Please accept this correspondence as D R Horton, Inc.’s final response to the Revdex.com with regard to the above-referenced complaint The mailbox has been painted inside and out, the door hinge repairedNo other repairs needed or offered Sincerely, [redacted] Customer Service Manager DFW East Division

At this time all structural concerns are completed and a proper plan has been in place since the meeting to resolve all additional concerns

We have recently met with [redacted] and have agreed to repair the left side of the lawn, which is scheduled to happen soon

Here is our response HVAC units are covered by the Manufacturer’s Warranty, Not the Home warranty as this was not an installation issue The manufacturer, in this case [redacted] clearly states in their warranty, that it does not cover “Labor or other costs incurred for diagnosing, repairing, removing, installing, shipping, servicing or handling of either defective parts or replacement parts or new units.” The customer clearly states that [redacted] will cover the parts as they state in their warranty We consider this matter closed ***

Complaint: [redacted] I am rejecting this response because:My issue still has not been resolved and the last response from DR Horton was that the electric company caused the crack in my driveway [redacted] has sent an inspector and they have denied causing this driveway to be cracked Regards, [redacted] ***

Item #– Garage door Warranty Manager inspected the garage door cedar panels again today, December 6, and found no unusual cracking or splitting of the cedar used in the panelsHe took pictures for documentationNo offer for any type of repair is being made for the garage doorIt is recommended that the homeowner seal and or stain this door every year to maintain the woodItems #– Roof flashing We do not show receiving another request for a roof/flashing leak since July Our records indicate that issue was addressed and completed in August If agreeable we will gladly have our roofing contractor go and inspect the roof/flashing and any damage possibly caused by a leak in the flashing

Dear Ms***Please accept this correspondence as D.RHorton's reply to the Revdex.com withregard to the above referenced complaint.Our Construction Area Manager, [redacted] met with Mr [redacted] and we will install a 18"-24" berm on the right side of his yard to alleviate the surface water going through his yardwhen there is a rain eventHis yard has 8-10% slope and it drains as intended and he agreed.He is happy with this method of repair

We appreciate the customer reaching out regarding their concerns and have confirmed the warranty department is in communication with the customer and is actively working to resolve the remaining open warrantable repairs in their homePrevious requests have been addressed and responded to within the confines of the warranty guidelines

Thank you.D.RHorton, Inc(“DRH”) is in receipt of the above referenced complaint from Mr[redacted] to the Revdex.com (“Revdex.com”)Mr [redacted] closed escrow on [redacted] ***, the (“Property”) on September 24, In Mr [redacted] complaint, he indicates that per his purchase contract he was not issued a five-year certificatefrom a pest control company obligating them to retreat the Property should termites bediscovered within a five-year period from the date of original treatmentPlease let this letterserve as DRH’s response to Mr [redacted] complaint.The contract Mr [redacted] signed with DRH for the purchase of the Property does state that“at closing, Seller will deliver to Buyer(s) a certificate from a pest control company obligatingthem to retreat the Property as many times as necessary to control such termites should termitesbe discovered at the property within a five-year period from the date of original treatment.” Mr[redacted] was issued a certificate for one year of termite coverage for the Property at his closing.DRH will honor the commitment in the agreement for five years of termite coverage from theclose of escrow (September 24, 2014), at no cost to Mr [redacted] should termites be discovered atthe Property within that periodDRH will work directly with Mr [redacted] to provide him withreasonable written documentation of this commitmentDRH will rely on Mr [redacted] to provideto DRH reasonable notice of, and professional inspection reports documenting, termite problemsat Property, if any should arise

We are in communication with the customer and have a repair plan in place to address his concernsAn appointment is scheduled on 11/and 11/29, and we look forward to resolving all of the homeowner's concerns

Below is our response Mr [redacted] The national average for building a home is to months and longer for smaller custom builders Your home was started 3/21/ to months would have your home finished 7/21/to 8/21/ Your home is projected to be completed 8/26/ This is right at the national average The building of your home is progressing in line with every other home being built in America The Santa Rosa Beach community we are building your home in has a population of approximately $12,people Unlike big cities like Atlanta, Tampa and Jacksonville there is not a large trade base The fact that DR Horton can build a home to the national average is an outstanding job by the local building team with the limited trade base available in that area There are no abdelays in building your home thanks [redacted] D.RHorton Inc., "America's Builder" [redacted] ***

The FPL transformers are set such that they prohibit positive drainage from the side yard swales to the street Our Land development team is working on a solution for this home owner and a couple others on his side of the street It will take approximately 2-more weeks to implement [redacted] Vice President – SWFL Construction D·R· Horton, Inc- America’s Builder

