Fitness Evolution Reviews (1353)

Review: I recently decided to join the gym and was told that if I paid for the year I would receive a discount. So I decided to pay for the year. Just recently, I found out that due to personal and work related issues, I need to relocate to Chicago, il and Fitness Evolution do not have gym in the Illinois area. I reached out to [redacted] at the Natomas location and she stated, I needed to have proof that I was relocating. I in return went into the location on April 5th and spoke with the manager [redacted] & [redacted] and provided them with the proof of my relocation as of the first of June 2016. I was told by [redacted], she would send over the my information to the corp office and they would cancel my membership and process a refund for the balance of my membership and to call her first thing on April 6th and she will tell me how long it will take for the refund and also how they will be sending it back either via mail or placing a credit on my credit card which is the card I made the payment with.

Today April 7th, I called and she now says, per corporate I can not be given a refund. I said what? that is not what you told me before and it is out of my control that I have to relocate and I want my money back. She said, I needed to call corporate and deal with them.Desired Settlement: I am looking for a refund of the remaining amount of money since I will only have the membership from March to May. I paid in full on Feb 29th, which means, I have only used the gym during this time and will use it thru March only. My purchase was $199.00 and I am looking for a refund of the remaining 9 months of a refund.

Response:

Hi [redacted],Can you please provide us with proof of a new lease or utility set up per agreement. The membership agreement requires written evidence of relocation. I'm not sure if that would be available yet as the move will not be until 6/1. Once we receive this we can prorate and get the refund processed.

Consumer

Response:

I am rejecting this response because: I provided a receipt of me paying my security deposit for the apartment and was told that was all I need at this point. I took that information in and it was submitted to corporate and per [redacted] corp told her. that I could not receive a refund. I would not be paying for a security deposit to move into a unit if I am not moving there. I believe this is enough information for you all to see, I do not have to make this up. This is ridiculous that someone would have to go thru all of this to get a refund for a yearly payment and obviously this was not something I knew back when I signed up for the gym. As, I stated before... due to personal and business reasons, I am moving back to Chicago. I am from Chicago and not California. Please review the information given and let me know when I can expect a refund of my payment. I already have my bank involved with this as well, as it unfair you have to deal with a company that want to keep a customers money when they clearly will NOT be able to use the service. thank you

Business

Response:

We apologize for the confusion and we appreciate you forwarding that information to us. As it is understood, you will be relocating out of the area on 6/1/16. Review: I was a member of [redacted], When Fitness Evolution took over I was told I could maintain my $19/mo and cont to use the facility. I agreed and since have been charged the same monthly fees. I noticed in mid-March that since Nov 28, 2014 I have been charged an additional $29.99/mo, meaning that each month since Nov, I have been charged my regular, agreed upon $19/mo and an additional $29.99/mo that I never agreed to. When I brought this up to the staff, they pulled up my account and did not see the $29.99/mo on my account. I showed them a copy of my [redacted] statement that clearly states each month on the 27th, $29.99 charges from 'Fitness Evolution So 1st 209-527-3041.' I have given a copy of my statement to 2 staff members and was told that I would receive a CREDIT for the $179.94. while I enjoy working out at this gym and the staff, I felt this was a disrespectful resolution to such a gross error. I have been wrongfully charged 2 times a month for 6 months. Since March I have spoken with the manager Jay on multiple occasions, he told me in April that I would be receiving a refund to my [redacted] card. I have yet to receive that, nor did anyone reached out to me to acknowledge the mistake or follow up with the issue. I emailed corporate, got no response, I have spoke with Dominique, the collection specialist multiple times, I sent a copy of the charges on my acct and did not received any correspondence informing me of what will be done to rectify the bill until I called them multiple times. I was then told to once again provide more personal info to the company to further research the issue, I sent them full credit card bills, asked them to please maintain communication as I felt I was being disregarded. I did not hear from anyone for weeks, I left 3 voicemails and mult emails w dominique. she finally responded after I mentioned the Revdex.com, she said she passed it on to member services & would contact them to see what is happening & then let me know. That was 4 days ago, still no refundDesired Settlement: I would like a refund of the amount that was removed from my account without my knowledge or my consent, $ 179.94

Business

Response:

We are not showing any record of additional charges outside of the $19/month. Please provide us with a copy of your statement showing the overcharges so we can investigate further. Please email the statement directly to [redacted]

Consumer

Response:

I am rejecting this response because: I have already given my credit card statements to 3 different employees within the company, you can contact [redacted] and speak with her regarding what she was able to resolve. At this time [redacted] will not return my emails or phone calls. She has full credit card statements of mine and has not been capable of communicating with me. Thusfar your company has not proven to be trustworthy or responsible with my financial information, please work with your coworkers and resolve this.

Business

Response:

Hi, I understand your frustration. [redacted] is no longer with our company, but we did find your statement. The only problem is that it shows only the last four numbers and in order to find out what the charges are exactly for, we need the complete number. Can you please either email or call [redacted] and give her the complete number so we can get this resolved for you. The email is [redacted]

Consumer

Response:

I am rejecting this response because: I have tried multiple time to reach someone via the number provided, no one answers the line and there is no option to leave a message. I am now awaiting a response via the email provided. Nothing has been resolved as of yet and no one has reached out to me.

