Review: Fitness Evolution created 3 separate accounts & then proceeded to charge me for 3 separate times each month. No refund after 6 months & many requests. I joined Fitness Evolution in September of 2014. 3 separate accounts were created and they charged me for 3 memberships. They closed the 2 extra accounts in December and promised a refund. 6 months later, no refund and no communication. I have called the corporate office and my local club and been told they are looking in to it. 6 months is more than enough time to figure this out. I call the club they say call corporate, I call corporate, no one answers the phone and when I leave messages, no one calls back. I want my $237.92 in extra, non-authorized charges refunded. It is that simple. From local clubWe have a member my name here that has been awaiting a response from our corporate team in regards to his refund request. He has made many attempts to contact our customer support team. In his last attempt he spoke with corporate representatives name here who informed him they are still reviewing his request and will follow up shortly. What is the status update on this? There are no notes on his account regarding any new information on his refund.Below is the service request form submitted earlier this year explain his membership situation. Please advise the member, he is copied on this e-mail. Review: I have have applied to this gym in for one month to try and get back in shape. I was told that I could cancel membership whenever wanted and there would be no extra charge. Now they are telling me that I needed to have given them a 30 day notice. Now I have to pay this month (120) plus next month (120) and I was not told that. Also, that is not the amount that I agreed on paying. Unfortunately my girlfriend was put in this mess so now in order to "cancel" my girlfriend and I would need to pay ($450) together give or take.Desired Settlement: I would like to not be charged (my girlfriend and I). I think it is unfair they want to charge me something that I am no longer using. Especially if it was not explained correctly. We already paid for the month that we assisted

Business

Response:

HI

Regarding the account under Luis Beltran, his march payment returned resulting in a balance on his account of 89.99. In order to cancel, an account must be in good standing. Same thing happened for his girlfriend's account. She has a balance of $77.99, that must be paid in order to cancel the account.

Per all membership and PT agreements, a 30 day notice to cancel is required, making a payment for anything owed within the next 30 days due, as well as any current or past due balances.

As a courtesy, we are willing to waive the last month's dues and take payment for current past due amount to cancel. However, we are unable to waive any fees as members both have agreements on file for group training.

Review: I have tried to deal with Fitness Evolution in my own. They refuse to give a copy of my contract. They have a personal training section that is separate. Both ends of the business have taken money out of my account for other people...and now in my bank statements it shows they still take money out of my account and I can not afford these mistakes.Desired Settlement: To be refunded. I tried to make deals with manager's to resolve these issues..but they always end up quitting and explaining to me the amount of issues they must deal with.

Business

Response:

This complaint is regarding the personal training company Professional Fitness. Fitness Evolution does not have access to her agreement with them. I have attached a transaction history for the member's club services. She was a paid in full membership with month to month childcare. Once her CC was cancelled, September was her last month.

Consumer

Response:

I am rejecting this response because: if I paid in full......then why does it show transaction sbeing taken out of my account??? I paid in full in the beginning with [redacted]. so why does it say debited transactions? also, if you do a partnership with who ever it is in your business shouldn't you try to figure out the problems because I have written to you several times and you have done nothing about your partnership. I have no problem going to litigation with this. I demand better customer service because I myself am a business owner and you guys have the most rudest people at your front desk . I almost got into a confrontation with Isis, whom you will see someone who did a transaction on my account. I demand this to be fixed.

Business

Response:

Hi,The transaction history I attached to the initial response shows only the child care that was charged each month. You can see the transactions only go up to September, with no other childcare charges after that. The health club membership was paid in full and therefore there were no monthly charges from Fitness Evolution, except for the childcare, which stopped in September. Are you showing childcare charges after that date? I don't have access to your personal training contract, so I am unable to know what you had set up with them.

Review: I would like to file a complaint against Fitness Evolution in Carmichael, CA. I purchased 12 training sessions on May 13, 2015 for 600 dollars. The contract states that I have a 5 day right to cancel. I cancelled the very next day when I asked for fitness/meal plan and they trainer told me, "we will figure it out". I signed the cancellation form on May 14, 2015 and was told that I should get my money back in few days. I followed up with the fitness manager and was only given a customer support number and an email. I called and email several times and nobody ever responded. I called the manager again and was just told "I am sorry". It has been 15 days and hasn't gotten my money back. This place is unorganized. This place is clearly for money and not for customer service.Desired Settlement: I would like to get my money back as soon as possible.

