As previously explained, as outlined in the Lease agreement (See Page 2, under Other Terms and Conditions Return of the Vehicle), you will return the vehicle in clean condition. If you do not buy the vehicle from us under your purchase option, you agree to return the vehicle to us at a place we designate. When you return the vehicle, you must give us a completed, signed odometer disclosure statement. You agree to pay us any amounts you owe under the Lease and have not paid.
Please be advised, GM Financial does not provide you an Odometer Disclosure Statement. This document must be obtained from the dealership from which you turned the lease vehicle into. Please remit your odometer statement to GM Financials Remarketing department via email to [redacted] or you may fax the documents to fax number ###-###-####.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  I spoke to [redacted] at GM financial friday the 23rd and tried on several occassions with my banker [redacted] from [redacted] to fax my banking statements without success.  I faxed from another location my banking statements and they where received and proved that there was no reversed payment.  [redacted] advised me that [redacted] was able to credit my account to make it current.  I checked my account online today March 28th and saw that my account is paid up to date with my next payment of 309.24 due April 1st 2018.  I thanked [redacted] on her voice mail I was not able to speak to her for finally correcting their error on my account.

On August 13, 2013, you signed a Lease Agreement for a 2013 Chevrolet Malibu. Within the agreement, you agreed to a 39 month lease term with a monthly payment in the amount of $299.71 per month, due on the 12th day of each month. The lease maturity date of this contract is November 13, 2016.
Please note at the time of the lease turn in, your account was due for the October 14, 2016 base rent due date; however, as a customer courtesy GM Financial is honoring your request for a refund and waiving the remaining base rent in the amount of $299.71, leaving a remaining balance due of $90.74 for Excess Wear and Tear.
A refund in the amount of $299.71 was issued by GM Financial Invoice Number [redacted] and sent to your address of record today on October 31, 2016. Please allow 7 to 10 business days from the time the check was issued for it to be received.
Please be advised, as stated in your contract (See Page 2, under Other Terms and Conditions, section Standards for Wear and Use), you may be charged for excess wear and use at the end of the scheduled Lease term. The vehicle will not have road damage, chips, scratches, cracks or damage to the glass, body, bumpers, frame or interior.

On March 31, 2011, you entered...

into a Retail Installment Sale Contract (“Contract”) with Mercedes-Benz of Southbay for the 2007 Mercedes-Benz GL450 in the amount of $43,536.08 at an interest rate of 17.75%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $994.11 per month, beginning May 15, 2011. The contract is a simple interest contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of the contract. Explanation of interest accrual, application of payments, and how late or early payments change what must be paid is explained on the contract under the section titled “Finance Charge and Payments”. By signing the contract, you agreed to abide by these terms.
On April 27, 2017, the vehicle was repossessed as allowed by the contract. At this time the account was 70 days past due. Please note that on March 9, 2017, you requested that GM Financial cease phone calls to you regarding your account status. The state of California does not require a cure period or notice of repossession be mailed prior to repossession. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
Review of your account reflects that you agreed to reinstate the vehicle and the release form was sent to the repossession company, Coastline Recovery Services, on April 29, 2017. Please be aware that the repossession company is an independent contractor and is licensed and insured as such. If you feel that Coastline Recovery Services damaged the vehicle, please contact their office directly at [redacted].

In the event that the credit bureau reporting agencies are unable to delete the inquiries, we have asked that at a minimum they convert the hard inquiry to a soft inquiry. I am rejecting this response because:The Hampton city tax sheet for 2016 is not ledgable and the total listed isn't what I was charged from GM. I paid 473.and change. I'm in the Hampton city office now and they said I should've been charged 355.42. I can't accept this being resolved until I see something that is readable and identifies to my truck and not another. The one thing I can read are dollar totals and it doesn't match my charge from GM financial.

I am rejecting this response because Ms. [redacted] response completely ignored the fact that I forwarded copies of the original email threads to GM Financial President & CEO [redacted], Exec VP & HRO [redacted], VP & Executive CFO [redacted] reflecting the dates of my account and credit inquiries to [redacted] June 29, 2016 (7:05 am), July 9, 2016 (12:13 am), August 11, 2016 (9:08 pm), July 22, 2017 (1:38 am) of which the July 22, 2017 indicated an incoming payment of $1,200 for August 10, 2017.  [redacted] never responded to even of these emails.  I was told on August 7, 2017 when I called that he is now VP in another area at GM Financial and there was no note to the account and thereby I was told on August 7, 2017 (when the vehicle was seized prematurely), the account was put in repo status August 1, 2017.  This is not the first time [redacted] has not responded to emails from me.  I have provided prior date and threads  which [redacted] has not addressed either.  The vehicle has been delivered as of August 14, 2017.  It is obvious from the response I received from [redacted] August 8, 2017 that upon getting his new position he did not feel accountable to responding to my emails nor delegating anyone to respond to my inquiries.  Therefore, I was left unanswered although has been my direct contact since my 2014 Attorney General complaint.  How was I to know any different?  To date, GM Financial is not providing satisfactory response to any of the other concerns I addressed in my complaint beginning with1) Email was sent to [redacted] July 22, 2017 advising $1,200 would be sent to the account by August 10, 2017.  I was notified on August 7, 2010 that Mr. [redacted] did not document the account.  Therefore, the account went into repo status. Mr. [redacted] has been my direct account contact since my Attorney General complaint 2014.  There have been a few occasions where there were no responses to account nor credit inquiries on June 29, 2016 (7:05 am), July 9, 2016 (12:13 am), August 11, 2016 (9:08 pm), July 22, 2017 (1:38 am)Correction to my account and credit report and reimbursement for erroneous fees due to the account not being documented by [redacted] Violation of FCRA provisions(a) failing to correct inaccurate and derogatory information to credit reporting agencies(b) failing to follow up on credit reporting disputes(c) failing to refrain from continuing to submit information that you know to be inaccurate, and(d) providing results of the investigation of the dispute within five (5) business days after the investigation is completed;2) Violation of FDCPA of phone contact attempts by [redacted] after he was notified multiple email exchanges to communicate in writing as August 8, 2017 (12:47 pm);  [redacted] required phone contact as a requirement to secure the vehicle AFTER the reinstatement arrangement Monday, August 7, 2017 and payment August 10, 2017 which was emailed to him with copy of the insurance policy.  Mr. [redacted] willfully ignored multiple written requests to cease phone communications and conduct matters in writing as a matter of record August 8, 2018 (12:48 pm).  I received two (2) calls from Mr.  [redacted] August 8, 2017 (3:27 pm and 3:28 pm)3)  A payment history of the account back to inception4)  A copy of the recorded conversations with Allison, [redacted] and [redacted] on August 7, 2017Problems such as this is the primary reason why I make my communications with GM Financial in writing so that I have time/date stamped record.It appears this may have to go into litigation for resolve.