Review: I have tried and tried to get in contact with them about canceling my membership as I have moved out of state. They require an in person consultation/meeting with their manager to do this. And have continued to charge me for a service I am not using. I do not see why I must pay for air fair to cancel a gym membership. The membership was placed on suspension for the period of time for my vacation to determine if I was moving and I have indeed moved to Minnesota. They haven't returned my requests(they being corporate) and the Hammer Lane branch refuses to cancel my account. I've been charged for the month of August and I fear I'll be charged for the month of September as well when it comes time. I will not be flying(400$) to cancel a membership(9.99$). This is outrageous and unprofessional.Desired Settlement: I want my membership cancelled and the August 16th charge and bank return of payment fee paid for. The cost for the membership is 9.99$ The cost for the bank fee is 27.50$I shouldn't have to pay for these as I have requested multiple times to have my membership cancelled to no avail.

Business

Response:

Hello,The member does not need to come into the club to cancel. The member can always send a certified letter, as per theoriginal signed agreement. The $9.99 charge is valid, however if the membersubmits a certified letter postdated by 9/15, we can waive 30 day notice requirement. Thank you.

Consumer

Response:

I am rejecting this response because: the membership fee charged my account and put it in overdraft. Had they replied to me in a timely manner I would have gladly sent the letter and transferred funds to avoid the overdraft. The lengthy reply time and what clearly took a Revdex.com review to even get communication from them has lead to a 27.50 overdraft charge. This in my opinion is still unacceptable. I should not have to file with Revdex.com to get any communication. It's unacceptable that I have to go through Revdex.com to get you guys to even communicate with me. And we know it's to save your reputation.

Business

Response:

Hello,I have attached the member's agreement that outlines the policy for cancellation. All charges are valid per the agreement. As stated previously, we will waive the 30 day notice if we receive a cancellation letter. We will extend the deadline to September 10. Thank you.

Review: Unable to cancel gym membership over months of trying to reach out to start cancellation process.

For weeks I have been trying to "Fitness Evolution" gyms in my area to get info on how to cancel my membership. I would dial all numbers provided and all I got was a voicemail machine. After countless messages left, I tried again to call and cancel, and someone answered. I was told that I needed to write a letter of intent to cancel and that it would take 30 days. I had no problem with that, however, two charges could have been avoided if the calls would have been returned. Due to my jobs I am unable to show up at the gym to inquire for any information. During the hours of operation for the gym, I am at work. This is the reason why I wanted to cancel in the first place. I WOULD NOT RECOMMEND THIS GYM AT ALL. THEIR BILLING PROCESS AND CANCELLATION IS A NIGHTMARE! BAD BUSINESS ETHIC, AND CUSTOMER SERVICE IS WORSE. THEY HAVE NO NEED FOR A PHONE LINE, CLEARLY, SINCE THEY NEVER ANSWER THEIR PHONE. All this bad business could have been avoided if someone could have answered the phone. I am requesting that the two previous charges be reversed. Since cancellation process procedure is not made available after joining, through phone or on their website.Desired Settlement: I am requesting that my charges be reversed for the passed two months, since that is how long I have been trying to get a hold of the gym.

Business

Response:

We have not received a proper request to terminate the membership. What I'm able to do is terminate the membership moving forward but there will not be a refund issued.

Review: Fitness Evolution was previously [redacted] where my partner and I established gym memberships in April 2014.On 1/16/15 I noticed a 'pending transaction' stated on my bank account for $152 listed under the name "Fitness Evolution Modesto".The following is a copy of the email I sent on 1/19/15 to Fitness Evolution's corporate office:"To whom this may concern-This is my third attempt at resolving this matter. On Friday, 1/16/15 I noticed a "Pending" charge on my online bank statement for $152 from Fitness Evolution (the contract that I signed was for $20 per month, for two memberships at a total of $40 to be debited from my account). I immediately called your Gilroy, CA location (where my membership is based) and spoke with [redacted] at 7:10am. She apologized, stated that the manager was not yet in and took my contact information- she said a manager would call me back. I heard from no one all of Friday, Saturday or Sunday. On Monday morning I called back at 7am and spoke with [redacted] ([redacted] was not there, nor a manager) and, again, explained that now my account was no longer "Pending" $152 but charged the full amount. It has now been several hours later and still no one has called me back, even to say that they are looking into resolving this matter- NOTHING!If I do not hear anything back from someone regarding the refund of this money that has been STOLEN from my account, I will pursue this further as theft by contacting my bank and the authorities.$152 is a significant amount difference from $20. As a matter of fact there should be no reason that a total like that could be made access to you unless there is some sort of illegal access being made to your clients accounts. As I mentioned previously, if I do not hear from someone with authority to make this right by 3pm today (Tuesday, January 20, 2015) I will take this to the fullest extent I possibly can."It is now almost a week later and have been getting the run around regarding my missing money."

