Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Yes, [redacted] from LA Fitness did call my home and apologized for the staff not knowing or understanding their jobs and I was informed that I would still not be allowed back because the woman that was occupying the lap lane over the time period noted on the walls complained about me I spoke to the woman less than seconds, it was the staff that showed her the signs and told her about the over use of the lap lane and I'm getting blamed for that That is an in-justice This lady gets in the lap lane aprox7:AM and uses the lap lane and saves it for her husband who arrives about 11:AM There is a one hour swim class at 9:AM but most of the time it is not full and they leave one lap lane open and this lady uses that lane and makes it her personal domain until her husband arrives at 11:AM and uses it until about noon This happens every day of the week Other members came to me to thank me for reminding the women about the minlap lane limit Several members are upset about this as well but I was the only one who was singled out I realize I control my own destiny and I also know right from wrong and individuals that play by the rules while other do often get kicked to the curb It is amazing to me how a second conversation has resulted in such an injustice I have been a member of this club for over years with no know complaints about me and I have made many club friends and I miss them dearly Please reinstate my membership, I did nothing wrong What about my complaint about the women holding the lap lane and not letting anyone else use it all the time, my complaint doesn't count? Member’s personal training agreement also includes a provision that allows her to terminate the agreement early without a fee if she becomes disabled and is unable to receive the benefits of the serviceHowever, our records do not reflect that she has provided verification of such a disability However, as of the time of this response, member has disputed the payments with her bank and defaulted on the agreement term Since it is apparent that she now has no intention to fulfill her contractual obligation to the remaining personal training agreement term, we have released her from this obligation to make the remaining payments due under her agreementAdditionally, LA Fitness will not pursue her for the outstanding balance she currently owesPlease note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member

Management spoke to [redacted] on 4/17/regarding the cancellation of her monthly billed fitness membershipAfter much discussion a refund in the amount of $has been refunded back to the [redacted] cardRefunds take about 5-business days to be refundedMember is satisfiedThank you

Member purchased personal training services pursuant to a written and fully executed agreementThe agreement was for a minimum initial term of months, beginning 3/11/(the “Initial Term”)Member paid a total of $up front, which included the processing fee and payment for the first month of personal training sessionsShe further agreed to make more payments, in the amount of $each, every month, beginning 4/11/15, for the remainder of the Initial TermThese terms are clearly outlined on page of member’s agreement and she acknowledged her understanding of these billing terms by initialing three separate sections of the payment schedule outlining these termsMember’s personal training agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining ba [redacted] due under the agreementThis provision is clearly outlined on page of her agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement, the initial term of months and the voluntary cancelation provisionThis Checklist was reviewed with member at the time of the sale, as acknowledged by her signature on the New Client Checklist (copies of the agreement and New Client Checklist are included with this response)Member’s personal training services agreement specifically provided her with a 10-day right to cancel if these terms did not match her understanding (or for any reason) for a full refundHowever, she did not take advantage of this option within the rescission periodThus, under the clear and explicit terms of the Agreement, she is not entitled to a refund or to terminate the agreement and abandon her contractual obligations early without a feeLA Fitness is willing to reduce the cancellation fee from 50% down to 33% of the remaining agreement ba***Please note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member should she elect to take advantage of itOtherwise, she should be expected to honor her agreement as LA Fitness stands ready to provide the services for which she contracted

Management made several attempts to contact [redacted] regarding his concerns with the cancellation of his monthly dues membershipLA Fitness provides members with the option to cancel their membership at any location between the hours of 9AM-5PM Monday through Friday, but we strongly encourage that members mail in a written cancellation request via certified mail to ensure return-receipt This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly [redacted] states that he attempted to cancel on Saturday, when an Operations Manager is not scheduled and therefore unable to assist with in person cancellations As a courtesy, a cancellation was processed on September, with no further monthly billingShould [redacted] need additional assistance we encourage him to return our callsThank you

LA Fitness processed a refund in the amount of $for the second month of training dues (refund applied to the same account used for payment)Please allow 5-business days for the refund to apply to member's account

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution would be PARTIALLY satisfactory to meI partially accept the offerI accept the portion for my personal training contract to be terminated however I want my money refunded for the unused sessionsHere is the reason why.I met with the new personal training manage [redacted] on December 23, We discussed the issues at hand regarding the consistency of the personal training program and having a trainer available in the morning [redacted] said he would find an available trainer to complete my personal training sessions and we would meet to discuss the progress at a later date [redacted] scheduled a personal training session with me and a trainer of his choice for January at I had to change the time (and let him know about this days prior) and we changed it to 6:PM a mutually agreed upon time [redacted] did not show up to the training session, and his trainer [redacted] did not have time to complete the agreed upon session [redacted] and I discussed meeting the following morning for sessions from 6-amAfter the session occurred the following day, [redacted] said he would contact me so we could set up further sessionsI had not heard from [redacted] , so I emailed and text [redacted] on Friday December 6, to let him know subsequent sessions had not occurred On Sunday I received an email from LA Fitness saying I had two training sessions scheduled for the subsequent morning at 6AMWhen I logged into my account, I realized there were two training sessions a day scheduled for me on Monday-Friday starting at AMOn Friday, January 20th, I had training sessions scheduledI text [redacted] to ask him about this since no one had contacted me to set up the sessions and times but he did not respond againWhen I was driving to the gym on Monday morning I received a text from [redacted] at 5:AM saying his car broke down and he would not be able to attend the session that morning and he would contact me to rescheduleWhen [redacted] left me a voice message that evening he let me know that he would not be able to keep the AM time since he now had to rely on public transportation to get him to workI forward the voice mail to [redacted] but have not heard backDespite promises made about having my sessions being available, there is not a trainer available to provide training for meWhen I signed up for the personal training sessions I was told that the time would not be a problem but this agreement has not been fulfilledDespite informing the personal training management, they choose to ignore the problem instead of addressing itThe sessions I signed up for were not provided by LA Fitness despite meeting with people who agreed the sessions should occurThis is why my sessions need to be refunded due to breach of contract Regards, [redacted] And [redacted] And [redacted]

Management contacted Mr [redacted] regarding his concerns related to the reservation of a racquetball court at our Pasadena-Rosemead BlvdlocationWe appreciate our member’s feedback and concerns regarding our facilities and strive to provide an opportunity for all our members with court service to make reservationsManagement reviewed the different options and time frames for completing reservations, including via a member’s online account or mobile applicationManagement also offered to review the schedule with Mr [redacted] in person to resolve any disputesWe will continue to support this member and encourage Mr [redacted] to contact his local club should he need any additional assistanceThank you

Management spoke to [redacted] regarding his annual paid in full membershipAfter explaining to him his annual renewal and providing him with a copy of his agreement he is aware that his yearly renewal is $per yearAs a courtesy, a refund has been issued in the amount of $back to the [redacted] for the 2015-year in order for him to rejoin should he wish to at a lower renewal rateMember is satisfiedThank you