Dear [redacted] , Although we appreciate the first Mutual Release form you provided dated 3/3/17, there was a second Mutual Release form in which you also signed on the 3/20/releasing the amount of one thousand dollarsThe reason you have been refunded one thousand dollars and not the one thousand, five hundred dollars, is because you only paid one thousand dollars Please note the attached documents siting this pointUnfortunately, with the first contract signed on 3/3/17, it was apparently realized as a mistake and one in which was amended via the newly signed Mutual Release form on 3/20/ We appreciate your diligence in this matter and thank you for your patience

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my dispute Please enter your reason(s) for rejecting the business response below Regards, [redacted] SECOND PARAGRAPH OF D.RHORTON'S RESPONSE - We were Never given a copy of the MLS listing We were shown the house by [redacted] and was quoted a price of $349, We went home [redacted] contacted us by phone and we make an offer of $320,based on the quoted price over the phone Within six (6) hours [redacted] phoned us to say that our offer was accepted We were never given a "configuration sheet" during this process Mr [redacted] notation that we paid less that the MLS listing price is correct - $2,lessThe MLS listed price was $322, After attorney review we found the MLS listing of $322, Another untruth is the comment that we received an explanation that the same house constructed on a different lot in the Camelot community would cost $20,more That discussion never occurred with us and we resent the attempt by those representing D.R.Horton as some great benevolent benefactor The MLS price represent a house that was completed in June and offered as a Quick Sale There was an "unadjusted price" - Adjusted to fit a cash buyer We have a copy of the listingTHIRD PARAGRAPH OF D.R.HORTON'S RESPONSE - We signed a contract based on [redacted] explanation that "a junior employee entered the wrong price on the MLS listing" with misgivings unaware that there was another option As the attorney review was completed we signed the papers and gave a deposit of $5, Ms [redacted] was unaware that we knew of the the MLS price when she presented us with papers justifying the $349,price Her paperwork was prepared in advanceWe did not inform our attorney of the pricing discrepancyFurthermore, our attorney, [redacted] , was unaware of this incident until we asked him if we could file a complaint days before the complaint was filed It is our understanding that in New Jersey items advertised lower by a seller must be honored We were not given the option of making a lower bid for this houseIn addition, [redacted] works for the interest of D.RHortonShe did not show up for the closing She sent someone else to the closing who was completely unaware of what was taking place We expressed our dissatisfaction with the entire process at closing and made it very clear that dealing with D.RHorton was "Messy" We may or may not receive remediation for what happened However, it is our expressed intent that D.RHorton and those acting in their interest will conduct more honest, transparent transactions in the future It is our belief that we were victims of "improper conduct" by those involved in this transactionNo letter from an attorney or anyone's attempt to muddy the facts will change what occurred There is no misunderstanding Thank you for your attention in this complaint [redacted] and [redacted]

To Whom It May Concern: This letter is in reference to your correspondence, same of which is dated June 13, 2016, and whereby you requested a response to the aforementioned case number from D.RHorton, Inc After conducting a thorough investigation, D.RHorton concluded the following in this matter Mr [redacted] claims that he made several attempts to contact D.RHorton without a response Contrary to his correspondence, our Division Sales Area Manager, [redacted] ***, did respond to Mr [redacted] Regardless, we have provided him with a cancellation notice so that he can receive his deposit As such, this matter should be resolved Please let me assure you that DR Horton strives to provide satisfied customers Thank you for the opportunity to respond to Mr [redacted] ’s complaint, as D.RHorton’s goal is to always respond to customer concerns Feel free to contact me directly with any questions

As you can see by the attached email from the customer, we are addressing her problem and we believe this matter to be closed from the Revdex.com standpointPlease find attached Ms [redacted] email to me yesterday: [redacted] I am writing to you about the problem with my property at [redacted] *** [redacted] I put a warranty claim into DR Horton Warranty once I moved in and noticed the pulling of water standing in areas throughout my yardI sent several emails and phone calls to [redacted] and [redacted] regarding my grading issuesAfter several attempts, day after day, I would get [redacted] via telephone with the promise someone would be out at a specific time/date with "no shows"...this went on for approximately weeksIn addition [redacted] was trying to contact [redacted] throughout this same time period to no evalScott also stopped up at the [redacted] Sales Center looking for helpFinally, I decided to put a Revdex.com claim in and call Texas Corporate seeking some resolution- this is now weeks into begging for resolution with nothingI was relieved to hear last Wednesday that [redacted] was going to be the lead of this grading project and elated to find an engineer on my property trying to identify the issues for correctionNow, through this process of resolution, [redacted] has went above and beyond with constant communication and explination of timelines and appropriate resolutions which has made the process much easier and stress freven came out Saturday and stayed the entire day to oversee the projectAll looks well thus far, and he as been giving us progressive updates with a final resolution for the end of this weekI'm very greatful that You put [redacted] as the lead and relieved me of the constant empty promises from your warranty departmentAll companies have issues, there is definitely some within your warranty departmentThe community at Vilano is looking very beautiful and coming together nicelyThank you for allowing [redacted] to lead the project of getting my yard back in order; it has relived the daily stress I was encounteringSincerely, [redacted]
