Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved.

Please review our previous response as we have already refunded the charge of $47.33 for the initial bottle sent. Our policy requires customers to return product when receiving a refund. We will make an exception and will not require the product to be returned. The amount of time it takes for a refund to process depends on your bank. What we show is the account has been refunded $47.33 Trans-ID: [redacted] on 7/25/14. Generally it takes 3-7 business days for a refund to process, depending on your bank. If the charge has been processed on to a credit card it can take up to 30 days from the date of the issued credit.

At La Creme every customer is given the right to try their first 30 day supply without charge for the first 14 days. After the 14 day trial period, if the customer is unsatisfied with their product, they are...

to return the remainder postmarked for return within their 14 day trial period and also contact customer service to notify a request for cancellation. If the customer keeps their 30 day supply after the 14 days, they are automatically billed for their product on the 15th day and then automatically shipped  and billed a product every 30 days thereafter. The customer has the ability to cancel at anytime by calling customer service or emailing [email protected]. If a customer needs to contact customer service, the phone number is listed on lacremeskincare.com, the product, the pamphlet, and the package the product is shipped in. The terms are disclosed clearly on lacremeskincare.com where the customer would have ordered their product. The customer has to also click "I agree to the terms and conditions"  twice before the order is processed. If the customer does not "agree" to the terms, the order will not process. The terms and conditions are disclosed directly on the ordering website  not only on the bottom of the first page, but also highlighted in a large white box on the second page where the customer inputs their card information as well as sent out with the product.
The consumer placed the order on 01/05/15. This is when they paid the initial $4.95 and this began the 14 day trial period to sample from the initial 30 day supply. We tracked this package and show it was successfully delivered within their trial period by ups.com on 01/15/15: [redacted]. We attempted to charge their account for the item on 01/20/15 as per the terms and conditions of the trial. However, the charge declined and the consumer was given a three day courtesy extension. Her final charge was applied on 01/23/15 for the retail price of $87.63. She did in fact contact us on 01/22/15 by e-mail to cancel the account. She was notified she had contacted us by our terms and conditions and we issued a full refund of $87.63 immediately on 01/25/15. We apologize for the delay in her e-mail response, and hope this can resolve her complaint.
As a further courtesy, even though we can track the package and see it delivered successfully, we have issued the refund of $4.95 shipping and handling back onto her card. This will be a total credit of $92.58 back onto her account for the La Creme Skin Care order.

The customer placed the order on 1/7/16. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. The order was delivered on 1/11/16 (tracking number [redacted]). Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 2/8/16 as explained in the terms and conditions which they agreed to. To date, the customer has not contacted us with a request for cancellation. We have cancelled the account and the customer has been sent a cancellation confirmation via email.
We have refunded the amount of $87.63 due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. We state the terms and conditions clearly, and send a synopsis card with our contact information, with each order. Terms and conditions are located on all ordering websites, and should be read as they are there for a reason. The customer placed the order on 3/18/2015. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Hello,
My complaint #[redacted].   I have received a credit from Lacreme skin care in the amount of $4.95. I am in shock.  I sent an email stating I want the total amount of $92.58 they charged, credited to my credit card . This was in my email I previously sent to the company.
I am  just giving you an update on situation, and I appreciate your helping to resolve this and making these businesses stop ripping people off.

Thank you, [redacted] ###-###-####

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved.  While I appreciate their response to refund my money, I still feel that their documentation can be easily misinterpreted by someone who is grasping at straws to help their loved one who is suffering with one or more medical conditions.
I will be returning the UNOPENED container and sales brochure, now that we have this resolution.

The consumer placed the order on 10/10/14. This is when they paid the initial $3.95, which was offered as a discount from the original $4.95, and this began the 14 day trial period to sample from the initial 30 day supply. The consumer contacted our company on 10/19 and requested to cancel. At that time, as a courtesy, we offered her the option to return the remainder of the product for no additional charges or she could keep the 30 day supply she had for a discounted price of $44.00. The consumer declined to keep for the discounted price and the account was closed. At that time, the consumer was informed she would need to return the product back to us as she was not interested in keeping it. At this time we have refunded the shipping charge of $3.95 for the product to be returned.

[redacted] placed an order on 07/29/14 for our 14-day trial of a 30-day product supply of the La Creme Skincare. The last change we made to her account was on 07/31/14 regarding her trial period. She asked to cancel, and to receive no further contact. We cancelled the trial and as a courtesy,...

refunded the $4.95 charge back onto her account. We have not replied since, as was her wish. We apologize for any confusion, and hope this clears up the account. Refunds usually take three to seven business days to credit. If she has any further questions or concerns, she is free to contact us directly regarding her account.

