Ms [redacted] first visited our Brio community on 8/29/ Ms [redacted] expressed interest in our Home of the Week, [redacted] *** Chris D [redacted] our sales agent, took Ms [redacted] to the home site Ms [redacted] informed Mr [redacted] that she was not interested in the home because she did not like its location in the community Ms [redacted] thereafter came back to the community and again asked to see Lot Another sales agent, Travis [redacted] , was working that day, and he took her to the home site When Ms [redacted] and Mr [redacted] returned to the sales office, and Ms [redacted] indicated that she wanted to determine if she could prequalify for financing to purchase Lot Mr [redacted] gave her a prequalification, which Ms [redacted] took with her and completed at home The following day, Mr [redacted] followed up with Ms [redacted] on the status of her prequalification application That’s when Ms [redacted] informed Mr [redacted] that she did not want to purchase [redacted] ***; instead, she was interested in purchasing Lot at Symphony (another D.RHorton community just across the street from Brio) The home being built on Lot at Symphony was an entirely different plan with a more desirable location than the home being built on [redacted] *** As such, the home on Lot at Symphony was priced more than the home on [redacted] Angela Carmen, D.RHorton’s Area Sales Manager, and MrDowney have both spoken with Ms [redacted] and informed her that the two homes in question are entirely different homes in two different communities with two different prices based on their locations, included features and the like Ms [redacted] refuses to accept this fact Please feel free to contact me if you have any questions or need any additional information Sincerely, Terry Morga SVP of Sales & Marketing Broker (CA BRE License #01182797) D.RHORTON "America's Builder" South Coast / Inland Empire Division Wardlow Circle, SteCorona, CA

Citizens Dispute Counsel has requested that the parties attend a mediation and same is scheduled for September 12, However as a point of clarification, Ms [redacted] has indicated that she is self-employed and did not lose her job Instead she lost a client and does not qualify for a refundWe hope to resolve this matter with our customer at the upcoming mediation Thank you, [redacted] D.RHorton, Inc

There are multiple warranty requests submitted for my address since we purchased new concerning standing water, over-saturated ground, and poor drainage in the swales surrounding our houseEach request has either been ignored or a poor fix has been implemented to try and resolve the problemI was advised by the last contractor sent from DR Horton that the standing water was not acceptable and fully warrantableI also have second opinions from multiple landscapers acknowledging poor drainage due to inadequate planningMy last claim was approved conditionally in the event that the work performed would solve the problemIt has not, however the DR Horton has failed to acknowledge thisPlease assist with sending a proper landscaper to insert a drainage system

Complaint: [redacted] I am rejecting this response because:3rd different warranty rep came out, looked at house and said he would come back next week Again did not commit to any sort of resolution.Issue (6F temp difference in Master bedroom) is still not resolved Regards, [redacted]

Good afternoon We have received the attached complaint from the [redacted] household Our response to the matter is summarized below: On or about May 30, 2015, our contractor graded the homesite beside the [redacted] home Shortly thereafter, Mrs [redacted] reached out to our office with a complaint about the water that was standing along the common property line After explaining that the water was standing due to a recent heavy rainfall and the sod not being laid, our Construction Manager agreed to have the grader come out again and rework the common boundary line before installing the sod on the neighboring homesite A few days later, the grader completed the work While doing so, he cut back the existing sod to a point that extended roughly 2-3’ beyond the property line in order to provide the best flow to the swale area Once the grade work was complete, sod was placed upon the recently graded areas Once complete, our Construction Manager visited the site to inspect the work and found that it met or exceeded industry standards As an effort to provide even better customer relations, we have agreed to rework the area again and will be doing so later this week At that point, we will consider the matter closed Thank you

