Review: Tried Cancelling with the gym but nothing is being done on Fitness revolutions end.

I went into "Fitness Evolution early NOV. to cancel my membership. I talked to the girl at the front desk and told her I wanted to cancel my membership, she said "we would have to talk a manager here to be able to put the cancellation through." I asked her when the manager will be in she said " you would have to book an appointment." The soonest they had was on DEC. 4TH @4pm. I took that appointment. Yesterday, I missed the appointment because I had to work. I called this morning and I asked if I could go in today because I missed my appointment yesterday. The employee there said the manager is not in today she's in a "corporate meeting, she will be in tomorrow but there is no guarantee that she'll be able to process your cancellation." I just want to cancel my membership. When I signed up for this gym the company I signed with was "FIT U". When they switched over to "FITNESS EVOLUTION" they never contacted me or gave any notification. The employee's there have terrible attitudes and are unprofessional. Not helpful at all!I will be sending my thirty day cancellation notice today. If no actions are taken after 30 days I will be taking legal action. Thank you!Desired Settlement: I want to cancel my membership, I don't have time to book appointments a month ahead. I have a job and we only get to know our schedules two weeks in advance. So I can't keep booking blindly. I have had multiple fee's charged from my bank due to fitness evolution and I'm tired of it. Please help me resolve this issue. Thank you.

Our records show that this membership is currently pending cancel and is set to terminate January 31, 2014.

Review: It was impossible to cancel membership with Fitness Evolution. My gym membership was originally with [redacted] and when I decided I wanted to cancel my gym membership, I contacted [redacted] to cancel it. The rep over the phone told me that my gym location is no longer affiliated with [redacted] and that I had to cancel my membership at the location in person. I went to that gym location and after the "manager" tried to convince me to stay with no success, he gives me a piece of paper with an address on it. He said that I need to write a letter stating that I wanted to cancel my membership. I was so annoyed and aggravated that I spent almost an hour of waiting and listening to this "manager" when all he needed to do was give me a piece of paper? I immediately left and went straight to the post office because I wanted this gym membership over and done with. I noticed that I was still being charged every month from [redacted] and my membership was still open. I was a new Mom and having to deal with this with no resolution I decided to do a stop payment on the gym membership. I did a stop payment for $21 with my Chase Bank for my gym fee. That didn't work because they tried to deduct $47! I called my bank to dispute the charge and they credited me back my money. I did a stop payment for all payments to "CLUB SYSTEMS DUES" so they won't deduct anymore money from me. Now, I'm getting collection calls from an outside company stating that I owe Fitness Evolution over $300! They threated me that if I don't pay what I owe, I will be reported negatively to my credit bureaus. I never ever received any notices about [redacted] switching my account over to Fitness Evolution. I never signed contract agreement with Fitness Evolution. My contract was with [redacted] and with that company, I was no longer in a contract and can my cancel with [redacted] anytime. I feel like there is no other option to cancel my gym membership without doing a stop payment.Desired Settlement: I would like Fitness Evolution to cancel my membership and update their system that no balance owed to them from me. I would like no more collection agency calls about this membership. If there was any negative reporting to the credit bureaus, I would like that removed from my credit report.

Response:

Our company has no record of the member's cancellation on file.If the member can provide proof of cancellation (cert letter receipt) we willbe able to waive necessary charges. It appears that the member stopped payment on the account in January, making all further charges valid at this time. If the member is unable to provide proof of cancellation, we can settle for 65% of the balance ($128.05).

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

I have attached the copy I made of the cancellation letter I mailed to Bally to cancel my membership along with part of the envelope that includes my return address if it does not get delivered to them. This was done the date on the cancellation request 12/15/2014.

Response:

It looks like this issue is yet to be resolved and I'm still receiving collections calls. Just today, I see that there's is an open collections reporting in my Transunion credit report. I don't know what else to do and now it's wrongly negative against me that affecting my credit reporting. Can you please help me to resolve this matter and reopen the case I had against Fitness Evolution

Review: Never informed that I needed an appointment to cancel my membership, in turn incurred additional monthly dues.

