Dear Revdex.com:Please see the attached letter in response to the complaint file against our business.Let me know if you have any further questions.James Z*** April 14, Revdex.com of NM Jefferson Street NE Suite AAlbuquerque, NM Dear Revdex.com: This letter is in response to the complaint filed by Mr [redacted] on April 5, 2016.First, let me be clear in that Mr [redacted] was never forced to purchase the car, and never once was not given the opportunity to test drive and/or take the unit to a third party for inspection before he took deliveryIn fact, on several of the forms he provided the Revdex.com he acknowledges with notary confirmation that he understood he could take it to a third party and he declinedCar & Truck Gallery did acknowledge the after the sale and within the NMVQAA (15day/500) that the power steering pump was leaking and fan motor were not working properly and those items were replaced under the implied warranty that was provided on the vehcileThe car was then returned to Mr [redacted] , passed emissions, was registered and titled and has been used by Mr [redacted] since the day the car was returned to him including a long trip to Southern NM in that time frameHe states the check engine light has been on since the day he bought it, but that is impossible, or it would have not passed the required emissions test in Bernalillo CountyIn early March 2016, Mr [redacted] came to our offices and informed us about the check engine light, that he had a cracked windshield (again this was not the case at time of sale), and that the AC was not working properlyWe informed Mr [redacted] that we would be willing to top off the AC freon for him at no charge out of goodwill and even filled a goodwill repair form which he refused to signWe also let Mr [redacted] know that the car was no longer under the warranty provided and that now it was his responsibility to maintain and care for his vehicleThe facts of this complaint are this, Mr [redacted] bought a used vehicle, which by law, Car & Truck Gallery has a specific implied warranty, fully acknowledged by Mr [redacted] in the paperwork provided, and all of the items that were of issue under the warranty were cured and have provided Mr [redacted] with reliable transportation since he purchased the vehicleClearly after the implied warranty time period had passed some issues have come up on a used vehicle and it now seems Mr [redacted] thinks he has no responsibility to care for his vehicle and that Car & Truck Gallery should provide a warranty beyond what is required by law or that he agree to at the time of saleThank you for your time and please contact me with any further questionsSincerely, James Z***

Initial Business Response / [redacted] (1000, 5, 2015/05/10) */ ***, the Manager, answered the phone and spoke to Ms [redacted] apologizing profusely for the wait on her online purchased delivery orderMs [redacted] was very hostile on the phone and after minutes of yelling at ***, [redacted] did give the phone to the Lead Delivery Driver, to try and settle the issue by either bringing her food immediately or refunding her moneyShe was not please with any solution we tried offering herWe did refund her moneyMs [redacted] then called the next day and spoke to ***, the General Manager [redacted] again apologized profusely and told Ms [redacted] that her money had already been refundedMs [redacted] again was not happy with any reply and was very hostile for minutes at least and told [redacted] she was going to call the Revdex.com [redacted] apologized again and asked if there was anything she could do for Ms [redacted] Ms [redacted] again said no she would be contacting the Revdex.com and hung up Initial Consumer Rebuttal / [redacted] (3000, 12, 2015/05/28) */ This is not true and you an ask the driver and ask the people that were at my house that night and heard her and heard her hang up on me timesshe refused to give me back my refund and yes I was angry no $ and no food and they wouldn't do anything and it took over hours that is uncalled for

Mr [redacted] does have his deposit back as of 4/18/2016, see attached copy of checkI'd like to explain the events that took place and who he actually spoke to during the process of trying to buy the *** [redacted] spoke to my Sales Manager, Vince, during the process of getting the Bank required documents handled for the loanI was the one who secured the financing and Vince the detailsI am sorry if you felt he was rude in explaining what the Bank needed to secure the loanBernadette offered to assist you on Monday in obtaining a NYS ID card but stopped the process when you canceled the saleI will speak to Bernadette about checking her voice mail more often and returning calls or passing them to a ManagerWe only have people that sign checks and if neither are here we cannot get a check signedWe do not hold deposits and usually have happy customersWe are not perfect but try our bestThank you for your time, Hal TGSM Foggs Automotive

In response to complaint IDby [redacted] : Unfortunately we have no control over the post office as to when the mail is delivered I know that we have received a couple of complaints similar to this in the past Most if not all the mail received at Guardian Water and Power, Monday thru Friday, is opened and processed on the same day Guardian does not set the due date or amount of the late fees All due dates and late fees are set by the property All money collected for late fees is forwarded to the property I have left a message with the contact listed for this property explaining the situation My suggestion would be to contact the property

This place is the worst burger king in all of New YorkNever can I get food after 2:am and they are hoursThey are rude and can't service food at allhow are they even open this longThere sales have drooped and I will never go here again

You have not gave a grace period In fact on the telephone I was told the payment had to be there before the due date I have sent a payment that I know of FOR SURE before the due date and was still charged a late fee I feel like I am being penalized for whatever happens in the mail or however long you chose to hold my check before you cash it Which is in by no means fair Regards, [redacted]

My response is as follows: The property sets the due date and the late fee We have contacted the property to review, based on the complaint submitted by the resident to Revdex.com, and they may get back to us yet this afternoon I will follow up once I hear more from the property We have suggested to the property to extend the due date

In response to the Revdex.com Complain# [redacted] : Attached is a copy of the AR (accounts receivable) that displays the date and amount of the bills that were sent from Guardian Water and Power Ms [redacted] was billed once in September, October and November The bills that you received in September and October were higher than was had been previously billed due to some additional work at the property that was completed early December The property manager is permitting Guardian to send corrected bills Your September bill will be corrected to a total of $and the October bill corrected to $ Before the corrected bills are issued I must receive confirmation that you accept the total dollar amount of the corrected bills Thank you, Pat A [redacted]

In response to #11987864: Disheartened to hear that you think Guardian Water and Power is a shady company A shady company would not have an A plus rating with the Revdex.com.As I mentioned in my previous response, it is the responsibility of the property to notify Guardian if any residents move in or out of properties We cannot accept that information from the residents I did contact [redacted] Rentals and confirmed that you did move out in October The address for [redacted] 9B is now listed as a vacant unit You should no longer receive an invoice from Guardian for this address Thank you for contacting Revdex.com with your concerns.Pat A [redacted] , President
