I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  They are not addressing anything that I have said in the past emails, and have only responded with a denial of a refund of any type; which is not good enough.

[redacted]"The only documentation that we have for this order is the credit application and sales order that were signed by Mr. [redacted]. Since Mr. [redacted] was the one who signed for the order and also signed the credit application, he was agreeing to the terms and conditions of the sale set forth by the respective documents.  Since the timeframe to cancel has passed, we regretfully decline the request to cancel this order."They clearly had attached the agreement I signed in a previous email which is a completely different form from [redacted]'s. I did not sign off on [redacted]'s order at all and was not aware that we signed two separate documents until it was too late to cancel the order. The principle of the matter which needs to change (as well as me receiving my money back) is that this business has an extremely shady process by not even giving its consumers the chance to test out their product (or see the kitchenware in their house themselves) with a reasonable time frame for them to change their minds.[redacted]

Right above the signature line on the sales order that Mr. [redacted] signed, it states:
 
“You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction.”
 
Since Mr. [redacted] did not cancel the order within the allotted timeframe, the account is no longer eligible for cancellation. Since we shipped the merchandise that was on the sales order, any exchange of merchandise will need to be done via the Independent Distributor that did made the sale and Mr. [redacted]. As previously mentioned, the filter comes with 15 year warranty to be free of defects in workmanship. Should Mr. [redacted] wish to have the unit inspected under the warranty, he will need to contact our Customer Service Department and any representative will be able to assist him.

Corporate was calling my cell phone while I was at work. My phone is on me at work incase of emergencies. Whenever I said something to the representative about my number, they said [redacted] was not on the account, yet I was getting calls from the corporate office in Wisconsin.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]I am requesting a refund and cancellation of the agreement since was all was a fraud and now I know your products are made for household because they do not last even a month. When the sale dand agreement was made I was told this product was made for restaurants,even the manager of the sales person [redacted] has accepted infront of a witness that his sales rep lied to me in order to make her sales quota that month. So is clear that I am a victim like many others of fraud by HYCite and  my business as well . I f you want to take this to court we can take it to the next level I am sure I can find other customers that are willing to join me on a law suit and the news as well. If you need an statement from witnesses I can provide that information as well.

As previously stated, Ms. [redacted] signed a sales order outlining the terms and conditions to cancel the order. Since the order was not cancelled within the allotted timeframe, the cancellation is not being accepted and Ms. [redacted] will remain responsible for the account and its balance. Should Ms. [redacted] refuse the shipment, this will be a voluntary and the cancellation will still not be accepted.

In review of the complaint received by Mr. [redacted], In order for us to see if a customer is eligible for financing, we need to pull a copy of their credit report and in Mr. [redacted]’s case a copy of his credit report was pulled to check for credit eligibility. I do not believe that I the consumer am at fault for the seller selling faulty cookware, who now wishes to do anything but reimburse me or replace it with something of equal value, not somethings of equal value.

We understand Ms. [redacted]’s concern, however the warranty period for the strainer has expired. The previous times the strainer was replaced, it was covered under the 2 year warranty. As of December 2015, the warranty on all non-motorized components had expired and in order to have the item replaced, a cost will be required.

Since Mr. [redacted]’s credit was not needed to approve the order and his credit was never ran, we will be more than happy to remove him from the account, leaving Ms. [redacted] the sole party responsible for the account. With regards to the cookware and the warranty, should there be a reason that the cookware require warranty assistance, it would be the responsibility for the customer to pay to send it back to us for inspection. Once received, the cookware will either be repaired or replaced under the 50 year warranty.
