Fitness Evolution Reviews (1353)

Review: In August of 2014, I moved to Dublin, California and I informed the person working the front desk, at Fitness Evolution, that I would no longer be using their club, because I moved more than 50 miles away from Modesto. They told me thanks for my business and that I would be charged for September and then I would receive a cancellation letter. In October 2014; I noticed that my bank account was charged again, so I went to the gym explained that I never received my cancellation notice and that I was charged again for October. The staff member was very helpful; pulled up my history and agreed that I had not been in the club since August 2014; apologized and promised that I would get a cancellation letter and charges would stop. In December 2014; I went back to the club and asked to speak to the manager. Now this guy tells me a totally different story; he said I never cancelled the service and that I needed to produce a cancellation notice (how can I produce a document that they promised to deliver to me, but never did) I explained to him that I have been charged until December 2014 after I cancelled in August 2014. I paid for 4 months after I cancelled. I contacted my bank and let them know that I was no longer accepting charges from Fitness Evolution. In January 2015 and for the next 5 months I observed Fitness Evolution attempt to debit my bank account (my bank rejected all the requests) In July 2015, I made one last attempt to put this situation to bed. I went into the club spoke to the manager, [redacted], I explained that I cancelled, that I had not been in the club since August of 2014 and that I never received any cancellation notice; he checked my history confirmed that I had not be in the club since August 2014 and he said that the account was closed and they stopped billing in May 2015 and assured me that the corporate office would contact me. I actually was nave enough to walk out believing him. September 2015, a Fitness Evolution collection appears on my credit report!!Desired Settlement: I would like the cancellation letter that I have been promised and the collections removed from my credit report.

Response:

Member came into a Fitness Evolution club in November regarding cancelling the account. He did not want to follow the cancellation process and threatened to stop payments through the bank. As of January 2015, the payments were stopped through the bank. All charges are valid. Fitness Evolution can offer a settlement of $104 (65% of original balance of $160)).

Review: Fitness Evolution denied me a refund of my payment of three personal trainingsessions for $105. They have not even given me a response to my request for a refund that I requested, April 17, 2015.In February 2015 I reluctantly signed up to do personal training with a new trainer named [redacted]. I was reluctant because he did not seem too knowledgeable andhe looked often at this cell phone. The first session he was unprepared and continued to text and look athis phone while working with me.The next time I went to the gym I asked the desk clerk if they couldrefund my money. The desk clerk said Id have to talk to my personaltrainer about it. I was feeling a little uncomfortable telling [redacted]I did not feel he was a good personal trainer and so decided to tryone more session with him. He continued to text, look at his phone, and was not prepared.[redacted] canceled our next appointment with me he reported due tomigraines. When I arrived at the gym he was still there. The next time I came in for a session he was late. I spoke with his supervisor [redacted]who asked me to wait. Because I had to pick someone up at the airportafter my planned session, I was not able to wait. [redacted] mentioned thatI should ask him for a free session to make up for being late. The next session I scheduled, [redacted] called and left me a voice mailstating he was quitting so he was canceling our session.I arrived at the gym and asked the front desk what I could do since[redacted] quit. After waiting a long time, I spoke with another staff member named [redacted] who toldme [redacted] is having a hard time in his life. He wants more money.Hes thinking of driving for [redacted]. But I think I convinced him to comeback so it should be ok. I told [redacted] Id rather not work with[redacted] anymore. I did not feel like I was learning from him and Ifelt this was unprofessional. [redacted] offered to work with me at thenext session until they could find someone else.[redacted] then canceled the next appointment due to last minute car trouble. That same day I requested a refund from [redacted]. [redacted] did not respond to my text. Thenext day I wrote him a text explaining more why I wanted a refund. Ialso asked if there was someone else I should be talking to about arefund or if he was the right person to speak with. He offered me twofree sessions.I once again told him I would like a refund. He did not respond to me. Nine days later I asked him to please respond about my refund. (Thisis today 4/17/15)He wrote me back and said he was on vacation and I could call [redacted] atthe gym. I called [redacted] at the gym. [redacted] answered and said she wason vacation.I called the number for PT customer service. The woman I spoke withtold me to send the text messages I had received from both from both [redacted] and [redacted]. I sent her an official request for a refund with copies of the text messages they had sent me. (I am not sure what the text messages have to do withgetting a refund.)I requested in the email an answer to this email by May 22, 2015. On May 24, 2015 I received and email from [redacted] stating that she would call me. She never did call me.Desired Settlement: DesiredSettlementID: Refund

$105 for three sessions I did not receive due to the staff canceling the sessions many times.

Business

Response:

Member requested to have the personal training stopped after two months. There will not be a refund issued as member was passed the 5 day grace period.

Consumer

Response:

I am rejecting this response because: The gym staff canceled or was exceptionally late to four sessions in a row. There ought to be an exception to this 5 day rule if your staff are the reason I am not able to get service. Also, I tried to find out your polices on refunds and got the run around for several weeks.

