garnishment and refund his overpayment.On August 24, 2015 AllianceOne received a call from [redacted] inquiring on how to stop the garnishment and asking when he would get a refund check for an overpaid amount. Our agent attempted to clarify to [redacted] he would not be able to personally stop the garnishment however his employer would be able to stop it by contacting our legal department. He was advised that his employer could contact them directly by calling the number provided on the garnishment writ his employer was served. Unsatisfied with the call outcome, [redacted] contacted our consumer hotline and expressed his concerns. I explained to [redacted] I would need to investigate this matters and I would contact him the following day.As I investigated his concerns it appeared that his employer appeared to be withholding too much money from his paycheck. I contacted our Legal department and they agreed and faxed documents to release the garnishment on [redacted]’s pay check. A request was submitted to our posting department which expedited the refund process for [redacted]. On August 26, 2015, check number 3601737, in the amount of $90.28, was sent to him via [redacted] overnight service to [redacted]’s address. July 28, 2015Dear [redacted]:I am writing in response to the concerns expressed to your office by [redacted] on July 24, 2015. I appreciate the opportunity to respond on behalf of AllianceOne Receivables Management, Inc. [redacted] has once again rejected our response dated July 22, 2015. He continues to state that AllianceOne has not provided adequate proof of debt and that he wants credit reporting deleted. In our last response we informed [redacted] that we provided proof of debt which included a transaction by transaction break down of the charges supporting the amount due for this debt. We also requested that if he had a more specific dispute to provide any supporting documentation. [redacted] has not provided any additional information with regard to his complaint. AllianceOne has complied with all regulations and the documentation forwarded to [redacted] supports the assertion that the debt is valid. We also informed [redacted] in our last response that we do not report to the Consumer Reporting Agencies for [redacted] Bank. If [redacted]’ account is being credit reported it would be the bank reporting not AllianceOne. We have been responsive to [redacted]’ complaint and unless he can provide a more specific dispute we have responded appropriately. Without a more specific dispute from [redacted], we are not able to supplement our previous responses with additional information. difficulty changing her address with our company and that she doesn't believe she should have to pay the full balance owed.The [redacted]) referred account #[redacted] to AllianceOne for collections on July 25, 2017 with a balance of $130.04. Because any fines or fees were assessed by [redacted] directly prior to the account being placed with our office, we do not have any authority to alter the balance owed. Our client has informed us that the owing balance is $130.04, the account will not be returned to our client as resolved until the full balance owed is paid. The validation of debt outlining the balance is attached.Our records indicate that when [redacted] originally called in to our office, she refused to verify the information on file so that we could disclose. In order to protect our consumers' privacy, a person must be fully verified prior to altering any contact information for a consumer, including the address. We apologize that this process was not explained clearly enough for [redacted] in her original calls. October 30, 2015Dear [redacted]:I am writing in response to the concerns expressed to your office by [redacted] on October 13, 2015. I appreciate the opportunity to respond on behalf of AllianceOne Receivables Management, Inc.[redacted] states in her complaint that she has been receiving phone calls and letters from AllianceOne attempting to collect a balance of $1865.55 and she would like communication to cease until the debt can be verified.[redacted] referred to AllianceOne for collection account #[redacted], client reference # [redacted] with a balance of $1865.55. On October 6, 2015, a letter was mailed to [redacted] informing her that her account was referred for collection and offering her an opportunity to settle her account for less than the balance owed.This is a [redacted]’s account opened June 19, 2004 and [redacted]’s last purchase was dated October 15, 2013. The last payment posted to [redacted]’s account was dated November 23, 2013. We have requested more complete documentation from our client and will forward it to [redacted] when we receive it. Until we are able to provide it AllianceOne will stop all collection activity.[redacted] should be advised that AllianceOne does not credit report on credit card accounts.AllianceOne agents have attempted to contact [redacted] on only one occasion and upon the receipt of her complaint we submitted a request to cease both letters and calls to [redacted].If [redacted] has any questions concerning her account, she may speak with an agent at ###-###-####. this account on numerous occasions because she doesn’t believe this account was hers. She also states that in order for the account to be properly validated a signed contract between her and [redacted] must be provided to her. Upon Receiving [redacted]’s complaint we marked the account as disputed and reached out to our client to validate the account.