Product_Or_Service: Gym memberships

Account_Number: $20 per month, for 2Desired Settlement: DesiredSettlementID: Refund

I want $132 refunded to me IMMEDIATELY and the 2 memberships that I currently have with Fitness Evolution to be cancelled, with no cancellation fee or retaliatory issue. I have not yet decided if I will further pursue this as theft (by accessing my account fraudulently and removing money that was never authorized)- that is something that can be discussed, if need be.

Business

Response:

We recently acquired this location and the accounts were transferred "as is" in their system to ours. It shows the there has been a balance of $132 running through the account since the initial sign up. If this amount was paid we need confirmation so we may issue a refund.

Consumer

Response:

I am rejecting this response because:Every month the dues are automatically withdrawn from my [redacted] account- two payments per month of $20 each for our memberships under the names of [redacted] and [redacted]. Their argument makes no sense. This is absolutely ridiculous. It seems that now they are coming up with this bizarre story of "past due" or "outstanding balance"... If this is the case, why hasn't a word of this been spoken to me when I've been calling multiple times per day for the past week??Thank goodness for electronic banking- I have every posted payment since last year that I can easily supply, if needed. This is so absolutely insane- as a matter of fact I will be contacting the several other people who have been overcharged (I know of 4 people, so far) and see what we can do legally as a class action lawsuit.

Business

Response:

Attached is the account ledger that was sent to us during the conversion reflecting the charges and payment to the account.

Consumer

Response:

To the thieves at Fitness Evolution:I have attached a copy of my original gym membership contract for your viewing pleasure. Clearly there is no outstanding balance or lack of payment. I signed up to pay the stated amount and have been auto-deducted each and every month since then.I now await your ridiculous counter-argument as to how I owe your organization anything and as to why you would STEAL from my personal bank account any money other than the $20 per month (which was the only authorization I consented to). This is a complete joke and a waste of my time, my patience and my sanity. I am not a wealthy person and the money you STOLEN from me is placing me in a growing financial hardship. Your entire business is comprised of liars falsifying stories and excuses to cover gross error. You lack any customer service skill and what you have displayed is absolutely deplorable (I have yet to be contacted by anyone from corporate for any explanation, update... NOTHING!) This experience should not have escalated this far- someone from corporate should have returned my calls/emails the vary same day I alerted Fitness Evolution of the error (rather than getting second-hand information and excuses from gym staff with no knowledge of my situation or authority to rectify this matter) and made me whole again. I eagerly await to see what other excuse you can claim regarding charges or fees or anything else your company can create as your rebuttal. And now that I have been so inconvenienced and financially stressed with so much time having lapsed since my original complaint 21 days ago (plus the fact that your conjured up story has me severely worried about your business ethic and my personal information) I will most definitely be seeking legal counsel. If someone would like to speak to me from corporate, I'm sure something can be worked out that doesn't further waste either one of our time. Regards, [redacted]

Sorry for the delay on this account, we are still working the conversion. Attached is the refund acknowledgement form that needs to be signed by the member so I can process the refund. Review: Visited the Fitness Evolution in Carmichael and after brief walk thru tour agreed to join because it would be free to me thru my health insurance. At that time HIGH PRESSURE SALESPERSON insisted I take advantage of the ONE TIME ONLY OFFER OF 3 PERSONAL TRAINING SESSIONS FOR $99.00. Salesperson stated this is only offered at sign up and I could cancel without issue. Against my better judgement I paid the $99.00. A few days later decided to cancel the sessions. I had not been back to the club since sign up. Had not met with any sort of trainer did not set up any work out plan. I personally drove to this location and informed themI had changed my mind. A young man, [redacted] assured me this was not a problem and my account would be credited within 3-5 days. I have copy of form I signed to cancel - Again he said no problem. Credit would be issued. If I had questions or did not see credit posted, I was to call "[redacted]" at corporate. Two phone numbers given - both phone numbers have been disconnected. Called location today to speak with Mgr. I was told she was signing someone up and did not want to be rude to new client so could not talk to me. Said she is Mgmt and next highest level is corporate. I told her phone #'s were disconnected and she provided an email. I have attempted to email - meanwhile I have opened a dispute case with my credit card company.Desired Settlement: Request $99.00 credit back to my credit card as promised.

Business

Response:

Company can issue a refund for the $99. However, if dispute has already been submitted for charge, we will be unable to refund the money owed until that is cleared.

Consumer

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution would be satisfactory However, how can I go about getting this refund? I cannot find anyone at the location who has the ability to refund the $$. Is there someone I can speak with from Fitness Evolution?

Response:

hi [redacted].I have attached a refund form. If you can fill it out and sign and email or mail back we can get the refund processed as soon as received. The email address and address are at the bottom of the form.Thank you.