When I signed up for a membership with Fitness evolution, then Gold's Gym, I was never informed that I needed to make an appointment in the event that I wanted to cancel. Upon trying to cancel my membership I was told I needed an appointment. I wanted to cancel in time so that I wouldn't incur June dues. Well they said I had to make an appointment, which I did a week later. Upon canceling my membership I was told since I paid my first and lasts months dues upon sign up I would not need to pay any other fees. I was charged $54 for the yearly maintenance feeDesired Settlement: I am seeking a refund of $54.99 because I had paid my last months dues and also tried canceling with a proper 30 day notice as stated on my original contract.

Business' Initial Response

We apologize for any inconvenience to Ms. [redacted]. Unfortunately, there is a full 30 day notice to terminate and a termination fee per Ms. [redacted] signed membership agreement. All of the proper termination policies and procedures are stated on the signed membership agreement that was provided to Me. [redacted] at time of sign up. The termination policies are also stated on the termination request that Ms. [redacted] filled out in club and Ms. [redacted] was emailed a copy for her records. Feel free to contact us directly if you have any further questions or concerns [redacted]@fitnessevolution.com

Review: Fitness Evolution purchased Modesto Court Room. Never were we notified of this by mail, email or phone. My last membership dues were deducted from my checking account November 5th, 2014. Previously it was agreed upon with Modesto Court Room that $65 would be deducted on the 5th of each month. When there was no change of ownership notification and no money taken out of my account for December and January we assumed we were no longer members. On Friday, January 30th I noticed (without any explanation & on a random date) a charge of $130 was removed from my checking account. I was unsuccessful in attempts to reach someone by phone to expain these charges. I was forced to stop payment &block the new owners access to my account. The following Monday I physically went by the old Modesto Court Room to discuss the situation. [redacted], the acting manager refused to close my account until I payed her $130 stating that they bought my contract and it states that they have access to my checking account for dues. To this I responded I never would give a company I don't know access to my checking account. I requested a copy of my contract. Fast forward a little with many attempts to resolve this issue by phone, in person, by email & by certified letter (all with requests to terminate membership & multiple requests for copy of my contract). [redacted] called me greater than 30 days (end of March) after the certified letter was sent & received. She stated she was canceling my membership because she was unable to find my contract. On July 17 I get a collections call, they stated I owe more than $700. I called F.E. and the boy working could not find my account. I spoke with my family attorney he said to report Fitness Evolution to the Revdex.com, District Attorney's office & follow through with my threat of reporting them to the Attorney General's Office. So this is where I am now & I think I should bill them for my time spent dealing with them and their lack of professionalism.Desired Settlement: Stop harassing myself and others. Send me or show me my contract as requested multiple times. Handle the claim you sent in my name to collections. I also need physical proof that my account is closed. [redacted] calling on the phone saying she closed my account was apparently ineffective.

Business

Response:

We spoke with the member in February and explained to her that in order to terminate her membership, we required that her past due amount on the account be paid. We can't complete the cancellation because of the past due amount. We are able to settle this account for $266.50.

Consumer

Response:

I am rejecting this response because:I am rejecting this response because: Please re-read my complaint & demands for resolving this conflict. It appears you have missed many details outlined in my complaint. Please speak with your manager [redacted], and refer to certified mail she signed for that was sent to the McHenry Ave. business. I will state clearly again that this letter documented a formal request for a copy of my contract. According to [redacted] the contract should prove that you had the right to continue my membership without my consent. At this point I am unable to negotiate any resolve until the request to see the copy for my review takes place. If [redacted] was unable to locate this contract back in March & closed my account I'm curious how you see I owe Fitness Evolution any money. Please read all the other complaints about your businesses thoroughly & speak with your staff before responding.

Business

Response:

Hello,All correspondence and attempts to previously settle the account have been recorded via notes, including the past due balance on the account to cancel. Attached please find the copy of the membership agreement as requested.

Consumer

Response:

I am rejecting this response because: I am in the process of reviewing the contract which apparently you were able to find after 6 months. There are many inconsistencies and questions raised in review of the contract. Questions regarding the way payments should have been handled, and your billing practices. Also, there are 3 different monetary amounts you claim I owe you. Your previous requests for payments are unclear. I still have not received any mail or bills from you or the "collection agency" regarding my account. Please send me by mail an invoice with explanation and details of your request and your proposal to resolve. I am in need of this before resolution of this account can be discussed. I am certainly okay if you send it certified mail. Thank you, Karla

Response:

The member's balance is attached. We have waived all the statement fees as a courtesy. The balance due is $360, however as noted in our message dated July 30, we will settle the account for $266.50.Thank you.

