I am rejecting this response because: there has not been a different solution offered to the problem. I spoke with Vikki again yesterday and she offered to have the vinyl floor replaced at no charge but since they no longer carry the floor I have and I did not like any of the other options, I would have to pick one I don't like and continue to pay for the new floor. She also mentioned that the subfloor would be replaced at no charge. I never knew they were going to charge me for this since this was supposed to be repaired when the initial floor was installed! She again offered laminate flooring (which I don't want) at an additional charge. I told her that these were the same options that were previously presented and that I want a full refund so I can have the floor replaced by another company.

We have been in contact with Empire and we are actively trying to come to some sort of resolution/middle ground, however, we are not sure at this time whether or not they are willing to meet us in the middle. They called and offered us $1500 off original price of tile and additional 60 square feet of tile installation in bathroom. We countered with $1500 off original price with installation of hardwood floors in kitchen and sunroom as originally planned. We are currently waiting for their response.

We sorry to learn the customer did not receive the emailed terms from the finance company. The finance company emails the customer directly regarding the terms and conditions which includes costs, fees, etc. We recommend the customer contact [redacted] directly for a copy of the terms and conditions.

I am rejecting this response because: I was willing to take a refund of what I paid, although with all that I have been through with this situation I feel I am entitled to more. I had to cancel a birthday and anniversary party due to the conditions of my floor. They also wanted me to sign an agreement that with accepting the refund I am waiving all rights for repairs, replacement or talk negative about Empire. When I agreed to the refund I told them that the debit card intially used was closed and if they could send me a check. The manager refused to send me a check stating that the refund has to go on the account intially used. I told him that the account is closed and if they attempt to put it in that account it would be rejected. He has refused to mail a check. So this will have to be handled by the courts. And the agreement to not talk negative about Empire is also out the window. I was hoping this could all be resolved without filing in small claims court but unfortunately this is the route I have to take.

speak with anyone from Empire.  We have played phone tag for the last week, and they have not left any real information on my voicemail.  Nothing indicates that they understand our frustrations or will do anything to make things right with us.  I left a message yesterday requesting communication by email.  24 hours later I have not heard back.