A refund in the amount $600 was issued on 6/9/15.

Review: My wife passed away last year, and I decided I nedded to get in shape, so I learned about Evolution Fitness and went to give it a try. When I went, I told them I wanted to check it out BUT DID NOT WANT TO JOIN, so they offered a trial session, I thought for free. I did go, but decided it was not for me and left with out giving any more of my information. This was last Nov 2013. Aprox 2 weeks ago, I received a Collections notice for the registration fee of $39.00, I was shocked to get it, and had not received any notice or attempt to contact me from the health club since 2013. I called the health club 3 different times to try and resolve this matter, and spoke with the manager [redacted], who told me the issue was out of their hands, since I apparently filled out a information page and INITIALLED it, I did not sign it, which in my mind is not signing up for their program. I was given a web site to file a comment/complaint which I have done so, but as of today, have received no responseDesired Settlement: I would like to have my supposedly registration fee of $39.00 refunded, along with the $2.00 Collections fee. And to get a written apology from Evolution fitness.

Review: I cancelled my membership to the [redacted] facility on February 25th. At the time I was informed I still owed one month’s membership for March. I paid it. In March 5th I was charged $9.95 for April, which I did not owe. I called the local gym and they confirmed I did not owe it. They gave me a phone number (([redacted]) and email address ([redacted]) to contact their customer service department to request a refund. I called and left two messages and sent an email. I have not received a response, and there’s no other live person I can speak to about this.Desired Settlement: I would like for Fitness Evolution to refund me the $9.95 they took from my checking account, for which I do not owe.

Business

Response:

We apologize, but there was a system error, and a refund is due to the member. Please find attached a refund form. The account was terminated as of 3/31/16

Review: SO unfortunately my new wife and I signed up for the fitness evolution in fair oaks for the 9.99 which came out to 20.00 every month probably around November or December .. around February we saw a charge what they call their annual charge which for me and my wife 27.00 each we except but then that following month we were charged another payment of 28.00 each and another 28.00 the next month by no we have been overdraft at our account more then once we decide we were no longer happy with the membership that we decide to cancel it...we have to pay 3 over draft payment... In march we went in to get a cancellation for both me and my wife and was told we had to pay 20.00 to cancel both membership... April roll around and we got charger 28.00 each when are membership is only 9.99.. I went over to the gym to talk about what was going on and I was told that on their end our balance was at 00 dollars but at corporate we had a remain balance once again I paid a over draft fee and was told I would get a cancellation statement in my email and I have received the email only to find out that I now owe 118.00.... Please helpDesired Settlement: I want either a refund of the money they keep take or a completely free cancellation for me and my wife affected immediately... I've paid the cancellation fee of 20.00.... I shouldnt be getting billed anymore I don't have the money to just keep giving them money....

Review: After canceling my personal training contract due to the trainer being inappropriate and sexually harassing me, and the company being unable to provide a female trainer after 2 months. They have charged debit transactions for different amounts to my bank account without my permission. I have tried asking the local office for the corporate number so that I can file a complaint myself and they have refused.Desired Settlement: I would like a full refund of all expenses paid to Fitness Evolution for the personal training sessions I never received and for the wrongful amounts billed to my account.

I am rejecting this response because:Corporate has only returned one of my calls. They told me they have to verify my claims with the general manager that I spoke to at the time of canceling the personal training contract. They have since not returned any of my calls, or explained what these supposed costs are for. They continue to try and bill my account 3 times since I filed this complaint. Once for $480 and twice for $580. I've had to since close my bank account and this continues to cause stress and financial difficulties in my life. I want everything cancelled and all of the money I spent on the personal training sessions refunded since I never received a single legit training session.

Review: I received a collections letter stating I owe $260.10, never received a bill or statement prior. They wont send me any information

I received a collections letter on 4/30 from Fit U gym. My account number is 429817, and my service reps name was Annika H. I signed up for the gym on 8/10/2012 with what I was informed was a month to month agreement. I never once received an email or statement from the company, not even as much as a flyer for the entire 7 months until the collections letter. After only using the gym a few times in the first month and not getting a bill or statement, I forgot about the whole thing due to having my first born child. If I had been informed this matter would have been taken care of immediately. When I contacted the company about this matter they said I had to contact their corporate office via email. I have been back and forth with the company about getting a copy of my signed contract, or copies of any of the statements or emails they said they sent, and nothing was provided. They just told me it was all in the contract that I signed and am liable for all charges and to contact the collections agency, when I did they could not provide me with any information either concerning my account. I feel that these charges are unjust, and I am not the first to have this problem. I am very disappointed in how Fit U conducts business and treats their customers. They can just charge my account without a statement, and let this amount of debt accrue over the past months without notice. I just want this issue resolved. Thank youDesired Settlement: I want the balance to be expunged, and to be taken off my credit report. I also want this contract terminated immediately.

