On November...

17, 2012, you signed a Retail Installment Sales Contract (“Contract”) for the purchase of a 2011 Dodge Grand Caravan in the amount of $18,890.06 at an interest rate of 18.00%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $433.89 per month, beginning on January 1, 2013. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. If all payments are paid by the due date, the account will be paid in full on the contract maturity date. Late fees are assessed according to the retail installment contract which states the following: If we do not receive your entire payment within 15 days after it is due, you will pay a late charge of 5% of the scheduled payment.
Review of your account reflects that after the $400.00 payment posted on May 18, 2017, a balance of $33.89 remained for your May installment. This amount was rebilled with your June 15, 2017 installment for a total payment of $467.78 along with your late fee balance of $352.44, totaling $820.22 due. Please understand there was no late fee assessed on your May 2017 installment and it will not be reported as past due with the credit reporting agencies as the amount was small enough to be rebilled when your June statement was sent on May 26, 2017.

Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
On April 3, 2012 you entered into a Retail Installment Sale Contract (“Contract”) with Gerry Lane Chevrolet for the 2012 Chevrolet Malibu. GM Financial employees were not present at Gerry Lane Chevrolet (“Dealer”) during the signing of the contract and GM Financial was not an original contracting party in any agreements between the two parties. The contract was subsequently assigned to GM Financial.
The “Notice of Right to Redeem or Reinstate” and the “Notice of Our Plan to Sell Property” were mailed to your address of record on September 8, 2015. These notices explained that you would be required to pay the difference between the amount you owed to GM Financial and the amount the vehicle sold for, plus expenses if you opted not to redeem/reinstate the vehicle. After the sale of the vehicle at auction, a “Deficiency Calculation” letter was mailed to your address of record on February 11, 2016 to inform you of the remaining balance owed.

We empathize with the problems you may have experienced with the vehicle; however, the responsibility for this contractual obligation remains. All mechanical issues would have needed to be resolved between yourself, Gerry Lane Chevrolet, and/or the manufacturer of the vehicle, if necessary.

This is GM FINANCIAL's way of avoiding the question of, I want a copy of a contract that bears my original signature or remove it from my credit report.

I am rejecting this response because: the 3 credit bureaus told me that if GM Financial removed there comments than the dispute will be resolved. Result of this not happening I have lost a mortgage loan because GM Financial couldn't simply remove there comments from the dispute and I have removed all the comments of the dispute with all three of my credit bureaus, but they couldn't do there part. I no know that they can't take care of there customers. Is just simply sad customer service.

What's been stated by GM Financial about the specifics of my lease agreement terms are not in dispute and is the same exact response I've received following numerous other calls, emails, etc. to the company...which directly avoids my point of contention. GM Financial showed a balance of $0.00 until we went to pay our April payment at which point it was then showing 2 months due. We immediately made payment at that time. GM Financial's failure to maintain and implement it's website, as other customers have complained about on this Revdex.com forum, was the direct cause of my payment being credited 2 days past the 30 day mark. What's most troubling after reaching out to the company numerous times regarding my frustrations, is their failure to acknowledge fault or take steps to correct this customer service error which is the actual violation of the Fair Credit Reporting Act. Hiding behind dates and not acknowledging a system that a customer has informed them was misleading, flies in the face of the fairness that the Act was intended to uphold. I'm asking GM Financial to consider the entirety of the circumstances surrounding this March/April payment when determining if a late payment was indeed made as they are required to do under the FCRA.Regards,

This is not fair, that is not what I was told when I called regarding my payment. I am so tired of complaining with your company and how I've been treated and been pushed around, I will pay, but what I want is to even it at 1500, remove me from my collection and I will have my account on auto pay, that is fair from everything I've been through with this company.

Please be advised that GM Financial places a high priority on adhering to all...

state and federal laws. The state of Maryland does require a Pre-Repossession notice to be sent prior to submitting the account for repossession. This notice was mailed to the address of record on May 10, 2017. The cure notice detailed the amount needed to cure and provided a cure date or date of last payment.
On July 4, 2017, GM Financial made the decision to place the account out for repossession due to the account being over 60 days past due and subsequently the vehicle was repossessed on July 11, 2017. A Notice of our Plan to Sell Property and Notice of Right to Redeem was mailed to you on July 12, 2017. This letter detailed the information and amount needed to reinstate the account. The letter also specifically states that any additional amounts coming due or expenses incurred that are not reflected on the notice, will be added to the total you must pay.
After a thorough review of the account it has been determined that the handling of the account including repossession was in compliance with all state and federal laws. Our records also reflect as of July 24, 2017, the reinstatement amount was paid and the vehicle is back in your possession.

entered into a Motor Vehicle Consumer Simple Interest Installment Sale Contract (“Contract”) for a 2012 Dodge Avenger in the amount of $17,075.80 at an interest rate of 17.50%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $387.41 per month, beginning June 7, 2012.
Our records reflect that on December 12, 2017, the vehicle was involuntarily repossessed as allowed by your contract. At this time the account was 118 days past due. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
Please note that the vehicle has not been sold and an auction date not yet been set. After the sale of the vehicle at auction, a “Deficiency Calculation” letter will be mailed to your address of record to inform you of the remaining balance owed.

I am rejecting this response because:I sent my bank account statement as requested over a week ago and was told I would receive a refund in 3-5 business days. I got a call the next day saying I needed to still fax it in. I told them that the fax machine was unresponsive for 6 tries so they had me email it, and they then said that they haven't checked the email where I sent it yet and that they would get back to me that afternoon with a update call. I never received a call back. I was originally told that my account was under refund review for 60-90 days, so this response is not news, nor is it a resolution.