Response:

I am rejecting this response because:Myself and several others feel we have been and continue to be harassed by Fitness Evolution. There is now a Stanislaus County District Attorney/fraud division open and active investigation into Fitness Evolution's practices. I have reviewed the copy and bill you provided through the Revdex.com. I have found several areas where you have violated the contract. February 2, 2015 was my 1st request to end our relationship and at that time a balance of $130 was owed. On February 26, 2015 [redacted] (your manager) called and stated she could not find the contract and was closing my account. I am willing to settle for $130. This proposal of settlement will require someone from Fitness Evolution to accept my in person payment and sign a paper stating that1- Fitness Evolution has received a final payment of $130 and has closed my account 2-Swift Funds Financial Services, any other collection agency, entity or person representing you will cease trying to collect on this bill/account. 3- Swift Funds Financial Services, Fitness Evolution, nor anyone else on your behalf has reported this to any credit reporting agency.

Review: fitness evolution bought out my old gym in January of this year and did not tell me of the change. They proceeded to charge me for a membership that I did not want nor did I know that I had a membership with them. When I asked why was I not notified of the switch all they said was that the old gym was supposed to tell me that they were buying them out. I then asked how can you charge me for all these months without telling me about it and they said because they bought out the gym and they got all the old memberships. When I said wanted to cancel my membership to them they said I can't because I owe them money for the last two months. The card they had on file had expired 3 months before and they proceed to try and run the card and add more fees for not being able to run the card and they knew it was expired they told me so on the phone. When I asked how can you charge me with out my concent or signature they said that they coppied it from my membership with my old gym. When I said you can't do that with out telling me they again said it was my old gyms job to tell all of this. At the end of this they told me they were going to keep trying to run my expired card and add more fees and then send me to collections later. The whole time I asked to speak to someone and they said no one is available or that they don't have time for this when they are the ones who called me.Desired Settlement: I want a refund from when they took over the gym and started charging me as fitness evolution in January of this year. I also want my membership to be canceled with no more fees to pay or added on.

Business

Response:

The acquisition of the club included all the current members. The member still needs to follow the original agreement which requires a 30 day written notice and no balance on the account to cancel the membership.

Consumer

Response:

I am rejecting this response because:I never signed anything to be apart of your club nor was I told about the change. If I was told about it I would have given my 30 days and ended the membership with fitness evolution. I am not going to pay for a gym membership that I did not want nor know that I had. I want all the money they have taken from me while under the new gym which is six months worth.

Business

Response:

We took over the gym in December 2014 and our log in records indicate that the member checked in at the gym 3 times after the change in ownership. The member was able to cancel her membership at any time with a 30 day written notice. We do not have a record of a 30 day cancellation notice on file for this member.

Consumer

Response:

I am rejecting this response because:I am a man not a women so someone else used it then. Still doesn't change the fact that no one informed me of the change at all and that you don't have paper work with your heading on it with my signature on it. Plus you are still trying to charge me more now for the membership after you already know the card is expired.

Review: As many Americans, we tend to make New Years resolutions, some unfortunately we do not keept. I decided in January 2013 to go to a local gym, the price and what they had to offer sounded good. So, I went in, had a brief tour and signed up, which only took maybe 15 minutes. This is a non-contract and non-commitment place, or so they say and advertise that.\

I had only gone a couple of times, I have no problems with the facility itself.

In July my relationship status, along with my living situations changed, I no longer lived in the area of this particular fitness center. So, I decided to go in and cancel my membership. I found no reason to continue to pay $19.99 a month for something I no longer use.

The process has been a difficult challenge. As, I went in to cancel, I was told that I needed to send a letter to cancel, So I went home drafted one up and sent it n. I went back a couple of weeks later, thinking my letter should have arrived by then. I was told by the clerk,oh, yeah, we got your letter, but it has to be certified, that way it shows we received it. That should have been my clue to call them out on this, since she told me, that they have received it.

Since I now live 30 miles west of this place, I thought I would start to see if there was a fitness place closer to me, since getting out of this seemed like to much time and effort. I work in San Francisco, so I found one, but in the area in which it is, trying to find parking remotely close is impossible, So, I decided to cancel again, keep in mind time had passed.

