Member purchased a monthly dues fitness membership pursuant to a written and fully executed agreement beginning 3/25/Member paid a total of $up front, which included the initiation fee and payment for the first and last month of membership duesShe further agreed to make payments in the amount of $each (plus tax), every month, beginning 4/25/16, until written notice of cancellation is providedFour days later, member purchased personal training services pursuant to a separate, written and fully executed agreement (“Agreement”) The Agreement was for a minimum initial term of months, beginning 3/29/(the “Initial Term”)Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training servicesShe further agreed to make more payments, in the amount of $each, every month, for the remainder of the Initial TermThese terms are clearly outlined on page of the Agreement and she acknowledged her understanding of these billing terms by initialing three separate sections of the payment schedule section of the Agreement Her Agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the AgreementThis provision is clearly outlined on page of the agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement with the initial term of months and the voluntary cancellation provision This Checklist was reviewed with her at the time of the sale, as acknowledged by her signature and initials on the New Client Checklist (copies of the fitness membership agreement, personal training agreement and New Client Checklist are included with this response)Thus, under the clear and explicit terms of the Agreement, she is not entitled to a refund or to terminate the personal training agreement and abandon her contractual obligations (which were very clearly spelled out for her and acknowledged by her) early without a feeAs outlined above, member may cancel the monthly dues fitness membership at any time by providing a written notice However, If member no longer wishes to continue with her valid personal training agreement, LA Fitness will honor the voluntary cancellation provision of that Agreement should she elect to take advantage of itOtherwise, member should be expected to honor her Agreement as LA Fitness stands ready to provide the services for which she contracted

Management contacted member regarding complaintTo resolve this matter and as a courtesy we will refund the last four months of dues $ Refunds typically take about 7-business days to complete and will go back to the [redacted] card on fileWe believe this matter to be resolved Thank you

Member met with our Personal Training Director (***) and Assistant Personal Training Director (***) regarding his concernsThey reviewed the terms of the personal training agreement once again, which member acknowledged his understanding of, and he will continue with the personal training program

Management spoke with Mr [redacted] regarding his complaintAs a courtesy resolution, Management cancelled all the membership on file and processed a full refund of all the charges paidRefunds typically could take up to 5-business days to completeWe now believe this matter to be resolvedThank you

Management contacted [redacted] regarding the cancellation of his monthly dues membership and his frustration with staff at the local club [redacted] stated he attempted to cancel via telephone and emailThese are not acceptable forms of cancellation and as a result, no such cancellation was processed The history on [redacted] account reflects that he was advised by telephone of the accepted cancellation proceduresLA Fitness provides members with the option to cancel their membership at any location between the hours of 9AM-5PM Monday through Friday, but we strongly advise that member's mail in a written cancellation request via certified mail to ensure return-receipt This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly [redacted] cancellation was processed on 11/15/based on his in person request at the [redacted] location [redacted] final billing was 11/10/2016, which was prior to his cancellation request, so a refund is not warranted in this case Nevertheless, our District Operations Manager offered to accept the email [redacted] states he sent to customer service on 10/25/as the effective cancellation dateAdditionally, we offered to refund $ [redacted] declined our resolution offersShould he decide to accept the resolution offers, we encourage him to contact us so we can move forward with processing the adjustmentsWe believe this to be a fair and reasonable resolutionThank you

Our District Vice President attempted to contact member to address his service concerns but his call was not returnedLA Fitness cancelled his personal training agreement and regular fitness membership with no further billing

LA Fitness provides members with the option to cancel their membership at any location between the hours of 8-Monday thru Friday, but we strongly advise that member’s mail in a written cancellation request via certified mail to ensurereturn receiptThis cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properlyThe cancellation form can be printed off of our website www.lafitness.comThank you

We appreciate member’s feedback and have added the session from 6/27/back on to her accountLA Fitness strives to provide excellent customer service and we regret that member came away from his experience feeling like she needed to go to a different location to trainHowever, a discount on her monthly membership dues is simply not due in this caseNevertheless, our Personal Training Director, [redacted] P., and Regional Vice President, [redacted] G., have both attempted to contact member to address her concerns but she has not returned their callsWe encourage member to return their calls for further assistance

Our previous response still standsManagement contacted [redacted] on 6/18/in regards to the cancellation of his gym membership [redacted] states he cancelled verbally in January and is seeking a month refund for monthly dues Our records indicate we have not received a cancellation request for the membership and [redacted] cannot show proof of cancellation With no confirmation of a prior cancellation, typically no refund would be issuedLA Fitness provides members with the option to cancel at any LA Fitness location between the hours of AM-PM on Monday through Friday, but we strongly encourage members to send a written cancellation request via certified mail to ensure return-receiptOur cancellation policy is not designed to make it difficult for our members to cancel, but to ensure cancellations are handled properly As a courtesy, we have offered a month refund and [redacted] has declinedNo further action will be takenThank you
