Ms. [redacted],

We recently received your complaint from the [redacted] in regards to your Blizzard White account. According to our records, we received your order on May 19, 2014 and shipped your package the same day. Please note that we do not offer samples....

The terms of the offer that you agreed to at the time of your order clearly state that you were to have a one week trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $94.31 eight days from the date of your order processing for the product.”

These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to.

When you ordered the product you also checked a box indicating that you had read and agreed to the terms of the offer. When a customer checks that box we must assume that they have actually done what they are stating they did. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.

Since we did not hear from you during your trial period, you were charged $94.31 on May 27, 2014. Inside your shipment there were two products. One is labeled “Free Trial” the other is labeled “Complete Program.” The Complete Program is  what you were billed $94.31 at the end of your trial period.

The first time we heard from you regarding the cancelation of your account was on May 29, 2014 after you had already been charged. Your account was immediately canceled and you have not received any shipments or charges since then.

At that time we reminded you of the terms of the offer that were agreed to at the time of your order which state that once the trial period has ended, product from the initial shipment is not eligible for a return or a refund.

However, in an effort to maintain our standard for customer satisfaction I have made an exception and am allowing you to return your product for a full refund. The following return instructions outline the steps required to receive your refund.

Dear [redacted],

This email is being sent to confirm that your account is cancelled. You will no longer receive charges or shipments.

The RMA number you requested is [redacted]. This is valid for one package. Under the Return Policy, you may only return one package for credit. The package must be received before 2014-07-01 to qualify for credit. If your return is received opened or damaged there will be a $19.60 repackaging fee.

Please write the RMA number prominently on the outside of the shipping package. You will not receive credit if you do not use this RMA number.

Our return shipping address is:

Web Fulfillment Center[redacted]

Once your package is received, a credit will be issued back to your credit card. Please note that returns are typically processed in one business day once we receive your package and it can take another day or two with your bank before it shows up on your credit card account.

If you should need further assistance, please contact our Customer Service Center. We're happy to assist you in any way we can.

Thank you,

Blizzard White

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I’m writing to let you know I reject BlizzardWhite’s decision. These are the reasons:They sent me in Dec. the TRIAL offer of 1 pen for $4.95. I received the TRIAL offer and was told not to use it on dentures.  I called the company  12/5 to obtain the RMA number to send it back and told them I did not want any more. (NEVER USED IT)When my credit card statement came in I questioned the $94.31 charge and told them I would not pay it as I NEVER received a 30 day supply. They in turn told me I had not sent the trial back in time. I counted from the day I received the TRIAL and they said they counted from the day I ordered (Dec.10).  That doesn’t make sense, how can you try something you don’t have in your hand??They are claiming now that they sent the 30 day supply the same day as the TRIAL.  Why would you do that before you even tried product??  I NEVER  RECEIVED THE 30 DAY SUPPLY!!We’ve had an awful winter here in the Northeast and sometimes our mail was held up.Unfortunately my credit card company advised me to pay the whole bill so my credit would not be ruined and then they would dispute charge. I never should have paid it and disputed it then.I feel this company is running a scam, their so called polices are at the least quite questionable!! They are  based in Nevada, but follow the laws of Arizona??Would you please help to resolve this situation so I can get my $94.31 back. Please let me know if I have to send all the papers I have re: this case?  I sent quite a few to my credit card company and also to the Revdex.com here in Boston.  They assured me they sent it all to you. Thank you for your kind cooperation and consideration.Regards,[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.1.) I have not recieved any refund from the company as of July 7, 2015.  Once I have received the refund then I will accept the terms.  In their letter it states that they refunded me the money once the product was returned to them and that was not the case.  I just went back and searched through my bank records and I do not see a refund for the $94.31.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.

I would like to add that no where did I see the amount of $94.31 mentioned even when I went back and looked twice after ordering the free trial. Also I never received any emails from Blizzard White for any reason. I do appreciate your refunding the shipment and will return it to you right away.Regards,

Mr. [redacted],

The number provided does not match our format for RMA numbers, as it contains no letters. It is clear that you contacted the other company listed in your response, but failed to contact us. We still have yet to receive your return product. Again, as long as the product is received by the return deadline date you will not receive any further charges.

The product is a teeth whiting kit. I order the kit at $1.03 on 12/09. The chargd my account another 3.87 on 12/11. I recived the product on 12/16. They then charged my account on 12/17 94.17 because I didnt cancel on 12/16. By the time I got the product, the call center was closed. The set up the shipper to make sure the consumer cant cancel the product. This is a scam. I spoke with employee [redacted] and a supervisor [redacted]

we never agreed to any of this with them.their website was rigged so when we hit the x button to closeout the page, instead of closing the page, it processed the payment when we never agreed to it.after we had called the company to explain this, they would not listen, they would not let us speak to a manager, and they would not give us a refund.  the people I spoke to were very rude, and even after I cancelled the order they still sent the package to my house when I ask them not to. Also, after my order was cancelled we were again charged with another $3 fee. There was nowhere on their page that said I would be charged any money there was no small text or anything saying that my card would be charged. I had called the customer service numerous amount of times and every single person I talk to lied to me and tried to rip me off. Also, after checking Google and search in the company I had found out that they had skinned thousands of other people. Their website is fake and was made to whenever I exit out of their webpage it sent in any information that I typed in the space. I called them seconds after this happened, and ask them to cancel my order and not to send anything to me they said they would not send me anything or charge my card but they did. Everything you did was it illegal and they need to be stopped before they hurt any more families. There is no way what they did could possibly be legal.
