made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I was called a single time from someone named [redacted] at [redacted]. He called yesterday and upon listening to his voicemail I called back immediately. Roberts phone went to voicemail and I left a message in return. 
None the less, I simply would like to know how LA Fitness obtained my credit card number. That doesn't require a telephone call, but an email. Yesterday I also got into touch with the [redacted] Department of Agriculture and Consumer Services. Perhaps they can figure out how my federally protected payment information was found.
Please consider this my written notice of membership cancellation and stop charging the credit card number that was never given to you.

Our previous response still stands
Management spoke to [redacted] prior to this complaint. [redacted] Paid In Full (PIF) membership agreement.  The PIF agreement includes an option for the member to renew the agreement at the current discounted rate upon expiration of the initial term.  It does not provide the member with the right to purchase a membership at any time in the future at the same rate for the rest of that person’s life. Here, [redacted] PIF membership ended in January 2014. 
He did not renew the membership at that time at the special renewal rate.  However, he then wanted to take advantage of this preferred renewal rate almost a full year later in December 2014.  By that time, this renewal rate was no longer available to [redacted] because he had let his membership lapse, rather than renew it.  However, as a courtesy, instead of paying the normal rate for a new membership, he was given the option of renewing his expired membership at the old renewal rate, but such a renewal has to be treated like a true renewal, meaning in this case it attached back to the original date it was up for renewal (January 2015). 
Thus, [redacted] had the choice, and LA Fitness will continue to provide him with the choice, of either doing his preferred 2-year renewal rate based on the date of his original membership expiration, January 2015 (with the two-year membership expiring in January 2017) or simply purchasing a new membership at the current rates.  No further action will be taken at this time. Our District Manager has attempted to contact member to address his concerns but member has not answered. As of the time of this response, member has disputed the payments with his bank and defaulted on the agreement term. Since it is apparent that he now has no intention to fulfill his contractual...

obligation to the remaining personal training agreement term, we have released him from this obligation to make the remaining payments due under his agreement. Additionally, LA Fitness will not pursue him for the outstanding balance he currently owes. Please note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member.

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”). The Agreement was for a minimum initial term of 6 months, beginning 2/22/16 (the “Initial Term”). Member paid a total of $310.00 up front, which included the processing fee and payment for...

the first month of personal training sessions. Member further agreed to make 5 more payments, in the amount of $260.00 each, every month, beginning 3/22/16, for the remainder of the Initial Term. These terms are clearly outlined on page 1 of the Agreement and she acknowledged her understanding of these billing terms by initialing three separate sections of the payment schedule section of the Agreement.
  After signing and initialing digitally on a signature pad, a hard copy of the agreement, which clearly reflected her name, was printed, reviewed with member once again and she signed and initialed next to her signature and initials on the hard copy as well (copies of the digital agreement and hard copy are included with this response). Member was provided a hard copy of the agreement at the point of sale and a copy was also included in the e-mail confirmation sent to member on the day she joined (a copy of the e-mail confirmation is included with this response). It should also be noted that member previously had a 12 month personal training membership with LA Fitness several years back.
She specifically chose a smaller 6 month program this time because she did not want as long of a commitment as her previous 12 month program. Member’s personal training services agreement specifically provided her with a 3-day right to cancel if these terms did not match her understanding (or for any reason) for a full refund. However, she did not exercise this option within the rescission period.
Thus, under the clear and explicit terms of the Agreement, she is not entitled to terminate the Agreement and abandon her contractual obligations early without a fee. Member’s Agreement also includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the Agreement. LA Fitness will honor this cancellation provision in her Agreement should she elect to take advantage of it. Otherwise, member should be expected to honor her Agreement as LA Fitness stands ready to provide the services for which she contracted.

LA fitness in [redacted] has falsified selling itself and does not provide a quality service where I am seeking a refund in retribution and a reduced rate until you are able to get your company up to code.
Main issues of concern: Equipment falling apart Floors and ceilings caving in Employees watching [redacted] with customers
Unclean environment No cleaning supplies accessible to customers
No regulation of equipment/ re-racking weights
Rowdy and unruly customers that are not re-directed over flowing trashes
I have been with your gym a while know and have continued to attempt hanging in there as you tried out many managers to improve your facility. The sad truth is that it continues to go down hill and has ruined my impression of your company. This last week has crossed the line, you have staff watching [redacted] with other members in the wait room near the basketball courts. Talking inappropriate things about the women they sleep with. Staff is never working or monitoring your program. Trash is overflowing, weights are impossible to find as they are thrown across all 3 levels and other members are exhibiting inappropoaite behaviors with no re-directions.
I would like to be reimbursed in retribution to the faulty services you are providing. I want to have a decreased membership price for the duration you take to get your facility back up to the basic level of needs. And you need to hire a manager that will walk around and ensure their staff is acting accordingly. No [redacted] in the gym. Every employee needs to be responsible to take trash out and re-fill paper towels. And you need to stop taking new members until you can provide the service you claim to be provide us dedicated members. I am a manager and understand the operations that you need to run. If you actually came to the site, you would see the same exact things I see if your looking to stay in business. If your not looking to improve I would suggest closing your doors to save your companies name. Thanks

Per his request an immediate cancellation was processed for [redacted] as [redacted] states it was to be cancelled at the same time as his. No further billing will occur and a...

one month refund in the amount of $34.95 was refunded back to the [redacted] card on file. Refunds take about 5-7 business days to be refunded. We believe this matter to be resolved. Thank you.