Review: I have been dealing with this company for several months now when I initially signed up I signed up for a three month contract with a specific personal female trainer which before we even got a chance to do our first training session she was apparently let go by the company at that time I asked if I can go ahead and opt out of my contract I was told I couldn't by the Manger pete and sofi but that I can put it on hold into another female trainer would be hired to their company at that time I got put out of work due to a work related injury so I asked if they can please put my contract on hold and at that time the Manger [redacted] told me that I didn't need to do that. personal training sessions would not expire whenever I'm ready that I can go ahead and use a female personal trainer. at this time I reminded them it was only a three month contract and that I didn't want to extend my contract they said do not worry about it it automatically stops after three months which this in fact was a lie apparently I was supposed to stop it but I was misinformed so therefore they continue to take money not out of my account out of my husband's account which I never authorized them to do that I specifically had given my credit card number on the day that I signed up for the personal trainer and I specifically told them this will be deducted from my bank account not my husband's bank account they said no problem your credit card will be noted and put on file that also was a lie they proceeded to remove money from my husband's bank account for over 8 months when the contract specifically was only for 3 months when I try to resolve this matter I've been getting the run around with corporate office I've spoken with several different people in the corporate office [redacted] ,[redacted] they just stop responding back to my emails stop accepting my phone calls are very rude and very hostile when I did try to communicate with them they're very short and just put me off as yes will get ahold of you next next week.Desired Settlement: I would like a full refund of my personal training I never not once got to use the personal training I was lied to from the beginning that I be able to train with the specific female trainer that I wanted to I specifically gave my credit card which they took the initial payment and then there after they got into my husband's account which they never have permission to get into and remove the money from his account so I need all of that money back because they were never authorized to take money

History:

A charge of $432 on March 31st appeared on my [redacted] from [redacted]s during the sale of the health club to Fitness Evolution, and this charge appeared to be a duplicate of prior charges. I discussed this charge with [redacted]s fitness manager [redacted], and [redacted], my trainer in mid-April, 2014. [redacted] believed this was either a duplicate or a charge she attempted to stop on my credit card for personal training and was unsuccessful. On April 29th I disputed the charge through [redacted]. [redacted]s did not respond to the request from [redacted] . Per my email to [redacted] and [redacted] on May 27, and attached, I believed the issue had been resolved. [redacted] was satisfied with the resolution as well.

In June, the front desk of the fitness center stopped me and let me know I had a $432 balance past due. I discussed the issue fully with [redacted], the fitness manager, and [redacted] on June 17th as [redacted] was no longer employed by Fitness Evolution. Per my discussion with [redacted], [redacted] and I agreed that I would purchase 4 - 1 hour personal training sessions at $216 and we would call the issues closed. Frankly, I really wasn't concerned as I continue to go to the gym, and continue to burn down my training sessions so I agreed to the solution to make it go away. [redacted] responded - in writing - to his agreement of the situation.

A week or so after my agreement with [redacted], a collection agency called me and I suggested they call the management of the club to solve the issue. I left a message at the desk for [redacted] the day of the collection call, then I then spoke to [redacted] the next [redacted]e I was at the club, and he indicated he would go back to their systems and makes sure the issue was resolved. To my knowledge, the problem was solved.

On September 10 I received a letter from the collections agency showing past due of $216. On Sept 10 I met with [redacted] and [redacted] and [redacted] understood the problem and indicated he would solve the problem with [redacted]'s help as [redacted] has been involved in every discussion on the same.

At this point, I don't have confidence that Fitness Evolution has solved this problem. Please respond letting me know that your billing issue is resolved.

Thank you

[redacted]Desired Settlement: Removal of charge of $216 to my account, and correction to my credit report

Response:

Company request to remove member from collections was sent to collections agency 9/21 and $216 was already removed from account. Company considers this resolved.

Review: I cancel my membership with fitness evolution on October 2015. I notice that I was still being charge for membership dues even though I was no longer a member. I talked to a manager to get this situation solve on February 2016. The manager told me that he was going to cancel my membership again and that this would be the last time. He promised me that I was not going to get charge anymore and gave me a customer service to their HQ so that I could receive my money back. I been calling the company everyday and left several voicemail over the past few weeks. So far its been a month and I have not received a call from their customer service team. Today (March 2, 2016) I get charged again for monthly dues. I don't think its fair that Fitness evolution is charging me for services I am no longer using. I don't even have my membership pass because they took away from me when I first cancel my membership. I am requesting a refund of $140. I was charge $19.99 on November, $59.99 on December, $19.99 on January, $19.99 on February and $19.99 for March.Desired Settlement: I am requesting a refund of $140. I was charge $19.99 on November, $59.99 on December, $19.99 on January, $19.99 on February and $19.99 for March.

Response:

Hello. The member came into the club and froze the account in June of 2015 for 3 months per our records. Member then came in on 2/8 to cancel in the club. If the member can provide proof of cancellation from October of 2015, the company can issue a refund for the charges. If the member does not have proof of the October cancellation, the charges are valid. The member's agreement calls for a 30 day notice either in club or via certified letter for the cancellation of a membership.