Review: I signed up at a Fitness Evolution in Dec 2014 when I was visiting home for the holidays in Lodi. When I signed up, they convinced me to sign up for a monthly membership because it would be cheaper than paying for separate day passes, assuring me that it would be fine if I wanted to cancel at any time. After using it for 2 days, it was time to go back to SF, and on the second visit to the gym, I requested that they cancel my membership at the Lodi location. The person told me that the manager wasn't there, but that they would give my request to the manager to cancel since I couldn't come back.Fast forward two months, I'm still getting monthly charges! I call the manager and explain my situation, and ask that they cancel my membership. She says that the two ways you can cancel are in person at a location, or via certified mail. As I mentioned earlier, I attempted to cancel in person once already, and they failed to process it. I told them that I was rescinding their authorization to continue charging my card, as I had submitted a request to cancel in person, and that any subsequent charges would be charged back, and would be their responsibility.Fast forward a couple months, they're still charging me! I charged back on my credit card for those charges, now having submitted two different requests for cancelation. Now I've got this collections agency calling me telling me I owe Fitness Evolution $330 dollars! For a gym I visited twice. I'm going to take them to small claims court and bill them for the time I've spent attempting to resolve this issue, unless I can get this resolved.Desired Settlement: I want my outstanding bill (which is outrageous) to be removed from their records, and my name removed from their collections agency.

Business

Response:

Hello,The member did not cancel the membership per the membership agreement or the staff's instructions. Fitness Evolution, however, will remove the member's account from collections as a courtesy. Thank you.

Response:

I am rejecting this response because:I am continuing to receive calls from Swift Financial as of 5 minutes ago. Can you please confirm the removal of my account from their files?

Business

Response:

Hi,I am sorry that you received another call. We have notified them to remove your account. It may take a few weeks for them to remove you, but please be assured, they have been notified.Thank you.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

Review: This Fitness Evolution gym club is unreasonably requiring methods to cancel service and trying to increase my billings without my consent.

The Evolution Fitness at [redacted]e in San Jose is not recognizing my cancellation, making it unreasonably difficult to process it, and claim I owe them $49.98 versus my belief that I should pay $9.99 to close out my account. They also threaten they will increase the amount they claim I owe each day if I do not comply with their rules - which seem to change daily. They are also rules they have not been willing to provide me in writing - not even a copy of the agreement I signed and which they should have on record.

For more details, you can visit the [redacted] site for the prior brand, [redacted], that ran this operation at at [redacted]-san-jose.

And updates are now being placed at the new Fitness Evolution site on [redacted] . The relevant reviews are the ones posted by ray s.

An abbreviated version is here:

My kids and I have been members at this [redacted] (now Fitness Evolution as of this summer) since around October of 2013. When told this August to submit a notice in writing regarding cancelling membership, I did so and got a postal receipt for the same.

This process alone required a number of visits and calls to the location to understand and sort out. I planned simply to cancel by stopping by the gym. They would not accept my cancellation and required a scheduled meeting with the manager or a letter sent by registered mail. (Note: My husband was later informed over the phone in October by a woman named Logan that the gym does not arrange appointments with the manager.)

Canceling membership (btw, mine was supposedly a $9.99 month-to-month, contract-free obligation) with these types of gyms requires providing a termination notice a month in advance so customers end up paying for an extra month. We were aware of this requirement and I mailed the notice for the service to be canceled knowing that we would have to pay for one extra month of September even though we did not want to use the gym anymore.

The club denied receiving my letter (a copy of which is posted on [redacted]) and I had difficulty finding the postal receipt and presenting it due to a very hectic schedule.

The club said that without the receipt for the letter, they could not honor the cancellation and I would have to make an appointment with a manager to process the termination fresh, all over again.

They threatened to continue billing and to have a collections agency come after me for these payments - even after receiving multiple in-person and phone call cancellation requests.

I, and now my husband, have talked to representatives of Fitness Evolution (including someone named ** who we've been told is the manager), who claim to have bought our membership from [redacted], multiple times in person, over the phone, as well as go through the administrative process of writing and mailing a letter. When my husband requested a record of the last visit at the club by my family, which I'm pretty certain was many months ago and which we know they track, the club did not not provide that information. When we went to the gym together to discuss the matter, we were informed that to cancel fresh now, we would owe another $39.99 for some kind of annual fee - that we were not aware of. Apparently, they billed it on October 3 - many weeks after many calls about our cancellation desires.

Fortunately, our credit card was changed by the credit card company and Fitness Evolution no longer has access to our credit account so they need to work with us on a resolution.

This gym seems to have a big part of their business that feels like a scam and possibly even fraudulent. Apparently, there are a number of other customers who feel the same way. Just go to the Fitness Evolution site on [redacted] for this street addrDesired Settlement: We are fine paying the company $9.99 in cash for the one month of September to complete this cancellation and resolve this issue. They may also retain whatever personal trainer fees we've paid and have not used.

