Review: I am a member at Anytime Fitness at [redacted] I signed a 2 year contract with this gym. My contract is up in Novemeber/2016. I want to cancel my membership and asked what the fee is which should be in my contract. The owner [redacted] said that I won't find the amount in my contract but in a cancel form they have put into practice 9 months ago. I have been a member in 11/2014. I shouldn't have to pay an amount that I did not agree to and it is not in my contract. They refuse to cancel my membership until I pay the [redacted] fee. I requested proof that I signed this and agreed to pay that amount back in 11/2014. I don't believe a business should be charging a customer an amount they did not agree to.Desired Settlement: I agree that I have to pay an amount to get out of the contract, but that amount should be disclosed in the contract. Not a made up price by the owner. I want them to cancel my membership effective 04/06/2016 & not receive any further contact or charges by the gym.

Response:

Here at Anytime Fitness, we don't want to hold any member to a membership agreement that they no longer want to be a part of. When the member joined in November of 2014, we covered every cancellation policy that we had in place. We even went as far as to discuss in detail the cancellation portion of the membership agreement and had the member initial off on the back of the membership which states that all policies are clear. Those cancellation policies are: 1. Member can cancel within 14 days of joining for any reason at all. Any money spent within those 14 days would be fully refunded. 2. If member moves for than 30 miles away from their home club they can cancel with a proof of relocation. Member would have one final payment with a 30 day notice along with a [redacted] early termination fee. 3. If the member gets permanently disabled or dies during the membership, the membership will be cancelled. On top of this, we offer an option to freeze a membership for 3 months every calendar year for any reason at all. Our buyout option is not listed on the membership, but it is a supplemental option for a member to buy out of the agreement if they wish to end the membership but don't meet any of the cancellation requirements that they initialed off on. I have attached our buyout form to prove that the [redacted] buyout fee is not just a made up dollar amount. We charge this to all members that wish to end their membership early and most members appreciate the ability to get out of their agreements. If we held this member to what was signed off on, the member would be required to fulfill the remainder of the membership without any buyout option as the member signed off on our cancellation policies and that wasn't an option available when she signed up.

Review: I joined this fitness club and only attended one time. I called to cancel my membership because I realized that I could not afford the monthly dues. The club advised me that they have a 72 hour cancellation policy. I thought I had 30 days to cancel. Since I only went there once, I felt they should have allowed me to cancel. The initial payment was $98.00 and payments in the amount of $68.00 thereafter. I called again because I noticed that they took another fee of $15.00. I spoke with [redacted] and he told me the $15.00 fee was a one time club maintenance fee. I did not see this $15.00 fee in my contract. He then told me that I would be liable for half of the total membership fee, because I didn't cancel within the 72 hours. (which would be about $384.00) I told him I could not afford to pay this. He said "that's not my problem". The manner in which he spoke to me was very rude and nasty.Desired Settlement: I would like them to cancel my membership. Since I only used the club once, and notified them within the first week, I feel I shouldn't be liable to pay half of the total membership fee. I would like them to stop sending me collection notices and threatening to take me to court. They are trying to ruin my credit.

The business has responded. Please read below:

Hello,

We received [redacted]'s complaint regarding canceling membership at Anytime Fitness in [redacted]. We completely understand when there are financial hardships with our members.

In order to help our Members as best we can Anytime Fitness in Pleasantville has offered a great option to help pay membership dues. We have placed [redacted] on a Complimentary' 3 Month Financial Freeze' with No Fees at all during this time.

If Members are unable to continue with membership dues at that point still we offer another great opportunity to pay off their balance. Anytime Fitness in Pleasantville meets our members half way. Instead of paying a full balance we only require Half the Remainder of the agreement.

Again, we understand the hardships in life and are happy to have put [redacted] on a 3 Month Freeze to help with his individual situation.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Sincerely,

Review: I am filing this complaint on behalf of my parents who are members of this gym. Over the past several months, my parents have been dealing with a number of medical issues, and under advisement from their physicians, they should be exercising at this gym.

In order to cancel the contract for the gym, the gym provides a medical form that needs to be filled out by a physician. This form asks for detailed health information. The gym is not a medical facility. This form was also not provided at the time of contract signing. My parents provided a note from their physician that they should not be exercising at the gym in lieu of the form. The gym has insisted that their form be filled out and disregarded the note from the physician. It will then need to be "approved" by someone in the organization with no indication on who will be reviewing this information.

There are several issues with this:

1) The medical form does not indicate how the gym will be protecting this healthcare information. Any organization requesting healthcare information must provide a guarantee on how they will protect this information under HIPAA.

2) The medical exemption "approver" for the contract is not a board certified medical professional who has the proper skill set to interpret the information from a doctor.

3) My family over the past four years (sister, mother and father) have provided over $4000 of business to your Gym. Not understanding their medical circumstance is poor customer service.