Business' Initial Response

We apologize for the inconvenience to Mr. [redacted]. Unfortunately, we have no record of Mr. [redacted] ever requesting to terminate his membership. The membership continued to bill per the signed membership agreement; we sent multiple statements via email and USPS with no response. After several months with no response Mr. [redacted] membership was sent to collections per the membership agreement. Mr. [redacted] has been provided with his membership agreement for review at time of signing and when Mr. [redacted] contacted our corporate office which states all of the termination and billing policies.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

Because I never received any of that? My only point I was trying to make was I received nothing from this company since I signed up. I know I paid the first month, why wasnt I even given a receipt? this is so redundant its offensive. They have sent that same response to every email I have sent their company. They will not give me the courtesy of a phone call, Maybe those statements you sent me got lost in the mail along with my termination letter? sounds about right doesnt it. they claim they sent me statements and emails but cant supply me with any proof? is that even legal?

Business' Final Response

Unfortunately, our previous response stands. We tried to contact Mr.McLemore for several months using the contact information he provided at joining with no response or payment.

Review: My boyfriend and I have had a Fitness Evolution membership for a year. I went to cancel our memberships over the phone and was told that you have to send a certified letter stating that or meet with the manager. I asked to meet with manager and they only allowed so many appointments daily so I would not be able to meet with them for several days. I decided to send a certified letter. I followed up with a phone call to the manager to make sure that the letter and cancellation were processed because I had friends who had problems with this. When I talked to the manager named [redacted] I was informed that I still had to pay for another 30 days because that is there policy so they would still be taking it out of my bank account. The fine line in these contracts are not pointed out or made known to the consumer. They will sign you up and take your money over the phone but trying to stop it is a nightmare. I called my bank to stop anymore payments from being removed and now I am getting calls from [redacted] at fitness evolution to collect. This business should make consumers aware of what they are getting into when you join. I have met their obligations and am now being harassed by them.Desired Settlement: DesiredSettlementID: No further contact by the busi

I would like Fitness Evolution to quit calling me about this situation. They are also calling me for my boyfriend because we signed up together and they were billing from my account. So I would also like them to quit calling me about Scot Wallace also. We met our obligation and want to be left alone.

Business

Response:

In order for us to cancel a member's account, the account must be current and in good standing. Since the member stopped payment on her final monthly payment, we were unable to process fully her cancellation. Her account at this time remains open, since we still show a balance due.

Consumer

Response:

I am rejecting this response because: I paid my last months dues and by sending a certified letter to the business as requested, saying I was cancelling does not obligate me to another full months dues at a place I will not be using. This business sneaks in that last part without you knowing until its to late. I have fully met my obligation and would like them to go rip off other people. Every person I have ever mentioned this gym to has experienced this and worse.

Review: Fitness evolution are very deceptive in their advertisement of no contract for membership & that you only pay month to month and you can cancel anytime.I went with a friend who wanted to join and I would be a guest on his membership. My friend didn't have all his info. so the rep. said "let me just take your info. since you are going to be a guest we need it anyway and we will put the membership in his name when he comes back with his banking info." My friend paid for the initial fee. The rep. stated that they only needed my debit card on file to start the membership and it would never be charged. My friend came back in with his info.and they set him up with a new membership instead of putting him as the primary person on the account already established like originally discussed. They debited my card $228.92 overdrawing my bank account. I went to fitness evolution and asked for it to be immediately closed I couldn't afford it, didn't want it I was deceived. The manager said he couldn't close it due to a new balance owed and I needed to make arrangements and he would lower the amount so I can close it & prevent it from going on my credit so I agreed and initialed on the computer screen. But after researching I discover they can't legally refuse to close it. This bill continues to accumulate. I never used the gym not even once and I'm still being billed. I will never be a customer due to deception for the reason my bank info.was needed & the second deception that I could not close the account with a balance & I had to initial to lower the payments in order to get the membership closed. I spoke to [redacted], [redacted] and they did not attempt to resolve this issue. I called headquarters and they never called back. I'm requesting a refund so I can get my bank account out of the negative. The bank has reversed the provisional credit originally given based on agreements Fitness evolution provided them with my initials.I would have never initialed if I knew this was another lie to force me into membership.Desired Settlement: I would like for Fitness Evolution to zero out the currant balance, close the membership immediately and refund the $228.92 back to my bank in order to settle the overdraft that was caused.