On January 31st of 2015, I went to the post office with a letter in hand in the pittsburg, ca area, which has perhaps 4 miles or less from Fitness Evolution. I had it certified, I was told by the clerk, that wow, she has seen so many of these being sent to Fitness Evolution. I told them in my letter, that I get only Sunday and Monday's off and I will be in on Monday, March 2nd to finalize this transaction. A month went by and I had not heard from anyone.

The morning of March 2nd, I did my laundry, went to get gas prior to heading East to fitness evolution, while cleaning the trash out of my car, I threw out the only proof an my certified letter.

I made my way up to Fitness Evolution with them telling me that they did NOT receive my letter and I would have to start this process again. All I want is to close this account.Desired Settlement: But now, I am so over this, that I want my money back from last August until this is resolved. I have sent you this letter along with other agency's and I will blast this over facebook, hoping to get other involved. That same time I was there, another guy was there trying to close his account. So, I know that there are more people out there.

I will save this letter and possibly seek legal council.

Kind Regards,

Business

Response:

I show we did receive the certified letter and the membership is set to terminate on March 31, 2015. There will not be a refund issued.

STAY AWAY!

They do not let you cancel your membership and keep charging you. They say you must make an appointment with a manager during work hours to cancel your membership, or send a certified letter via postal mail. Are you kidding me?? I cannot just call you and cancel? This is simply extortion. I have tried to cancel my membership three times already and they keep charging me.

Read the reviews and stay away from this place!

Review: Fitness Evolution (in Rancho Cordova, CA) had just opened up in our city and approached the business I work in. We were given a promotional discount price of $13.50 a month with no annual fees plus there would be no contract (a month to month membership). I was told the promotion was only for that day but if I signed my husband up for the partial then I could sign him up for a full membership later at the discounted rate. So I paid the extra $5 for his partial membership (so he could access the gym twice a week with me). My husband and I went in the week of November 1st and after a few days he decided he wanted his own membership. Again while my husband was signing up (with the same person who signed me up at work), I was told that he could sign up at the promotional discount price too. They signed him up and we thought everything was good until I saw the first charged.

I’m writing because I feel Fitness Evolution (in Rancho Cordova, CA) have not held up to their agreement and have over charged my account. I’ve reached out to the manager of this location multiple times regarding this issue. I was only able to reach him twice in the beginning but have since been told each time I call that he’s in a meeting, not there, out of town, etc. His response to me (the two occasions I’ve been able to talk to him) was that I should not have been charged the amount of $52.50 (promotional rate plus $40 for annual fee) and that he would contact headquarters. Each time he’s taken down my number to call me back but he has never called me back (including each employee who has taken it down). I feel he is avoiding me and that Fitness Evolution never intends to refund my money back or they would’ve done so already. It has been three weeks and I have been patient long enough with no resolution. I have my contract and will provide it upon request.Desired Settlement: I believe Fitness Evolution owes me at least $40 back because of the promotional rate my husband should’ve gotten. I feel they’re being shady and non-cooperative. I canceled our membership in the middle of the week but I fear that they will over charge me again. I would appreciate it if I can get my issue resolved through the Revdex.com because I’m not getting anywhere with them. If they can do this to me I’m sure this is happening to others as well.

Review: My original contract with [redacted]'s total fitness was transferred in April to Fitness Evolution; No one at [redacted]'s could prove that there was ever a notification of the change sent to me via email, phone, or mail- I had no idea this happened. Suddenly, at the end of July I get a call from Fitness Evolution telling me my account was due for $120, and that my contract with [redacted]'s no longer existed since April. I told them immediately that I needed to cancel that, they said it was not possible until I cancelled the whole Balance. After calls and email back and forth, and having asked the collections person that I needed to speak to a supervisor, this was completely neglected. I call back again, and they now charged me for the month of August. They are now threatening me that if I don't pay the balance, my account will be sent to collections, and then to the credit bureaus. The way all this has been handled is extremely unfair, and clearly they waited until July to inform me, ensuring the account increases in debt balance. This is all done with premeditation, and they are clearly taking advantage of this situation.Another thing- they are charging me $20 per month, when their website advertises $10 per month, without any contracts!!! But they are abiding me to all the strict notes in my contract with [redacted]'s, which was signed over 10 years ago. Please help, these type of people should not be able to hold a business permit; this is really serious, you can go to [redacted], and see all the complaints they have regarding billing, and their horrible shady ways of handling their accounts.

Review: Cheated out of my money. Using up my pt sessions when I'm not even there at the gym.