In October 2015, the buyers Mrand Mrs [redacted] entered into an agreement to purchase the model at Camp Chapel At the time of the contract the buyer was made aware that there were additional homes to sell and that we would need to utilize the existing model they purchased When they signed the contract, the also signed an addendum agreeing that the closing on the model home would not occur until days after the last home sold in the community Since they purchased the Company has continued to market and sell homes and only have homes left to sell Also during this time the buyers went through the loan application process per the contract During the loan application process they were informed that they would need to sell and close on two homes in order to secure a loan Also, as a condition of the loan process, an appraisal was ordered and performed on the model home The buyers were informed by our sales representative and the mortgage company that the value came in less than the sales price Per the sales contract the seller can chose to lower the price ad close the home or to not lower the price and cancel the sales agreement and refund the buyer’s EMD As the Seller still has homes to sell, we had yet to make a decision on how we would proceed The sales rep who sold the home was moved to a new location in April but was still taking care of his backlogAs our last two homes will be completed in July, we have decided to work with the buyer and allow them to close earlier and not have them wait the days after our last saleI have placed two calls to the buyer and have yet to hear back from them as of today I will make another attempt today We plan to send the buyer a settlement letter to let them know the good news We really were not aware that they had to get out of the agreement or wanted to get out until the recent letter We want to work with the buyer to get them into the home they agreed to and patiently waited for [redacted] DR Horton - Capital Division Vice President Sales and Marketing [redacted] ***

I would like someone who knows what their doing complete this job because it seems the two who are doing it now do not know what they are doing

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my dispute.Please enter your reason(s) for rejecting the business response below Regards,Given that this is the second time we have had to have our hardwood floors replaced throughout our entire downstairs, we are unwilling to simply move forward with the replacement without assurances as to the root cause of the failure We have been told the floors failed due to the glue However, our last replacement used a different glue from the initial installation, and both failed Therefore, it seems strange to me to attribute the repeated failures to the glue given that glues have been used We have repeatedly asked for copies of the reports identifying the root cause of our flooring failure We have never received any reports We will not proceed on our flooring replacement without the proper assurances that the root cause has been properly identified and remediatedIt is unfortunate that DR Horton did not see fit to be present at any of the previous inspections of our flooring by the flooring company and the glue manufacturer We were told during the inspection by the glue manufacturer that our slab had a high moisture content and moisture readings of our slab were beyond the acceptable limit Therefore, we have requested to meet with all interested parties - the flooring company, the hardwood company, the glue company and DR Horton to discuss the issue Contrary to Mrs [redacted] response to our complaint, another flooring replacement at no charge to us in no way compensates us for the extreme amount of time and heartache this issue has caused my familyWe are unwilling to undergo this extremely disruptive process without being adequately assured that we will not have to undergo this process again in the future We do not want to have another meeting without all of the involved people and without documentation supporting the root cause of our floor failure

Concrete issue have been repaired, I spoke with homeowner on Friday which previous flooring repairs that were done by builder was not a permanent fixOne of our production managers, [redacted] which have set up an appointment with him, builder manager and a engineering to review issues with floor and come up with a repair plan on 11/ @ am

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my dispute Please enter your reason(s) for rejecting the business response below.I have been told that strand was gonna come out for the last months and have yet to hear from them or [redacted] They seem to try and fix instead of having it inspected and fixed properlyWe currently as of today 7/29/have still not heard from strand nor [redacted] ***We still have trimming falling off the windows, support post falling apart and seperated, door frame is still bowing though it's been replaced xs carpet is still torn up from where the warranty guy pulled it up to remove debri and hammer in nails that popped a few months ago, drains in back yard have still not been addressed, all nails on all window frames are still popped out and black, cabinet trim nor cabinets have yet to be fixed from when they pulled from wall in Nov of just months after closing, The A/C company has no call no show twice but eventually showed to put the vent in upstairs room but never showed back up to balance it or fix a part on the outside unit as they said they would be backPlus other warranty work that hasn't yet been completedThese have been continuously the same issues that keep pulling apart after being repaired over and over Regards, [redacted]