Business

Response:

The membership is under your name with your billing information on file. As of today we have not received a termination request and the account is currently active. I do show there are notes stating one of our representatives called and left a message on 5/5/15. At this time there will not be a refund issued. We have also received a notice to dispute the charge on the account from your bank.

Consumer

Response:

I am rejecting this response because: Fitness evolution obtained a sale of membership by using deception. After my request to have the membership closed it is still open. As noted in my prior statement they refuse to close the account when I went to the gym to have it closed and now another bill is being accumulated. Through their own admission it is still open forcing me to stay in membership as I stated before. I want a refund based on deception and the account closed!!!

Review: My wife and I have belonged to this gym for about 20 years, with no issues of any kind, including billing, conduct or otherwise. We have added one of our sons, as well. On Dec 15, a trainer terminated my wife's membership. This was abrupt--no warning, no discussion--they were unresponsive to questions, and rude. We are seeking reinstatement or reimbursement.We have received no written notification or any other follow up concerning the termination.We have received no acknowledgment of our letters or online communications. Here are details:Amazingly, after being customers for 20 years at this facility, starting with Family Fitness, then through transitions to [redacted] and now to Fitness Evolution, a trainer walked up to my wife and said they were terminating her membership.Why? This was not explained fully. My wife's sister is a bodybuilder (at another gym). A member of Fitness Evolution asked [redacted] about training, and she said she gets tips from her sister. She showed a card, which has her sister's picture, and the other member asked for the card. She complied.Apparently the member gave the card to a trainer, who then said he was terminating my wife's membership. When we asked why, he said "it is in the contract". When she asked to see the clause, she was refused. We do not have a Fitness Evolution contract, as we confirmed the extension of our Bally membership by phone. We signed up in Fall of 2013 and confirmed by phone. In retrospect, we understand that this could be interpreted as soliciting business but this was never my wife's intent. It was not even her card. She was quite shocked, in fact. This whole incident could have just been discussed.But there was no discussion. No warning. Even though there has have no prior incidents or issues with my wife over the past 20 years upon which to base such treatment. The trainer, and assistant manager, were impolite, uncooperative, and dismissive. They refused to show the contract, discuss the issue, offer a warning, or even provide the name of the facility or regional manager when directly asked. We are incredulous at this treatment.At best this was a simple misunderstanding that was very poorly handled by staff showing absolutely no interest in trying to resolve the issue, or even to be professional or polite. Looking at Yelp shows a pattern of billing issues, customer service complaints and Revdex.com complaints over the past few months since Fitness Evolution acquired [redacted].Desired Settlement: Refund Reinstatement of my wife's membership, or refund of unused portion of memberships for my three family members totaling $321 based upon the following:10/21/2013 My wife member #[redacted] paid $239 for 2-year membership: $100 remaining10/23/2013 Son member #[redacted] (Bally's number) $215 2-year membership: $90 remaining11/28/2014 Me member #[redacted]3 paid $143 for 1-year membership: $131 remaining}

Business

Response:

This member was caught on several occasions free lancing promoting personal training in the facility. The member was first warned advising her this was not allowed at the facility. Several days later she continued to pass out business cards at this time the member was advised that her membership was terminated. We are hereby terminating your membership effective immediately. Per section 18 of the membership agreement you signed you are in violation of the gyms rules and regulations regarding undesirable behavior. With that said it also states in the same section of your contract if we terminate your contract due to what we deem at our sole discretion to be undesirable behavior you will not be entitled to a refund of any portion of initiation fees or dues paid to the date of termination. In addition, since you are no longer a member of Fitness Evolution, you are no longer allowed on the premises. If you are found to be on the premises, we will consider this to be trespassing and the authorities will be contacted. In regards to the other family memberships they are still active. We do not issue any refunds on paid in full memberships.