I signed up for personal training sessions. I explained in the beginning that according to my work schedule, I will know a day and a half before hand that I have to go out to another city to help with under staffed offices. I paid $1500 for these sessions that "never expire" and they said they needed only 24 hours notice if I couldn't come in for my pt sessions. When I called them a few times to let them know I couldn't come in and that I'd call back later to reschedule, they would reschedule my appointments without my permission on days I couldn't even come in on, which I also explicitly told them while I wasn't available from the beginning, And then they would call asking why I'm not there and then they would take it out of my left over sessions. I literally paid $1500 for them to keep taking out sessions out of my balance number of sessions, without my permission. Why are they being used up if I'm not even going in and I'm giving them the required 24 hour notice. When I told the manager I wanted to have them cancelled completely because I'm going to be transfered to another location soon for work, she said she wouldn't help me. I asked her for the number to a corporate office so I could take it up with them and she gave me the number to the Watsonville gym location.. Not only is she rude but she is a liar who cheated me out of all of the money I could have been using to pay back my student loans instead. I want my money back. She lied to my face when I asked her about the corporate office and I don't have any trust in this Company or people working there. It's ridiculous how they can use their clients in these ways. I would stop every person I can possibly stop from going to this gym.Desired Settlement: I want my money back for being lied to and having my sessions being used without me even being there after giving them the required 24 hour notice. I want my money back.

Consumer

Response:

I am rejecting this response because: they would call me on days telling me that I was supposed to have an appointment and I was late ten to fifteen minutes even though I would specifically tell them I wasn't available on those days because I worked and then said it would come out of my balance sessions. Then it basically means that they intentionally lied about the sessions going out of my balance

Review: The local gym in Carmichael was claiming to have major renovations done by April including a new basketball court. They have failed to do so, I wanted a refund of $63.99 and a monthly charge of $24.99 because they failed to meet the requirements we agreed upon during sign up. I would also like to cancel there so called month to month contract.Desired Settlement: Two monthly charges one of $63.99 and one of $24.99 and to cancel the membership

Business

Response:

I'm not sure who agreed upon major renovations before the membership was signed but there are no notes in regards to this on either the agreement its self or on the membership account. I do show notes a call was made and they did inform you on how to properly terminate the membership. All termination requests must be done either in club with a manager or via certified letter mailed to the facility. There is a full 30 day notice needed to do so, any and all fees due in that 30 day period will be owed. There will not be a refund issued.

Consumer

Response:

I believe this complaint to be a contract issue. I looked up fitness evolution on the internet because one had just opened up in Carmichael, CA. The website was very promising, it showed it had all the amenities including a full court basketball court. I went to sign up on Dec 22nd 2014. The place was still under construction, they were updating an old gym into the new Evolution Fitness. I was showed around. The young sales woman convinced me they were taking over the lease of the building next door to add the full court basketball court by April 2015. I was sold on the idea. As the months passed no progress was made. I feel the sales associate lied to me so I would sign up with her right then and there. Looking back I should have figured they get a sales incentive because of how aggressive her sales tactics were. For the most part [redacted] agreed with me and refunded some of the monthly dues, however Fitness Evolution feels they are still entitled to a the "Rate Guarantee fee" of $63.99. I would like this amount refunded as they did not follow through with the sales associates verbal agreement.

Review: I was at the gym working when a person by the name of [redacted] approached me. He suggested a free training session because he felt I was doing some of the exercises incorrectly. I accepted his offer and at the completion of my "free" lesson I was forced into sitting down with both [redacted] and [redacted]. [redacted] proceeded to intimidate me, bully me and fat shame me into believing that I was clueless about my workout. I tried several times to excuse myself and [redacted] continued to harrass me and scare me to the point of agreeing to sign up for personal training. After 45 minutes I could not get out of the gym fast enough, so I signed up. I went home and then my mom and I went back to cancel, because he scared me so much, at which time he refused to cancel the charge. He proceeded to again try to intimated and bully both myself and my mother. I have filed a cancelation notice with my bank, but I also feel other people should know about this business and this individual.Desired Settlement: I want ALL of my money back and I think [redacted] needs to be trained correctly on how to treat customers or not be employed. I also would appreciate an official apology acknowledging his misconduct as well as adjusting the company "policy" on refunds.

Business

Response:

The personal training at this location is done by Professional Fitness, they can be reached at ###-###-####.