Consumer

Response:

I am rejecting this response because: I personally went down to downtown San Jose location and cancel my membership. I was not given any paper about my cancellation but your employee made me sign the termination form in the computer. This confirmation should be in the records of that location. Employee told me that there was going to be final charge for November since they required a 30 day notice. Furthermore she told me that my membership would end November 17, 2015 and that I was welcome to use the facilities meanwhile. I told her that I no longer needed the services and gave my membership card to her. If you look through your records you can see that my membership card has not been use since. I have witness with me that went with me to cancel my membership. If your records don't show that I made a cancellation on October then there must be something wrong with your system and you should fix it so other individuals don't get over charger. I understand that sometimes there might be technical issues, but I should be held responsible for any problems that might had happen on your behave. If anything your downtown location should be held accountable for this mistake since I went there and talk to an employee to cancel. When I called back on February to cancel my membership AGAIN, your manager told me that I would not longer be charge since they messed up in canceling my membership in October. I do required refund because if you look through your records I have not use your facilities since my cancellation. I could also understand that maybe there was a human error and your employee did not summit my cancellation properly, but I do not feel your company has done enough effort to investigate what went wrong. I don't think anyone would be paying $20 for a membership that he/she would not use.I am still waiting on a call from one of your representatives.

Review: I want to cancel my membership in this club and I talked with the manager [redacted] this morning. The whole conversation was very frustrating and I am not happy with the following issues:1, When I singed contract in January, I joined premier membership(14.99/month) instead of regular membership (9.99/month) because they said they would offer classes to premier member. They did not offer any class until the middle of May,but they still charged me 14.99 for April and May. I was not offered with classes in the past two month, so I need them to refund my 10 bucks back.2, When I singed the contract, the sales person told me I need to mail them a letter 30 days in advance if I want to cancel my membership. I wrote them a letter in May 14th and I am sure they got it shortly since we are in the same zip code. I got no feedback from them after that and when I went there today, the manager told me they couldn't accept my cancellation since I didn't certify that letter in the post office. I have to send out the mail again in the "right" way and they will still charge me for another month since I missed the "cancellation deadline on 15th". I didn't know I have to "certify the cancellation letter" when I signed the contract and I don't want to pay another month because they ignored my letter for about 2 weeks.3, When I signed contract, the sales person told me I need to pay 39 dollars in May to keep my rate in the next year. Since I decided to cancel my membership, I simply don't need to keep my rate. But the manager won't refund me that money. According to her, this 39 dollars is with my membership and I have to pay that if I was still a member in May. But if what she said is correct, the 39 dollars is an annual membership fee other than "keeping-rate fee". So they lied in advertisement.Desired Settlement: DesiredSettlementID: Refund

I want them to refund me the following money:1, 10 dollars premier membership fee in April and May;2, 39-dollar so called "keeping-the-rate fee".I also want them to stop charge me from June 15th. I sent out my first cancellation letter before May 15th and I don't think it was my fault to create current situation.

Business

Response:

I do show we received the termination request and have made the proper adjustments so that there will not be any further charges on the account. There will not be a refund issued as the fee was to be billed in May any fees incurred to the account within the 30 day notice needed to be paid in order to complete the termination request.

Consumer

Response:

I went to their official website and found the pictures in the attachment. So this fee is clearly not claimed as an annual fee. The purpose of the fee is to guarantee members not to experience any price increase. It doesn't say I have to pay for that if I want to keep my membership. And this notice also leads people to think I do not need to pay that money if I don’t care about the price increase. In my case, I don’t want my membership anymore, why should I pay for that? When I signed the contract at their place, this term was already on the paper. The sales person told me the purpose of this fee was to keep the rate and they did not have an annual fee. If this is what have to pay as a member, the Club should change the so called “annual rate guarantee fee” to “annual membership fee”.

Review: I joined a class it was $99 monthly, so I joined signing a contract on may 5th and I was told I could pay before 15th.I went in to pay and sign contract. That was friday may 15th, I paid cash. Come Monday my bank account was charged $117 that made my account overdrafted and at negatives. I spoke to person in charge of class he said he'd fix it. And would waive next month fee, which was june. So yesterday my account was charged $216.99 I am beyond mad because it overdraft and put me at negatives again! I spoke to manager and she said she had to send out a request before any refund is made.

Review: Around Summer of 2014 I joined [redacted] Fitness for $9.99 a month. During the few months I was with [redacted], it was bought out by Fitness Evolution. Around June/ July I was moving back home to Sacramento where there were no Fitness Evolution branches, So I wanted to cancel my membership. I called them and was told I would have to make an appointment to speak with a manager about the situation. I received no further contact after about setting up an appointment and called back and told them that I had no time to wait around for an appointment and I needed to cancel my membership ASAP. They then put me on the phone with the manager who assured me that my membership was canceled, but I was never told by any member that I had to write a 30 day notice of cancellation until a year later, when I am now being contacted by collections to pay 400 dollars for a gym membership that wasn't active and supposedly canceled. They continued to take money from my account until my card information was compromised and the number changed. Now I am being slammed with calls from collections and the gym refuses to remove my name from collections and cancel the membership that was canceled a year agoDesired Settlement: I want my name removed from collections.

