contacting GWC warranty in response to this concern. I have reviewed the customer’s statement of the problem and the contract details associated. GWC Warranty has approved the repair claim in question in accordance with the terms of the vehicle service contract regarding parts and labor coverage. GWC has approved a total repair of $1787.21 based on the verified failures to the engine.
The repair shop is recommending other repairs to the customer that was not verified as failed during the claim and inspection process. The customer would be responsible for any repair shop recommendations where a failure has not occurred.

I am rejecting this response because:
the problem was diagnosed and there was no need for further diagnosing because nothing else was wrong. needless to say I paid for it out of my pocket because I needed my vehicle back .they replaced the transmission and my car works fine now. so the diagnosis the garage gave me was exactly right on it could not have been anything else because now my car works. I think they wanted me to send my car to a shop where they know someone and are getting money back from other garages. I felt safe where my car was. when I purchased the warranty I was told I can take my car to wherever I choose to. I should not have had to wait over a week for them to do diagnostics on a vehicle when it took only a day to figure out the problem.I will not be happy unless I get a refund for my warranty I paid for and for the repair.

The response from the business is of course just a run around to the real problem.  I did not choose the shop to do the repairs from out of the sky.  These shops are in the warranty company's network and were given to me as a choice. So again if they already have these shops in there network and their contract specifically states $100 deductible, why is it the responsibility of the customer (myself), to have to pay out of my pocket more than I'm contracted to do, when the warranty company should already have agreements with their shops.  Are they The only Warranty company who works back words,  or think I'm just the dumb customer who they screw again.  
Well I'm not that customer and if this is not resolved Within 30 days from today,  either by fixing my rear view mirror and I pay my $100 deductible for this and all future services,  or refund my money for this falsely advertised contract,  so that I can purchase a warranty from a marketable warranty company. 
Next communication needs to be a resolution or my next communication will need to be legal. They cannot do this to customers telling them one thing to purchase and than giving them the shafts when your vehicle needs important repairs....like a rear view mirror!!!

 I have reviewed the customer’s statement of the problem and the claim details. The vehicle service contract does address labor coverage specifically as follows;
5. LABOR: Labor charges shall be based on the current ALLDATA Labor Guide and hourly rates shall be within accepted industry standards.
The repair claim was paid in accordance with the terms of the vehicle service contract.
If the customer requires assistance locating a repair facility, they are urged to contact GWC customer service to obtain a referral to a GWC preferred repair facility.

the contract details associated. The customer did have a claim initiated July
17, 2015 for lower rear control arm bushings, front strut mounts, and a failed
stabilizer link. Those items are not listed in the Component Coverage section
of the vehicle service contract. GWC Warranty would have no obligation towards
the costs associated with those repairs.
The customer is urged to contact me directly if they would

I have reviewed the customer’s statement of the problem and
the contract details associated.
The customer did have a claim initiated on December 5, 2014
for a reported engine noise. A mechanical inspection was completed on the
vehicle and there was no mechanical failures verified.  The repair shop was recommending updated
parts due to a technical service bulletin. The vehicle service contract
addresses this issue specifically as follows;
9. EXCLUSIONS (WHAT IS NOT COVERED): This Contract
provides no benefits and GWC has no obligation under the Terms & Conditions
set forth for what is not covered herein listed below.
• Any Covered Component which has not
experienced a Mechanical Breakdown but which a repair facility recommends to be
repaired or replaced.
The customer did have another claim initiated on March 24,
2015 after the contract expiration. The contract had expired by time on
December 8, 2014.

I am rejecting this response because:
The repair has been approved for a new part but GWC isn't paying full price for the new part. They DID NOT approve the amount of the new part which is $621.00 they approved $500.00 of the $621.00. Therefore the new part was approved by GWC but the entire cost of the part wasn't approved by GWC. They approved for the shop to get the new part but isn't paying for the new part. Therefore I have to pay an additional $121.00 per part towards a part that is supposed to be covered in full by the warrant. I'm only suppose to pay labor difference not part difference.

