On December 21, 2016, a recurring payment in the amount of $402.05 was set up, the confirmation number provided to you for this online transaction was [redacted].
Please be advised that a payment overage refund in the amount of $402.05 was sent to your address on January 30, 2017 via FedEx overnight, tracking number [redacted].

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my dispute.
Please enter your reason(s) for rejecting the business response below.I understand what they are responding as that is the same response I received when I contacted them on my own over the line prior to submitting my complaint. However, I am trying to let them know something is wrong because I did NOT authorized the 2nd payment. I authorized the payment that was scheduled on the 26th of Sept to be debited on Oct 16 (my due date). Their response dies not make sense because they are claiming I schedule the payment for the 16th on the 26th of Sept (which is accurate) and that on the 10th of Oct I requested a same day payment (which I did not). What they are claiming does not even match up with my bank statement . I have a debit on the 16th of Oct (which again is correct) and another one for the 20 of October . I do not have one for the 10 th because I never authorized one for another other date aside from the authorization on the 26th of Sept for the 16th of Oct .

concerns and would like to offer the following information. On April 15, 2013, you entered into a Retail Installment Sale Contract (“Contract”) with Pruitt Ford for the 2008 Ford Edge in the amount of $16,388.33 at an interest rate of 13.60%. Within the agreement, he agreed to repay the loan in 72 monthly installments in the amount of $334.19 per month, beginning May 15, 2013. On December 08, 2016, the decision was made to repossess the vehicle, as allowed by the contract. At this time the account was 67 days past due. Please be aware, numerous efforts were made to contact you regarding the status of his account. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws. Included for your review is a copy of the Contract and Account Payment History. As a courtesy, GM Financial waived half of those late fees, leaving you with a total of $710.91 in late fees on the account. These fees will need to be paid to be able to release the title.

Contract and Security Agreement (“Contract”) for a 2012 Chevrolet Traverse in the amount of $20,899.00 at an interest rate of 23.65%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $551.15 per month, beginning on March 26, 2015. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. If all payments are paid by the due date, the account will be paid in full on the contract maturity date.   Please note that GM Financial places a high priority on adhering to all state and federal laws. The state of Montana does not require a cure period or notice of repossession be mailed prior to repossession. On September 15, 2015, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 81 days past due for the fourth installment payment of this contract. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.  On September 18, 2015, you were quoted a reinstatement fee of $2,003.45. This amount included the past due installments of June 26, 2015, July 26, 2015 and August 26, 2015; as well as the cost of the repossession.  When you called in on September 22, 2015, your next installment payment was also included in the reinstatement fee, as this payment became due during the same week. The account must be paid current in order to reinstate the vehicle. Payment of reinstatement fees must be paid by certified funds like MoneyGram or Western Union Quick Collect. The reinstatement questionnaire is part of the reinstatement process and does not include an additional credit check as an application for credit would. You have indicated that you are disputing the inquiries as unauthorized; and as a result, GM Financial has requested that the appropriate credit reporting agencies remove the GM Financial inquiries from your credit report. In the event that the credit bureau reporting agencies are unable to delete the inquiries, we have asked that at a minimum that they convert the hard inquiries to a soft inquiries. Please be advised that it can take the credit reporting agencies four to six weeks to update your credit report.

and Credit Application were e-mailed timely each time and to each party as requested. This process did take longer than normal due to issues that occurred outside of GM Financial’s control, such as multiple parties applying to assume your lease and errors on the Assumption Lease Contract by the approved assumption party requiring correction and reissuance of the document. Please understand that you are responsible for keeping the account current during this process and for any payment billed prior to the completion of the assumption process. Our records further reflect the assumption process concluded on August 3, 2016, and you are no longer liable for future payments. As per your request, the account was set up on the ACH payment plan on June 21, 2016, to be effective beginning with your July 28, 2016 base rent payment. On July 28, 2016, a one-time payment was also submitted online via Western Union Speed Pay in the amount of $169.69. As you have been advised, in order to refund one of these payments, proof of cleared funds is required. Proof of cleared funds can be a bank statement reflecting both payments and a before and after balance, or a letter from your bank on bank letter head referencing that both payments have cleared as well as the dates cleared; this letter must also provide the name and contact information of the bank representative providing the information. Unfortunately, we are unable to honor your request to apply the funds toward your monthly installment due dates as insurance proceeds and warranty refunds will only be applied to the principal balance of the account.

I am rejecting this response because: Thank you for the resolution on the October 2015 payment. I am Rejecting this resolution because of the mark that will still exist for March 2017. I called GM Financial yesterday to further understand why the March payment was still being Marked as 30 days passed due. The explanation given to me was the Mark was for the February payment. The computer records show the payment coming in and then being reversed and then received on March 9th. While reviewing my bank statements the payment was taken out prior to march 9th and prior to 30days past due. I have provided my bank statement to GM Financial to show that the payment was taken prior to the marked date in your system. When making payments to GM Financial I use western union and not any automated bill pay from my bank. I emailed my bank statement to [redacted] yesterday. If needed I can provided my bank statement here.