Response:

Per the [redacted]'s agreement in order to terminate the membership the request does need to be sent via certified mail to the local facility. As a courtesy we allow members to meet in club with the Manager to complete the request. We received the request to terminate the membership in club on 10/23/2014. We would not be able to accept September as the last month dues.

Review: They are trying to collect money and sent us to collections for a cancelled membership

My husband and I joined Gold's Gym and we cancelled our membership 1 1/2 years ago. At that time we were told to fill out the form (which they sent to us) and return it before the next billing cycle. We did this. Never heard another word from this gym. So when my purse was stolen there was no need for me to contact the gym because it had been cancelled. On 5/9/13 I received a call from a very rude young man stating we had been turned into collections for cancelling our membership incorrectly. Why did the Gym not contact us. We did not move, we did not change our phone numbers?? Never received a single notification by mail or anything. Never received a notice from the collection agency until the call came in yesterday. Needless to say I was in shock. I am very upset, I have NEVER even set foot in this gym. Paid the membership but never went and now after 1 1/2 years they want to bill me for $250 for a membership that was cancelled wrong! I did exactly as I was instructed by the Gold Gym employee. I think with 90 complaints to the Revdex.com for the all similiar issues, the problem is not with the members. They have an excuse for everysingle question you can possibly ask them. I do not feel I owe this money and I am going to fight this and possible contact all the others and speak to someone about a class action lawsuit.Desired Settlement: Take this out of the collections. Send me a certified letter stating it was taken out of collections and it is a zero balance.

Business' Initial Response

We apologize for any inconvenience to Mrs. [redacted]. Unfortunately, we have no record of any termination request ever being received for Mrs. [redacted]. The membership account continued to bill per the signed membership agreement. We tried to contact Mrs. [redacted] multiple times regarding her past due balance. The proper termination policies and procedures are stated on Mrs. [redacted] signed membership agreement. If Mrs. [redacted] has any further questions or concerns Mrs. [redacted] may contact us directly via email at [redacted]@fitnessevolution.com.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

They did not try to contact me in any way shape or form. They had my phone number, cell number and work number. They also sent nothing by mail. This is why we believed our membership to be cancelled. We heard NOTHING from them for the past year and a half. The collection agency had no problem contacting me. One would thing after 99 complaints filed they could finally admit that just maybe it is not the members!

Business' Final Response

We apologize for any inconvenience to Mrs. [redacted]. Unfortunately, unless the proper steps to terminate per the agreement are followed the membership account continues to bill. We tried to contact Mrs. [redacted] via mailed statement with no response. If Mrs. [redacted] has any further questions or concerns Mrs. [redacted] may contact us directly via email at [redacted]@fitnessevolution.com.

Review: I signed up for personal training at this facility and the faculty.Trainers failed to schedule training sessions.

I signed up for personal training. I made several attempts and phone calls to the gym to schedule my training that I signed up to pay 176.00 per month for. My phone calls were never returned by **. I then was charged for the second month of training's. I went into the gym and was promised that he would refund the first month and would fit all my training's that I was owed into the next month on starting on May 1. Since I never heard from ** or received my refund. I called to cancel and was told I can only come in to cancel. I went in and was told I need an appointment. Today I have now been charged a 3rd charge of 176.00 equaling 528.00 total and I have been unsuccessful with setting up ONE training session. I have been told we will call you back 1-2 times a week. No response or phone call. Corporate now says they will refund me for one month and it has been a week with no refund and no answer by corporate, no matter what time of day you call. I am very livid at this point because I have paid several hundreds of dollars and have received no service or even a phone call.Desired Settlement: I am seeking a full refund for my personal training sessions that have been paid for on 3/26. It is now 5/27 and there has been no attempt to contact me back to provide the service this business was paid for.

Business

Response:

I show that the members received their refunds on 5/26/2015.

Consumer

Response:

I am rejecting this response because: We did not receive a full refund. We received a refund for 1 month for the month of May AND your business attempted to draft the money back out of my account 1 day later for June and I stopped the transactions with my bank. We have yet to receive April's payment back for 8 sessions of training we have not been given. We refuse to pay for a service that has not been delivered.

Review: On the Fitness Evolution website, they advertise repeatedly that their basic membership is $9.99/month with no contract. This is a blatant lie. I have numerous other complaints beyond that. But the company uses false advertising to get their customers in, and they make it very very hard to get out.

The reality is that the basic plan:

1. Requires a contract

2. Requires $99 enrollment fee that is a one time fee

3. Requires a $39 price lock fee that is charged 1x/year

4. Requires $9.99/month fee. As advertised.

I cancelled my membership after only being enrolled for 2 months. I missed the contractually bound 30 day notification period. I understood that and am willing to pay the $9.99 for January. However, they refuse to waive the "required" $39 price lock fee for 2016. This is bad business. I don't need a price lock fee for the year when I have cancelled my membership. And it's not as advertised. And by the way, within 30 minutes of me cancelling, they had sent me an email inviting me to come back with a free 3 months (that equals $30!). So, it's not about the $ for them.

