Response:

Hello,We are in receipt of you complaint on behalf of the customer.

We understand the customer frustrations and have responded to the complaint by

providing a full month customary refund of $89.95 on 2/24/2015. Please allow up to 10

business days for the credit to show. Also, please be aware that it was

stated in the terms and conditions that the customer would be charged for the

full 30 days for the trial bottle if they didn't cancel before the 14 days was

over. The system does not and will not allow the client to proceed to the

checkout section to complete the purchase unless he acknowledges the terms and

condition of the product. The customer is automatically signed onto our

monthly subscription until they call in and ask to cancel the product.

After the customer finishes their 30 day supply of the product, they will be

charged on the card on file for a 30 day supply plus shipping and handling.

Usually, the customer must receive and RMA number from the customer service

department to return the product and they will then receive a refund.

Nevertheless, the customer account has been cancelled and will no longer be

receiving anymore products or be charged. It was stated in the terms and

conditions every customer agrees to before proceeding to check out. The customer

must call in and cancel their account before the 14 day trial is over. If the

customer fails to cancel their account, they will be charged for the trial

product and be subscribed onto our monthly subscription. Sincerely, Beau Derma

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

THE TOTAL AMT. WITHDRAWN FROM MT ACCT. BY THIS BUSINESS, IS $173.00 + S&H.NOTHING LESS, WILL BE ACCEPTABLE.

Review: I responded to an internet ad on Facebook for what appeared to be a free trial of Beau Derma and Revita Eye products I was asked for my Visa card information to cover the $10.90 cost shipping and handling these "free" products. I apparently inadvertently clicked that I had read and understood their 10 page statement of terms and conditions which required me to pay much more for my "free" products by automatically charging my Visa card without my explicit authorization. I tried both products and found them to be no more effective than inexpensive over the counter cosmetics. On November 16, 2014 I received a fraud alert from my Visa card issuer saying I was being charged an additional $175.90 for these products. I immediately contacted Beau Derma at the numbers provided and received cancellation confirmation numbers [redacted] and [redacted]. I was still charged an exorbitant amount for these rather useless products. On Nov 17, 2014 I was charged $$89.95 for SRM*Skinremedy and on Nov 18.2014, I was charged $85.95 for EYA*EyeAdvanced. I e-mailed Beau Derma asking for a refund and it was only at this time that I learned that their "risk free" trial was neither safe nor free. I am very upset by their deceptive practices that lead innocent customers to believe that the only cost for their risk free trial is the shipping cost. Once a customer cancels their unwanted order, callers to Beau Derma are simply told their account has been cancelled and given no option to speak to a live representative. I sent a letter by certified mail to Beau Derma on Nov 25, 2014 and as of yet I have received no response.Desired Settlement: I would like two things from Beau Derma.1. A full and complete refund of $175.90 for their unauthorized charges to my Visa card. This refund will have to be made via mail or via my PayPal account at [redacted] as I have cancelled my Visa account to prevent further unauthorized charges.2. I would like Beau Derma to modify their marketing to make sure future customers clearly understand any charges that they will be subject to. The term "risk free trial" should not be used.

Response:

Hello,

Review: On 3/9/15, I ordered a trial product. Trial period clearly states money back guarantee if not satisfied with product. I phoned 888-510-9185 in to cancel the order and membership on 3/22/15, clearly within the trail period. On 3/23/15, Beau Berma charged $89.95 for a monthly subscription fee. I called on 3/23/15 and they confirmed my account was 'cancelled' & I would a get a full refund and to ship back anything that may have been shipped from their office. I called back today 4/26/15 wanting an update on the reimbursement and the operator stated that I did not cancel within the 30 day period. I stated that I cancelled on 3/22/15, but the operator stated that I used the automated service to cancel and not speak with a live representative. Their 'policy' does not allow the automated service to cancel. I expressed to the operator that nowhere in their terms (http://trybeauderma.com/terms.html) does this state that the automated system to cancel membership is not a valid methodology to cancel accounts. This is the most bizarre business model that I have observed, I cancel within 14-days and they refuse to refund a 30-day membership fee. Why develop an automated cancelling service that doesn't 'count'? Revdex.com history shows a current history of over 27 complaints dealing with non-refunding of an automatic membership fee. Revdex.com what needs to occur for you to take action against business practices who refuse to refund fees as spelled out in their terms?Desired Settlement: I am requesting a full refund of $89.95 but requesting Revdex.com to fully review the business practices by Beau Berma as defined in their terms http://trybeauderma.com/terms.html. There are so many contradictions in their terms and conditions that the Beau Berma operators are simply not refunding due to the ambiguity of their poorly written terms.