Consumer

Response:

I am rejecting this response because: that still does not address the issue of the business ethics of that individual miles and how fitness evolution conducts business. If Fitness Evolution is contracting with Professional Fitness, they still have an obligation to satisfy customers needs. Not harass or belittle customer knowledge and guilt a customer into a contract that is nonrefundable.

Review: I am a former member of fitness evolution. In February of 2013,I became a member of the club with a month to month contract. Shortly after joining, I lost my job and I decided to move. Late March I came into the club to cancel my membership, and was told that in order to cancel my membership I needed to meet with the manager. I scheduled an appointment at the advice of the employee for the following day. I arrived early for my appointment to be turned away as the manager was not in for the day. I was upset, but but rescheduled as I needed to cancel my membership. I rescheduled an appointment for two days. I received confirmation and showed up the following day as planned. Once again the manager was not present, as he had a family emergency. On Friday prior to my move, I showed up to the club in desperation, hoping the manager was there. I was informed that he was not there and I advised to send a letter via certified mail. I went straight to the post office, sent a letter via certified mail expecting my month to month membership to be canceled. In March 2015, I discovered that I was sent to collections for non payment on the account, and advised to call the concord club to sort things out. In the past 2 weeks I have called to speak with the manager 13 times, left 4 messages for a call back, and scheduled an appointment to meet with him. I arrived 15 minutes early for my 4 PM appointment. He wasn't thereI was provided [redacted]'s email stating if I email him he will respond within the hour. I emailed him while waiting in the club. [redacted] never respond to me via phone or email. While I was waiting on a resolution, another employee, [redacted], after reviewing my file, stated that my cancellation letter was processed in August, 4 months after I sent it. He stated that even still, my membership was not cancelled until December due to non renewal. He also stated that several notes had been deleted from my account info. He stated he would have [redacted] call me this morning at 10:30. He never called.

Product_Or_Service: Month to Month Gym MembershipDesired Settlement: DesiredSettlementID: Other (requires explanation)

I have been greatly inconvenienced by this, and have had my credit tarnished. I feel as if 250.00 plus retraction of the debt to collections is a fair resolution. I do not owe this money and would like to resolve this without a law suit.

Business

Response:

The member did send in a request to terminate the membership, however, the request was denied as there was a balance due on the account. The account did remain active as we are not able to make any changes to the account when there is balance due and was referred to collections for non payment. At this time there is a current balance of $209.94 we are able to accept a settlement payment as previously discussed of $126 to settle and close the account. To make the payment you can either go in club or call [redacted].

Review: Ok. First problem I had was them losing my checking information. I gave them our routing number and account number three different times. Even saw their employees type it into the computer and when it came time to bill me they said our account was not working. They even read our account number back to us and it matches up but apparently the only way they could bill us was through our debit card which added a 10 dollar late fee. So after that my wife and I decided to end our membership with this company. I had to send a certified letter stating we wanted to end our membership. So after they received our letter I got a call from the assistant manager and was told to male a final payment. I went into the gym paid our final dues and fitness evolution took our key cards and said to me that that day would be my final day and that we were all done. I worked out my last day. Or so I thought so. Just got a call yesterday saying we still owe them 17.99 each and that if we dont pay our membership will continue as if we didn't cancel. I told them our key cards were taken away and that our last day was when they took the key cards. The assistant manger said that no they shouldn't have taken our keys and that we still owe them money even though I was told that I had my last day working out there. So basically I was told two different stories and had our membership keys taken away. And since I was told it was my last day I never went back. The assistant manager said all I had to do was tell them my last name to get in. Very shady to my wife and IDesired Settlement: DesiredSettlementID: Other (requires explanation)

Don't think we owe them anymore money since we were told by an employee to turn in our key cards and that it was my last day at the gym.

Response:

We understand Mr. [redacted]s frustrations. Unfortunately, per the 30 day notice stated on the membership agreement the request to terminate must be provided via certified letter 30 days prior to the next billing date. If a bill date falls within the 30 day notice those dues/ fees are owed. Per the attached account transaction history for Mr. [redacted] the original checking account information came back non sufficient for two months before it came back as a closed checking account. The "unable to locate is due to the invalid checking account information provided on 8/24/14 and 9/5/14. Currently Mr. [redacted]s account is past due and he will need to pay the last month dues. Mr. [redacted] was informed that he need to pay a total of $55.98 to terminate his membership on 9/12/14 when the Facility manager spoke with him, however he only paid $37.99 on 9/14/14. If the last month dues are not paid per the agreement the account will not be terminated. Mr. [redacted] may contact our corporate office directly to make payment ###-###-####.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

STAY FAR AWAY!!!!!