I believe that a note from a physician indicating that they should not be exercising is enough medical information for a non-medical facility to know in order to determine if they "fit" for exercise.Desired Settlement: We would like the contract to be cancelled and billing to be stopped due to medical issues. We believe a note from the physician is enough medical information for the gym to process this information.

We are willing to pay a reasonable cancellation fee (ex: 1 month gym fee).

We have reviewed the letter concerning the member’s son. Both members have the ability to cancel their membership, as we havecommunicated this multiple times. All they need to provide is a physician form.We are in no violation of legal and HIPPA rules, as we are following the contractwhen they joined the club. The members and their son refuse to follow the simple instructions that are laid outin the contract One of the members is past due on their account.Instructions have not been followed as to canceling their membership, yet they haverefused to do so.Regards,Steve S[redacted]Anytime Fitness

Review: I joined Anytime Fitness in February of 2013, the office manager that signed us up didn't really show us around or ask if we had any questions-but since my friend and I were excited about joining a so-called convenient 24 hour facitlity we didn't think too much into it. We signed up for an 11 month contract ending in December 2013. In September I lost my key, since the office hours are very limited, Monday-Thursday 1000-1pm and 4pm-7pm Saturday 1000-2pm it was very difficult to get in touch with someone since I work. finally after three voicemails someone called me back and indicated that they had to report the key stolen then request for someone else to call me back for a new key, meaning it could take over a week for the key to be replaced. At that point I was very frustrated as I already lost 1 week of working out. I indicated that I would like to cancel- since I was not moving or since I didn't have a medical issue I was not allowed to do so, even for a fee. So I stated that I want it noted on my account that I will not be returning and I want the contract canceled. The person I spoke with stated that this was fine.I was charged 35.99 in January of 2014, which made no sense since my contract ended in December. I called three times and left voicemails each time. I had not recieved a call back until I sent a message on Facebook- I was told that I should have called 30 days prior to remind her to cancel. I feel this is very unprofessional and I should not have been charged.Desired Settlement: A refund of 35.99

I am sending this email in response to the above case, [redacted]. All documentation of our conversations with the customer is attached. We have gone our of our way to work with her, even gave her a free month as well as a free month of tanning in October since we could not reach her due to a wrong phone number. The copy of the contract is attached. On the bottom right side of the contract is a section called "optional renewal program" which states that the customer must provide a 30 day written notice to the club to cancel or it will automatically renew on a month to month basis ( which the customer did not do).. The last payment was taken according to the terms of the contract.

Consumer

Response:

When I called and spoke to [redacted] and she indicated her office manager told me to call 30 days prior to the contract renew date. This information was never disclosed to me as I would have made sure to call. That same evening I said you can clearly see I have not been to the facility since I don't even have a key- and I clearly told the office manager I would not return. [redacted] then told me that she is the owner and does not have to refund the money if she didn't want to. This is really disappointing that a so-called grown adult would act this way.

Basically this has turned into a he said she said issue. I was told I didn't have to call back since she would note that I am not returning. It is not my fault that her employee lied and said she told me to call. I do not feel I should be punished for it.

Review: I was ill and had a procedure done. Spoke with gym to cancel membership in March 4th 2013. This was the end of my contract. At that time continued to be charged full price to credit card on file. Called and complained on May 4th 2013. Was advised that membership was placed on hold. Wrote a letter on June 25th. Was then charged again $50 cancellation freaks well as may and June full dues of $30. I'm going to cancel my credit card next but this is very upsetting. I feel like [redacted], owner of this franchise has stolen my credit card numbers to bill as he pleases. I have documented text messages and verbal communication with a trainer named [redacted] who can verify this is all true. Thank you. [redacted]Desired Settlement: I would like this to be documented as I've heard I'm not the first person he has done this to. He is also known to harass female clients. He has my cell phone and has called and texted . I feel harassed. I called today and spoke w the manager [redacted]. He apologized and refunded $50. I fear that the billing if my card and cell calls and texts from [redacted] will continue. I specifically asked the manager [redacted] 1:30pm July 5th to advise [redacted] not to contact me again. I received cell call from him @2

Review: On 5/25/13 at 10:19am I contacted Anytime Fitness and spoke with a woman to place my membership on hold because I will have been out of town for several months on business. I was advised that there would be no charges for 3 months, and then my membership would pick back up, as requested. On 6/5/13, Anytime Fitness charged me again for the next months membership. I contacted the financial department that handles the billing (the number listed on my credit card statement) and they refused to help me. I explained to them that I contacted them over a week ago to handle this, and it should have been handled, and yet they still refused to assist me. They also stated that if I did place my account on hold, that it was never done. They said that I needed to contact the gym that handles my membership, meanwhile, every time I call them, I am constantly unable to speak with someone.Desired Settlement: I want a refund for the $55 that they charged my account. I also no longer wish to continue to come to that gym anymore because no one can honor a request, and then I pay the cost. So, in addition, I would like my contract with the gym to be null in void.