The other bad business practices:

1. No way to cancel except by going in or sending a certified letter.

2. No way to find that information on their website. You have to call or go in to find out

3. they will take your money at 5 am, but they won't let you cancel except from 9 am to 6 pm.

4. There is no phone # or contact info anywhere on their website.

5. I have submitted requests for help via email, via contact form on their website, and to the phone # that the manager of the store provided me - all with no response or a bounce back saying the email address doesn't work.

Last bit of false advertising - they say on their signage in front of the store that they're open 24 hours, but if you arrive at 4:50 am (as I have) on a Monday morning, they're not open. This is at the gym on the corner of Meridian and Hillsboro in [redacted].

In summary, this company is taking advantage of people with false advertising.Desired Settlement: I would like to not be charged the $39 price lock fee in January. I also would like the Revdex.com to investigate the claims of false advertising and get the company to correct its practices.

Business

Response:

I would like to apologize for any frustration you may have experienced. All our advertising that is sent out does say to see the club for details, so all areas of the membership can be covered. All club contact information is easily accessible on the website. [redacted] is our corporate email for the [redacted] market. In regards to the rate guarantee fee, it is part of the agreement, however we can waive your last month's dues as a courtesy. We show that this membership is set to term out on 1/15/16.

Review: Fitness Evolution falsified their club membership. On 10-30-14, my 12 year old daughter and I jointed. I spoke with [redacted] over the phone and [redacted], who signed me up in [redacted]'s absence. I was never told about a 39.99 one time hold your 9.99 membership for a life time guarantee until I was ready to comitt to the 9.99 debit from my checking account. At that time [redacted] told my "oh by the way, there is also a 39.99 fee that guarantees your 9.99 payment will stay the same." I questioned this because it was never mentioned over the phone but now. [redacted] assured me the 39.99 would hold the 9.99 for as long as I was a member. My other concern was that I was having foot surgery in December or January and the fact that my account could be frozen for 3 months was appealing to me or why even join. [redacted] assured me the 39.99 would not be debited from my account as the account was "froze". On 12-18-2014 I phoned and spoke with a young man, I believe it may have been [redacted]. I told him about my foot surgery and asked how to freezed my account. He told me I can do it for you right now. I gave him my information and my daughters information. He told me no worry, your accounts are froze and wished me the best on my surgery. In January and February 2015, the membership fees continued to be deducted out of my account. I phoned on 2-20-15 and spoke to [redacted]. She told me the accounts were never froze. She assured me that she would send a request into corporate to refund me for the 3 months totaling $60.00. She also told me the 39.99 was also deducted and there was nothing she could do about it and stated I had been misinformed about that fee being frozen. Needless to say, I have not been refunded. Every time I phone to remedy my account I am told a different story. I have spoke to another manager named [redacted] who has totally given me the run around. I tried to contact the district manager, [redacted]. She will not return my call. Finally, I phone my bank and told them what happened.Desired Settlement: DesiredSettlementID: Refund

I was advised that due to the misrepresentations they could dispute and stop paymnent from further due deductions. This company has a very poor reputation on the various business cites. I do not want further business relations with this company. I want any affiliation with them resolved. I have a credit score of 823 and do not want it marred by a dishonest company that misrepresents their services. Thank you kindly.

Business

Response:

We do not show we ever received a request to freeze the accounts so the accounts remained active. There will not be a refund issued. What I'm able to do is terminate the memberships moving forward. Please note if the payment is returned for any reason included but not limited to charge backs, insufficient funds, etc. the account will be referred to collections.

Review: I had a membership with fitness evolution and when I signed up I enrolled with a manager in Oakdale, Ca and I love my experience with them in Oakdale, ca. I suspended my membership for 4 months due to have an injury. my injury never healed right so I ended up needing to cancel my membership and in the beginning they told me that I had to make an appointment with the manager to cancel so I did and the only available appointment was April 9th this was at the end of march when I made that appointment. they charged me for all of April and then I finally got in on April 9th to cancel my contract with them while doing so I made sure to ask the girl If I was going to get billed for the next month just making sure!.. but why would I since I canceled the beginning of the month that I just payed for right? but I did get charged for may and because I didn't plan for this charge my counted was over drafted! I called for two day trying to get ahold of a manger and didn't until 5:30 pm on may 5th he never returned any of my calls and I left several messages for him. I spoke with a manager named Eddie Brown he informed me that he doesn't know why someone just didn't send the papers out to me via mail since this is what they do to get it done faster when you can't get in with a manager...but I was never told this what I was told was I had to make an appointment with a manager to cancel.. he told me that they always charged for the following month.. this makes no sense? I canceled with them at the beginning of a month that I payed for why would they bill me for a month of their gym when I already canceled the month before? they just billed me for a month that I can't even use because my membership is canceled. this is very stressful and agravatingDesired Settlement: I really would like a full refund of what they charged me and also a refund from them of the the fee that my bank is now charging me for my over draft charge. I asked in the beginning if I was going to be charged and they told me no! If I would have known I would be charged for another month that I don't get to use at their gym I would of planned to of had that money in my account the day it gets automatically taken out. this has been a huge stress and burden finacially

