I have repeated the above mentioned process on several occasions before I filed this complaint to no avail. I have disputed this with Experian several times and it continues to remain on my credit report. I need it to be removed immediately.
Our office recently received your correspondence of April 25, 2017 regarding the above mentioned consumer's rebuttal of our response to his complaint.Our records indicate that the disputed [redacted] account does not appear on the consumer's current Experian credit report. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.Opening another complaint does not resolve the issue. The fact is that this same process was already done. [redacted] failed to comply. They did not provide the required documentation within the 30 day period. Also, they repossessed the vehicle after a verbal protest, which constitutes disturbing the peace in my state. According to FCRA rules, because they did not comply, within 30 days, this needs to be deleted from my credit report, not resubmitted to them for another 30 days. Experian cannot continue to provide [redacted] with unlimited extensions. Experian is in direct violation of credit reporting laws. This no longer has anything to do with [redacted]. It is now Experian who is 100% at fault because they are continuing to report this. I will be filing an FCRA complaint within 48 hours if this issue is not immediately resolved. In case you did not read the previous complaint, here is some of the highlights: Under the laws of the State of [redacted] (** Revised Statute, Title 6, Chapter 9, “Additional Default Remedies Act”) and State RISA and MVISA statutes a deficiency can not be claimed unless all of the required notices were properly and timely given and all of the allowable redemption and cure time limits were adhered to. It also states that oral protest by debtor shall constitute a breach of the peace by the repossessor and that prior to the repossession a notice must be sent to the debtor stating “[redacted] law permits repossession of motor vehicles upon default without further notice or judicial process” (typed in at least 12 point font). Again, I will allow Experian 48 hours to correct their mistake before I file a formal FCRA complaint.

Both accounts reflect they were transferred.A 3" [redacted] account does not appear on the consumer's current Experian credit report.An account that displays as transferred indicates that either the debt was bought by another company or the debt was transferred to another account with the same company. A transferred account will remain on the personal credit report for 10 years, unless the account had been past due prior to the transfer. Then the account will remain for seven years from the original date of the missed payment. The balance of the transferred account will reflect a zero or N/A, while the new company that is collecting on the debt will show the balance as it is owed.Research indicates that the 2 [redacted] accounts have been investigated on at least 5 separate occasions, most recently on 03/29/2016. In each instance the creditor confirmed the accuracy of the accounts. Results of the investigations were provided directly to the consumer.Each national consumer credit reporting agency may interpret the requirements of the Fair Credit Reporting Act differently and each company has their own policies and guidelines for disputing information. Therefore, we cannot update or delete information in our database based on the results of a dispute with another consumer credit reporting agency nor can we dispute information for a consumer with another consumer credit reporting agency.According to the Fair Credit Reporting Act (FCRA), a national consumer credit reporting agency's role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the furnisher of the information or the vendor that collected the information from a public record source, such as a court or other government office, notifying them of the disputed information and disclosing all relevant information regarding the consumer's dispute. In order to help resolve the consumer's dispute, Experian will review all relevant documents submitted by the consumer with the dispute and will forward such documents to the furnisher if Experian is unable to resolve the issue based on those documents. Consumers may also contact creditors directly to dispute items reported by the creditor. If the issue is not resolved, then the consumer credit reporting agency must offer to include a consumer statement on the personal credit report.