[redacted] referred account #[redacted] to AllianceOne for collections on July 12, 2016 with a balance of $283.98. Our client was able to locate previous statements for [redacted]’s account however the process for residential customers is to sign up via web enrollment and therefore a signed contract is not available. Because a signed contract is not available, we closed the account back to our client as disputed. For additional questions regarding this matter [redacted] may contact [redacted] directly.AllianceOne has submitted a request to remove our tradeline from [redacted]’s credit report to the credit reporting agencies. AllianceOne since May that was the result of an overpayment on his account.San Diego Superior Court referred to AllianceOne for collection account #[redacted], client reference #[redacted], on October 15, 2012, with a balance of $2709.10. [redacted]’s account was referred to the Franchise Tax Board (FTB) on September 26, 2013, due to nonpayment of his account. [redacted]’s account reflects a zero balance. Upon receipt of [redacted]’s complaint, we forwarded his dispute to our client for their review.During the May 20, 2016, call he updated his address with our agent and wanted to know when he could expect his refund. [redacted] also updated his address with an agent on July 26, 2016.AllianceOne received an overpayment on [redacted]’s account and issued two refund checks in the amounts of $93.46 and $251.64 on April 30, 2016, and May 31, 2016, respectively; the checks were sent to our client for their review and mailing per our agreement with the court. The court mailed both checks to [redacted]’s last known address on July 12, 2016. After [redacted]’s refund checks were mailed, he notified us of a new address. We stopped payment, reissued new checks, and they were mailed to his new address. has reported a [redacted] account and he was informed that AllianceOne no longer manages [redacted] accounts. He states his account was referred to another agency and that agency also reported the debt to the credit reporting agencies and that he resolved the debt with the new agency. He wants the AllianceOne tradeline removed from his credit reports.[redacted] referred to AllianceOne for collection account #[redacted], client reference #[redacted], on March 5, 2015, with a balance of $184.08. [redacted]’ account was returned at the request of [redacted] on November 2, 2015 and a request was submitted to all three credit reporting agencies for tradeline removal.Unfortunately, at least one credit reporting agency had some incorrect information and our request was not actioned properly. As soon as AllianceOne was made aware of the error we asked the credit reporting agencies rerun our request with the proper information. We were assured that the tradelines requested would be removed. Upon receiving similar complaints we determined that not all tradelines were removed and we requested that the credit reporting agencies reconcile our reporting.As a courtesy to [redacted] we have again requested removal of our tradeline. Please accept this letter as confirmation that on August 8, 2016 AllianceOne submitted a request to the credit bureaus to delete its tradeline from your credit reports. Our request was submitted electronically (via E-Oscar, confirmation #[redacted]) which should expedite the removal. They have confirmed that a separate violation T[redacted]294-1 in the amount of $15.00 was paid, however violation T[redacted]585-1 (ticket #[redacted]) in the amount of $65.00 is owed to the Port Authority of NY & NJ for using a dedicated E-ZPass lane without an E-ZPass device. tradeline on her credit report. She states she has received no help from AllianceOne agents.We are unable to locate an account for Ms. [redacted] with the information provided. We would encourage Ms. [redacted] to provide additional information such as: the full account number, name of the original creditor, and type of account. Her social security number, date of birth, and/or address would also help to identify her. This is done to ensure that we are respecting our consumer’s privacy and aren’t improperly disclosing information.Unfortunately for AllianceOne to remove a tradeline we must be able to tie the removal to an account number. At this time the best way for Ms. [redacted] to have the tradeline removed is to dispute it directly to the Credit Reporting Agencies (CRA’s) as they will have record of who reported it to them and the specific account information. They will then then notify AllianceOne of the dispute with identifiable account informationWe apologize for the difficulty Ms. [redacted] has experienced and would very much like to help her resolve the matter. Dear [redacted]I write in response to the concerns expressed to your office by [redacted] on June 6, 2015. I appreciate the opportunity to respond on behalf of AllianceOne Receivables Management, Inc. and the extensions to respond that you have provided.[redacted] states in her complaint she should not have to wait 4-6 weeks to get her money returned after she was wrongfully garnished for a paid in full account.In her complaint she states she was wrongfully garnished for an account that was paid in full in 2014. I would like to thank [redacted] for bringing this matter to our attention so that we may fine tune our procedures to avoid future issues for her and other consumers.AllianceOne’ s posting department received [redacted]’s payment from the California Franchise Tax Board on May 13, 2015, however over payments are usually not processed for 30 days. AllianceOne expedited the refund process for [redacted] as soon as we became aware that a failure in our process contributed to the overpayment. On June 4, 2015, check number [redacted], in the amount of $518.47, was sent to her via [redacted] overnight services to [redacted]’s address.We appreciate her bringing this to our attention and are working with the Franchise Tax Board to implement controls in the process to prevent this type of thing from happening in the future.
