluation of the complainant’s vehicle, we noted that the appraiser, [redacted] of PDA East StLouis, noted that there was prior damage to the vehicle in the form of “cracked fenders.” An estimate for the cost to repair the damaged fenders was subsequently written and was completed on April 12, On April 13, 2017, the handling adjuster received the requested information needed to complete our evaluation The actual cash value of the vehicle was $after the appropriate deduction for prior damage and the salvage value of the vehicleThis amount reflects a CCC Value of $1,less unrelated damage of $1,and a $salvage deduction In an attempt to resolve this matter, the handling adjuster extended a settlement offer in the amount of $ The Complainant rejected our offer and requested to speak with a member of management I spoke with Ms [redacted] briefly and explained that the unrelated damage does adversely affect the value of the vehicle The Complainant advised me that she recently purchased a battery for the car and a new tire so that all the tires had matching whitewallsI advised the Complainant that I would review the file and would get back to her with a response Upon my review I discovered that the independent appraiser noted that the unrelated damage would total $ While no estimate was provided I used this amount in an attempt to resolve this matter with the Complainant Additionally, the Complainant advised me that the new tire cost her $and I added that to the value of her vehicleI contacted the Complainant and extended a revised offer in the amount of $The Complainant advised me that she will not be acceptingCorrespondence was mailed to the Complainant providing a breakdown of the offer I have attached a copy for your review Should you have any additional questions regarding this matter, please feel free to contact me directly

Please be advised that the complainant in this ***er is not our consumer but rather a third party claimant pursuing a claim against our insured's policy Upon our notice of this loss, the handling adjuster immediately began an investigation into this ***er Our investigation into the facts surrounding this loss revealed that our insured was the proximate cause of this lossAn inspection of the third party’s vehicle determined it was a total loss on October 31, The adjuster obtained authority to transfer the file to the total loss adjusterThe total loss adjuster made an offer on November 16th which was acceptedThe title was received on November 21st and payment issued the same dayShould you have any further questions, please feel free to contact me

We have not denied the Complainant's rental out of pocket Again, rental is on a reimbursement basis, and he was informed of this He has not sent us a copy of his rental receipt, but when he does it will be evaluated for settlement of this aspect of his claim

A representative of the Complainant's insurance company reported the loss to us and arrangements were made for the Complainant to take her vehicle to a recommended shop for an estimate We have the estimate, but the handling adjuster needs to confirm the facts of loss with our Insured Unfortunately, our Insured has not responded to his efforts to gain her cooperation The Complainant was contacted by the adjuster on June 6, and advised the status of her claim

The Complainant is a third party claimant The Complainant reported this loss to us on March 25, 2016, and a claims service representative requested two estimates from her A claim form was also mailed to the Complainant, and on April 4, the Complainant left a message for the handling adjuster The adjuster retuned her call on April 5, and during the conversation the adjuster reiterated the need for the Complainant to send us two estimates, and the adjuster also requested photos The Complainant stated that she had already submitted the estimates, but they were not on file, which the adjuster explained On April the Complainant left the adjuster another message requesting a return call We still had not received the estimates and photos The adjuster returned the Complainant's call on April and explained again that we needed two estimates and photos The Complainant claimed she had not been informed of this, and the adjuster reminded her of their April conversation We received the claim form completed by the Complainant on April but we not the estimates and photos We received one estimate and photos on April 22, and we received the second estimate on April The estimates are inconsistent and include damage that may not be present Adjustments are being made, and after this is done, the Complainant will be contacted with an offer

Upon first notice of loss the handling adjuster immediately recognized a coverage issue, as the individual reported as the driver of the insured vehicle was not scheduled on our Insured's policy A coverage issue arises when there is a possibility that an insured, a first party to the contract, has not complied with all of the conditions of the insurance contract Provided an insured has complied with all conditions of a contract, an insurance company, the second party to the contract, has a duty to indemnify The Complainant is a third party, and liability is a moot point if there is no coverage An investigation was conducted, which included our Special Investigation Unit, and upon conclusion of our investigation, it was determined that we will afford coverage The Complainant's vehicle has been deemed a total loss, and a total loss adjuster will be in contact with the Complainant to advance his claim forward

All of our recommended shops guarantee their repairs Regarding the Complainant's demand that we pay for a rental in advance, we only offer rental reimbursement Therefore, our offer remains the same for the damage to the Complainant's vehicle, and our position on the rental also remains the same

The Complainant is a third party claimant pursuing a claim against our Insured's policy On March 27, our Insured reported that he had been in an accident, but he did not provide us with any of the Complainant's information On March 28, we received an online loss report filed by the Complainant and one of our claims service representatives attempted to contact him the same day Our file reflects that when she called him someone picked up but the call was disconnected On March the Complainant called, and an assignment was made for an appraiser to inspect his vehicle and write an estimate On March the handling adjuster returned a call to the Complainant who informed the adjuster he had rented a vehicle The adjuster explained that we pay for rentals, but it is on a reimbursement basis The adjuster also explained that she had not yet received the estimate on his vehicle but would call him upon receipt; we have not received the estimate yet

Please be advised that upon our notice of this loss, the handling adjuster immediately began an investigation into this matter The complainant is attempting to pursue a claim through their policy with Founders Insurance Company for damages to their vehicle However, a review of their declaration page revealed that they did not purchase collision coverage with Founders Insurance Company Accordingly, Founders Insurance Company will be unable to assist the complainant with the repairs to their vehicle Should you have any additional questions, please feel free to contact me

The [redacted] vehicle is a [redacted] Our insured struck the passenger side of the vehicle The vehicle was determined to be a total loss, but in this case the vehicle had unrelated prior damage that exceeded the value of the vehicle The vehicle is in very poor condition and has over 200,miles An offer of basic transportation has been extended and rejected We mailed out the offer letter and forms in case Ms [redacted] changes her mind We regret that we cannot offer more as the valuation of the vehicle is less than the prior damage, not caused by this accident If Ms [redacted] wishes to accept the total loss settlement she may contact us and return the paperwork

Upon our notice of this loss, the handling adjuster immediately began an investigation into this matter A coverage issue was identified as the reported date of loss needed to be verified Accordingly, a coverage investigation commenced Upon completion of our investigation into coverage for this loss, Founders Insurance Company determined that coverage would be afforded for this loss With coverage resolved, the handling adjuster turned their attention to the damages being claimed The complainant has advised that damages to both the left rear quarter panel and the right rear quarter panel are as a result of this accident However, our review of the damages revealed that only the left side damages are related to this loss Accordingly, the handling adjuster contacted the complainant and extended a settlement offer in the amount of $ This amount reflected the damage estimate in the amount of $less the complainant's $deductible, less betterment of $due to prior bumper damage International Auto Rebuilders located at NKedzie Avenue in Chicago IL can repair the vehicle per this estimate The complainant has rejected our offer Our settlement offer is still available should the complainant choose to accept Please feel free to contact me with any additional questions

There is a residency coverage issue, and we need the Complainant's driver's license number The handling adjuster will follow up with her to obtain the information and documentation needed

Complaint: [redacted] I am rejecting this response because: I have had no problems contacting the insured She filed the claim on line with Founders right after the accident Sincerely, [redacted]