I wish I would have checked into the reviews before I signed up for my membership. I went in to cancel my gym membership and the guy at the desk told me I owed $14.99 and that it would be cancelled. I asked if there was anything else I needed to do and he said no that my membership would be cancelled. I checked my bank account today only to find out that another $53 was taken out. I immediately headed over to the gym after work. I asked the lady about the cancellation process and she told me the same thing as the guy I dealt with the day prior told me. I then asked her why I was charged $53. After catching her in about three lies she told me she would call the corporate and get back to me. She later called me back and told me that I would be getting an email from the corporate for a refund... been checking my email since and I haven't received a single email. I have read multiple reviews on here saying that they will continue to charge you and then send you to collections. I am going to the gym tomorrow to complain and get proof of my cancellation. I have read on here that they will try to say that they don't have proof of your cancellation, so I want to ensure that they do and so do I. This place needs shut down!!!

Review: I went to the club once with my daughter, signed up, but had no credit card on me, hence no billing information. Did not get a key tag to come back or even a hard copy contract, just initialed a screen. On Saturday October 11, I received a collection notice for $88.00 from [redacted]l [redacted]. I never received a phone call, or a billing notice from Fitness Evolution, and I have never been back, I lost my job the weekend after I went with my daughter. Since I did not receive notice, a key tag to return, and the fact that they had no billing information, I was not aware that I needed to cancel a month to month contract that was not renewed after one visit. I went to contest this with the manager "[redacted]" he stated they do things differently now that he is there, but that he could not help me.Desired Settlement: I have not paid the collection, but want this off of my credit report please. I believe this is bad business practices and am unable to pay this now that I am unemployed.

We offer member month to month membership with a 30 day written notice to terminate the membership. Once the agreement is signed it is emailed to the member, the email we have on file is [redacted]. Since we did not receive notice the accout remained active until it was referred to collections.

Review: Tried to sign up online, website said they were unable to process my account. So I gave up and company started to charge me without notification.

Tried to sign up for the gym through their online process. Website said they were unable to complete my signing up. I gave up on signing up online and went and signed up for another gym. Looked at my account the next month and this company had charged me for the monthly dues anyway, without any notice of confirmation. I contacted the corporate office and they were very rude about managing my issue. This company has continued to charge me even though I had explained the situation. They have charged me late fees as well. I am upset because their website failed to tell me that the account had been created. It specifically said "we could not process your payment information". I even tried multiple times to process it and it continued to say it would not go through. Not to mention they did not get back to me in a prompt manor, and when they did they were very rude in the emails that I finally received after emailing multiple times without a response. I have emailed them about negotiating the balance on my account so I can terminate immediately, without a response. I don't think this is fair for them to charge me because their website said that it could not complete my payment. My balance for the gym is now over 100 dollars.Desired Settlement: I would like for the company to terminate my account that I did not receive authorization for them to create. I would even settle for them to remove the late fees and I just pay the remaining balance for the original $10.00 a month. But I still do not think this is fair for me to have to pay something I had not fully signed up. I would ideally like for this account to be terminated completely without paying for something I had no idea I would have to. Especially as that it took multiple emails for me to get a response from them regarding this matter.

Review: I have a torn rotator cuff and was advised that a gym would assist with the strengthening and recovery. I received multiple advertisements for Fit U health clubs and choose to try it. (January 2013) While signing up I had to make an appointment with a personal trainer sales person. He stated that they could help with my shoulder and teach me how to use the machines. 5 trainers later, (June/July 2013) [redacted], the trainer, stated that he would not work with my injured shoulder. This statement was made in front of 2 other employees, [redacted] and I believe the mans name is [redacted] Both [redacted] and [redacted] stated that they would cancel my membership immediately. Now, (October 2013) I am receiving bills for monthly payments, statement fees and returned item fees. I called the gym and was informed by a very rude girl that I needed to pay to cancel my contract which is supposed to be month to month. A asked for a corporate telephone number which the girl would not give me, but stated that I could e-mail corporate. I have sent them 2 e-mails that I have not received a response from. I called the gym and spoke with [redacted]. She stated [redacted] is the manager and she was not available. I called back and [redacted] stated [redacted] was at lunch. I left my name and number. [redacted] did not call me back. A man named [redacted] called me stating that I need to pay to cancel and send a certified letter stating that I want to cancel. I asked for the corporate telephone and address, again he would not provide. I requested that he have corporate call me. [redacted] stated he would do that. I still have not heard from corporate. I have also requested a copy of my supposed contract that I have not received.