Review: I purchased a membership to Anytime Fitness on November 14 and have been unable to use the facilities due to a knee/leg injury. My orthopedic doctor and the physical therapist have both recommended that I not use the lower body machines and bikes. The woman at the gym told me I could cancel my membership if the doctor signed their paperwork to confirm my injury. I returned to the gym with the signed documents only to be told that I had to pay a $50 early out fee plus another month membership of $48 and that I may not be approved for cancellation because I was still able to use the upper body equipment. I feel like these people are robbing me of my hard earned money and forcing me into a membership that I am not able to use. I refused to pay them the $98, so they put my membership on hold until the spring at which time I will be responsible for monthly payments for two years. I'm very angry with their business policies and do not wish to be a member of their gym - I'll be going there in the spring against my wishes.Desired Settlement: I would like to have the membership cancelled for good. I don't mind paying the $50 early cancellation fee, but I don't feel I should have to pay another monthly fee when I can't use the facility. They said it took a month to process fees, but my membership fee went through the very next day after I signed up.

Response:

Dear Representative Revdex.com: Anytime Fitness received a letter from the Revdex.com on December 7th 2013, 2013 with an ID of [redacted]. The member joined the club on November 14th 2013. When she joined she let us know that? she has fibromyalgia and severe arthritis. She also made us aware that she was recovering from a bad fall and leg injury. She instructed us that she needed to start with some low impact workouts, as she needed to strengthen muscles and lose weight to help with the previously mentioned issues. On December 4th at 9am the member came into the club wanting to cancel her membership due to her knee and leg injury. She previously informed us about these injuries and that she was instructed to build muscle and lose weight to improve her condition. The member was then given a medical form to bring to her physician to fill out. l am not going to attach that form as it has confidential information included on it. The Physician has two options: 1) to recommend a medial freeze or 2) Medical Cancellation recommendation. The medical freeze allows the member time to recover from an injury and not be charged by the club during that recovery time. The medical cancelation option is only for the physician to complete if the patient is not able to use more than 2/3 of the equipment at Anytime Fitness for a period of six months or more. The member’s physician signed on the line where they recommended a medical freeze AND also signed on the line where they recommend a medical cancelation. This carelessness leads us to believe that the physician did not pay attention to the form or they would have only picked one of the options available to them. The Regional Manager spoke with the member on December 9,2013 and she said the discrepancy was from the secretary filling the form out. The member simply asked that someone fill out the form so she could cancel the membership. The member then became very agitated when she was asked clarifying questions on the issue. A physician is supposed to fill out the form and make the appropriate recommendation which did not happen in this situation. The member was given options by the regional manager which she was not receptive towards. The member was aware of the knee/leg injury at the time that she joined the club. We offer a plethora of different workout options to all members. We also offer personal training sessions to all new members to help them develop a diet and workout program. When someone has a medical issue such as this member we will also offer additional free personal training sessions. The purpose of those training sessions is to have a certified personal trainer work with them and show them workouts that they are capable of doing, ensuring safety around the medical limitations. With that being said, a knee/leg injury by no means would prevent a member from using more than 2/3 of the club for more than six months. The member did sign an agreement with the club that was explained in detail by the club managers. It is also explained to new members that whenever they would like to cancel they are responsible to give us a 30 day notice. They are also responsible for any payments that fall within that 30 day period. Early termination, either due to a move or medical issue, does constitute a $50 early termination fee. I am not sure why the member is referring to this as robbery as the breaking of an agreement or contract, be it a health club or cell phone carrier etc. will lead to a fee of some sort. The member does state in the letter that she sent to the Revdex.com of Western Pennsylvania that she was given the Freeze option. She also stated that she will return in the spring against her wishes. The club is accommodating her by allowing her to have the medical freeze option for the full 6 months that she requested. We gave her the medical freeze option for the knee/leg injury that she had already informed us about at the time that she decided to join the club. If she decides to start back before the 6 months is up we would be happy to set her up with personal training sessions to ensure that she is working out safely and does not further injure herself. We have many members with some very severe medical issues and handicaps that have worked with the trainers and had tremendous success. This member has failed to allow us to provide her that opportunity at this time. We are here to offer a clean and safe environment and provide all of the necessary equipment and instruction to ensure each members success. We hope that the member will return after her time off with a positive attitude and willingness to learn so that we can help her reach her goals that she set up for herself.

Response:

My doctor filled out the form and signed it, not the secretary. She put a date on the first page in the space that was to freeze the account and then crossed it out because I wanted it cancelled. My doctor signed his name to everything - no one else. And also, no one instructed me to join a gym to lose weight or strengthen my muscles. I joined on my own with these medical issues. The doctor and physical therapist told me not to use the weight machines the following week. I am willing to pay the fees involved to cancel and my doctor's signature is on their papers - but these people will not guarantee that I will be cancelled because they feel they know more about my health than my doctor. I am very angry with all of this nonsense and have contacted an attorney.