Business

Response:

As there is a 30 day notice to terminate any and all fees during that time need to be paid in order to cancel the membership. The request was made on April 9th making the last month due in May. There will not be a refund issued. You have access to the facility through the month of May.

Consumer

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

Review: In August 2013, my wife had major back surgery with an up-to-two-year recovery period. After the surgery, we decided to cancel her membership with Fitness Evolution (she had the membership for over 10 years prior when it was [redacted]). We were told she had to physically come to the facility to cancel - no exceptions. In March 2015, she felt up to going there. She was told since there was no manager on duty, they couldn't cancel her membership. On April 2, I called to confirm that a manager would be available that day, and she went there to cancel. She had to pay through the month of May in order to cancel, despite the payment for April coming out of my account the day before. Supposedly, this was in the original SVAC contract and is also Fitness Evolution's policy. This has cost us $1449.00 for a complete lack of use of the facilities. I believe this policy needs to allow for exceptions such as her medical case.Desired Settlement: DesiredSettlementID: Other (requires explanation)

I would like to see the policy changed, at a minimum, to allow exceptions like hers. If possible, I would like the policy changed. It allows outright gouging of the customers and is unfair, and more importantly, totally lacking in compassion.

Business

Response:

In order for us to make any changes to the accounts we need a written request from our members. If a member is not able to go in to sign their termination request they are also able to send a certified letter.

Consumer

Response:

I am rejecting this response because: 1) I want to see your associates trained to accept a written request as opposed to forcing the person to physically coming in. Twice we were told that the ONLY way to cancel was to come to the center. 2) The response did not address the fact that we had to pay for May when canceling on April 2. We were told "30 days", which to me meant May 2, not May 30. Last thing we were told was that "we don't pro-rate anything". I will accept this response once I am assured that training of your associates to accept a written request has taken place AND I receive a satisfactory explanation (more than 'it's our policy...') as to why we had to pay for 59 days instead of 30.Thank you,[redacted]

Business

Response:

I have contacted the facility to ensure that our employees are properly trained on how to advise member of our termination policy. There is a 30 day notice to terminate the membership and any fees due within that time need to be paid to complete the request to terminate the membership. As your request was made on April 2nd the last payment due will be May 1st.

Consumer

Response:

I am rejecting this response because: Actually, I am accepting the response with the exception that we have ALREADY paid the May fees. It was required BEFORE the membership was terminated. Please be sure not to charge our account on May 1. If you do, I will respond through the Revdex.com again. thanks, [redacted]

Review: Fitness Evolution (FE) took over the gym that I belonged to and then refused to allow me to change my family membership status while charging me extra monthly dues for several months. FE purchased Modesto Court Room in December 2014. I was planning to drop the other four members of my family from the gym membership to reduce my monthly bill from $75/month to $20/month for a single rate since my family members were not using the gym. I attempted to do this three times in the month of December and was told they were not allowing membership changes due to the corporate change. I attempted to do this twice in January and was told the computers weren't prepared to make changes. Later in January they told me they could do it, but when they reviewed my account they said that since my wife and two of my kids were over 18 that they had to physically come into the gym and request to be removed. This is a completely unfair business practice as I am the account holder and was able to add them to the account. Last week my two adult children stopped by the gym and were told they could not drop because my bill wasn't paid for February yet (even though I have auto bill pay and have never been told my bills are paid late) and that they would be charged for the entire month of February and March since they needed to give a 30-day notice. They subsequently told me that I had to send a certified letter for them to accept the account change, even though I was physically present and offered to write a letter. In addition to all of this, the gym under new management frequently does not have towels, wipes to clean the equipment and the pool was closed for health reasons. So here's my conclusion:This company does not care about it's current paying customers but will advertise extensively to attract new customers. They would not allow me to make changes, but they charge me for not providing a notice. There are plenty of well managed gyms available, they do not deserve anyone's business.Desired Settlement: Fitness Evolution should cancel my family membership effective immediately and refund me prorated dues back to December when I first attempted to change my membership and put them on notice. I have used the gym since then, so I do not expect a refund for my $20 per month membership. I also expect Fitness Evolution to refund any surplus funds in my account. I had a surplus of approximately $30 in my account when the corporate ownership was changed but they can't locate it on the system.

