$fee for final distributionFees deducted from your account are not taxable or reported as income to youThis fee is part of the recordkeeping agreement between your now former employer / plan sponsor and ADP Retirement Services (the record-keeper)Administrative fees for certain services or transactions you request may be charged directly to your account if not paid by your employer or by the plan or bothThe plan sponsor has fiduciary responsibility for the 401(k) plan and is aware and agreed to all individual expenses as explained in the participant fee disclosure statement

The employee was sent the guide of how the FSA account works at the time of acceptance and also how the account works at time of termination May 11thThese are federally regulated programs that we are in strict adherence toAt this time there is nothing further that ADP can do once the account or employee has termed and has not submitted the claims prior to separation

ADP Benefit Services (“ADP”) is a service provider who contracts with employers to perform Consumer Health Spending Accounts (CHSA) administration servicesThese contracted services include processing participant spending account claims and reimbursement of only eligible expenses to the participant
according to the client’s plan provisions and federal regulationsReimbursements are funded by the client upon notification from ADP that an expense is eligible for reimbursableADP provides CHSA administrative services, as described, for our client; Mosaica Education, IncADP is not the Plan Sponsor or Plan Administrator, in regards to the client’s CHSA planWhile Mosaica Education, Inc is the plan administrator, the Internal Revenue Service (IRS) determines the regulations by which claims must be adjudicated under the Commuter Spending AccountsThe participant’s account was reviewed along with the health FSA (flexible spending account) claims that were paid to herIt was noted that this payment was delayed due to the timing of the wire transfer of funds from Mosaica EducationThe participant was emailed with her account balances and an apology that the incorrect payment date July16th was given to her by the ADP solution centerADP also provided the contact information of a Service Delivery Manager should she have any future questions or concerns regarding her HC Flexible Spending AccountADP apologizes for the misinformation provided to this individual

we tried to contact the employee on 02/10, 02/and 02/to resolve and they did not respond

*** ***/*** *** *** retained ADP to provide payroll data processing and tax filing services in December 2017. On December 21st, Mr*** was on a conference call with ADP Sales and New Accountants representatives in order to assist Mr*** with his account
registration into the ADP payroll platform. During the call, Mr*** did say he was unsure how much he wanted to pay himself and would need to go through his records and mentioned between $90,to $100,once a year. Mr*** went into the payroll system (on-line) and submitted the payroll by clicking the approve button himself without any prompting to do so by ADP. After Mr*** transmitted the payroll amount of $95,gross pay, $61,net pay, and tax liability of $41,076.72, the New Accounts representative advised the Mr***, a couple times, that the tax liability for that payroll would be $41,and this amount would be debited from his bank account to cover his payroll taxes. Mr*** agreed. ADP paid this tax liability on Mr*** behalf to prevent any penalty and interest and sent request to his bank to debit for the requisite payroll tax liability amount Mr*** bank did not honor the debit request and a wire was required to cover the Mr*** payroll tax liability that was already paid by ADP. Mr*** was provided the wire instructions although he did not follow through and did not wire the payroll tax amount to ADP. Since ADP was not able to collect the payroll taxes from Mr*** that ADP already paid, his account was turned over to *** ***

After thorough research, our records show that the complainant elected to participate in the commuter benefit effective September Based on an incorrect address in our third-party vendors system, his passes where sent to the incorrect address for the months of September, October and November
To rectify this, the participant has been issued a credit to be used for any orders going forward beginning Dec 1, We have also assisted the participant in terminating future orders so that he may utilize the credit he will be issuedWe again thank you for the opportunity to review this matter

As mentioned previously the only solution I was seeking was to make sure other clients will know what happened to me and think twice before they use their services. I still would like to see my complaint posted for other Customers to see