Hello,

Review: I called and got an automated message the account was cancelled and no more auto shipments would be sent with charges. Again this month my card was charged for one of the products. After calling the customer service they said I could send the product back but they would not credit my account. I cancelled in March but the charges still were put on my card.Desired Settlement: My card creditted for the product I did not order. 94.50

Hello,

Review: I ordered a trial sample of the eye cream and the face cream for $4.99 x2. I advised them not to send any more and advised them immediately that I did NOT authorize any further charges to my credit card. They continued to send me two packages/month and charged my credit card $180/month x3. I refused the packages as return to sender. They refuse to credit my account for the $540 they effectively stole from me.Desired Settlement: I want my credit card credited $540.

Hello,

Review: I order a sample from [redacted] and charged to my credit card they sent another order and charged my credit card $94.90. I put refused return to sender that was on 03/07/2015. I called this week and ask them to refund my money, they said they would only refund only $44.98. I did not agree to this refund. they have the product back and refuse to return my money. thank youDesired Settlement: Would like my money back.

Hello,

Review: Product was advertised on internet, purportedly with [redacted] endorsement. I received the "free" product paying only for "shipping and handling." Later my account was charged a very high amount for a new shipment (mailed on Sunday March 15th) that was not disclosed in the advertising. When I called the VISA number there was clearly an expectation that the customer would be calling to cancel the account since it was the first (and perhaps only) choice in the automated phone entry system.Desired Settlement: I would be happy to return product shipped unopened if confirmation of refund to my credit card is made.

Review: On 1/17, I ordered product from this company. On 1/18 I received a shipping notification via email that the product had shipped. I received the product on 1/22 as evidenced by delivery confirmation of the USPS. In looking at the shipping package, noticed that it in fact shipped on 1/19, not 1/18. It was for a trial period of 14 days. It is my opinion that the 14 day trial period started on the 22nd when I received it, not on the 17th when I ordered it. How can you try something for 14 days when you only have it in your possession for 9 days according to their scenario. I cancelled it on the 31st, which was within my 14 day trial period. I asked for my money back and they refused stating that my trial period had run out. They are practicing unethical business practices. They are taking advantage of the public and should be shut down.Desired Settlement: I would like a refund and an investigation of them as well as their sister partner in crime [redacted]. Same experience with them

Review: I ordered a free sample of their face cream and paid $4.95 for shipping. I got the sample in the mail and 2 weeks later they debited my bank account for $89.95 for the product. I only ever received the sample and didn't subscribe to anything. I called right a way and cancelled, but they refuse to issue a refund of the $89.95! This is fraud and I need my money back!Desired Settlement: I want them to refund my $89.95.

Review: My husband purchased a trial of Beau Derma and [redacted]. Upon using the product it started burning my skin around my eyes causing deep rash and peeling skin. I stopped using the product. We received additional charges on our bank account for future purchace of the product and when my husband called to cancel and get a refund due to the allergic reaction they told him he could get 15% although they advertise a 30 day money back guaranty. I now have to file a dispute with my bank and pay to return a product that we cancelled before it was shipped.Desired Settlement: I would like the company to make this right and include their turms and conditions in with the products and also honor there money back guaranty policy.

Hello,

Review: I ordered a free 30-day trial of beau derma and revitaeye as advertised online. There was a 30-day money back guarantee, and all I had to pay was $5.95 & $4.95. I palced the order on December 8 and received the order on December 12. On December 15, I called the toll free numbers, which was a recording that I did not want the order anymore, and pressed the option to cancel, and was told my order is cancelled and I'd be charged $42.71 (revita eye) and $38.71(beau derma), a charge which was not authorized. I called my credit card company to notify of these charges right away, and was told that thay already put the charges through, but I can file a dispute because this has happened several times with this particular company. When I called both customer service numbers this morning, December 16, to discuss these charges, I was told I had 15 days (I am still within this time period from order date) to cancel and return the products and should have spoken to them instead of opting out on the phone. After a lot of back and forth both agreed to give me a 15% refund, then 30% and finally 50%. After I insisted on getting my full refund, and that I was going to report to the Revdex.com, Revita Eye agreed to give me a full refund and the address to send back the return. However, Beau Derma said they would only refund 50%. The sad thing is there is nothing that clarifies the return/refund policies. Also, I researched the address I was given to return the RevitaEye product, and realise that it is a UPS address.Desired Settlement: I would like a full refund from both Beau Derma and Revita Eye.

Response:

Hello,

Review: I ordered Beau Derma skin cream in January 2015 via their website. They sent and billed me for shipping and handling $4.95 and sent me their sample size to try. Then I would go on regular shipping every 30 days until I cancelled. I did not like their product but did not cancel before the 10 days of initial ordering. They then charged me $89.95 on 10th February for the regular price plus shipping and handling. I received no other products from them. It is my belief that they should have been very clear as to their practices. Surely I should have, at least, received my first product that was paid for, instead of my having to pay product price, shipping and handling again for a product that was not sent. I tried to stop payment for the second amount of $89.95 but could not receive a refund.I believe this practice is a scam and wanted to let you know, or at least to let other people know what these people are doing. I was appalled at this practice and believe they should be reigned in.Desired Settlement: Would preferably like my $89.95 refunded as I did not receive any full-size products. Only received sample size.