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is as they stated regarding not charging me the $80 some dollars.  The Company starts their 14 day trial on the date the consumer 1st contacts the company.  It takes 7 days to get the product.  The consumer has 7 days to try the product but the consumer isn't supposed to see any improvement for 30 days.  Go figure???  I suggest the Company allow the consumer 30 days to try the product from date of receipt.  Also they should put their criteria up front in full size print instead of hiding in tiny print.  This case can be closed.

Review: My bank called me today to verify a charge on my Visa from La Crme in the amount of $87.63. I directly called La Crme to question the charge. At the beginning of March I ordered a trial sample of a wrinkle cream from La Crme for the cost of shipping/handling. I was not aware that I would be later charged for the product. La Crme's Customer Service Agent canceled my account per my request but said I wasn't eligible for a refund because I agreed to the Terms and Conditions. He later in the conversation agreed to a 50% refund. The Terms and Conditions were not fully available on the computer screen used for ordering. This company's cancellation policy does not adequately allow one to realize if the product is working. Even though I was unaware of the 14 day cancellation. There is a Satisfaction Guarantee symbol on the ordering web page which seems contradictory since a full refund was refused. The website also advertised the product is limited and to act quick which dissuades one from gathering all the information.Desired Settlement: 100% refund

At La Crème Skin Care, every customer is given the option to try their first 30 day supply without charge for 10 days after receiving their order. During the 10 days, if the customer is not satisfied with their product, they are to contact customer service via phone or email with a notice of cancellation and the product must be postmarked for return within those 10 days. If the customer keeps their 30 day supply after 10 days from the date of delivery, they are automatically billed for the product and then billed and shipped a new 30 day supply every 30 days thereafter. The customer has the ability to cancel at any time by calling customer service or emailing [redacted]. If a customer needs to contact customer service, the phone number is listed on [redacted], the product, the pamphlet that arrives with their order, and the package the product is shipped in. The terms are disclosed clearly on [redacted] where the customer would have ordered the product. The customer also has to click “I agree to the terms and conditions” twice before the order is processed. If the customer does not click the box to agree with the terms, the order will not process. The terms and conditions are disclosed directly on the ordering website, at the bottom of the first page, and also highlighted in a large white box on the second page where the customer inputs their billing information, as well as sent out with the product. The customer placed the order on 03/05. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 03/20 as explained in the terms and conditions which they agreed to. The consumer contacted La Crème Skin Care on 03/24 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent refunded the amount of $43.82 that day. Once a refund is processed, it takes 3-7 business days for it to be credited back to the customer’s account. We have refunded the remainder of the amount, $43.81 due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. We state the terms and conditions clearly, and send a synopsis card with our contact information, with each order. Terms and conditions are located on all ordering websites, and should be read as they are there for a reason. Please refer to our website, [redacted] or [redacted]/main/index.php. Below is a brief explanation of our terms and conditions:Terms and ConditionsYou will have 10 days from the date you receive your bottle to decide if La Crème Skin Care is right for you. You must pay a shipping and handling fee of $4.95 for us to send you a full 30 day supply of La Crème Skin Care. We ship the product the day after you place the order (orders placed Saturday-Sunday will be shipped the following Monday). If you are unhappy with the product at any time during those 10 days, you must call us at [redacted] and cancel your order to avoid being billed for the full cost of the product. If you are satisfied with our product, then do nothing and we will bill you $87.63 for your initial order, and every 30 days thereafter we will send you a new 30 day supply of the product for $87.63. Review: Internet ads stating free samples, shipping was paid for with credit card. Since I had a reaction to product I called their customer service department to make sure they removed me from their mailing list for automatic refills of product monthly with a monthly charge of almost $90.00!!! They said my subscription was cancelled and there would be no charges HOWEVER, they told me I had to return the unused product! This is definitely advertised as "FREE".Desired Settlement: I do not want to pay shipping charges to return the unused portion. It was advertised as a "free sample".

Response:

We are affiliated with Bellalabs by advertising, however we do not have access to their information in regards to accessing their accounts. We have located your La Creme Skin Care account, and show you have been charged the monthly membership of La Creme Skin Care at the retail price of $87.63. There have been 4 full charges of $87.63 applied to your account since August 2014. We show the last approved charge was applied 10/31/14. You contacted our company on 11/17/14, and accepted all charges, but requested to return October's last bottle. This was honored, and one full refund of $87.63 was credited back onto your card. You accepted all of this information in a recorded phone call and closed the account from all further billing and ship[redacted]. There was no further notice provided to customer service that you were dissatisfied with the charges, and we considered the account completely closed.
