I have reviewed your complaint and respond as follows: All of the extended warranties through Zurich have a free look period As such, I will request cancellation of the Zurich extended service contract effective today's date The refund of the purchase price will be sent to your lender to offset the balance on your loan.Thank you, [redacted]

I'm sorry for the lack of communication you received in regards to getting the product cancellation refunds submitted to your lender However, you stated that you started the process on or about January 12th and left numerous messages for an employee in the cancellation department The person that you stated you called was on an extended medical leave and would not have handled the cancellations for this particular Russ Darrow store In any event, the first cancellation check for the Tire contract and service contract was cancelled and a prorated refund check was sent to PNC Bank on or about 1/31/and was cashed by PNC on 3/18/ The prorated refund percentage's are given to Russ Darrow by the warranty company and are refunded based on that criteria Also, please take into account any cancellation for any reason outside of the free look period (first days after purchase) are charged a cancellation fee, i.e$25/tire contract and $50/service contract The amount of this refund was $ The second cancellation check for the Credit Life was cancelled and a prorated refund check was sent to PNC Bank on or about 2/9/and cashed by PNC on 2/23/ There was no cancellation fee for this warranty The amount of the this refund was $ The combined refund amount was $2, I am unsure how you calculated a higher refund amount without the proration percentages from the respective warranty companies Also, while I can sympathize with you as it relates to the remaining balance on the loan, warranty refunds can take up to days to be sent out to the respective lenders In your case all refunds were sent out within days, albeit not cashed by your lender, but we cannot be responsible for any charges you incurred since the day of reporting the information to us[redacted] , Corporate Paralegal

I'm sorry that the Bankruptcy program did not work out for you, however, the application that was submitted to the lender had inaccurate information on it and had it of been filled out properly, there wouldn't have been an issue Russ Darrow only reimburses for aftermarket accessories a customer installs only if Russ Darrow was the reason the vehicle had to be returned In this case, the information as you submitted on the application was not factual The GM partially reimbursed you for the tint outside of company protocol and that was as a goodwill gesture only However, we will not be able to offer any additional assistance to you for the remaining balance.Nicole [redacted] , [redacted]

I have reviewed your complaint and your service history and find that you did complain about a front end issue a few months after being in the vehicle, but that issue was unable to be duplicated However, when you complained about the brakes, Russ Darrow provided a front brake service and machined the rotors, which apparently took care of the problem because it was not brought up again Your vehicle has been in for services on the following dates: 11/1/16, 11/14/16, 11/21/16, 12/6/16, 12/12/16, 12/17/16, 12/20/16, 12/26/16, 1/10/17, 2/27/17, 3/2/17, 8/29/17, 11/21/and lastly on 11/24/ These service issues ranged from oil changes, windshield wiper repairs, warranty repairs etc There was not multiple complaints of the same issues in your history.You purchased a used vehicle with did not have an implied or stated warranty by Russ Darrow You may have purchased an additional warranty to cover mechanical issues with the vehicle or their may have been manufacturer warranty left, but Russ Darrow sold the vehicle as is.If you would like anything fixed by Russ Darrow, I would be more than happy to offer you and this vehicle a 15% discount on parts and labor.Nicole Pieper, Corporate Paralegal

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowIn a previous complaint about Russ Darrow - one of the things I brought up besides the missing air conditioning was the amount of pressure and coercion I was subjected to regarding a loan for me - this loan that the salesmen pressured me on was *sure to get a lower interest rate*I even had to go through it twice at two different dealers - RD Honda and RD ToyotaI was extremely angry at the *amount of time wasted [redacted] on the sales pitch for the using their loan services, not only because they kept pestering me until I finally relented and unless I relented they did not show me cars, until I talked loans with themI have to say I was right they were not able to get me a better rateSomething I said to them over and over againI might as well have been talking to deaf peopleOnce we finally got past the business of financing the car I wanted to purchase, then I was subjected to relentless pressure about signing up for the warranty package that I am now complaining aboutAgain, over and over - I kept saying no thanks, but different people came out to talk to me, as if I were too stupid to understand how important this wasI kept saying noWhen I sat down to sign all the paperwork - the business office employee - asked me why I didn't take the warrantyI said because I bought a Toyota and I don't expect it to start breaking down until it gets to 200,milesMy own testimony to how good the Toyota's run - was simply not good enoughI had to be subjected to another sales pitch from business guyI'll give him credit - he was a lot smoother than the othersI feel like at this point - I have two choicesI can either lose my temper and say, FOR GODSsake, DROP IT ALREADY? or I can sign up for the warranty because it was obvious he wasn't going to let me sign anymore paperwork and leave there until I agreedIt was getting dark out and I had started mid-morning on this purchaseIronically, I knew which car I wanted all along but had to go through hoops of sales pitches to buy *that [redacted] carI signed the paperwork for the warranty - I was near tears - I just wanted to go home with my carThe only thing this guy told me specifically about the warranty was that it covered EVERYTHINGI was never shown the details of the deal - he did not have me sign off on anything saying I understand I will have to keep paying for this even if the warranty expires before the paymentsWhat kind of warranty takes longer to pay off than the actual coverage??? I resent being taken advantage of because I'm politeI'm sure many customer's feel the same wayI know this is yet another type of predatory lending technique - the technique depends upon the customer not losing their temperBecause if the customer lost their temper - well then, "we were only trying to help" - and it becomes an embarrassment to the customer and uncomfortable hard feelings the rest of the dealI can see how a customer might take advantage of the warranty by only paying for it until the car is no longer qualified for the warrantyTo cancel at that point would be, well, unethicalHowever, the circumstances under which I "purchased" the warranty were unethicalIf need be - I will take this to court and show that it was not explained to me at all or at least properly that if I totaled my car - I would still have to keep paying for the warranty because I may or may not have gone over the set criteria for the warrantyCancel my warranty - and refund me the NOW that you have taken unauthorized from my bank accountThe mileage is: Please contact [redacted] ** [redacted] [redacted] I want to make this perfectly clear - I don't care if the miles have exceeded the warranty coverageI cancelled the warranty because I no longer have the car - it's totaledI never used the warrantyYou got more than enough money out of me, with the worthless overpriced upgrades, and the time I will never get back because I had to spend an entire day - listening to unethical people tell me they know better than I do - how I should buy a car [redacted]

