Thank you for the notification of complaint The Warranty Department understands and sympathizes with our homeowner’s frustrationsOur Warranty Department has been in regular contact with our homeowner and as protocol dictates, we assigned the repair tasks to the original installation plumbers Ultimately, our homeowner did not feel confident with the original plumbing vendor and thus, abruptly escorted an assigned technician from his home.In order to accommodate our homeowner, we assigned another of our pluming vendors to repair the leak, though a vendor not relative to any original installs within this particular homeowner’s home As for the shower, our Warranty Department has contacted the manufacturer and requested they send out their own technician to investigate the issue As of today, the newly assigned plumbing vendor has completed the drain repair with positive accolades from our homeowner and the shower manufacturer has been tentatively scheduled for next Wednesday, January 25th, pending our homeowner’s schedule Our Warranty Department will be following up with our shower manufacturer, and of course, our D.RHorton homeowner, not as a reactionary means, but because we do value our homeowners, including this particular homeowner and his family

I have spoken with both the HVAC company and the above homeowner to confirm that repairs have been completed on her system and that all is operational I had the HVAC company run a full diagnostic on the system to just verify that all other components of the system are in good working order and all is well Thank you, [redacted] Customer Service Manager- Carolinas Division

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my dispute Unfortunately [redacted] (builder) is lacking integrity and their response is full of statements [redacted] /Dr Horton has made little attempt to resolve both walk thru items and day list I work from home and implications I am not home for repairs is a direct lie [redacted] builds a poor quality home, their subs do not care and often create more problems than resolving, when they occasional show up for a repair Wes and the [redacted] Dr Horton team should be ashamed of their response, the lack of concern, or attempt to fix problems They have no direct employed repair resources and completely rely of their subs, which often employ child labor, and have no interest in spending their time on a repair I have over items needing repair or resolution, all documented, all received by [redacted] for months The flooded landscape areas with most shrubs dead is one of items [redacted] Dr Horton is a "sloppy" builder with no integrity, avoid at all costs I had a handshake promise from the sales person, [redacted] that walk thru items would be resolved in a timely manner, over days later, more than half the list unresolved I have also tried to just receive parts or paint, to do the work myself, and that does not work Assume they do want to spend a few dollars even when the home owner will perform the work.Avoid this builder at all cost - not worth the investment - no integrity!Regards, [redacted] ***

[redacted] Home Closed January 8, RE: Revdex.com Complaint I have reviewed the rebuttal from Mr [redacted] regarding his home at [redacted] The Residential Warranty Co(RWC) performed an inspection on June 29, the inspection report has not been filedSo, we are currently waiting on the results of the RWC Fact Finding Inspection As for statements made regarding service, each time Mr [redacted] has contacted our warranty office we responded to his concerns and addressed the warrantable and some non-warrantable items in his homeIf there are new warrantable items in Mr [redacted] s home, we would recommend to our customers (Mr [redacted] ) to submit a warranty service request (WSR) to our office at [redacted] and we will arrange an inspection of his warrantable items If you have any further questions regarding this matter, please feel free to contact me Respectfully [redacted] WARRANTY MANAGER

The site manager spoke with the homeowner today regarding their landscaping concerns and discussed a repair planPending the homeowner's acceptance of the repair plan, [redacted] will move forward with the landscape work and looks forward to addressing the matter for the customer

On 7/14/ [redacted] inspected [redacted] roof above the garage and found that there was an issue with the flashing at the connection of the main house and garage The technician from [redacted] removed the existing flashing, and 2-shingles so he could correct the issue The technician installed new flashing and then installed new shingles in the areas that he removed The drywall repair in the garage is scheduled for tomorrow, 7/21/16, and the siding repair will be scheduled as soon as possible A written report will be provided to Mrs [redacted] detailing the work which was completed by the roofing technician Sincerely, [redacted] Area Construction Manager Capital Division [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to meHowever this will be the 8th time that I have had to make special arrangements for D.RHorton to be at my home to look at this problemTheir independent inspector will need to come on my schedule as I have missed an unacceptable documented amount of time from work already due to this defective installationThis will be the second meeting that I will have involving the manufacturer as they have already been out on 6/6/and determined that the material was not the issue after D.RHorton's installer blamed the material for his inability to do a proper install at our meeting on 5/12/They have my contact information and I will be expecting to hear from them shortly [redacted] ***

The Warranty Manager, [redacted] , met with [redacted] and all of his complaints were addressed and the homeowner was satisfied and said he would remove the complaint

First, [redacted] takes great pride in the construction of our homes and in the customer service we provide to our homeowners [redacted] has worked diligently with [redacted] to address all of the warranty concerns in her home as set forth in her Revdex.com complaint With the exception of a damaged window blind, which is scheduled to be repaired on July 14th, all items listed in [redacted] **’s complaint have been completed/repaired On July 3rd, [redacted] submitted a new customer service request to [redacted] asking for repairs to an additional items Repairs to the vast majority of these items are scheduled to be made on July 14th Several of the service items involve manufactured products, and we have submitted these items to the manufacturers to be scheduled and addressed A few of the items submitted are fit-and-finish items such as scratches and water stains on the kitchen countertops that are not covered by [redacted] ’s warranty and, therefore, will be denied As [redacted] noted in her complaint, she purchased a model home from [redacted] The home was open to the public for many months before [redacted] bought the home, and hundreds, if not thousands, of prospective buyers walked through the home As such, the home was not “new,” and [redacted] sold the home to [redacted] in an “as-is” condition without express or implied warranties [redacted] acknowledged she was purchasing the home in an condition when she executed the attached Model Home – Possession at Close of Escrow Addendum at the same time she signed the purchase agreement for her home Many of the service items submitted by [redacted] are not covered by any [redacted] warranty Nonetheless, [redacted] has accommodated most of [redacted] **’s concerns as a courtesy to herWith regard to [redacted] **’s request for compensation for “physical and mental injury” and for “delaying [her] work,” under California law, the damages a homeowner may recover for construction issues are set forth in California Civil Code section 944, which is part of a statute known as “SB 800” or the “Right to Repair Act.” [redacted] received a complete copy of the Right to Repair Act when she executed the purchase agreement for her home Pursuant to Civil Code section 944, a “homeowner is only entitled to damages for the reasonable value of repairing any violation of the standards set forth in this title, the reasonable cost of repairing any damages caused by the repair efforts, the reasonable cost of repairing and rectifying any damages resulting from the failure of the home to meet the standards, the reasonable cost of removing and replacing any improper repair by the builder, reasonable relocation and storage expenses, lost business income if the home was used as a principal place of a business licensed to be operated from the home, reasonable investigative costs for each established violation, and all other costs or fees recoverable by contract or statute.” As noted above, [redacted] is making repairs to all legitimate defects in the home that are covered by the Limited Warranty for [redacted] **’s home and even a few items that are not Therefore, [redacted] must respectfully decline [redacted] **’s request for compensation for “physical and mental injury” and for “delaying [her] work.”