[redacted],

# members of our staff have informed you of our cancellation policy. The last one who spoke to you noted in your account that you used bad language and hung up on them. Our cancellation policy is detailed in the membership agreement you signed which was emailed to your email account on file upon joining. Cancellation requires that you have a 0 balance on your account and that you provide thirty days notice either by meeting with the manager in the club or by sending a certified latter requesting to terminate. Please follow the guidelines and your membership will be terminated. Thank you.

Review: They have gone out of there way to postpone / limit & refuse my requests to cancel my contract so that they can continue to charge me for services.

I've gone in to the gym on two different occasions to cancel my membership. The latest attempt was on 7/30/2013. Each time the gym has been fully staff and not very busy, yet they tell me that I have to make an appointment to cancel. The appointments that they have given me are dates that are roughly 10 to 14 days later.

I asked to speak with a manager so that I could get information on who to complain to about their policies and service. I also indicated that I wanted the contact information for their corporate office. An associate named Jordan presented herself as a employee from corporate and said that she was unable to give out any information about their corporate office other than a customer support email.

I emailed their customer support and indicated that I wanted to cancel my account, I provided my phone number so they could call me (nobody would give me a company number that I could call) and of course they send me back and email that indicated I could not cancel my account except through speaking with a manager or by registered mail. Yet each time I've gone into the building to speak with a manager, they send me away telling me I need an appointment (that they'll schedule for me almost two weeks from the time I went in).

This time was extremely frustrating as my yearly account was set to renew in the first week of August. I went in on July 30th and they told me that I could not talk to someone about it until August 8th (10 days later, just after my yearly renewal fee would be charged).

This organizations has no integrity and should be shut down. Their staff are trained to lie and make it as difficult as possible to actually cancel your account in hopes that they can extract another month or two out of you or even an annual renewal fee. Desired Settlement: Account cancellation as of July 30th with no erroneous fees.

1. In each response, they have failed to address any concerns. They simply have a canned response.

2. They will not produce a copy of a "signed agreement".

Review: To whom it may concern,I received an invoice from FIT EVO gym for $89.00 when I have never been to their gym. I have never even heard about them, I used to go to Gold's gym last year but due to some issues I didn't wanted to continue my membership with them. Manager told me that he will allow me to use their facility for three months because of all the hassle I had to go through.... he said if you don't come back in three months, we will go ahead and take your name out from our system. I didn't go to their facility since that day, didn't even use the three month period. Now FIT EVO, is saying they took over Gold's gym and my name is still exsisting in their system and they sent me bill for $89.00 I don't think it was my responsibility to go back to FIT EVO and told them about all that happened because as I was promised that my name will be taken out from their system by last year December. Now FIT EVO is threatning me to send me to collection agenices and ruin my credit and I don't think this is fair to me.Please advise. Thanks,[redacted]

I don't think I should be paying anything to them, when I haven't use thier facility at all. They can even check by going to their card scanning system and check if any card was swipped under my name to get the ocnfirmation that I have even been there.

Business' Initial Response

We apologize for any inconvenience to Me. [redacted]. The facility is still under the same ownership deeming the membership valid. Unfortunately, per Ms. Nehas signed agreement the proper termination procedures were not followed. The proper termination policies and procedures are stated on the agreement. All of the charges on the membership are valid per the signed membership agreement. Feel free to contact us directly via email [redacted]@fitnessevolution.com.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

I am still not satisfied with their infromation which have been given it to me. My concern is why would you continue to bill me when you know that I am not using the facility. I am in a process of making a decission to see what can I do but you must stop charging me from now on..... I can't just make a decision over night. I shouldn't be getting anymore charges from FIT EVO as of 5/1/13.

Business' Final Response

We provided Ms. [redacted] with another copy of her agreement on May 8, 2013. Per the agreement the membership will continue to bill until the proper policies and procedures are followed to terminate the membership. Please review the termination policies and procedures stated per the signed membership agreement.
