will provide the results of our investigation directly to the Consumer.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court's public records and supply that information to Experian. Experian does not divulge the names of our vendors as this is proprietary information and they are not the source of this public record information. Experian's method of verification for public records complies with the requirements of the Fair CreditReporting Act (FCRA).When a consumer disputes the accuracy or completeness of information on the personal Credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as requested or delete the information, in some instances, upon reviewing the credit file and any relevant information submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. Investigations can take as long as 30 days to reach a conclusion. After we complete our processing, we send the consumer the results.In addition to the consumer's right to dispute information in the credit file with the credit reporting agencies, the consumer also has the right to dispute information in the credit report directly with the furnisher of the information.If the consumer questions the results of the dispute process, then they may want to contact thefurnisher of the information directly or review the original information in the public record. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I am trying to get a dismissed Chapter 13 bankruptcy removed from my file. The Fair credit Reporting Act mentions nothing in Section 1681c relating to bankruptcy about dismissals or filings. The law clearly states from "date of adjudication" or date of "order of relief". Any case, civil or otherwise, which is dismissed no longer exists in the eye of the law and a case filed may never have actually been adjudicated. THIS COMPANY WILL NOT ALLOW YOU TO DISPUTE INFORMATION AND TRY TO GET IT DELETED OR UPDATED. IF ITEMS CAN NOT BE DISPUTED, THEY HAVE NO RIGHT TO REMAIN ON MY CREDIT REPORT I AM ASKING THAT THE BANKRUPTCIES BE DELETED AS WELL AS COLLECTIONS ITEMS. IT IS MY RIGHT TO DISPUTE INFORMATION ON MY CREDIT REPORT A MILLIONS TIMES IF I CHOOSE TO. above mentioned consumer's Experian credit report.Our records indicate that the disputed [redacted] account is appearing as [redacted] stated on his personal credit report. We are in the process of forwarding the consumer a current credit report for review.Regarding our investigation process, Experian contacts the source of the disputed information directly by letter, telephone, or through an automated verification system. We ask the source to check their records to verify all of the information regarding the item questioned, and report back to us within 30 days of the date that we received the consumer's request. Once we receive their response, we send the consumer the results of the investigation. If we do not receive a response within 30 days we update the item as requested or delete the information, and send the consumer these results.According to the Fair Credit Reporting Act (FCRA), a consumer reporting agency's role in the dispute process is to investigate the information to determine the accuracy and completeness of any disputed item by contacting the source of the disputed information and informing them of all relevant information regarding the consumer's dispute. I have contacted Experian several times by certified mail in regards to deleting Santander consumer USA from my credit report. Equifax has deleted the account. I placed a Fraud alert on the account 10/15/2017 and This account keeps coming back verified but Experian has broke Federal by not providing me proof of how they have verified the account as being accurate. They continue to violate the FCRA regarding refusing to delete this unverified unproven noncompliant account. Despite my three written request plus fraud alert the unverified account is still being reported. Experian still has not identified who in their company verified the accuracy of the account or how they verified the account. What this means is that Experian must be willing and able to produce a document that proves the account in dispute belongs to me and the information being reported is accurate and to do this they must have 1st hand knowledge of the alleged account and all that has ever transpired from the alleged account under oath and the penalty of perjury. Their failure to provide me with verifiable proof required for your company to post the account below is evidence that it does not exist and therefore is proof that you can't properly verify the accuracy of this disputed account. Experian is required to Delete all accounts that can not be verified. Section 616 and Section 617 states if the unverified account is not deleted within 10 days I will seek litigation under the FCRA..
