Management spoke to [redacted] on 5/15/regarding his yearly membershipIt has been decided a cancellation and a refund in the amount of $back to the [redacted] Refunds take about 5-business days to be refundedThank you

Our District Manager has attempted to contact members to address their concerns but his calls have not been returnedAs of the time of this response, member has disputed the payments with her bank and defaulted on the agreement termSince it is apparent that she now has no intention to fulfill her contractual obligation to the remaining personal training agreement term, we have released her from this obligation to make the remaining payments due under her agreement and cancelled her regular fitness membership with no further billing as wellAdditionally, LA Fitness will no longer attempt to call or pursue her for the outstanding balance she currently owesPlease note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member

Management contacted [redacted] regarding his concerns related to charges on his wife’s portion of the monthly billed family membership and his experience with a customer service representative [redacted] stated that his wife’s portion of their family membership was in a frozen status and was unfrozen in error on May 8, LA Fitness strives to provide excellent customer service to our members and we regret that he felt the customer service representative was unable to assist in resolving his concerns Our member records show a check in of the key tag for [redacted] membership, which then unfroze her portion of the account on May 8, However, as a courtesy, we have agreed to refund $back to the [redacted] Card on fileRefunds typically take 5-business days to completeWe believe this matter to be resolvedThank you

Management spoke to [redacted] on 3/20/15 regarding the yearly enhancement fee she was billed on 12/12/14 in the amount of 25.00. We explained to [redacted] that she has been charged this fee every year due to the [redacted] membership she originally joined with. Member did not want to... cooperate in regards to providing proof she has never been charged prior to 2014. After much discussion we have removed the fee and refunded the $25.00 back to the checking account on file. Member is satisfied. Thank you.

Our District Manager contacted member regarding his concernsWe offered to reduce the cancellation fee from 50% of the remaining agreement balance down to 25%Member elected to take advantage of the offer, paid the cancellation fee on 1/19/and we cancelled the remaining term of his personal training agreement accordingly

Management made several attempts to contact [redacted] regarding her monthly billed fitness membershipShe claims she was not notified when her home club was closing and her membership was transferred to a near by locationHowever, per her request a cancellation has been processed and no further billing will occur and the balance in the amount of $has been waivedWe have yet to receive a return call, if she wishes to discuss her concerns further we encourage her to do soWe believe this matter to be resolvedThank you

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”)The Agreement was for a minimum initial term of months, beginning 7/20/(the “Initial Term”)Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training sessionsMember further agreed to make more payments, in the amount of $each, every month, beginning 8/20/15, for the remainder of the Initial TermThese terms are clearly and conspicuously set forth on page of his agreement and he acknowledged his understanding of these billing terms by initialing the three separate sections of the payment schedule section of the AgreementMember’s personal training agreement also includes a voluntary cancelation provision, which affords him the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the AgreementThis provision is clearly outlined on page of his Agreement In addition, his Agreement included a New Client Checklist which outlined key terms, including his acknowledgement that he received and read a copy of his personal training agreement with the initial term of months and the voluntary cancellation provisionThis Checklist was reviewed with him at the time of the sale, as acknowledged by his initials and signature on the New Client Checklist (copies of the Agreement and New Client Checklist are included with this response)Even if he felt rushed at the point of sale, member’s personal training services agreement specifically provided him with a day right to cancel if these terms did not match his understanding (or for any reason) for a full refundHowever, he did not exercise this option within the rescission period Thus, under the clear and explicit terms of the Agreement, he is not entitled to terminate the Agreement and abandon his contractual obligations early without a feeLA Fitness will honor the voluntary cancellation provision in his Agreement should he elect to take advantage of itOtherwise, member should be expected to honor his Agreement as LA Fitness stands ready to continue to provide the services for which he contracted when he is ready to resume training

It is LA Fitness’ policy and practice to provide our members with a complete copy of their agreement at the time of enrollmentA copy of the agreement was also included in the confirming e-mail member received on the day he enrolledIn addition, his agreement included a New Client Checklist which outlined key terms, including his acknowledgement that he received and read a copy of his personal training agreement and his understanding that, after the initial term, the services would continue at the same price and with the same billing cycle until written notice to cancel is providedThis Checklist was reviewed with him at the time of the sale, as acknowledged by his signature on the New Client Checklist (copies of the agreement, New Client Checklist and confirming e-mail are included with this response)