Response:

Dear Representative BBS: I have reviewed the response made by the member in reference to complaint ID [redacted] and need to clarify some discrepancies. I am not going to include in this response the medical form that was received because it contains private information regarding the member. I do have that form in my possession and you can see that it was in fact signed in both locations recommending a freeze and cancelation of the membership. Furthermore, nothing was crossed out on the Medical form that was provided to the Anytime Fitness location. I do not understand how a physician would read a form, and recommend that their patient freeze the membership (because they would be able to use the club in six months or less), as well as recommend that their patient cancel their membership (because they would not be able to use the club for more than six months and would not be able to use more than 2/3 of the equipment). When I brought this up to the member she was the one that pointed out the secretary filled out the information which is illegal. The Anytime Fitness location simply asked that the paperwork be filled out completely and correctly by a physician. The member in questions physician did send us a form that was correctly filled out. The member will be held to the medical cancelation procedures that she agreed to when she first joined the club and her membership will be canceled from the club. She is responsible for a 30 day notice and all payments that fall into those 30 days once paperwork is received. She is also responsible for a $50 early termination fee with Anytime Fitness. When the member has paid these fees she will be canceled from the club. She has been notified by email on December 20th 2013 of this. The member will also be contacted by USPS of the terms of cancelation on December 20th 2013. Anytime Fitness does not assume to know more than a physician does about a member’s health. We simply ask that members and physicians follow proper and legal procedure when signing and completing paperwork. This is the first member that we have ever had at any of the franchise’s clubs that has had so much difficulty with following a simple procedure. In regards to the member contacting an attorney that is her prerogative and we would encourage her to do whatever she fills necessary. Anytime Fitness has gone above and beyond to help this member resolve the issue. We have followed all proper policies and procedures and feel confident in the ethical business practices that we follow, and would hope this member and her physician would do the same. Anytime Fitness will not be responding to any further replies by this member to the Revdex.com of Western Pennsylvania as we have fulfilled our obligations.

Review: I enrolled in a year long membership which Anytime Fitness would charge my credit card account for a monthly fee. After the year was up I went to a month to month membership with the monthly fee still being charged to my credit card account. After the first month I notified Anytime Fitness that I would be dropping my month to month membership and to stop charging my credit card account. The manager said that there would be no problems and that they would stop charging my credit card account. Two months went by and the monthly fee was still being charged to my credit card. I contacted them and they refunded $60 dollars out of the $70 dollars that they owed me (why $60 and not $70 - I still don't have an answer to that.) I checked my credit card statement again yesterday (03/16/15) and there is another withdrawal for the monthly fee. So now they owe me $45 dollars. I left numerous voice mails with Anytime Fitness and nobody calls me back. I called Customer Support on the 800 number on the corporate webpage (o 03/16/15) and explained my problem. When I gave them what billing information that I was given when I signed up initially, they couldn't find me in their system at all. I didn't contact the credit card company to dispute the charges since I want Anytime Fitness to credit to my account the $45 that they owe me (just like they credited the $60 from before). I don't want a check from them. I want the monies refunded to my credit card account.Desired Settlement: I would like Anytime Fitness to refund all of the monies owed to me and to stop charging my credit card account for a monrhly fee since I have cancelled my membership.

Wanted out of contract do to abuse to my financial information in Wich I paid my bill..my credit card company suggested suggested that I cancel my card .they had taken one payment out ,and attempted to take three more out ,in one month ,I talk to the owner ,and ask him to cancel my ,membership ,but he ignored me the bill has been growing and growing .I have contacted corporate and ask them to cancel my membership I have tried numerous times . and every way possible to let these people know that I do not want to be a member of their sports club . and it keeps going on my credit ..I have gotten letters from my bank ,with one of their employees saying it's their fault that they tried so many times to attempt to take money out of my account ..but they still refuse to cancel my membership ,,in the beginning I did everything I asked for to cancel my membership ,but they refused to cancel it ,

Review: I signed a contract with Anytime Fitness. $98 charged on my credit card when I signed the year contract, with a one year, money back guarantee if I decided to cancel the contract within a week after signing. I called and left a message during this time that I wanted to cancel the contract. Instead of the company crediting me the $98, they have continued to charge me $50 each month. I've been disputing the charges on my credit card, and I have left messages for the business advising I cancelled the contract.Desired Settlement: I want the initial $98 credited back to my credit card, and the two additional month charges, each at $50 credited back to my card. A total of $198.00.