Business

Review: I never signed up for fitness evolution. I was a [redacted]s gym member but opted not to join fitness evolution when they bought this [redacted]s branch.

I was a happy [redacted]s customer and chose the [redacted]s franchise for their multiple locations and great childcare services. When this Willow Glen location close I was saddened to los the great gym. I chose not to sign up with the Fitness Evolution because they didn't provide the same service as [redacted]s..

Months later I find a letter stating that my family owes 300 bucks for unpaid fees.

I never signed anything with Fitness Evolution or used the facilities as Fitness Evolution.

Trying to stop this bill from going to collections.Desired Settlement: I was never a fitness evolution customer and feel that this bill is not valid. Fitness evolution does not offer the same service as the previous Ballys and I choose not to enroll with this gym. I never frequented Fitness Evolution and would like my balance zeroed as I never was a member.

Fitness Evolution took over [redacted]s in April along with all of their members. Your account was transferred over as an active account. We did attempt to contact you in regards to a past due balance in July via email but did not hear back and also via pone but the number that was provided to us was disconnected. We are unable to remove the charges on the account as they are valid. If you terminated the membership with [redacted]s we would need the termination confirmation letter you received, so we may review it.

Business

Response:

Members that did not want to become fitness Evolution members either terminated their membership or requested to be transferred to a different [redacted]s location. You may contact the corporate office for [redacted]s at ###-###-#### to request proof of either termination confirmation letter or the transfer request. Without either the balance is valid as this is the information we received with [redacted]s stating you were an active member.

I am rejecting this response because: Proof of the debt is required by the debt collector. Please provide proof that this is my debt. I am requesting that you provide validation of this debt. If you do not comply with this request, I will immediately file a complaint with the Federal Trade Commission and the California Attorney General’s office. Civil and criminal claims will be pursued. Review: Gym membership problems. I can never cancel with this company they always make an excuse. Making me pay for my membership when I want to quit.

I have been trying to cancel my gym membership for at least six months. I have been with this gym since it was "Gold's Gym". I thought after Gold's Gym went out of business so would my contract. I was wrong.

Every time I enter the store they always give me the run around. They say "I need my manager here". The manager is never there when I visit the gym. I call them, they say they aren't sure when their manager will be present and will give me some lame excuse saying "My manager is booked with appointments" or "She is in a corporate meeting all day." They tell me they need the manager there in order to cancel my contract.

I will write them a letter regarding my thirty day notice of cancellation. If that doesn't solve this issue and they continue to give me poor customer service. I am taking legal action and planning on suing the company. I lost to much money when it comes to this company. They keep charging me random fees and I don't know how to get out of it. I tried to cancel with them but they won't give me an answer. It is a never ending cycle and the employees there are very unprofessional and rude.Desired Settlement: I just want them to treat me as a human being and hear what I have to say. I want them to cancel my gym membership without a headache. I don't have time to go to the gym and be told the manager isn't there. I have a life and things to do. I would appreciate it if they would just cancel my gym membership and stop charging my debit card. Fitness Evolution is causing over withdraws and fees from my bank. Please help me with this issue. Thank you and have a blessed day.

Response:

We apologize for any inconvenience to Mr. [redacted]. Our records show that your membership is currently pending cancel and will terminate January 31, 2014 per the December 19, 2013 request date.

Review: Cancelled my membership on March 2nd at the Brentwood location. Assistant Manager [redacted] took care of it and stated I could use the facility for the rest of the month but would no longer be charged. Got charged again in the month of April. Spoke to several individuals who continue to tell me that Corporate must deal with the refund and they will contact me via phone or email. Still have received any communication from them and all communications with employees has not gotten any results. It has already been 2 weeks and I am afraid they are going to continue to charge me.Desired Settlement: Just refund my $29.00 and stop charging me any further.

Business

Response:

I do not show we received a request in March to terminate the membership. Please provide either the tracking number of the certified letter or the confirmation email you received for review. At this time the membership is terminated and no further charges will be going onto your membership account.

Response:

On 4/20/15 I filed a complaint with the Revdex.com against Fitness Evolution because they wouldn't cancel my account and they continued to charge me even ater I was told it was cancelled. The Complaint ID [redacted]. The business responded they would no longer be charging my account the $29.00 a month and I was fine with that and I said the complaint was resolved. In checking my account for this month instead of charging me $29.00 I got charged $15.00. I wanted my whole account closed that was the point of my complaint. I suspect they are still charging me possibly for my husband who was on my account. My whole account was supposed to be cancelled. I won't resolve this complaint this time until I get confirmation that EVERYTHING is cancelled and I get my $15.00 refund. You said I would no longer get charged and I was partially charged. This business is shady and will do anything to get over on you.

Business

Response:

Never in initial response did the member mention her husband’s account. Her account was not charged again after April of 2015. I attached transaction history for her account. If she provides husband’s information, we can locate her account and look into transactions for refund.