Consumer

Response:

I am rejecting this response because the company chose to fabricate false accusations to cover up a misunderstanding poorly handled by staff rather than to try to resolve or remedy with us."This member was caught on several occasions free lancing" FALSE. What could they be talking about? This member will discusses her personal routine, if asked, and works out with freinds. Everyone we know discusses their workout routine at the gym. But this is not freelancing. "The member was first warned advising her this was not allowed at the facility. " FALSE. There has never been any discussion or warning with this member on this issue.Another member asked her about trainers--her sister is a trainer and she took out the card to show the picture. The other member asked for the card and she complied. There was no intent to solicit by the member. In retrospect she should not have given over the card but this is a simple misunderstanding that could have been cleared up with a quick discussion."We are hereby terminating your membership effective immediately". NO DOCUMENTATION. This is the first notification of the termination. It took a Revdex.com complaint to get this? We never received any response to our email to them, submitted on their website customer comment form. We received nothing else but verbal termination, lack of cooperation, and rude treatmentIn fact, they do not have signed contracts for any of our three family members"In addition, since you are no longer a member of Fitness Evolution, you are no longer allowed on the premises. If you are found to be on the premises, we will consider this to be trespassing and the authorities will be contacted" OUTRAGEOUS. Look how they treat an member of 20 years. Are they threatening to call the police on a 108-pound, 50-year old woman? Really? Hear how mean and nasty this company is in handling this issue! They have made absolutely no effort to reconcile or even seek understanding on this issue, and seem unconcerned about satisfaction for three long-term, previously satisfied customers. Instead of an apology, they threaten. We are amazed that they would respond with the falsehoods above. Also interesting that their website does not have clear contact information for customer satisfaction or even headquarters oversight. We think this clearly shows a deficient service orientation and believe that the Revdex.com can serve as a way to warn and protect other Californians about the way this company operates.

Review: I joined the gym back in 2012 when the gym was Fit-U, my understanding is the gym has changed owners several times. The girl who signed me up in 2012 didn't put my apartment number when she took down our address. She also never ask for my email. She did not go over or print out our gym membership, but asked for an electronic signature. We never received a contract in any form from the company. Their website say month-to-month, no contracts. In January 2014 after Target card issues, my bank sent me a new debit card. My gym payments were auto-deducted from this card, I didn't notice right away that it wasn't being deducted. I wasn't going to the gym much, so in April when I noticed my payment wasn't deducted, I figured, I haven't heard from them, and I have a month to month contract, I'm not paying. So I stopped going. In late July I got a call from a collection agency stating that I owed the gym $195. This was the first time I had heard from the gym about ANY issue. I never once received a call, letter, or email from them. After the collection agency called I spoke to [redacted]. I explain I had not been there for several months and I was very upset no one had contacted me to address this before reporting me to a collection agency. [redacted] told me they DID attempt to contact me by email. He then looked at my contact information and noticed I had no email on file. [redacted] in customer support told me I had signed a contract and that they followed their procedures in attempting to contact me by email. She told me I attended the gym in February and March. This just made me MORE upset that I walked into their establishment, but no one ever address my balance due. I offered to pay for Feb- April but they would not agree and never apologize or took responsibility for their lack of customer service in every possible way. I paid the amount to avoid collections, but I still do not believe I should have to pay the whole amount since they never even tried to contact me at all.Desired Settlement: I am requesting a refund for the 3 months I did not attend the gym as well as the 2nd annual fee that I was charged for incorrectly. My annual fee was included in my monthly payment every month, yet I was asked by [redacted] to pay it again. The total refund I am requesting is $104.85.I requested to speak to a supervisor and asked for the owner's mailing address to send a letter in writing, but I have never heard back from the company.

Business

Response:

We understand Ms. [redacted] frustrations. Unfortunately, we did attempt to contact Ms. [redacted] at the contact information she provided at time of joining in 2012. Ms. [redacted] signed on the agreement that all information provided was correct. The agreement was signed for as a 12 month agreement that would auto renew as a month to month agreement. All month to month agreement will bill until a termination request is submitted per the agreement.

Review: I received a promotion in the mail from Fitness Evolution which offered a no contract membership for 9.95 Per/month. Also, if brought in proof of cancelling my pervious gym membership, they would waive all fees all enrollment fees. this seemed like a good deal, so I cancelled my gym membership and joined Fitness Evolution. Two months after I joined, I noticed a 40.00 charge on my card. The charge was not identified as Fitness Evolution on my bank statement, but I had a feeling that it was initiated by them. I called them to confirm if they had indeed charged my card. They explained that this charge is called a "Rate guarantee charge". Basically, they charge you forty extra dollars to not raise your rate for one year. I never agreed to this charge, and it was not disclosed to me when I signed up at the gym.Desired Settlement: Full refund.