I am rejecting this response because:
The GWC agent verbally described the coverage as including all of the car's electronics/technology.  I specifically stated that my only reason for getting extended coverage was for the assurance that the navigation, cameras, [redacted], etc would be covered.  These were issues with my previous car and I was willing to pay to avoid them.  GWC 's agent at the car agency (the sales agent) statedthe coverage that I purchased as "bumper to bumper" and that it covered all of the electronics/technology.  It in reality covers very little if any of the technology within the car  Surely GWC has a responsiblity to ensure that the people selling their products represent the product truthfully.  This product was not represented truthfully and I bought it based on the salesperson's assurances.

I have reviewed the customer’s statement of the problem and the desired outcome. The vehicle service contract addresses cancellation and refund specifically as follows;
13. CANCELLATION(S) AND REFUND(S):
• Only in the event that the Vehicle is declared a total loss by the Insurance Company insuring the Vehicle, or if the Vehicle is repossessed by the Contract Holder’s Lender will We and the Dealer refund a portion of the Contract price. We shall refund a portion of amount received by Us from the Dealer to You or the Lien Holder. We shall calculate the amount to be returned by Us by pro-rating the amount paid to Us by the Dealer based on the remaining time or mileage on the Contract and deducting any claims paid by Us and a fifty dollar ($50.00) service charge. All cancellation requests must be made through the Selling Dealer. If full Contract premium is not paid by the Dealer, We reserve the right to cancel this Contract within sixty (60) days.

The industry standard labor rate was determined to be $70
dollars per hour for this repair claim. Any additional labor charges above that
amount would be the customer’s responsibility to cover to the repair shop.

I have reviewed the customer’s rejection of our response. As stated in prior correspondence, GWC Warranty provided coverage towards the replacement of the engine components that were verified as failed. The customer would be responsible for any repairs recommended by the repair facility that were not verified as a failure. The contract addresses this specifically as follows;

Once again I understand I can call the for a referral.  WHERE IN THE CONTRACT DOES IT SAY YOU ONLY PAY $75????? This is contract Law 101, we entered into an agreement that said GWC will pay labor within "accepted industry standards"   This is an addendum to the contract for California which states i'm not subject to arbitration which means I can exercise my right to sue in small claims court (which I am filing now).    Other than that, there is no provision to say what is the industry standard except a sampling.  I have shown two locations that are no where close to the $75 and I will pursue this and have found mechanics that have been in the business for 30+ years that will testify that $75 IS NOT industry standard.
In reality, I called GWC and asked to repair shops; one was 11.6 miles away in [redacted], Ca, however, the number was disconnected and they were not in business and the other was 12.6 miles away in [redacted], CA.  IF in fact $75 was the industry standard, why is there NO shop closer that is at $74? There are 40+ auto repair facilities whiting 7 miles of my zip code of which NONE work at $75.   
So once again, back the the basics of contract law; the contract said they pay whitin "Acceptable industry standards" and I am prepared to litigate and prove that in truth and fact, they breeched the contract and that their are only two facilities both with are outside of 10 miles that will honor the $75 rate.  IF in face $75 was the accepted industry standard, then one of the 40+ facilities within 10 miles would accept that rate and they do not.  I'm willing to go to court on these facts.  This is the last opportunity to do the right thing and honor the contract or i'm done and will see you in court in [redacted].  Have a nice flight

This is in response to the additional information requested.
The contract holder had a claim initiated 3/10/14 at
[redacted] for a reported failure to both front axle shafts causing a
fluid leak. GWC warranty had approved that repair in accordance with the terms
of the vehicle service contract.
The contract holder had a second claim initiated 3/26/14
from [redacted] for an internal transfer case failure. They stated
they do not perform internal repairs to that unit and would have to refer the
customer elsewhere. GWC had provided a referral to a preferred repair facility
if the customer chose that option for the repairs.
These were two separate repair claims that carry a
deductible charge for each claim.

I am rejecting this response because: I have  received the paperwork from the mechanic  saying that it was authorized at labor rate 82.50 which is the rate set by gwc and this ammo service dept.  My car was scheduled to be completed on Friday I get a call saying that my car is done but gwc isn't going to pay the 82.50 rate that was agreed . So I had to come up with the difference myself.  The owner of ammco Was also told that he was getting the 82.50 rate which was approved by a representative  of gwc. Also after numerous conversations with gwc always talking about the claim and the quote that was sent in at the 82.50 rate which was approved they never a aid anything about the difference I  rate until the end of the wotk.