interest rate of 15.65%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $517.87 per month, beginning on December 20, 2014. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. If all payments are paid by the due date, the account will be paid in full on the contract maturity date.   As per your contract, we may apply each payment to the earned and unpaid part of the Finance Charge, to the unpaid part of your Principal Balance and to other amounts you owe under this contract in any order we choose.  The payment you mentioned that you intended for the late fees were applied towards past due installment payments. On the date of July 25, 2015, GM Financial received a payment in the amount of $543.76; at this time your account was past due for the June 20, 2015 and July 20, 2015 installment due dates. Of this payment, $517.87 was applied towards your June 20, 2015 installment due date and the remaining $25.89 was applied towards your July 20, 2015 installment due date. As you have requested to defer the August 20, 2015 and September 15, 2015 installment due dates, the deferment fee you are required to pay, in the amount of $207.15, will be applied towards the accrued interest balance while the account is in deferral. Your contract reflects that you will pay additional finance charges at the Base Rate on the amount extended during the extension. GM Financial has not charged you the additional $15.00 extension fee also referenced within your contract. The deferment arrangement is currently pending the receipt of the $207.15.  In an effort to assist you further, the Team Leader whom you have been corresponding with has waived your late fee balance of $77.67 as a one-time customer courtesy. I am rejecting this response because: I'm sorry I just really am having a hard time with this I don't feel that my file has been taken care of the way it should be. I signed up for auto-pay. It was not taken out of my account like it was supposed to. And because of that my payment is late and now my credit has a ding in it. I don't understand how that is my fault. Also like I said before I have had the same phone number for 20 years they have had my phone number on file since day one. As I said before this is my fourth or fifth car with GMAC. I think I am being treated unfairly and this really upsets me.I work in customer service and I know for a fact when somebody doesn't make a payment you reach out to them you find a way to get info to them. You email them you call them you send stuff in the mail I got none of that. That's why I thought everything was taken care of I was out of town my grandma died a tragic death she fell and hit her head and we had to sit there and watch her die it was horrific..... We had minimal service there and I came home to this mess I really can't emotionally deal with this right now but I can tell you I'm extremely extremely upset. I feel like you guys have all my contact info but you didn't care to use it to let me know my payment wasn't taken out..... Signing up for automatic deduction makes people not have to think or worry about their payment because in most cases things are taken out correctly.....but in my case someone dropped the ball and it never got set up correctly...... And I was told if anything is wrong with my payment they would let me know that never happened....can I just pay it in full and close my account? And go elsewhere???? I was going to probably  lease another Chevy Equinox but now I'm thinking I'm going to switch over to Jeep.............

Thank you very much for your very detailed response. Again, I submit to you that you have incurred no costs for these late fees and did not in my mind make a good effort to advise me that the title was not being released. At the very least I would have accepted this had you sent a registered letter but you did not. The fact of this matter is that I no longer want the car due to mechanical issues. Since you are not willing to release the title, you are still the "legal" owner of the vehicle. You have made this clear in your statements. Please advise where I can deliver the car for you to take possession of it .

Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
On September 6, 2012, the vehicle was involved in an accident and declared a total loss by Progressive Insurance. On September 10, 2012, GM Financial quoted a payoff to Progressive in the amount of $11,049.95 good for 10 days. On September 14, 2012, GM Financial received a payment from Progressive in the amount of $10,598.54. As per your contract, the payment was applied to the balance of your account reducing what you owe. Insurance proceeds will only be applied to the principal balance of the account. As outlined in the total loss letter sent on September 10, 2012, you are still responsible for maintaining the monthly installment payments and are still subject to monthly credit bureau reporting until the account is paid in full. The insurance proceeds received from Progressive were applied to your account balance and were not enough to pay the amount you owed. This balance was reported as a charge off on November 30, 2012. The GAP Insurance refund was received on December 27, 2012 satisfying the charge-off balance.

I am rejecting this response because: GM Financial received funds from me which were lost for 4 weeks. I have yet to receive an explanation for how this happened. Personally, I feel that the credit should remain on my account and the money should be refunded to me. More importantly, I hope this response serves as a warning to other consumers. This situation cost me time, interrupted multiple work weeks, and elevated my anxiety to a terrifying degree. I felt helpless throughout the entire experience. Ultimately, a corporation took money from me and failed to provide the purchased service (lease account credit) for 4 weeks. There was nothing I could do and no way to hold them accountable. I did not feel like resolving the issue was a priority for GM Financial.
