your Blizzard White account. We take complaints very seriously and we hope this
response will provide you with additional information. We received your order...
on December 27, 2013
and shipped the package the same day.
The terms of the offer that you agreed to at the time of your order clearly
state that you were to have a one week trial period starting from the date of
your order processing in which you could cancel your account to avoid further
charges. They also indicate that “you
must take affirmative action to avoid further charges or you will be charged in
the amount of $94.31 eight days from the date of your order processing for the
product.” Our purchase terms also
specify that if you cancel your account within the trial period you will be
required to return the included 30 day supply within 15 days of the cancelation
date.
These terms were presented to you in multiple places on our
website when you ordered our product. Additionally, you were sent an order
confirmation email after your order was completed that provided a full written
version of the terms you agreed to.
When you ordered the product you also checked a box indicating
that you had read and agreed to the terms of the offer. When a customer checks
that box we must assume that they have actually done what they are stating they
did. If there was any confusion with the terms you could have called our
customer service team and they would have been happy to assist you.
According to our records we have never received any communication
from you requesting to cancel your account prior to this complaint. Had you
contacted us we would have been happy to assist you. You will be required to return the portion of
your shipment that is labeled “Complete Program” back to us to avoid the full
charge for the product. Please follow the return instructions listed below.

A month later we still had not received any cancelation requests and a second shipment was sent to you on March 12, 2015 at the cost of $105.22 ($94.31 product price plus $10.91 shipping). The first time we heard from you regarding the cancelation of your account was on March 17, 2015 after you had already been charged for your second shipment. Your account was immediately canceled and you have not received any shipments or charges since then.Our records show that our representative issued you an immediate refund for your March shipment. As a courtesy you can keep the product at no charge. Keep in mind that the purchase terms all stated this information and it was your responsibility to abide by them. Please note that we have done everything possible to assist you with a viable outcome on your account. You have refused all offers of assistance and opted to file a frivolous complaint instead. Youraccount was immediately canceled and you have not received any shipments orcharges since then.At that time we reminded you ofthe terms of the offer that were agreed to at the time of your order whichstate that once the trial period has ended, product from the initial shipmentis not eligible for a return or a refund.However, in an effort to maintainour standard for customer satisfaction we made an exception and allowed you toreturn your product for a refund or to receive a $56.59 refundin lieu of returning the product. You accepted the $56.59 refund option andthat refund was issued back to your card on March 25, 2014.I apologize but you are noteligible for any additional refund. Your account remains canceled and you willnot receive any further shipments or charges.
Ms. [redacted], Those same terms are located on the same page where you entered your credit card information in 12 point font. You were required to check a box stating that you had read and agreed to those terms before you were allowed to submit your order.
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.The terms were not stated clearly until after the item was requested. The terms were then stated in an email and I was not given the opportunity to cancel without incurring unnecessary shipping and handling charges.Regards,[redacted]
