I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.The business has not responded to the original complaint as to why they were sending the needed items to repair the motor per their warranty.
The mechanic that installed the motor purchased from them followed the instructions from them to the letter, per line of their warranty the engine could not be opened and inspected without their prior written authorization without voiding the warranty for the engine.
SW Engines stated they have a year warranty on the engine, and from an exterior inspection the engine did not have any leaks around the oil pedestal OR the head gasket.
In contacting the business I had been informed on phone (which they record their phone calls per their on hold message) they had all things needed for repair of the engine ready to ship to me, and they placed a stop work order for those itemsAt this point I have done everything they have requested to enforce my warranty for this engine, I am out the diagnostic fee and potentially $for install of a head gasket plus price of part, and even more for the oil pedestal and labor to install thatafter having spent over $for this engine and it is not even a year old, it has not overheated and am watching it daily for oil level I feel that the least they can do is honor their warrantySince they infer in their response the engine was not inspected they are putting out a warranty on an engine and then laying all responsibility on mechanic and purchaser and basically stating the warranty and engine are as isI purchased the engine from them because of the warranty and good price, I am aware that things can happen but they need to forward me the parts and the money to have these items installed on the engine, the parts are not accessories but intricate parts of the engine and its function

Per the terms on the SWE website
SWE warrants to the original purchaser that each used engine sold by SWE shall be free from knocking, excessive oil consumption and cracks in the block, subject to the following terms and conditions
The engine that we bought is experiencing excessive oil consumption; while this is due to a defective head gasket the company quality department should have caught this defect before shipping the engine SWE is using legal trickery to mislead customers into thinking that they have a warranty Yet they are trying to deny every claim This is evident by the low customer satisfaction and numerous business complaints This is not ethical and to accept this response would lead to other consumers being sold defective products while SWE benefits financially while the consumer is left with additional repair bills that were directly related to the engine
SWE always refers back to their warranty However they were late on delivery and poor on customer service when we first ordered the part It took nearly a month to receive the engine that was committed 7-days SWE has poor business customer service and defective products as such I would never recommend them for any one seeking an engine
I am not satisfied with this response and wish to pursue further

It is a bad engine, we do not want it, we do not want to pay for it, we want them to take the engine back. OUR mechanic looked it over and told us it is a BAD engine. So it is their word against our Mechanics on the engine. We want them to take the engine back.........period

The invoice number I was finally able to get today is #[redacted]It's not clear if this covers the purchase of the transmission and engine or just the engineI left a message for the terminal manager [redacted] at 13:hrs on 26Sept

[redacted] will take care of the credit for the cleaning solution

The alternator housing is an integral part of the front engine timing cover and is part of the engine and not a bolt on peripheral. I would like them to credit back the cost of replacement for the part and related part to resolve the issue. This includes the gaskets and bolts that need to be replaced when disassembling the from engine timing cover. This should also include the cost of the guide rail since the mileage on the engine is in question. If they agree I will send a parts list and the selected vendor and the costs of said parts

The complainant is claiming we are denying the warranty claim even though he has submitted the warranty registration and this is not the case.  The Terms and Conditions of the Free Warranty clearly states in the LIMITED LIABILITY FOR TRANSMISSIONS section: “Warranty must be activated...

within 10 business days of delivery OR ALL WARRANTIES WILL VOIDED. Falsifying information will automatically void your warranty.”. The Terms and Conditions must be agreed to upon before making the purchase and is indicated by the standard checkbox seen on most sites. Our system records all attempts to activate the warranty automatically as a log file. The email the complainant has attached does not meet the requirements to activate the Free Warranty, nor does it meet the time requirements as you can see on the attachment provided by the complainant.  The Free Warranty was not officially submitted by the complainant until 7-5-16 as shown on the screenshot provided. The complainant has hand-written in pen the warranty was activated on 3-19-16 and our automated log files indicate no so such attempt was made until 7-5-16 which is reflected by the date on the screenshot named SWTransProof.pdf.  The system does not allow customers to go back and look at the process or online documents once the claim has been submitted.  Therefore, the complainants claim was denied based on this information. Additionally, the claim is denied on the basis of another violation of the Terms and Conditions of the Free Warranty: “Falsifying information will automatically void your warranty.” Please keep in mind this is a Free Warranty on a Used part and not new or rebuilt.  Our Terms and Conditions follow the standards within the used part industry and is in no way designed to “scam” customers.

The Terms and Conditions of the Free Warranty do not cover initial install and only covers labor after the following criteria has been met: “LIMITED LIABILITY FOR ENGINES: Parts and labor warranty begins on the...

14th day & 501st mile after the part is installed.” Therefore, regardless of whether or not the complainants Free Warranty had been activated the initial install labor would not be covered nor would our representatives elude it was.  We sent out the replacement engine free of charge on 3/2/2016 and the Warranty was activated on 3/10/2016 for the replacement. We now consider this claim closed for the time being.