Review: I signed up for this gym in November based on the idea that I would have access to all of its equipment at the times that were convenient to me. I became very frustrated to find that in general the treadmills (my main desired equipment) were often all in use for long amounts of time when I went. Between this and general crowding I decided to contact the gym and cancel. The corporate website suggested contacting the gym, and so I sent a certified letter explaining my issues and requesting information on how to quit immediately. A month or two later the letter returned unopened despite the address being correct. At this time I noticed that I had been billed for two additional months since sending the letter. I contacted my bank and described the situation and the bank felt that it qualified as an unauthorized transaction. The bank told me it was necessary to change my card and that I was entitled to chargebacks for the months I had been charged since contacting the gym to quit. Several days later I received a collections notice, which stated that I must contact [redacted] to dispute the debt within 30 days. So I called them to dispute and was told that they could not mark it down as disputed (despite what their form said), and that they would continue to bill me. So I called the gym and tried to resolve the issue with them but was told I needed to wait for the owner to call. The rep called me several days later to tell me the owner said I could cancel my membership for over $300. He suggested that since I was probably not going to get out of it I should try the gym again. A contract is an obligation, but they neglected their end for many months by having insufficient equipment. I went onto their website to access my "agreement information" and, not shockingly, that document is not available. It seems to me that they have intentionally made it impossible to quit, which wouldn't be so bad if it weren't for the fact that I couldn't even use the gear I had signed up to use in the first placeDesired Settlement: Since I have been unable to use the equipment that originally attracted me to this gym, all I want is to be free from the gym without further penalty. If I had known the equipment would be unavailable so often I would never have signed up in the first place.

Review: Anytime Fitness has refused to provide a copy of the contract I signed back in June. * For October; My account was debited for an amount almost double what the original contract stated. Original paper stated $39.95 monthly. I was charged $68.95* I have not used the facility at all; not once, not one day of October.* They have canceled my account now and locked me out with NO notice or explanation. No one is ever available in their office to explain and they do not return call when I leave messages.Again, they have debited my account and then breeched contract by canceling my membership without notice or explanation. I have paid MORE than the agreed monthly fee AND have received ZERO access to the facilities for October.

Customer called about a additional fee of 29.00 that all members pay called club enhancement fee that happens one time per year this is disclosed in our agreements in which we have mailed him a copy highlighting area in which he initialed and also given a copy himself. On Oct 2 he called gym before staff hours demanding return of extra charge not understanding that this is was apart of his agreement we then notified him of the fee reminding him that its on his agreement only one time per year this charge was 29.00 in which all members pay. On Oct 5, he came in upset again about fee and employee then notified management and we told him we only want to satisfy him if he's that unhappy we will let him out of the remaining bulk of his agreement at no charge since he has expressed unhappiness with club and members of facility, we felt at this point we were not a good fit for him in which we tried to work our best with him. Employee notified management back stating he wanted to go ahead and cancel his membership. On October the 5th he was canceled in our system at no charge. On October the 9th he showed up at the door after staffing gone knocking on door wanting in and one of our trainers was working spoke to him advising him to come back during normal business hours 10-6 . He was told that his key was denied because the Sat. employee was told to end his membership. At this point we once again called letting him know we did as he asked which was to cancel him because he wasn't happy about extra fee. On Oct 23 I received letter and we have mailed him a copy of his contract and also gave him back his October 68.95 since he wanted immediate cancellation and after October 5th could not gain access to club. Review: Anytime Fitness in Uniontown Pa. They have you sign a contract for a year and pay a deposit of 70 for a key card to use their gym which they explained would be returned once the key card was returned. A complete lie they don't return the 70 deposit for the key card. After several months of calling and telling them we did not wish to renew the contract they renewed it anyway. They have charged us over 4 months after our membership was cancelled. During the 12 month period the payment taken from our account was to be 40 but over 6 months they charged us 60. That 20 more a month from what we agreed to. When we called to complain they told us that our bank was at fault and our account was over drafted. Which we even offer to take them a copy of our bank statement to prove this was not the case. They refused to refund the extra 20 charged. When calling the staff is Rude and will Cuss you Out. This gym is a complete rip off. There is another gym in uniontown called planet fitness they charge only 20 dollars a month and that includes alot of perks including tanning which anytime fitness charges an extra 40 for that to. Even when calling to explain that they continue to bill me for a gym membership I cancelled they claim no one ever called even though both my husband and I have called several times and when I tell them about over charging over a six month period they claim that was the old staff and they have a complete new staff. Yet refuse to refund the extra 4 months they billed after I cancelled and the extra 20 over the last 6 months of the contract. I have seen other reviews online of them doing the same things to alot of other people.Desired Settlement: I would like them to at least refund the 4 months of payments @ a sub of $40.99 that they collected after the membership was cancelled. The contract with them ended in January they were still billing in April. I will not ask for the months they over billed us in the sub of an extra $20 but think that others should beware.

