Relevant sections from contract below below.  I find no mention of estimate related to closing time.  Per prior response from [redacted] [redacted] There are no abnormal delays in building your home.From section 16. CLOSING, Subsection a. Closing Date:The parties agree that the Closing shall take place on or before 06/07/2016. Seller shall notify Purchaser of the final date and time of Closing at least three (3) business days in advance.  Subject only to the provisions of Section 27 below, Closing shall occur no later than that date which is two (2) years after the date that Purchaser signs this agreement.Section 27: EXCUSED DELAYSNotwithstanding any other provision herein, if Seller is delayed in performing any of its obligations here under or meeting any specified completion dates by labor disputes, fire, delays in deliveries, adverse weather conditions, unanticipated damage to or destruction of the Property, governmental controls or moratoria, acts of God or any other causes beyond Seller's reasonable control, then the time-period specified herein for performance of such obligation and/or meeting such completion date shall be extended a sufficient number of working days to enable and allow Seller to perform and/or complete the obligation.Regards,

I am rejecting this response because:  Any reasonable or reputable business would not leave their own customer/patrons in hazardous...

conditions.  We also have a hole under our shrub bed which is causing the driveway to crack and sink lower than it's adjacent area of concrete.  We would also like an exchange on a tree and some shrubs that they told us were just in shock (even Home Depot will exchange trees and shrubs for a year).  Builder tried to lie and say that he would take pictures of everything and then take care of it if there were any problems.  We also rejected over 10 pallets of dead sod that they tried to place on our property and we would not close until it was replaced.  They laid the same sod in a common area next to our house and its all weeds and dead Bermuda.  We paid the price that they asked for the home and the company didn't deliver as promised.  We feel defrauded out of our hard earned money.

They did come to see the issue, but they only put stucco on a part of the wall that was not affected. The part of the wall that gets water to the garage was not touched and the wood chips/mulch next to the wall were not even moved to see what was below that. The garage is 6 inches below the foundation of the rest of the house.I appreciate the fact that they fixed one part that should have been fixed, but I don't see any change in the affected area.  Regards,

Please enter your reason(s) for rejecting the business response below. I understand that maintenance is required on homes, what I don't understand is why only certain portions of the stucco is falling off. I have read that if stucco is properly applied it can last for up to 100 years. I may be naïve in expecting this to be case from homes built by D R Horton but after reading all of the complaints from other home owners I now understand that their quality control needs help. The person that came out from DR Horton was quite pleasant and told me about the repair kit that I would need to purchase. The problem is this repair is close to the roof. Not something I am comfortable with doing. So DR Horton now has another unhappy customer who purchased one of their homes. I was also told I could call and get the name of the company that did the original Stucco on this house, why would I want the same people doing the work again when they did not provide quality work initially.

On 7/14/16 [redacted] inspected [redacted] roof above the garage and found that there was an issue with the flashing at the connection of the main house and garage.  The technician from [redacted] removed the existing flashing, and 2-3 shingles so he could correct the issue.  The technician installed new flashing and then installed new shingles in the areas that he removed.  The drywall repair in the garage is scheduled for tomorrow, 7/21/16, and the siding repair will be scheduled as soon as possible.  A written report will be provided to Mrs. [redacted] detailing the work which was completed by the roofing technician   Sincerely,

I am rejecting this response because:[redacted] will not answer the following question, same response.Why did they not tell the truth to an 82 year old Veteran, that the appraisals were coming in $40,000.00 over list price? Also [redacted] received the appraisal on May 30th and we did not received it until June 15 @ 4:56 PM, sixteen days later.

I am not satisfied with Ms[redacted] response.  My issue is that Ms. [redacted], the DR Horton
Agent, assured us that all items on our inspection report and punch list were
being corrected, including upgrading to the 5 ton A/C unit.  Several items including the A/C unit were not
addressed (please see initial letter). 
We were not given any notice that the items were not being addressed
until the day of closing.  DR Horton did
not deliver the home as promised. 
 
We could not continue with the purchase of a home from a
company that clearly lied to us.  DR

We spoke with this customer on September 28th and she stated she was on her way to the doctor at that time and would call us back.   We have attempted to call her back on multiple occasions since then as she did not return our call.   Our tech for this subdivision went by her home...

on  Monday, October 3rd  and was going to discuss her concerns with her if she was home since we could not get her back on the phone.  She answered the door and told him that she could not speak with him at that time because she had to leave.   We will continue to attempt to reach her but at this time we cannot get this customer to respond to us.   Thanks [redacted]Revdex.com
MESSAGE:The reason I got the better bussiness bureau involved is that I have a  problem with a board that has a  bow in it, ( the board is not lying flat) in the backside of my home on the second floor between two windows.  There is nothing wrong with the  vinyl in that area according to an employee that was sent by the technician over this subdivision that I have my new home in.  I was told by a builder that is the problem and not a cosmetic issue as stated by someome at the DR Horton local headquarters in Sandy Spring, Georgia and that I should not be concerned about it.DR Horton sends customer satisfaction forms to have the homeowners ccomplete them.  Well, I did complete the last one they sent me a few month back.  I listed my two concerns which was the problem with the unprofessional way they did the door and the door jam of my front door.  This is not something you can insulate and walk away from.Another serious problem was the way the right an back side of my land was cut totally off grade.  When it rains the rain water from  my neighbor, a non-DR Horton home owner drains in my yard and after a couple hours of rain it remains in my yard like water in a trench,  Last summer mosqitos took advantage of the water in the trench and was biteing  the hell out of me and my little grand daughter.I did enquire about remedying the problems during the walk through.  You know level the land off by filling it in.  Atleaste the right side where the most rain flows from the neighbirs yard onto my yard.  Properly rehanging the door and do what ever needs to be done to the door jam so that it fitsthe way a door is suppose to properly fit.I received a call from an employee at the local DR Horton Headquarters after they received  my complaint from the Revdex.com.  I told this person what needed to be done hoping that this time some one with the authority would understand for once.  the person that I spoke with stated that they would let local managemnt know what I was needing to be done and would get back with me.  I never heard from that person aout what their manager was going to do.

