I'm sorry that you still feel that we are liable to pay for damages to your vehicle, however, as I stated earlier, the letter from Honda after turn in goes directly to the customer 30-days after the transaction is done If Russ Darrow takes the vehicle in on a trawe issue a payoff to Honda and keep the vehicle In your case, the vehicle was the property of Honda as it was not a trade in We do not get involved in the excess wear and tear charges under these circumstances and would not have known what was going to be charged until after Honda picks up the vehicle, thereby leaving the potential damages open ended [redacted]

I am sorry that you encountered issues shortly after purchasing the vehicle from the Russ Darrow Nissan location Used vehicles normally come with one key unless the previous owner trades the vehicle in with two We do not incur the cost to provide an additional key on a used vehicle However, I apologize that nobody from the dealership called you to give you advice on where to purchase a second key As for the recalls open on the vehicle, at the time of the safety inspection, we notate if there are any open recalls that we have not fixed or taken to the manufacturer of the vehicle, however, those services would be taken care of with no charge to you upon presentment A safety inspection was performed on the vehicle and there were no issues present at the time of inspection with the front fog light, license plate lamp, windshield wipers or link bushing If there was a factory warranty left on the vehicle, the local Hyundai dealership should have been able to cover the link bushing As for the lights, lamps and wipers, if this was cause for concern prior to delivery the customer would have had to bring this to the managers attention before taking delivery We do not perform a walk around of the vehicle to make sure the vehicle is in working order for delivery The customer has the right to a third party inspection that potentially would have caught these issues With the questions pertaining to the service contract that you purchased, no upgraded service contract would cover any of these issues, except maybe the bushing link If you wish to cancel the warranty at any time, I can assist you with that However, we will be unable to provide you with any type of upgrade for no additional cost[redacted] , Corporate Paralegal

I have reviewed the complaint with the Service Manager and he states the following:A Dodge Charger with miles brought to us not running and no start conditionThe customers insurance company provided a preliminary estimate for fire damage in the trunk near the batteryUpon our inspection we found items not listed on the insurance estimateWe called the adjuster, who came back out to inspect our findingsHe authorized additional items to continue in the process of repairOnce the additional items were completed the vehicle was able to be startedWith the vehicle now running, drivability concerns and check engine light exhibited themselves.Determining that the customer had previously had mismatched engine installed elsewhere, which is not compatible with computer controls and sensors on her vehicle, the insurance company would no longer participate in further repairs.The option was given to the customer to start with some of the obvious items needing to be addressed, such as oxygen sensor replacementThe customer was given an estimate (documented on repair order) which would cover her insurance deductible as well as the oxygen sensor replacementIt was thoroughly explained to the customer that this would be a starting point and could lead to other items needed , due to the fact that the vehicle had the wrong engineThe customer authorized us to continue After replacing the oxygen sensors, faults remained in the computer systemIt was determined that the computer control system would not allow proper fuel and air mixture perameters in order to properly run the vehicle The only remedy going forward, would be for the customer to have the proper engine installed in the vehicle that matches up with the original equipment.Russ Darrow can no longer participate in the fixing of this vehicle unless the repairs are pre-paid by the customer Her only recourse as I see it would be to go back to the shop that installed the engine in the vehicle and bring the current issues to their attention[redacted] , Corporate Paralegal

I am sorry that you feel we are responsible to purchase your vehicle even though there was no written contract We cannot hold an individual or business liable to purchase a vehicle because they came in and offered a dollar amount in which we accepted The customer then left and never came back Would we be able to go after that customer because of a verbal statement? The answer is no We offer to purchase vehicles found online on a daily basis However, if there is no contract, we are not legally bound to purchase the vehicle If the vehicle's purchase price had been set as you say, we would have kept the vehicle, written a purchase contract, inspected the vehicle and consummated the deal This was clearly not the case Instead you wanted to keep the vehicle, add additional miles and further depreciate the vehicle and then have us buy it at a later date This is not acceptable I'm sorry that you purchased a vehicle before you sold your Eclipse However, in your complaint you stated that you turned down many offers on this vehicle Please try and hold one of those buyers to their offer We are not liable to you under any circumstance Thank you, [redacted]

Thank you for providing a copy of the contract Yes, you are correct...I apologize You purchased a New Vehicle Service Plan on a used vehicle The pros for doing this is that the contract is drastically cheaper and you would be getting the same coverage, if not better than the used vehicle service plan If you would have purchased a used warranty the price would have been double the purchase price, which is why the warranty company and why the dealership personnel sell the new vehicle warranty in place of the used vehicle warranty I cannot tell you specifics on why this was presented to you since it was in excess of years, but this is not abin the industry.If you would like to extend your coverage, please go into any Russ Darrow location and they can give you pricing on a service contract so that your car can be covered for any mechanical breakdowns[redacted] , Corporate Paralegal

At present have no way to access last message, but will state, due to my ex leaving me penniless, I cashed maintenance service refund from Russ Darrow, as after reading all, found out It was short, because If you cancel, they rip you off $for cancelling & they best get a check of less then $1,to me, as I'm tired of their Inconsideration, no care for customer's, deceit as far as all the non disclosed problems, that will cost me at least $5,& the 1st started the night of purchase, another day after, more day's after purchase & more, but here Is just a few to start with; Transmission problems (started night of purchase), O.DLight Off was it up at mph & slipping, following day, rattle from under carriage & still & either something loose or no good on exhaust or heat shroud for catalytic converter, Windshield washer fluid pump never worked, as It was bad from day of purchase, quarter panel on front passenger side, must of been In an accident & never disclosed, as paint & sheet metal/body are gone & there's more! I'm sorry that there was an error made when submitting the warranty contract to the company, however, the protection product was applied to the vehicle at the time of contract As such, this warranty is a non-transferrable, non-cancellable item The contracts were submitted to the warranty company and they will cover anything under the warranty from the date of purchase There would be no denial based on them not having the contract as we have a viable contract that they would accept and back date the coverage As of recently, the contract has been marked received and applied to your account and will be available to you until you no longer own the vehicle.Also, it is my understanding that your husband contacted several dealership personnel and stated that he did not want to cancel this warranty and that he intended to keep the warranty Even if there was a request to cancel the warranty, this would not be a reasonable request since it is non-cancellable.Nicole [redacted] , Corporate Paralegal