Review: These people are seriously from hell. Not only were they very judgmental and critical in their behavior constantly, and telling me they watch my girlfriend and I on camera when no one else is there. But after I cancelled 8 months ago, only a few months later they started charging money out of my account again. I did not find out about this until it had been going on for 4 months. They didn't own up to what they did, and I've been trying to get my money back. The old guy ([redacted]) who is the owner has harassed me, and verbally insulted me many times. He called me a classy [redacted], and a [redacted]. This is no way to treat a costumer. They owe me over a hundred dollars from all of the money they have been secretly taking out of my bank account.. At my girlfriends request during her pregnancy I reluctantly signed us up for a gym, but I did not expect that I would have to deal with their scams and loop holes a year after I cancelled.Desired Settlement: I would like all of the money I spent on this gym back, and I would not like to hear from them again.

[redacted] and his girlfriend were members of Anytime Fitness. He called and requested to have his membership frozen. When the freeze came off in November, he was billed in November, December, and January. He didn't remember this. I sent him 1 months payment as a effort at compromising. In a resent conversation he now admits this. That he was not billed the money he is claiming. I'm not sure what his issues are now that he has been told to bring us any evidence that he has (bank records, etc.) and we will make it right.

Review: When my friend and I joined this gym on 12/3/12, we have a signed contract advising that $38.00 per month will be drafted from each of out checking accounts. That has been true up until today 5/4/13. Today I see on my checking account statement, there are 2 charges from this business one for $28.00 and another for $38.00. So I call the gym, and on the recorded voicemail message, it states that they are taking out a "Gym Maintance Fee" the first part of May. This was NOT disclosed to either one of us upon signing the contract. When we signed up, a staff member named Evan Watkins signed us up and he was unsure about what he needed from us. the Owner/Manager was not there. So he winged it on the contract and the Owner/Manager had to call us 3 times to finish the contract. She then stated on her voicemail message, that she sent an email to all members regarding this once a year fee. I checked my email box and my spam box and NOTHING is there!! I feel this is wrong, shadey, and very unprofessional and I do not do business like this.Desired Settlement: The 2 parties involved are myself [redacted] and [redacted]. We are both requesting the $28.00 to be refunded to both of our checking accounts and to have the remainder of the contract cancelled WITHOUT any penalties or fees. I do not feel comfortable using that gym now, because I feel they can not be trusted.

No one achieves anything without the involvement of others. Each Spring, ATF has the opportunity to join together to make major improvements to the club to keep us fresh and current for our members. In order to make this happen we use a resource located in the membership agreement each member signs when they join. This "club enhancement" fee charge is $29 per year and the funds raised are added to money provided by the owners to purchase some equipment both large and small. There are 3 ways we communicate the fee to our members: 1. It is written in the membership agreements the customer signs when they join, it is located under the title "maintenance of facilities and it explains the fee. 2. Email reminder was sent through Constant Contact on April 11, 2012 as a reminder about the upcoming fee drawn on May 1st. Members emails are entered into Constant Contact when they join. 3. A letter explaining the "enhancement fee" is put in the New Member Packet which is given out at the time the customer joins. It is unfortunate that this customer missed all 3 of the attempts to communicate the "club enhancement" fee. I checked my records and the customer's email was entered into the system in December of 2012 when he joined the club. After receiving this complaint I resent the email from Constant Contact to the customer which was originally sent on April 11, 2012. It did not come back in the system as bounced or returned, which means it was received. The customer's signature is on the contract for authorization for Preauthorized Payments, where it states by executing this preauthorization you choose to instead of getting this notice only when the payment would differ by more than %50 from the most recent payment, which the enhancement fee does not. I have only heard from the complainant and not the other member stated in the complaint regarding this issue. The other customer mentioned in the complaint has a separate contract and personal information. I cannot prove that this customer received a new member packet, since I was not the person who signed him up. However, all employees to the best of my knowledge always give a new member a packet when joining. The customer had two other opportunities to learn about the "enhancement fee". When signing a contract agreement it is always important to read the contract to which you agreed. As with any other business, a contract is a legal and binding agreement to what each of the party's responsibility. Therefore, I am not waiving the customer's responsibility for payment of the enhancement fee nor the time commitment of the signed contract. The customer is responsible for monthly payments for his membership. I have already given him a $21.00 discount for his employment with [redacted] and will also offer him a $25 gift card for a personal training session to assist him with his personal fitness goals.

When I signed up with this "Gym", [redacted] was NOT there. The 2 people that were there were [redacted], and a lady. It took 45 minutes to complete the process. Photo copies of our Drivers Lic were not even gotten then, as [redacted] had to photo copy them at a much later date. [redacted] had to call us 3 times regarding the payment information. So as you can tell, the sign up process was very mishandled and less then professional as I am use to. We were rushed through the contract and I asked [redacted], "This is all that we will be charged is $39.00 per month?" His response was yes. As soon as I signed the contract, he quickly removed it from me and went into the office with it. No "Welcome Packet" was given to us nor mailed to us. [redacted] only gave us $1.00 off of the mthly membership, I am not sure where she arrived at a $21.00 savings. The correct business discount was not even quoted to me at the sign up time. I ahd to mention that again during one of the multiple calls made by [redacted] to get the correct payment information. I was quoted $39.00 monthly membership dues at the time I signed up, but my discount was $38.00. So I save a whole dollar. So in closing, if she is willing to offer me a $25.00 Gift Card, then I will settle with $25.00 refunded to my account. The $25.00 Gift Card to her facility will do me no good, as I will NOT step foot back into her facility or any other Anytime Fitness, as we thank god have other gyms in our area that DO NOT have hidden fees. Thank you