Mr. [redacted] had purchased an engine from us for a 1995 Honda Accord back on August 28, 2014. He had called us on October 7, 2014 to state that the lifters and rocker arms were a little corroded and rusty. We told him that it was a good running engine that was tested, we do not guarantee appearance...

for it is just a used engine from a 1995 vehicle. We had told him that could replace the rockers if he liked, but would not get reimbursed for them. Why would we cover the rockers if there was nothing wrong with the original rocker arms. From the pictures that he emailed us, they did not look rusty at all, they just had a little carbon on them relevant from normal wear and tear on a 1995 engine.

At the time of placement of order, the company clearly stated that the order was covered by Parts and Labor warranty. This was communicated to the VALLCO 76 SERVICE Manager Mr. [redacted] on a call that was made from his business phone[redacted] on Saturday Aug 22nd. When the defective engine was reported to the company, [redacted] the Customer Service representative restated that the second time labor will be re-unburden by them on completion of 500 miles after installation of replacement engine.
The company is lying and changing its commitment to not have to pay. They are lying and have caused tremendous mental agony. Please recover the amount due as the defective engine was sent by them and was part of a scam and dis-honest practice.Regards,

It seems you are not reading anything I am writing to you. For the third time: our understanding of your "policy" was that the 25% fee would not apply unless we cancelled the order after it had already shipped or if we returned the item. Since the order was placed late on Friday afternoon and cancelled as soon as you opened the next day, the order had not been processed (per [redacted]) and had not shipped, the fee should not apply. In addition, your employees were rude to me, hung up on me and no one has ever returned any of my calls. Your customer service is non-existent, and as far as I can tell, you are nothing more than scam artists. The only way you are going to prove otherwise is to waive the 25% fee, which amounts to roughly $650 for you doing absolutely nothing.

You can not cancel an order with [redacted] Black, he is just in shipping and tracking. You have to cancel an order with [redacted] the manager. And it is not on record that you ever tried to cancel the order with [redacted], and when you did cancel the order it was too late and it was already shipped out to you, they even emailed you a tracking number.

The complainant has been offered by us to replace the faulty lifter and rocker and did not accept our offer.  All other items are only left on for convenience purposes which is stated in the Terms and Conditions of the Free...

Warranty which all customers must agree to when making a purchase and are not covered.  As clearly stated on line #1 of the Terms and Conditions: “1. Engine warranties are limited to manufacturing defects in the block, heads, pistons, crankshafts, camshafts, rockers, and oil pumps. We do not warranty any attached accessory parts, such as switches, sensors, cables, electronics, belts, hoses, water pumps, manifolds, wire harnesses, valve covers, brackets, flywheel etc.” As far as we are ware from the mechanic’s statement the engine is not unusable as long as these items are replaced.  We will still gladly replace these parts as previously agreed upon.

I am requesting further action. I have repeatedly asked the business to provide me the documentation that they say I did not comply with in order for my warranty to be valid on a $2,375.00 motor I purchased from them.
I truly believe that this business has a practice of failing to disclose to a buyer that there is an additional step you must do in order for your warranty to be valid. And when you challenge them for the proof they will then stop all communications with you. I am not going away. If they continue to stall I will seek legal counsel and hopefully a class action lawsuit can come out of all this.  I have saw where other people have complained about them on the internet.
Again, I still wish to be instructed where I am to look on the copies that are in my possession to see where I allegedly fail to provide back to them.
They may provide me the proof or refund me a portion of my monies.
Just to make it clear I reject the company's response, talk is cheap, put up the proof.

[redacted] The items damaged were the intake manifold, vacuum line nipple broke, throttle body busted, plug and connector and unit broke in multiple locations.

I can't return the engine as it is installed and I'm happy to keep it. I only want to pay a fair price for the one I have with 163,000 miles on it. I'm willing to pay $1000. In fact, I was emailing with a GotEngines representative today who was very nice (no name given) and they offered me a $500 discount, but I'm afraid that isn't a fair price in my opinion. Given the engine has 4X the mileage, I would say it is only worth about $600, but I'm willing to pay $1000. Can we perhaps negotiate on the price of the engine that I'm going to keep please?

Just read the email and that clearly was not discussed via telephone but since it's policy ok.
unfortunately the money that is to be refunded is not correct. [redacted] and [redacted] said it would be estimate of 800$ because there were
2 different labors that were paid. which was the first engine that was sent and I paid for but it was not working properly and was sent back
then the second engine that was sent paid for labor for that as well. so the check should not be in the 400's when I spoke to [redacted] he calculated
as estimate for me being what you will pay for per policy and he states it would be like 832$ (in the 800's for sure)

We understand what Mr. [redacted] is saying, but harnesses are the same, he will need no extra parts, the only difference is the egr tube is in a different location on the engine, the engine is the same and works the same way, all emissions are legal and are legal in every state. We sell these types of engines every day and no one else has ever complained about the different locations of the emission tubes.

Mr. [redacted] had ordered an engine back on January 15, 2015 and we sent it to him in a timely manner. He had called us on March 30, 2015 to says that he wanted the engine picked up and refund, for he did not need the engine anymore for some reason he did not disclose. We had then picked up the...

engine and refunded him on April 10, 2015 when we got the engine back. His refund was minus the 25%re-stocking fee and minus 2 freights that it took to get the engine to him, and to bring it back here at $245.00 each way. He also agreed to those terms at the time of purchase.