Stop this deceptive practice

Business

Response:

We apologize for any confusion that may have been caused. As outlined on the member's agreement, the Rate Guarantee is a non-refundable $39 annual fee. See attached documentation explicitly outlining this fee and the timing of the charge. I have escalated this concern to upper management for the member's home club to ensure staff is explicitly outlining the Rate Guarantee Fee at the time of new members joining.

Consumer

Response:

I am rejecting this response because:According to CA law, an offer is: " A promise that is, by its terms, conditional upon an act, forbearance, or return promise being given in exchange for the promise or its performance. It is a demonstration of willingness to enter into a bargain, made so that another party is justified in understanding that his or her assent to the bargain is invited and will conclude it. Furthermore, NEW conditions may not be imposed on the offer after it has been accepted by the performance of its terms"I was sent an offer in the mail that specifically promised a 9.95 monthly rate and that there would be "zero" fees at sign-up if the offeree canceled their current gym membership. I called the gym to confirm said details of the offer sent. The customer service associate whom I spoke with confirmed my specific inquiries regarding the the zero fee offer. Based on the offer sent and information provided by the gym associate. I accepted the offer. Two months later I was charged a"rate lock" FEE to have the privilege to keep the rate that I was initially offered. The "rate lock" FEE, intentionally ambiguous, represents a change in condition from the initial offer. Additionally, the offer failed to display membership prices and fees “clearly and

conspicuously,” as mandated by state law. I will peruse a full refund of the fee to the fullest extent allowable by Law; Including a pending inquiry with the [redacted] (Public Inquiry Case[redacted]

Review: Fitness evolution uses false advertising. They tell you there is no hidden fees, there are no cancelation fees, and you can cancel at anytime but in reality u can't cancel at anytime it's when they are ok with you canceling also they want a certified letter of why you want to cancelDesired Settlement: All I want is my membership cancels an I want them to stop taking money from my bank and over drafting my bank

Business

Response:

Mr. [redacted],I have attached a partial copy of your signed agreement which outlines the cancellation policy and other fees that will be charged as part of your membership. Review: Unauthorized charges on my account, not allowing me to "cancel" my account until I pay off the monthly occuring debt charges.

Last November I started up a month to month membership at "Fit-U" gym in stockton Ca. The representative had me print my name, address, and phone number and a half sheet of paper to register, and she rubbed my credit card with a carbon paper. She then told me I would get a id tag when the gym has more in stock. I went to the gym for a few months and then stopped going.

last night, december 21 I went to the gym to start up my membership again. The represtative told me that I could not renew until I paid off my charge. I then inquired if I could cancel my membership, she no I would have to call an 800 number to cancel. I called the 800 number and the representative "mrs Finch" told me that I would have to pay off a fee of over 1,000$ and then cancel with the gym.

I am very upset and frustrated for several reasons:

1. when I signed up with the gym, in november 2012 the representative did not inform me of the calcelation policy nor did she provide me with paperwork stating that I would be charged every month until I came into the gym and canceled.

2. the gym representative at the stockton gym was not truthful with me re: how to cancel my membership. she stated that I had to call 1-800-270-9685 to cancel my membershipDesired Settlement: reverse the debt that has occured on this account

We apologize for any inconvenience to Ms. [redacted]. Unfortunately, our records show that we attempted to contact Ms. [redacted] via mailed monthly statement to the address provided at signing with no response or payment. Please be advised that Ms. [redacted] was provided with her signed membership agreement via email at time of signing to the email provided which is also the email address used above for this complaint. The membership agreement clearly states the proper policies and procedures for termination. To date we have yet to receive any request to terminate per Ms [redacted]s signed membership agreement.

Review: I contacted Fitness Evolution regarding putting a freeze or hold on my membership due to my family emergency. I had to leave out of town for a month.

I have tried numberous attempts to speak with a manager or supervisor to resolve my memebership putting it on hold or freezing for 30 days due to my family emergency. Left several messages and then was told need to email company direclty which I did and never had my issue resolved. I also tried to contact the district office in Modesto with no success. I have alwasys paid my dues on time and want this colleciton removed from my credit report.