At Anytime Fitness Waynesboro we never photo copy a member’s driver’s license, therefore I never photo copied the license and to the best of my knowledge called him three times. I did have to call him once for his credit card number since he did not have payment at the time of his sign-up. I arrived at the $21 savings to the member since the original monthly fee was $39.99 and I reduced it to $38 (the [redacted] Corporate rate), the monthly savings is $1.99 X 11 months on the billing contract equal $21.89. All members can cancel their contract for any reason within three days of signing. If the sign-up process was so terrible the member could have decided then to cancel the transaction. This member has his "story" on how he believes the events happened. I have provided documentation to the Revdex.com to validate our response to his complaint. Anytime Fitness offered three ways for this member to find out about the "enhancement fee" which is charged annually to all members. Even if he did not receive a "New Member" packet which is given to all members, I have proof of the email sent as a reminder and it s written in the contract he signed. It is the member’s responsibility to read the contract for which he is signing his name and agreeing to the terms as stated. It is clear that he did not read his agreement. He is responsible for the conditions and terms as stated in the agreement he has signed. My previous offer still stands, in good faith to give this member a $25 valued service to assist him with his fitness program and goals. I would appreciate that the BB edit the complaintant's responses to eliminate my staff and my name as it personally identifies us. We did not identify him in any of his responses per the Revdex.com instructions.

Review: To whom it may concernMy name is [redacted]. I live in Patterson CA, and I have an issue with a local business that needs resolution.I was once a member of the anytime fitness with my daughter. After 1 year I decided to cancel my membership. When I inquired about cancelation, the worker at the front desk was unable to provide me with the info needed claiming to notknow the email address needed for cancelation. Instead I was given a phone number to call. Once I called the number provided I was informed that I cannot cancel via telephone, instead they provided me with the email needed to cancel my membership. I sent an cancelation email to [redacted] on 9/27/2013. My daughter and I returned our keycards to the gym soon after. Recently I discovered I was still being charged a monthly membership fee and that my membership was notcanceled. A single letter spelling error in the email address caused the email to be sent to the wrong adress. I did not receive a failure to deliver email, so I assumed my email had been received. I had been charged for a membership that I beleived to have canceled. I enquired about being refunded for the 17 months I had been charged for a membershipto a gym I was not able to even enter, due to turning in my keycard 17 months ago. Once I had noticed the fees I contacted Anytime Fitness, inquiring about the sitaution and being refunded for membership fees I fell I should nothave been charged for, the desk clerk informed me that she would contact [redacted] on my behalf. The desk clerk wasunable to provide me with the email address for [redacted], instead she called. Within an hour I was informed by the desk clerk from Anytime Fitness that in order to cancel my membership and be refunded was to send the origonal email to [redacted]. Soon after I had re-sent the origional email that I was told to provide the origional confirmation email, which I could not do since the origional email had not been sent to the correct address. I started cancelation process over and completed it. I received and confirmation email on 2/28/2015 that my membership had finally been canceled I was informed by the staff manager at Anytime Fitness that thing such have happened before and I will be refunded evetually. I had enquired with ABC finanical about a refund and I was informed on 2/27/15 that they would inform the ownerof that location of the sitaion, and it was up to him to approve or deny the refund. On 3/2/15, after not receiving any correspondance of any kind from the owner of Anytime Fitness, I visited the location in order to inquire about the situation and the acting manager asked if I would like to speak to the owner. I received a call from someone who claimed to be the owner of the Anytime Fitness location. The man I had talked to failed to disclose his full name in the conversation. He had asked about how I had attempted to cancel the memebership, once I had informed him as to the steps I had taken. He then informed me that he was not refunding the money which totaled $1019. Upon telling me he was refusing the refund he became irate. His tone of voice became abrasive. At one point he said that if I had missed a car payment I would be in trouble. I fail to see how his analogy applies to this situation, I found it to be insulting. After several minutes of him raising his voice and making comments like this he asked for a copy of the origional email. His demanor during the conversation was so abrasive to the point that I could not talk with him. He would not let me speakand proceeded to talk over me in a volitile manner. The owner claimed that my account was still active and had not been canceled, even though I received the confirmation from [redacted]. I became too upset with him that I handed the phone to my daughters Fiancee so that he could write down the email. The owner then proceeded to raise his voice and continue his abrasive tone with my daughters fiancee. My daughters Fiancee asked about cancelations methods and he was infromed by the owner that while most Anytime Fitness locations allow phone canelations, his locations do not. Soon after the conversation was over. I would like to receive a refund for the 17 months of membership I had beleived to not have had. While I do understand the technicalities of this situation, I am very upset with the manner in which this situation has been managed. From the Anytime Fitness employees not knowing the companies cancelation methods clearly, to the rude interaction with the owner, the customer service has been atrocious. The Patterson location does not allow for phone cancelations, yet I was only provided with a phone number to cancel. Should they allow customers to cancel over the phone this sitution would have been avoided. [redacted] has detailed records of of every call I have made in attempt to resolve this issue. After the rude conversation I had with the owner I do not wish to have any more correspondece with him again. My origional email can be accessed from [redacted]. I do not feel I should have been charged for 17 months of membership fees since I had returned my keycards. There was no way for me to eneter the gym without keycards, and only members have them. If a gym can enter you into a system, set up billing and take the first payment, then they should be able to cancel from their location. I have never had to go through so many channels in order to cancel anything before, let alone have the establishments owner insult me over the phone. Any resolution to this situation would be appreciated. Thank you for your time.Sincerely [redacted]Desired Settlement: I would like a refund for the gym membership from when I had turned in my keys since I was unable to even enter the gym if I had known My membership was not canceled.