Review: I went to their Lodi facility in Jan 2015 and stopped in February. My intention was to go for 2 mos for aerobic conditioning as I was scheduled for back surgery in the near future. I paid a $10 fee and showed my bank check so they enter info so they could automatically deduct the $14.99 each month. I told the trainer in February that I could no longer come due to doctor's order. I checked my bank account in March and saw no charge, therefore believed that they cancelled my membership. TWO MONTHS LATER, On June 1, 2015, I received an email from "[redacted]" in the collections department, saying they had tried to contact me several times because they did not have the correct bank information for payment. I said, "you have my email and my physical address, and I'm just now hearing from you?" Further email and telephone communications took place. I provided her with a letter from my spinal surgeon, and she said that she would submit it to corporate and get back to me. TWO MONTHS later, I emailed her on Aug 2nd, and she did not respond. On Aug 25, I contacted [redacted] in "corporate" and she asked for a copy of the surgeon's letter. On Aug 26, she confirmed that she received the letter and would get back to me. On September 10, I emailed her to ask why she has not contacted me. She has not responded. In the meantime, they have sent my account to a 3rd party "[redacted]" for collection, who has added cancellation fees, late fees and interest! It's now over $315. I believe this is extremely poor customer service, no responses from employees or corporate, and poor communication from the beginning. They say they called me, but when they couldn't reach me, they waited two months to email me. I am on Social Security. They cannot attach my wages. They can sue me, and I am happy to show a judge all of my documentation of their lack of communication, no communication and extremely poor customer service.Desired Settlement: I am happy to pay for the two months that I attended the facility.I will not pay for the additional months that were impossible for me to attend due to major back surgery, nor will I pay for late fees, cancellation fees, and INTEREST!! They're not a bank. This is not an interest bearing account, and frankly I don't have that kind of money. And, their 3rd party collection service is harassing with phone calls daily.I am too old for this kind of treatment.

Response:

In order to make any changes to the account a member needs to sign a request which we do not have a request on file for your membership. What we are able to do is accept a settlement payment of $117.00 to settle and close the account. To make a payment we can be reached at [redacted] or by visiting your local facility.

Consumer

Response:

I am rejecting this response because: it is excessive. For the same reasons that I filed this claim, the unnecessary stress it has put on me,and because of any possible misunderstanding on my part, which I am still unaware of...I am willing to pay $75.00, which is 5 months of service from them, for which I used only 6 weeks. I honestly believed I left the facility on good terms, and was shocked to hear from them 4 months later! Again, this is poor customer service. If the company agrees to this, I will go to the Lodi facility and sign the document they need signed and pay the$75.00.

Business

Response:

Member received correspondence to phone number on file regarding past due balance. As of now, Fitness Evolution will offer $81.86 as a settlement offer (65% of the balance with the return charges deducted). To dispute that amount any further, doctor's note must be submitted as previous employees are no longer with the company.

Review: I was enticed to come here because for $20 they offer full gym membership with unlimited tanning. However, it was far from my house and I didn't even last the month. I started my membership in May and canceled it with [redacted] before the end of may. I filled out the paperwork and left. I received a few phone calls towards the end of June saying my account was past due. I told them that I already went in to cancel and they said they would look at it. Well it is now September and I decided I wanted to rejoin. I went online and singed up for the $20 membership, PAID, and brought in all my paperwork. When I arrived I waited FIFTEEN minutes at the front for someone to help me while I could see [redacted] standing in the child area talking to another employee even after making eye contact with me several times. When he finally came back he pulled out his phone and was texting while I was talking to him, answered a call, and helped someone behind me all while I'm trying to sign up. Then he tells me I owe a RIDICULOUS amount on my previous account and they could apply the $20 I paid today to the balance but to work out I would have to get it caught up. They said they had NO RECORD of me calling or signing my cancellation and unfortunately since I didn't print my emailed copy of request there is nothing they can do about it. I told him it's not my fault someone didn't do their job and from these Yelp! reviews, I'm obviously not the only one affected with poor employee skills. The manager [redacted] finally came and said he would put in a "request" to refund my new membership (which their system shouldn't have let me sign up for in the first place) and that he will cancel it. I am still waiting to hear back from corporate for my refund. This place is a joke and the employees are so rude and could seriously careless and act like us customers are the biggest inconvenience we have ever seen. They told me event thought I canceled my MONTH TO MONTH membership I would have to pay a fee even though I canceled it before my first month was over( which whoever I worked with never charged me anything and had me electronically sign the cancellation). This is a scam your month to month cost almost $200 to get out and automatically renews. I have reported them to Revdex.com.Desired Settlement: I would like any charges that I supposedly have to be cleared and my refund for the membership I purchased online that they WON'T LET ME USE!