We will have the member’s old account removed from collections. The member's most recent account set up in May will remain active. Thank you

Review: Fitness Evolution overcharged my debit account without authorization.

I authorized Fitness Evolution to only take out $19.00 per month and an additional $10 for a locker fee. However, a few days ago after reviewing my bank statement I discovered Fitness Evolution debited my account for $68. I contacted the general manager [redacted] twice to ask why did they over charge my account? Her explanation is I'm charged a charge to keep my membership at the same price. I explained I did not authorize this charge and I don't appreciate being over charged. She also stated I could not get a refund of the amount of overage and that all members get this charge. I asked again to take it off and close my membership which she responded I would have to send in a certified letter to close my account. Needless to say I'm pissed.Desired Settlement: I want a refund of all fees taken out of my account for this month along with a closed account immediately!

Business

Response:

All of our fees are disclosed in the agreement including the annual fee of $39. There is no refund due as you had the payment returned to us by your bank. I do show you requested to terminate the membership on February 10th. In order to complete the request the account has to be in good financial standing, there is currently a balance due of $73.99. To make a payment I can be reached at [redacted]. If payment is not made the account will remain active. Attached is an account ledger and your agreement.

Review: 12/13/14 I joined this gym paying $9.99/month as agreed for my first month. I also agreed to pay $39 120 days after I joined for a "lock-in rate" fee. Fitness Evolution charged my credit card the $39 2 days after I joined. When I asked, the staff said I was billed in error. I contacted their "corporate office" and they agreed in an email that I was billed erroneously on 12/18/14. After several emails for 2 weeks, Fitness Evolution said they would process my refund but it would take another 60 days. I have since paid $6.49 to send a termination letter via certified mail as I do not wish to belong to this gym. I have not heard anything from them since 12/26/14. There is no reason it would take 75 days to refund my $39 when it took 2 days for them to steal it from me. I have serious doubts this company will return my money. There is no name on the emails and no phone number to talk to anyone. It takes them several days to respond to my email. I'm afraid that they said they'll take another 60 days to refund my money because they are hoping I will forget and go away. There is no reason in today's age that they can't refund me $39. If they can't credit my credit card, then they should give me a check. This company did not have permission to take the additional $39 and I consider it theft.

At the very least, this company owes me $39. However, I feel they should return all my money for having to deal with their screw up - $22.99 + $39 + $6.49 = $68.48. I've had to spend a lot of time chasing this company to get a response, including going to the gym to try to resolve this issue. In addition, I had to go to the post office in order to cancel my membership via certified mail - another time consuming task. I only worked out in this gym once - the day I

I have submitted a request for a refund for the annual fee of $39 as it was drafted early. There will not be a refund for the additional fees you are requesting.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

The reason I contacted you is because Fitness Evolution admitted their billing error to me 12/18/14 and then said they'd refund my $39 on 12/18/14. It's been over 6 weeks and I still have not received my refund. That's fantastic that it took them a week to respond to you saying they'd refund my money. My concern is how long will this take? I have a greivance with this company and I don't see how you are helping with situation. Who do I contact to file a complaint towards Fitness Evolution so they don't continue stealing from people?[redacted]

Business

Response:

I do apologize for the delay. There was an error in our system, attached is the proof that the payment has now been refunded to the credit card on file.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

I have a feeling they finally responded because I filed a complaint with the CA Atty General's office this morning after I got off the phone with Revdex.com. I then wrote an update to my yelp review Fitness Evolution letting them know I did this since Revdex.com couldn't force them to pay me back. I also informed them that on 3/2/15, I would file at small claims court where Fitness Evolution would have to reimburse the filing fees. I want this claim with Revdex.com to stay opened. There was no error. They simply hoped I would go away. I sent them many emails and not once was I told there was an error. When I receive my refund, I will let you know.Thank you,[redacted]

Review: During part of September and October I purchased personal training sessions through Fitness Evolution. I completed the sessions, and paid for them. Yesterday ( 12/4/14) I woke to find a charge for $210 dollars on my credit card from Fitness Evolution. I called the gym to let them know that I had been overcharged, and that I was no longer participating in training sessions. I was told that in order to stop the $210 monthly charges (on top of my membership fee) that I would have to send a formal request via certified mail to cease charging my card. I find it absurd that I can't simply end the recurring charge by speaking to a human being at the gym, and providing them with my ID. I was also told that the most recent charge is non refundable but that they would be happy to set me up with a new trainer so that I can utilize the 16 sessions that were purchased on my card unbeknownst to me. I contacted the corporate office by email. I still had an address from when I was having issues with a particular trainer trying to get money from me under the table. I didn't hear a response during the day so, I called and left a message. There is still no response today. I've called once again with no result. I am livid. I need a refund, I need the charges to stop, and I would like to cancel my membership without having to go through the post office.

