CreditReporting Act, credit grantors with a permissible purpose may inquire about Credit information. Requests for your client's credit history remain on the personal credit report for 2 years. The federal Fair CreditReporting Act (the "FCRA) section 604 outlines permissible purposes of consumer reports.The inquiries shown on a Credit report are a factual record of the companies who have accessed and reviewed a consumer's profile. They are only logged on the report, when in fact, an inquiry was made. A record of this activity, pursuant to federal law, must remain a part of record. Please note that Experian does not receive a copy of any applications made to credit grantors. The consumer may wish to contact the creditor directly for that information.Therefore, we must respectfully deny the consumer's request to remove the inquiries. I am rejecting this response because: according to the Fair Credit Reporting Act, Section 609 (a)(1)(A), EXPERIAN is required by federal law to verify - through the PHYSICAL Verification of the ORIGINAL SIGNED consumer contract - Any and ALL accounts EXPERIAN post on a credit report. Otherwise, anyone paying for their reporting services could fax, mail or email in a fraudulent account.EXPERIAN HAS NOT VERIFIED - through the PHYSICAL Verification of the ORIGINAL SIGNED consumer contract - Any accounts EXPERIAN has posted on my credit report.EXPERIAN is REQUIRED under the FCRA to have a copy of the original creditors documentation on file to verify that this information is mine and is correct. In the results of their first investigation, EXPERIAN stated in writing that they “verified” that these items are being “reported correctly”? WHO verified these accounts? They have NOT provided me a copy of ANY original documentation required under Section 609 (a)(1)(A) & Section 611 (a)(1)(A) (a consumer contract with MY signature on it) and under Section 611 (5)(A) of the FCRA – EXPERIAN is REQUIRED to “…promptly DELETE all information which cannot be verified.” The law is VERY CLEAR as to the Civil liability and the remedy available to me for “negligent noncompliance” (Section 617) if EXPERIAN fails to comply.EXPERIAN'S failure to positively verify these accounts has hurt my ability to obtain credit. Under the FCRA, unverified accounts must be removed if EXPERIAN is unable to provide me a copy of verifiable proof, which is - PHYSICAL Verification of the ORIGINAL SIGNED consumer contract.