We have looked into the Revdex.com complaint regarding the above home. The SA Warranty Department has an active warranty claim for this address involving a flooring issue and concrete. Our flooring contractor has had a difficult time acquiring the materials to make the needed repairs and as of...

Also, they fixed Floor Molding alignment with caulking, and the caulking shrunk. I have informed the builder of that caulking shrunk, and am waiting for them to fix it.

First of all they did send someone in the fix the bathtub, well they should have, its very clear that it was damaged in shipping or during installation regardless of the fact that it wasn't noticed during the walk through. its a shame that it took a complaint to the Revdex.com to get any help in resolving any of these problems. They sent a couple of men in here to fix the ceiling, it looks worse now than it did before they started.  The job foreman came by and looked at it and said they would be back, this was monday, I haven't heard from them since.  Furthermore, they left my kitchen looking like the floor of a body shop with sheet rock dust on everything. I told them they need to stop trying to patch my ceiling and fix it, this isn't a used home it's a new one, and the craftsmanship should resemble nothing less.  I wouldn't recommend Crown Homes to an enemy.

MESSAGE FROM BUSINESS:Crown Communities scheduled repairs with the homeowner for May 24th but we cancelled the appointment because the homeowner did not accept the scope of work we had proposed per our warranty guidelines outlined by the contract between the homeowner and RWC accepted when the home originally closed. The reason we cancelled this appointment was due mostly to the fact that two previous appointments the homeowner had asked our repair team to leave their house because they did not agree with our repair plan. Crown Communities warranty service manager noted to replace carpet and pad from master hallway to master bath which includes both master closets. The carpet from the formal living room was to be used for this so that we have a dye lot match. Carpet from the formal living room was to be replaced because there are hardwoods at both entrances to this room and color difference would be noticeable. The homeowner requested we replace all the carpet that got wet but our evaluation of the carpet showed no signs of delamination damage to the backing layer of the carpet which indicates no damages to the carpet, also the source of the leak was not a black water leak, no black or gray water came into contact with the carpet and/or the padding. The padding was replaced in the formal family room on a previous appointment.    We advised the customer we only repair/replace what is damaged and our warranty guidelines gives the builder the discretion of repair. This information can be found in the Residential Warranty Company (RWC) handbook and was presented to and accepted by the customer at closing.  Our original proposal still stands – we will replace the carpet in the downstairs formal living room with new carpet and use the carpet from that same room in the upstairs hallway to ensure a dye lot match. We propose to steam clean the carpet used in the upstairs hallway and will guarantee the customer (in writing) they will not have any delamination issues with the upstairs hallway carpet as a result of the water leak for a period of three years from this occurrence.

Mr. [redacted]   We sincerely regret you’ve had a water leak in your new Crown home. We realize there is repair work needed to be performed at your home but we’ve come to a standstill on the scope of work to be performed, specifically with the floor covering.     Crown Communities, LLC stands behind the method of repair previously discussed with you. Your carpet was inspected by a professional floorcovering mechanic and was found to be in good order with no signs of delamination or other loss of integrity. Therefore, we don’t find your existing carpet has been ‘damaged’ by the water leak and will perform as new.   In order to ensure a dye lot match, we propose to take the existing carpet from the formal living room and use it to replace what will be taken from the upstairs hallway. This will enable us to use the same dye lot carpet with each other and prevent the possibility of an unwanted color difference due to different dye lots.   We propose to replace the formal dining room carpet with a new piece of carpet; this new piece will be from a different dye lot but because it will not touch surrounding carpet, the dye lot difference will be considerably less noticeable.   Before we do any of this, we’d like to inspect the carpet again that got wet and make doubly sure you won’t have a problem later on. We want to offer you an extension your carpet warranty for one additional year against failure due to latent water damage. If there’s long term damage to the carpet, it would manifest itself within a year. We also want to offer to steam clean the hallway area and any other area that got wet due to the water leak.   This is our offer for the scope of work regarding your floor covering. Crown Communities, LLC reserves the right of the method of repair as outlined in the Residential Warranty Company (RWC) booklet given to you at closing. We will not replace all carpet, pad or sheetrock due to the leak but will replace or repair those materials which are deemed unsafe, unusable or show signs of integrity loss. You should contact RWC if you have any questions regarding the warranty coverage. Their contact information can be found in the RWC booklet.   Our goal is to make your home ‘whole’ again and appear as if nothing ever happened.   We’ll await your response and approval to move forward with our action plan. We are in communication with the customer and have an appointment scheduled on Sept. 1 to address their concerns.

All agreed repairs have been completed. The fence height was inspected and found OK. The yard is draining as designed but we have agreed to continue to monitor it as the sod takes hold and grows in. No other Action agreed to at this time.