Product_Or_Service: Personal training sessionsDesired Settlement: DesiredSettlementID: Refund

I would like to be refunded $210 as a purchase was made on my card without my knowledge or consent.

Business

Response:

[redacted]We are unable to issue a refund for any of the personal training charges as we did not receive notice that you wanted to end the month to month personal training reoccurring charges until December 4th 2014. In order to terminate any membership a member must either go in club and meet with the manager to sign a termination request or via certified mail. Per the letter we received the membership will be set to terminate December 31st 2014, the last payment will be drafted on December 20th 2014. If you have any further questions please let us know. Thank you

Review: Fitness Evolution is continuing to accrue a balance against me even though I cancelled my membership. I visited the club on May 27, 2014 and cancelled my membership. They collected an extra 30 days dues from me for my thirty day notice that day. However, they then later attempted to withdraw funds from my checking account. I visited the club again. They said I needed to send a letter to their corporate office. I wrote and mailed a letter to the address they provided. The letter was returned as undeliverable. I have a copy of this letter and the returned envelope. This company has made it impossible to cancel memberships. I have already visited the club twice and attempted to resolve this issue. Now they are saying that I owe them $135 and I am getting collection calls. I cancelled my membership in good faith and even paid an extra 30 days dues. I need assistance in resolving this issue.Desired Settlement: I would like them to correct their records and stop trying to collect money from them that I do not owe. I would like them to correctly cancel my membership once and for all.

Business

Response:

We understand your frustrations. Unfortunately, we do not have a signed termination request for your membership. Please provide a copy the signed termination request form filled out in club or the tracking number for the certified letter sent for our review. Moving forward, if you are unable to provide proof the balance needs to be paid to terminate the membership.

Review: I was billed 49.99 on 2/1/2016. The business's workers, in particular one named [redacted], I was told was her name. I am sure the business would know for sure who did the enrollment. I enrolled the end of December and I went to personally ask for information regarding the money that would be involved in enrolling . I was told I would be charged a one time only of 29.00 for joining and 9.99 monthly. I also asked if that was the only fee I would be charged, namely, the 29.00 and 9.99 monthly. She said that was all and I again asked if forever and ever the 29.00 plus 9.99 was all I would ever be charged no matter how many year I worked out there and if there were no hidden fees ever. Again, she said , no, just joining fee and the monthly as long I remained there. I asked for a contract and she said the business didnt give out any to customers. I wanted to make sure they were not lying to me by reading the contract. She assured me regarding no hidden fees. I always check my card statements so I found a charge of 49.99 on my charge card and I called employees and they said I should call on the phone to customer service which I did several times over several days and I have left messages and never get my phone calls returned and no one ever answeres the phone so I may talk to someone. The gym is on [redacted]. I would not have joined as I am on a fixed income and if financially stressing me out. Please, I hope you can help me resolve this.Desired Settlement: I would like a refund and not be a member if that is what the business requires. Thank you.

Hi,All of our month to month membership accounts have a $39 rate guarantee fee, which is in the agreement. A copy of the agreement was resent to the member to review after she spoke to our staff. The rate guarantee is a valid charge.

I am rejecting this response because:they are lying. The staff never told me I would get charged yearly. I was not sent anything. They should have showed me a copy of the contract at the time of signing up. They dont show it because they lie

Review: I cancelled the membership via certified mail and was charged excessive fees for doing so.

2nd Email addressed to Fitness Evolution

To whom it may concern:

I am writing in regards to the membership I cancelled in November. I attempted to cancel in early October with ** and was told that I could'nt cancel unless I made an appointment. Then I spoke to [redacted] who instructed me to send a certified letter which is on file to explain how all this has come to this point and I have my receipt of the certified letter. Per [redacted] the Manager at the Hammer Lane location I was obligated to pay the following months membership of $19.99 and $25.00 cancellation fee which was in the bank account for the month of December. Your gym decided that since I cancelled the membership they would take it upon themselves to attempt to debit my account for more than they were authorized to do so, which was an annual fee of $39.99 (Why would I be responsible for an annual fee for the following year for a membership that was cancelled?) Also, the contract stated that the fee would be debited 45 days from the date of the contract and it was actually attempted within 31 days of the contract . Now, I'm receiving a notice telling me that my account is not in good standing and that I owe $99.95 for cancelling and fees?? I'm sure your aware that this is against the law to make it impossible to cancel a gym membership and to extort excessive fees from the customer all because they do not want the services of your gym!! I have contacted [redacted] on several occasions (12/4 is the only date I notated) but several times after and she has not returned any of my calls. On 12/16/13 I Jason (mgr) from the Modesto location who obviously could not explain why I was responsible for a "annual charge" for a membership that I would not be using for the next year, all Jason could do was read the contract that he could barely understand or explain. I am seeking legal advice because this is obviously a scandal!!! Then to be told to send a second certified letter to cancel is just ridiculous. I need for someone to contact me ASAP in regards to this matter before I have to visit the Hammer Lane location. I was and still is willing to pay the $19.99 monthly membership along with the $25.00 cancellation but I refuse to pay a "annual" and return fee not to mention my bank charged me a fee as well but I'm sure your company is aware of that since this is something that your company is well known for doing. Again, I want nothing more than to resolve this matter immediately!! And did I fail to mention that the services that your company provides is poor, the only options is to contact the gym location for a manager who obviously does not want to deal with this type of issue or an email address to the corporate office, what kind of business are you people running and how long do you think you can get away with this before someone takes action? A corrupt company will not stand long........ Desired Settlement: All I am asking is to remove the annual fee along with the return item fee due to the fact that there were funds in the account to cover the $19.99 membership fee for the month of December and the $25.00 cancellation fee. I should not be required to pay an annual fee for future services for a membership that I will no longer have. I should not have to pay a return fee because Fitness Evolution was not authorized to debit my account in that amount. Had they debited the account for the correct amount they would have received pymt. Per [redacted] I was only subject to two fees which I was willing to pay.