I'm sorry that we are not able to trade you out of the vehicle without further compensation for a down payment In Wisconsin all vehicles are purchased as is with no implied or stated warranty We cannot guarantee that that the vehicle you or anybody purchases will be free of service issues This is why we sell warranties However, based on the year and mileage of the vehicle, only certain warranties are available The documentation would have been given to you before you purchased the vehicle and or warranty for you to review [redacted] , Corporate Paralegal

I'm sorry that you don't feel that a place of business can contact a customer after a purchase to collect on money owed under the contract Your assumption is incorrect There is nothing illegal about it The amount due that was sent to collection was due to your up front costs not being collected under the contract The reason this was not collected and missed by the finance manager was you had paid a locate fee of $ This $was receipted and a copy put into your file The finance manager was unaware that the office refunded you $but did not void the receipt in your file This was a clerical mistake made by the office, not the finance manager, Jason Polster When it came to you taking the vehicle that night, you, by your own admission said that you had not paid that charge since you didn't have any credit card or check record, but then your male friend came up with a scenario that you paid cash from "babysitting" and that is why you didn't have a bank record for paying that amount.Obviously we both know that you didn't pay it, however, due to a claim filed with Mazda, the easiest way to close this and that case is to waive that amount and cease collections This would be called Goodwill towards a customer This matter is now closed[redacted] , Corporate Paralegal

I'm sorry that you feel the tires that are put on by the manufacturer are not up to par, however, the tires are a mid grade all weather with a large (85k) tread warranty We can offer to you a few different options to purchase, however, the tread warranties will be less than what you currently have For a mid grade all weather tire with a 50k tread warranty, it will run you about $plus tax For a mid/high grade winter tire with no tread warranty, this will run you about $plus tax If you do not feel these are good options, your only recourse is to call Kia Consumer Affairs directly as this is a design "flaw" of the vehicle, and they would be the only entity that would be able to potentially assist you Please let me know if you would like to set up an appointment to take advantage of one of the offers I relayed above [redacted]

I'm sorry that it took you so long to figure out the issue and try to come to a reasonable resolution The vehicle you purchased was dealer traded with another dealer in the Appleton area, not a Russ Darrow The vehicle that was suppose to be brought up from a local Russ Darrow store was unavailable and as such, an alternate like vehicle was obtained The mileage that was put into the system was the vehicle from the Russ Darrow dealer and not the ultimate dealer that the vehicle came from There was a lack of communication in relation to the mileage with the sales team and the finance manager who had you sign out the documents As such, there seems to be an mileage discrepancy of approximately miles In these types of matters, I use the Wisconsin DOT calculation for mileage discrepancies I also spoke with a DOT Investigator to confirm that I was using the correct mileage rate of $.20/mile He stated that the range is from $.15-$.25/mile, so I averaged the rate and came up with $.20/mile As such, I will offer to send you either a $Russ Darrow Gift card or a check made payable to you for $150.Please let me know which you would like to accept[redacted] , Corporate Paralegal

I have reviewed your complaint with all applicable managers and provide the following response:The Pilot is not the same as the Pilot Touring Elite The Touring Elite is a limited production vehicle that we do not take orders on Russ Darrow Honda has not even been allocated any Elites in months We do not offer discounts on Touring Elites under any circumstance as they are rare and we can get full purchase price very quickly We only take orders on standard Pilots and other trim models not including Touring Elites On a side note, Honda is out of the 20" wheels and our dealership will have to wait at least months out on receiving any The email we received as well as the complaint filed with the Revdex.com from the customer did not state or distinguish the exact trim level The General Manager has personally explained this to the customer by email and the limited availability on the vehicle he is searching In the complaint the customer states that he located a vehicle in Illinois that fits his criteria I would suggest that he purchase that vehicle as we will be unable to accommodate his requests as it relates to the current complaint[redacted] , Corporate Paralegal
