July 21, 2015Re: [redacted] Dear [redacted] As discussed in our previous correspondence, please be advised that Frost Brown Todd LLC represents Joseph Chevrolet ("Joseph") in the above referenced matterJoseph received the complaint filed by [redacted] on May 14, (the "Complaint"), which alleged that Joseph had employed a "bait and switch" in order to lure [redacted] into leasing a new vehicle [redacted] then responded to the Complaint on May 27, 2015, explaining that this was a typical sale in which [redacted] came to Joseph's new car showroom and entered into a lease for a Chevrolet Camaro LT Convertible [redacted] has now issued a rebuttal to Joseph's Response (the "Rebuttal"), which was received by Joseph on July 8, In response to the Rebuttal, Joseph states the following: [redacted] contacted Joseph over the phone and online about the availability of a specific used Chevrolet Camaro LT Convertible, serial #(the "Used Vehicle")At the time Joseph was contacted, that Used Vehicle was still availableIn the time between when [redacted] contacted Joseph about the availability of the Used Vehicle and [redacted] visit to test drive the Used Vehicle, he was notified by Joseph that it had been soldNevertheless, [redacted] elected to travel from Louisville to Joseph in order to see what other options were availableUltimately, [redacted] elected to enter into a lease for a new Chevrolet Camaro LT Convertible (the "New Camaro")At no point in time did Joseph act inappropriately or in any way unduly influence [redacted] 's decisions.Not surprisingly, the New Camaro was more expensive than the Used Vehicle [redacted] was initially interested inMr Sanders was fully aware that the less expensive Used Vehicle was unavailable before he arrived at Joseph's new car showroomHe was also fully aware that the exact Camaro LT Convertible he was interested in initially was available in Dayton at that timeIn fact, he checked with the Dayton dealership while at Joseph to ensure that it was availableNevertheless, [redacted] ultimately elected to go with the New Camaro through JosephHe now complains that the price of the newer vehicle is too highDespite thefact that [redacted] admits that he "loves" the New Camaro, he believes he is entitled to own the new car at the same price as a used CamaroHis reasoning is that Joseph may have had a Camaro available at the time that he freely entered into a lease for the New Camaro of his own volitionIn essence, [redacted] is experiencing buyer's remorse for leasing a newer, more expensive car, and expects Joseph to foot the bill.Joseph has reviewed [redacted] 's desired resolutions, all of which are totally unreasonableEach of these resolutions allows [redacted] to gain ownership a brand new Chevrolet Camaro LT Convertible, a vehicle which he merely leased, for the price of ownership of a used CamaroJoseph cannot agree to such an arrangement

We have reached out to [redacted] directly for an update as the rejection to our response came on the same day delivery management was updated by our escalations team The number on file with the Revdex.com for [redacted] did not appear to be a reachable number but we have emailed her in a follow up

We reviewd the account and did see reports of non delivery of the paperWe extended the subscription until November **,We also reached out to the Circulation Manager, to make him aware of this issueWe will work with him to reach a resolutionI spoke with [redacted] and advised of the changes to the account ans she agreed with what has been done so farI advised that I will be back in contact once a resolution has been met

Terms and Conditions provide explanation of our auto renewal policy for all subscriptions and the requirement to call for any cancellation As a courtesy, we have provided a full month refund to the subscriber as requested and confirmed our policy for any future subscriptions Sub should receive refund in seven to ten business days to the credit card on file

Revdex.com:Dow Jones/Wall Street Journal makes it very easy to sign up for a trial subscription but makes it very difficult to cancelAfter this complaint they did refund my money, therefore I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me and the matter has been resolved Sincerely, [redacted] ***

ALL subscribers are prompted to read and check off that they had read and agree to the terms and conditions of our subscriptions at sign upYou can not start an account without checking off you read and agree to the terms and conditionsWithin those terms and conditions it states ALL trial
accounts are on automatic renewal after the trial time We have already addressed this concernThe subscriber should check the paypal account associated with the account for review of informationWe have sent the subscriber a email regarding the concern being rectified

Unfortunately, we are unable to provide a refund to *** *** because he did not call to cancel the subscription prior to the renewal date, as he was advised toThe subscription is non-refundable which is stated in the subscriber agreement, which he agreed to at the time subscription was started
It is our company policy that subscribers call to cancel, not just through emailHe emailed on February ***, was informed to call in to cancel, and did not call until February ***He was charged on February ***The subscription was cancelled, but no refund will be allowed

The subscriber has been extended for each reported missed delivery We will call the subscriber to advise the Circulation Manager is aware of the concern and working with the local Delivery Team to resolve

All subscribers are prompted with the terms and conditions before subscribingThe terms and conditions states all accounts will automatically renew once the trail is overEvery person signing up is prompted with thisWe have contacted the subscriber directly in regards to his request

Here is some additional proof (see below) It is the email Dow Jones sent to me on Nov ***, marking the start of the trial I had until Jan *** to cancel the trial-- but they went ahead and charged me on the ***