Review: On 9-15-15 I signed up for 1 year of gym membership and paid $300.00 cash. At that time I was told the gym wasn't going to open for business for two more weeks or so. I went back the next day and cancelled my membership because I had to move to Carlsbad California(San Diego area). This was due to unexpected family emergency. I asked for a refund of the $300.00 and canceled the membership. The service gentleman Austin indicated only the corporate offices deal with cancelations and refunds. He indicated I would either receive a call or a letter from the corporate office. He wouldn't give me anything to sign. I gave him my new address in Carlsbad California. I waited but didn't get any calls nor mail form them. I called and asked to speak to a manager but service gentlemen Austin indicated there was no manger available so I gave him my number and requested the manger to call me back. I never received a call back. I have called them several times and there is never a manger available. I wrote them a letter requesting a refund but have not gotten a response.Desired Settlement: I would like a refund of the $300.00 I paid to them for the gym membership. I never used the gym. It wasn't open for business when I signed up, nor when I cancelled my membership the next day.

Business

Response:

The member was emailed a refund form from our office for his PIF amount. We are still awaiting receipt of the form from the member so we can issue the refund.

Review: The problem wit Fitness Evolution is that they don't want you to stop your membership with them, that shouldn't have been a problem because you don't sign any contract with them. They are advertising no contracts, no commitments, and if they don't honor their advertising is false advertising.

Start 03/2013 problem occurred on 07/2013

Please see attached letter of complaint and supporting documentation.Desired Settlement: I don't feel that I have to pay anything, because I asked to canceled and like the advertising said NO contracts. I did not have a contract with them. I am free to make my decision of not going anymore.

Business

Response:

Initial Business Response

Cancellation require a written 30 day notice. All payments due within the 30 day period must be paid for your membership to cancel. The term "no contract" is referring to a term. There is no term and you may cancel at any time with 30 days notice.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

I dont feel that the owner of this Fitness is training their employees right, because the person who sing me in, told me a different policy, he told me to let they know verbally a month before and that was all I needed to do, I did how I was told, in fact I spoke with [redacted] she give me a fake e-mail because she told me to e-mail the company an they will replay to me me they never did I also made an appointment with [redacted] the next monday and she never show up, second time I when I find another manager(knew) that she was not familiar with my case, so I said the same to her and she want me to pay over $60.. before I closed my membership, I said pls. this is ridicules I told the manager before like two months ago and I had not been in this Fitness for that long, and you want me to pay they never mention anything in written not the first time that I was there, or the second time, never said anything about written. third time go in there is another manager this time she made the effort to help me, but the regional manager told her no, she has to pay in it was already over $100.00 I told the manager the first time that the reason I come to this gym is because is no contracts my schedule vary a lot an is convenient, that was my reason, in is be coming to be my worst nights. I try to reach somebody an nobody listen, now I have to pay? Do You know the your team never give me the free months for singing my kids, like they said they will, they never give the free training the way the offer to me, or the T-shirts, I did not care that much, but it comes to respect peoples decisions, I do , every time that I went there it was a new manager so how serious this company is ? who you enforce your own policies when you change employees everyday and don't give them the proper training also not to mention different business names with it comes to draw money from your bank. Fitness Evolution is not respecting the customers rights, not even honoring their own policies. I am not agreed to paying anything because I did how I was told to do to cancel my membership from the beginning. I really hope you understand my frustration and help to to find a civil way to stop this nightmare. This Fitness Evolution has a poor reputation around the social medial and local , this Fitness Evolution was closed before for the same kind of problems, fake advertise, poor performance and poor equipment. I do not blame the personal that much, because they do what they are told, everything is in the owner of this franchise Fitness Evolution.

Final Business Response

We apologize for any inconvenience to Ms. [redacted]. Unfortunately, per all 3 members membership agreements the proper steps to terminate membership. To date we have still not received any certified request to terminate any of the 3 memberships deeming all charges valid. Ms. [redacted] was provided with all 3 membership agreements via email at time of signing. Once the proper steps are followed to terminate the 3 memberships they will be terminated. Ms. [redacted] please refer to the signed membership agreements for full details.
