I have reviewed the customer’s rejection of our
response. 
The customer was referred to contact the repair shop that
completed the power steering system repairs due to pending warranty on the
repair work completed there. Any concerns with the workmanship of these repairs
would need to be addressed with the repair shop directly.
As stated in prior correspondence, I have noted the
customer’s suggestions regarding their concern with our warranty processes and
shop referrals.
The contract application was attached with prior response.

Rejection response
I have reviewed the customers’ rejection of our response. As
stated in prior correspondence, the repair claim was paid in accordance with
the terms of the vehicle service contract regarding labor coverage.
As a goodwill gesture to the customer, I will agree to
reimburse the additional $12.50 per hour for a total of 15.6 hours of covered
labor. That would equal $195.00. I would ask the customer to contact me
directly to process the goodwill reimbursement payment to him.
A copy of the service contract application was included with
initial response.

We shall issue a pro rata refund of the amount received by Us from the Selling Dealer based on the lesser of the remaining time or mileage on this Contract, deducting any claims paid or approved for payment by Us and a fifty dollar ($50) service charge. All cancellations must be processed through the Selling Dealer or Your Lien Holder.
If the above conditions for cancellation are met, the customer is urged to contact their selling dealer to submit a cancellation request.

I have a 2008 gmc sierra with 99k miles which developed a rod knock, took my vehicle to the dealer and had them start a claim with this company for the repairs. Their inspector of the insurance company claimed the rod bearing failure was due to running low on oil or lack of oil. which was untrue due to the fact that I keep up on any maintenance because this is my first newer vehicle at the age of 31. From this false diagnosis the warranty company is not covering the repair costs, now and I am stuck still paying for a useless warranty and the cost of a new engine! BEWARE just because you pay for a warranty does not mean you will get coverage! I would like to know if the inspectors get any incentives for denying expensive claims? I payed the dealer to remove the rod bearing next to the failed one, which still looked in great shape with 99k miles. this is not a case of oil starvation, but more of a failed component which they don't want to pay out on! I am disgusted with companies that take advantage of the average consumer like this case! Hope this sheds light on anyone thinking of pursuing after market insurance. Good day

I am rejecting this response because:
As they point out, the contract says they pay within acceptable standards of hourly costs.  The warrant was sold by the [redacted] dealer and the dealers hourly costs are well within the "industry standard".  The response doe not address what the industry standard is?  They simply decide to pay a flat fee of $75 per hour.  Where in the contact does it say they ONLY pay $75?  The contract clearly states, "within industry standard" .  If you price the hourly cost at any [redacted] dealer in the area you will see that the hourly cost is "within industry standard".  There response supports my claim totally, NO WHERE in the contract does it says they only pay $75, they pay the "industry standard" and therefore, if they don't want to pay they need to demonstrate that the labor costs at the [redacted] dealer (i bought the warrant from a [redacted] dealer by the way) is NOT within "industry standard".  And if the [redacted] dealer is no within the standard WHY do they allow the [redacted] dealer sell their warrant if they believe the [redacted] dealer perform outside the industry standard???

GWC warranty does have a Management request procedure in
place. The client would not accept our procedure for a contact back from Management.
I urge the customer to contact me directly if they do have any further concerns

The claim in question was approved in accordance with the
terms of the vehicle service contract regarding parts and labor coverage. The
customer is responsible for any charges not addressed under the coverage listed
on the vehicle service contract.

I have reviewed the customer’s statement of the problem. The
vehicle service contract addresses cancellation specifically as follows;

(20) days after the date the Contract

mailed to You, or within ten
(10) days after the date of sale indicated on the face of this Contract Application if the Contract was delivered to You
at
the time of sale, and, if there are no claims, the Contract is void and You will receive a
full refund of the Contract purchase price.
The right to void this Contract is not
transferable and applies only to the original Contract Holder. You may return this Contract by mailing it to the attention of the Administrator at the address listed on the face of this Contract. If You cancel this Contract after the applicable time frame or if a claim has been filed, You will receive a refund of a portion of the Contract purchase price only if Your
Vehicle is declared a total loss by the insurance company insuring the Vehicle, or if the Vehicle is validly
repossessed by the Contract

vehicle service contract does address the concern the customer is having

9. EXCLUSIONS — WHAT IS NOT COVERED: This
Contract provides no benefits and NADN has no obligation under the Terms &
Conditions set forth for what is not covered herein listed below.
• Excessive oil consumption, loss of compression, or gradual
reduction in performance not associated with the Mechanical Breakdown of a
Covered Component.
The customer has been advised that if they choose to
diagnose the engine further  to display a
Mechanical Breakdown, GWC warranty will perform an inspection at that time to
verify the failures to determine coverage.