Business

Response:

We do not have a record of cancellation for the initial membership. The new membership that the member joined online has already been terminated. The Member does owe a total of $84.97 for monthly charges. Fitness Evolution can apply $20.99 towards the previous balance and waive $25 in fees once new billing is provided by the member. I've attached a transaction history showing the member only paid initial start up, and no last month was paid for dues due to account being frozen.

Review: cancel my subscription with [redacted]'s who I signed up and with Fitness Evolution and months later collection is calling and corporate won't call me back

Back I 2014 I signed up with [redacted]'s I got really sick so I had to cancel, I did all the proper steps and was later told I had been transferred to Fitness Evolution so I emailed and they told me I had to go in so I did and the customer service guy said it was done and cancelled. Now more than 6-8 months later they are saying it was never cancelled because I only paid half of what I owed when I cancelled!!! WHAT! WHY would I make the time to go cancel and go in and pay not to pay the full amount!!!!! I am nearly hearing of this and its now in collections!!!! Why didn't they contact me after like two or three months of so called not paying!!!! This is awful they are ruining my credit and corporate won't return my calls! they scam people because all they have at "corporate" is a recorder!!!Desired Settlement: I want them to clear my collection issue!!!

Business

Response:

Per the notes on the member's account, member was aware that the full balance must be paid in order to fully process the cancellation. Only a partial payment was made. The member was contacted in September and October regarding the open balance. We did not hear back from member.

Response:

I CANCELLED my membership over a year ago due to health issues. A year later I get a call from collection saying I owe?? For the first time today Fitness Evolution a manager called to say if I want to pay it or they will continue to charge me daily. He did not have any solution to my problem as I had went in specifically to cancel my membership and was told by the representative then it was canceled. I find out now barely that it was not canceled because I did not paid in full. Why would I have not paid it in full if I tried so hard to cancel it I emailed I mailed a certified letter I called and ended up having to go personally. That is when I went in and thought I had paid it all fully. As that is with the representative told me that it was paid fully. To their favor that person no longer works there because I specifically went back to make sure that. He own up to his mistake and make sure that my account was paid for. So now because of that employees responsibility I have fitness evolution charging me still and I have collections ruining her credit I have not even established . I can't even get a call back from corporate office I have been calling numerous times left several messages and no one can call me back besides today the call from a manager who says he can't do anything. I feel like this isn't a responsibility of the representative who said it was paid off and now it's falling on my hands which is totally unfair I tried so hard to cancel this even though I was severely sick at the time I had mailed something I had called I even went personally and even though I was so ill. It is so unfair that now they have been running a credit I have not established and no one from corporate can't seem to call me back it is unfair that I must pay for something I have not used and because an error on their behalf. I would like them to just charge me for the remaining balance that they so say not for days I did not attend and especially when I have specifically went in there to cancel it!!

Review: Personal training contract was cancelled on December 19 2015 per contract of 30 days notice of cancellation, last payment of $280 was to be collected on January 20th. Was billed for services that were cancelled on February 23 2016 in the amount of $280, causing checking account to overdraft and resulting in $35 fee. Because bank stopped payment I was billed $299.99 on March 3 2016, called and spoke to the manager of the location, and walked in, front desk submitted refund paperwork for $299.99 and $35 overdraft fee that was incurred. No refund has been received, I have called and left several messages for location and manager and corporate office and have not received a return call, or any other form of communication from the company.Desired Settlement: I would like the $299.99 that should not have been billed due to services being cancelled December 19 2015, and the $35 overdraft fee reimbursed due to being billed for cancelled services.

Business

Response:

We do not show a record of proper cancellation on file for personal training. Our notes do indicate an inquiry from the member on 12/18 about cancellation procedure. However, as a courtesy, we can refund $565 which includes the amounts from 1/20, 2/20 and the $5 return charge. I have attached a refund form.

Please sign and send back with ID and we will issue the refund.

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me. Attached is the requested refund form and copy of Drivers license. That has been required by Fitness Evolution.

Review: I went in to the local Lodi location of Fitness evolution on May 4th 2015 to cancel my membership. The lady at the front desk stated I could cancel my membership but I had to pay 14.99 each for myself and my finace to cancel. I advised her that my card was on file and if she had to take out one more months service when it was due that they could do so but I was not going to pay in cash that day for the lasts months service and then have my card still electronically debited again for the last months dues. She then stated that I could not cancel my membership and refused to do so. I asked for the corporate office number and she gave me a flyer and I left. As I looked at the flyer 30 min later I realized they do not have a number and you must email them. I called the Lodi location back again and spoke with [redacted] the manager, which in turn said I would have to again come back in and pay the last months fee in order to cancel my membership. I then emailed the corporate office that day and again on the 12th of May and still no response. This is totatlly unacceptable and I would consider it fraud to keep taking our money when I have tried to cancel twice within a 2 weektime frame.Desired Settlement: Refund of our last months dues and our membership totally cancelled. [redacted] & [redacted]

Business

Response:

Both of the accounts have been terminated making the last month due is for May. There will not be a refund issued.
