December 20, 2016Revdex.com Serving [redacted], Orange and Imperial Counties 4747 Viewridge Ave., #200[redacted], CA 92123[redacted]Dear Revdex.com.Our office recently received your correspondence of November 11, 2016 regarding the above mentioned Consumer's rebuttal of our response to her Complaint. Our records indicate that we previously investigated the [redacted] on 9/28/2016. At that time our vender confirmed the accuracy of the information.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the Court where the disputed public records are filed may not report this type of data, a vendor may Collect this data directly from the Court's public records and supply that information to Experian. Experian's method of verification for public records complies with the requirements of the Fair Credit Reporting Act ([redacted]).My own review of the public record documents on file at the [redacted] indicates the item is accurate as it appears on the Experian Credit report: a Chapter 13 Bankruptcy filed by the consumer on 4/23/2010 and dismissed on 5/25/2011.Additionally, the documents confirm the consumer's full name, last 4 digits of his Social Security number and address at the time offiling and dismissal, his current address. We are in the process of providing the consumer with copies of the bankruptcy filing and discharge documentation.Because the information was confirmed accurate, we must respectfully decline the Consumer's request to remove the disputed information from the Experian Credit report. Dismissed Chapter 13 bankruptcies remain on the credit report for a period of 7 years from the filing date.According to the [redacted], a national consumer credit reporting agency's role in the dispute process is to review the accuracy and Completeness of any disputed item which may include Contacting the furnisher of the information or the vendor that Collected the information from a public record source, such as a Court or other government office, notifying them of the disputed information and disclosing all relevant information regarding the consumer's dispute. In order to help resolve the consumer's dispute, Experian will review all relevant documents submitted by the consumer with the dispute and will forward such documents to the furnisher if Experian is unable to resolve the issue based on those documents. Consumers may also contact Creditors directly to dispute items reported by the Creditor. If the issue is not resolved, then the Consumer Credit reporting agency must offer to include a Consumer statement on the personal Credit report. If the consumer disagrees with the results of the reinvestigations, it is their legal right under the [redacted], to add a 100-word statement specifying the nature of his dispute. The statement will appear with the item as long as the item remains on the Credit report. Any further Concerns regarding the disputed information will need to be directed to the source of the information, the US Bankruptcy Court located at [redacted].If the Consumer has any additional supporting documentation regarding the disputed information, they may forward it directly to me for review. Our records indicate that the additional disputed information does not appear on the consumer's current Experian credit report.Thank you for allowing me to assist you. Please contact me directly if you have any questions.Sincerely,[redacted]