Management made several attempts to contact [redacted] regarding her monthly billed fitness membership. She claims she was not notified when her home club was closing and her membership was transferred to a near by location. However, per her request a cancellation has been processed and no further...

billing will occur and the balance in the amount of $21.43 has been waived. We have yet to receive a return call, if she wishes to discuss her concerns further we encourage her to do so. We believe this matter to be resolved. Thank you.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be PARTIALLY satisfactory to me. I partially accept the offer. I accept the portion for my personal training contract to be terminated however I want my money refunded for the unused sessions. Here is the reason why.I met with the new personal training manage [redacted] on December 23, 2016. We discussed the issues at hand regarding the consistency of the personal training program and having a trainer available in the morning. [redacted] said he would find an available trainer to complete my personal training sessions and we would meet to discuss the progress at a later date. [redacted] scheduled a personal training session with me and a trainer of his choice for January 3 at 12. I had to change the time (and let him know about this 3 days prior) and we changed it to 6:40 PM a mutually agreed upon time. [redacted] did not show up to the training session, and his trainer [redacted] did not have time to complete the agreed upon session. [redacted] and I discussed meeting the following morning for 2 sessions from 6-7 am. After the session occurred the following day, [redacted] said he would contact me so we could set up further sessions. I had not heard from [redacted], so I emailed and text [redacted] on Friday December 6, 2017 to let him know subsequent sessions had not occurred.  On Sunday I received an email from LA Fitness saying I had two training sessions scheduled for the subsequent morning at 6AM. When I logged into my account, I realized there were two training sessions a day scheduled for me on Monday-Friday starting at 6 AM. On Friday, January 20th, I had 3 training sessions scheduled. I text [redacted] to ask him about this since no one had contacted me to set up the sessions and times but he did not respond again. When I was driving to the gym on Monday morning I received a text from [redacted] at 5:40 AM saying his car broke down and he would not be able to attend the session that morning and he would contact me to reschedule. When [redacted] left me a voice message that evening he let me know that he would not be able to keep the 6 AM time since he now had to rely on public transportation to get him to work. I forward the voice mail to [redacted] but have not heard back. Despite promises made about having my sessions being available, there is not a trainer available to provide training for me. When I signed up for the personal training sessions I was told that the time would not be a problem but this agreement has not been fulfilled. Despite informing the personal training management, they choose to ignore the problem instead of addressing it. The sessions I signed up for were not provided by LA Fitness despite meeting with people who agreed the sessions should occur. This is why my sessions need to be refunded due to breach of contract.

Management contacted [redacted] regarding the cancellation of his monthly dues membership. [redacted] stated he attempted to cancel in January 2016. The history on [redacted]’s account reflects that his membership was frozen online but a cancellation receipt was not received. LA Fitness provides...

members with the option to cancel their membership at any location between the hours of 8AM-5PM Monday through Friday, but we strongly advise that member's mail in a written cancellation request via certified mail to ensure return-receipt.
This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly. As a courtesy, a cancellation was completed on May 5, 2016 and we have also agreed to a refund back to his [redacted] card on file in the amount of $40.00.
Refunds typically take 5-7 business days to complete. We believe this matter to be resolved. Thank you.

We apologize for any inconvenience this may have caused. All yearly members are contacted to renew their membership upon their up coming expiration date. We encourage [redacted]t to renew online or at her home club. Thank you.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.my complaint is only partially related to the way in which I was sold my sessions, and the shady dealings on that day, My concern at this point is that I am not getting what I am supposed to have received which was a "program" I was told during my initial complaint I didn't pay for a trainer but I paid for a "program" I have received a trainer that provides me with a 30 min work out the days that I am able to schedule, there is never a plan or program when I show up, its always "what do you feel like doing today" which in speaking with my physician is most likely why I am now dealing with shoulder and elbow issues because I always wanted to focus on upper body, and we ignored my lower body. The reason we amateurs hire trainers to to help us achieve goals, not to work out with us, and let us do whatever we want, and have it eventually result in injury.
I have been old I paid for a program, well I never received one, putting LA fitness in breach of contract. I was also sold on a signature member ship, but nobody at that time thought it worth mentioning my club was not a signature club, and all the benefits of a signature club, I was paying for, I wouldn't get ( towel service being the most obvious )Secondly my concern is the fact that I cannot use the sessions, as I am currently injured, I think this level of customer service only proves that they have no interest in the customer, and are only interested in the money, as the reality to the situation is, had they addressed my concern, and let me out of my current PT contract or suspended the payments until I was able to use them again, I would have happily sighed on for more sessions at a later date when I could use them safely, and without harm. But that is not the case, they are only interested in ripping of the customer, and getting money for services they are not providing. If this is the service they want to provide, we will cancel, and take our business to another facility. I am disgusted with the service, I am disgusted with the establishment and the management, and how poorly trained the staff are. Overall the LA fitness experience has been horrible, and I am happy to let everybody I know the kind of business they are running.ITs clear they are not looking at the big picture, when I am currently paying for 2 memberships, and PT sessions. If they are prepared to lose all that money in the long term over $980 it says alot and is of no surprise to me they are always losing customers to other clubs. I am sure [redacted] will be happy to take our money, and won't prove to be nearly as horrible a company to deal with.Regards,[redacted]