All cancellation requests must be processed through the Selling Dealer. If the Selling Dealer has gone out of business, You can submit your cancellation request directly to Us. In the event of a cancellation, the Lien Holder, if any, will be named on the cancellation check as their interest may appear.
• Right To Return Your Contract: You may return this Contract within the first thirty (30) days after the date of sale indicated on the face of this Contract Application and, if no claims have been made, the Contract is void and You will receive a full refund of the entire Contract purchase price. This right to void this Contract only applies to the original Contract Holder.
• If a claim has been filed under this Contract or if You cancel this Contract after the first thirty (30) days according to the terms and conditions listed in this Contract, You will receive a refund of a portion of the Contract purchase price. We shall refund a pro rata portion of the amount received by Us from the Selling Dealer to You or the Lien Holder based on the lesser of the remaining time or mileage on this Contract, deducting any claims paid by Us and a fifty dollar ($50.00) service charge.

the contract details associated.
There has been a claim started for reported white smoke from
the exhaust and loss of power.  GWC
warranty has had a mechanical inspection completed to verify the concern. The
cause of the failure has not been identified and will require additional
diagnosis and teardown to verify the extent of repairs required. The customer
would need to authorize the additional diagnostic time to the repair shop to
verify the failures and estimate repairs.
GWC Warranty does apologize for any interactions that were
construed as rude or condescending in the clients dealing with our company.

I have reviewed the customer’s statement of the problem and
the contract details associated. GWC
warranty has approved a repair claim on June 19, 2015. The claim in question
was regarding the power steering pump and automatic transmission replacement
totaling $1,720.04 from GWC warranty. The claim was approved in conjunction
with the terms of the vehicle service contract regarding parts and labor
coverage. These items are addressed specifically as follows;
4. PARTS: Replacement of Covered Components may be made with parts of like, kind, or quality and may be
new, remanufactured, rebuilt, exchanged, or serviceable used components as are
customarily used in the automobile industry and approved by the Administrator.
 
5. LABOR: Labor charges shall be based on the
current ALLDATA Labor Guide and hourly rates shall be
within accepted industry standards.

I have reviewed the
customers’ statement of the problem and the claim details associated. The
customer requested a contact from management regarding concerns she had with a
repair claim initiated December 15, 2014. I spoke with the customer regarding
the coverage and informed that the rental requirements were not met. The
service contract addresses rental coverage requirements specifically as
follows;
RENTAL CAR COVERAGE:
In the event that a Covered Repair requires repair facility labor in
excess of eight (8) hours, We will provide rental car
reimbursement of no more than thirty-five dollars ($35.00) per day for a total
of no more than five (5) days. Delays caused by unavailability of parts,
shipping, and repair facility schedules, or other factors do not qualify for
rental car reimbursement.
The repair claim was approved for 6.2 hours of total labor according
to the [redacted] labor guide, and did not meet the 8 hour minimum requirement.
I also apologize for any communications that may have been construed
as rude or nasty between the customer and GWC warranty, as that was not the
intent.

It is beginning to be quite obvious that GWC has not intention of answering the questions tht I have asked in these correspondences. There was never an invoice supplied showing how the figures for a "covered repair" were computed and how they arrived at my out of pocket expenses. As I have stated previously [redacted] could have performed the repair on the transfer case. As far as the deductables, once again, GWC could care less that the repair(s) performed were for the same problem which was leakage from the transmission area. I am dissapointed with the way in which this has been handled and to rate this company A+ by the Revdex.com is ludacris. They do answer the complaints but they don't answer the specifics of the complaints. To constantly refer me to the contract has been demeaning. I can read and have read the contract. Maybe GWC could supply invoices to their customers so they know why they aren't paying the full cost of "covered repairs." GWC did not pay the full cost of my "covered repair" and they should be ashamed of themselves for their misrepresentation. So, in closing, please do not reply to this rejection as I am sick of not having my direct questions answered. I will just chalk this up as a learning experience. GWC's motto, "Don"t worry, just drive" is a hook. There is plenty to worry about when dealing with this company.          Regards,[redacted]