Response:

This member's membership was terminated upon the proper cancel obligations by the member as per the signed membership agreement. The member firmly stated that she would contact the Revdex.com and anyone else until she received refund. As a business, we can not deviate from company policy and legal practice to accomade this member's request. This member continues to try escalate this matter by making false statements about the best practices of this business.

Review: Cancellation of membership and a refund of $80 for the past 2 months that I thought the membership was cancelled.

I am outside of the contract agreement period. A membership can only be cancelled through the gym you belong to.

On 1/6/16 I contacted the gym by phone to cancel my membership. The staff member I spoke with supposedly took down my name and said he would take care of it.

On 3/1/16 I was checking my credit card statement and found that I was still getting billed by the gym. I contacted the gym again. I told the staff member that on 1/6/16 I called the facility to cancel my membership, but I was still getting billed. That I wanted a refund for the months of February and March. The staff member I spoke with this time, again supposedly took down my name and phone number. He said that they were having a computer issue and when it was resolved someone would contact me. I have not heard back from anyone.

Both occasions the staff member I spoke with did not give their name when answering the phone. It seems like they have been trained to speak in a hurried manor on the phone. Tell you that they will resolve your issue and get off the phone as quickly as possible. In both occasions I was off of the phone then realizing I never got the name of the person I spoke with.Desired Settlement: Cancellation of gym membership.

A refund of $80 for the months of February $40 and March $40.

I was a member of Anytime Fitness and have been to several locations within Ca and various other states. I have had no issues with any other location AF location. My problem is with AF in Martell, CA. The owner decided to move the gym to a new location. The estimated downtime for the gym was 5 days. That changed to two weeks. No gym access for two weeks. I added a post on the gym's Facebook page stating members should be reimbursed for the two weeks of downtime. The same day the owner of the gym left a voicemail for me stating that "he was not happy with me" and that he has canceled my membership and that I am no longer welcome at the gym. His actions were unprofessional and uncalled for. Stay away from this gym. It is extremely cliquey and your membership may be canceled at the whim of the owner and the associated cliques.

I've been a member since day one at this fitness center, and they truly care about us (their members). I have always been ask or fan of excellent customer service, and I feel I've received top-notch service from this business. Kudos to them and their staff for providing that personal touch that most businesses lack in today's face pace world.

Review: This is both an advertising and customer service issue. I went to join the Anytime Fitness during an advertising promotion of two free months membership due. When I asked about this I was told that is only for certain types of memberships of which mine was not. The advertising promotion said two free months and nothing about certain types of memberships. The also told me with the membership I could access the facility and equipment at any time, which is not true. I was kicked out of the back room of there facility

When I have tried to talk with them about these issues they are rude and don't answer e-mails or calls.Desired Settlement: I would like them to honor the advertisement and give me the two free months membership.

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]This doesn't address the issue of the advertisement that offered two free months of membership. The advertisement doesn't say anything about what type of membership you purchase only that you will receive two free months membership. This is the resolution I want and will not be happy until I receive this.

Response:

When Mr. [redacted] came in to sign up, he was given the option of having the two months free and paying 44.90 per month (which is a regular membership), or paying 35.16 per month with no joining fee. Mr. [redacted] made the decision to pay the 35.16 a month, without the two months free, after the sales associate explained the different options. We wish Mr. [redacted] would have addressed these issues at the time of his sign up if he felt this deal was unfair, or at least asked more questions to gain a better understanding of the options that were offered to him. We would hate to lose a valued member, so we would like to offer Mr. [redacted] one free month and keep him at the corporate rate of 35.16 per month, which would be reflected on his January dues. We hope both parties can learn from this and come to an agreement soon. Thank you,[redacted], Office Manager