Desired Settlement: I have paid my dues in full and cancelled my membership however I do not feel that I should be penalized on my credit report for the companies imcompatence of how they dealt with my emergency.

The gym allows members to put a hold on their membership for a short periord of time however if I tried on my end to make contact and was never contacted I feel they are abiding by the memebership contract.

I want the collection from [redacted] PARKWAY, [redacted] XXXXX REMOVED ASAP.

Initial Business Response

Good afternoon Ms. [redacted],

We understand your frustration. Unfortunately, we have no record of receiving a certified letter requesting to freeze or terminate your membership. Our records show that the facility was in contact with you regarding your past due balance in November, 2012. We also have record of you visiting the facility in January, 2013 wanting to terminate but refusing to pay the past due balance later that same day you contacted the corporate office by phone raising your voice and using foul language toward both our corporate office representative and the facility manager still refusing to pay your past due balance. Per your signed membership agreement the full past due balance and collection balance is valid and will not be removed. Please refer to your signed membership agreement for full termination and collections policies and procedures.

Review: Signed up for a monthly no commitment membership for $9.99 a month. Was unable to cancel and they continue to charge my account.

I signed up and was told that I could make the payments at the gym and it wouldn't come out of my bank account. I noticed my bank was being charged so I went to the gym to see what was the issue. They said no matter what it was going to be coming out of my bank account each month and when they told me this I let them know just to cancel my membership because I didn't want it connected to my bank account. They said I would have to setup an appointment that would be a few weeks away and still have to pay for the next month.

Their advertizement clearly states it is no commitment and you can stop anytime you want. I felt misinformed and they refused to resolve the problem or even refund me because it was "Impossible".

I have only gone to the gym one time and have been charged for three months of use.

I tried speaking to the owner and was directed instead to the website. I left feedback on the website and requested to be contacted and never received any emails back.Desired Settlement: I would like them to refund me for the months I did not use their service and have my account closed with their business.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

When you sign up they are clearly misleading in the way they explain their membership. On top of this it is completely obvious they are intentionally making it more complicated to cancel at any time.

When I was signed up it was done on a small touch screen. Not something easily readable so it's easy to be misled by the gym when they are explaining the membership and fail to mention how complicated cancellation is. It's strikingly obvious this is a shady business practice to take advantage of a consumer and make more money.

Final Business Response

I do apologize for any confusion however the cancellation procedure is clearly outlined. I can assure you that we are not misleading you or trying to take advantage of you. This is our policy regarding cancellation and it applies to all members. If you wish to cancel please follow the terms of your agreement and your membership will be cancelled. Thank you

Review: They NEVER stopped charging my credit card after closing my account which was NO Contract, Month to Month base! They had kept billing my credit card, member services claims/cancellation couldn't stop it even after cancelling my Month to Month, No Contract membership. I've talked to different managers multiple times, they never gave me the corporate Gold's number and insists the charges would stay. I was stuck in this endless cycle, and finally blocked them from my credit card after almost a year of charge!!!Now, after two years I see a report of $168 debt on my credit report!!!Please help, seems like its a scam! when you search them online many complains like mine would pop out.Desired Settlement: They need to return a year of charge to my credit card back to me plus remove the debt on my credit report.

Response:

The member signed up 1/2013. Our notes from 2/2013 reflect correspondence between corporate and member. Member had called saying he had cancelled membership. Our corporate office let him know that no cancellation had been received. There was no further contact until 8/2013. In order to receive a refund, the member will need to provide us with proof of cancellation. If the member does not have proof of cancellation, a settlement amount would be $38.85 (3 months of dues at $12.95, all return fees waived)

Review: I was a member of Fitness Evolution which apparently has been brought by Crunch Gym. My last day at as a member of Fitness Evolution was November 12, 2014. I sent an email to [redacted] who was the manager to let him know that based on my work schedule I could not longer attend and do my personal training. He sent me an email acknowledging my last payment had been received. I have not had a single membership payment of $10 a month or personal training fees come out of my account since than. On April 25th I checked my account and my checking account was debited $159 from Crunch Gym. I have not stepped foot inside of the gym since November of 2014 and as far and I was concerned my membership was canceled. I have called several times to speak with the manager and emailed and have not had any feedback. Thank youDesired Settlement: I would like to have my checking account refunded the $159 that was taken out on April 24, 2015.
