agreement, each client has a five day right of rescission when becoming a client. If a client’s case is closed within those five days then no payment will be owed. Lexington allows for its clients to set their first payment out further than this five day period; however, even when the first payment is scheduled to be drafted beyond five days, the cancellation must occur within five days to have no payment owed. This first payment represents the pulling and analysis of additional credit reports, identity theft insurance and protection, a FICO score, and other online tools. Ms. [redacted] called Lexington to terminate the representation after the five day right of rescission, but before her first payment was due, which is why she was told about the payment being owed. Upon receiving this Complaint an attorney from Lexington has reviewed her case and Ms. [redacted]’s initial phone call with Lexington. Lexington has taken steps it feels should resolve Ms. [redacted]’s Complaint and has communicated those steps to her at the email address she provided. items directly with the credit bureaus and sending letters on its clients’ behalf to their creditors. As each client with Lexington has a different credit report with different factors influencing their report, no client will have the same results as another. Although any statistics may be an average of past results, it cannot be a guaranteed indicator of future results. Additionally, Lexington is not paid based on the results of a client’s case, but rather the work that is completed on the client’s behalf. Upon receiving this Complaint from Mr. [redacted], an attorney from Lexington reached out and spoke with him on the phone about his concerns. for services when they can't really afford it.  We sympathize, but must mention that customer actually agreed to set billing dates with the option to cancel at any time if she could not afford it or simply wanted to discontinue for whatever reason.   Additionally she specifically agreed to give us 3 days advance notice and we would use another date.   This is a great benefit to our customers, choosing the dates we bill, but we must have the 3 day notice to make this happen, and she specifically agreed in writing she would do that.  She is also correct in that previous payments had declined and were subject to repeat billing, but she specifically agreed to this and would be aware it would happen when her balance was insufficient.  In short we provided many ways for customer to avoid the situation she states she was in.  This is a difficult situation in that we really can empathize but ask customer to understand our position as well.  In order to show we do care about our customer's we will provide a refund back to her card for the last two monthly fees as a goodwill gesture in order to resolve this situation. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[redacted]

issues.  She also has been a customer with us since 2014 and has experienced our billing practices.   When she asked us to help her again in October of this year we were reluctant as she had previously refused to pay for our services, leaving us with a bad debt of over $300.  We did agree to work on her behalf again and did not require her to pay these arrears, but wiped the slate clean for her.   She was informed, and would know from previous engagements with us, that the first bill is issued five days after sign up.  She signed up on 10/05 and agreed to be billed the case set up and first work fee between 10/10 and 10/20,  and specifically selected the 13th every month thereafter as long as she required our services.  Customer is advised to re-read the copy of our agreement which should help her recognize our billing was as agreed.  We can also provide an additional copy if she so requests. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[redacted]

I am rejecting this response because:  It is incorrect.  The day I signed up with Lexington law, I was informed by the salesperson of the fees.  I agreed immediately to pay the initial 12 or so dollars so the company could pull my credit reports.  I was then told about the $99.95 fee.  I explained after agreeing to hire the firm, that I did not want then $99.95 fee taken out until December 15th, period!  The salesperson did explain that the firm usually charges the fee before that two week period but that she would make an exception in this case.  So this *. *. response from Lexington Law, again, without thorough research, is starting to seem like a constant.  In conclusion, add the additional errors already admitted and we can see clearly that there is definitely a breakdown in communication between departments/co-workers.  Now it just seems like everyone is in C.Y.A mode, unbelievable!!

to resolve the situation. During this client’s representation, Lexington performed its services as outlined in the Engagement Agreement which the client signed. In the short time the client was with Lexington, 2 negative items were removed. [redacted] about her concerns and explained Lexington’s procedures. After speaking and explaining its procedures, Lexington and Ms. [redacted] have come to a resolution to her Complaint. Lexington represents client in credit repair, and does so by sending challenges directly to the credit bureaus and letters to the creditors who report information. Letters to creditors are sent in the client’s name and on their behalf. This is stated in the engagement agreement that each client signs in order to become a client. Letters are sent in a manner that Lexington, in its years of experience, has found to be most beneficial to its clients to try and get the best results possible. Under the Credit Repair Organization Act, Lexington can only collect payment from clients after work has been completed. A client’s first payment is the cost to set up the case, including: pulling all credit reports, initiating identity theft insurance, credit monitoring, granting online access to credit coaching, and other online features. Monthly service fees are paid only after Lexington has worked and provided services on a client’s case. On May 16, 2017, Mr. [redacted] sent Lexington an email asking to close his case. Within 48 hours, on May 18, 2017, Mr. [redacted]'s case was closed. Lexington has attempted to communicate with the client, but has not received a response. once the payment clears it would be refunded, and that refunds take 3-5 business days to post in her bank account. The next day, October 31, the payment cleared and a refund was issued. The refund then went out from Lexington on November 1 to her bank. The 3-5 business days had not passed when Ms. [redacted] contacted Lexington and the Revdex.com on November 2. We see that every item on your report was selected to be disputed, or you asked us to verify their accuracy. As recently as 10/09/16, you logged into the site we make available to you, and one by one told us how to dispute each item. Additionally not one item was marked for us 'to ignore'.    However, in order to protect you from making this mistake, our system overrides any mistaken choice to dispute a positive item.  Without that safeguard in place, it appears you would have had us dispute your positive items.  Upon review we can see that no positive item was disputed by us.  Additionally every time we issued a dispute, not only did you provide the direction, we immediately notified you by email as the challenges were sent.  If you see a positive item removed, it may be for other reasons, or perhaps it was not positive as you believe.  We cannot advise you as you did not mention the item you believe we disputed improperly.   However, in order to ensure this is the case, we will investigate further if you provide the name of the creditor you believe was a 'positive', and the report you believe it was removed from, we may be able to allay your concerns more specifically.  We have been unable to reach you by telephone. Claudia I[redacted]Attorney StaffAdministrative AssistantLexington Law FirmNorth Salt Lake P: (801)297-2494Ext. 20056E:[email protected]

Lexington also provides services in credit monitoring and coaching, identity theft protection and insurance, and online access to other credit and budgeting tools. Lexington represented Ms. [redacted] for two months and provided services according to the engagement agreement she signed, which outlines what services are to be provided and the client’s rights and payment obligations during the representation. Lexington collects payments in accordance with the Credit Repair Organizations Act, which states that payments will not be collected until after services have been rendered. When a client terminates the representation, there is in most cases a final payment to be made based on work previously completed but not yet billed for. Based on updated credit reports Lexington received for Ms. [redacted], she had a number of negative items removed from her credit reports while a client with Lexington. Lexington is able to provide Ms. [redacted] with those updated credit reports at her request, but cannot produce the letters she is requesting as those can only come from the creditors and/or the credit bureaus that have made changes on her reports. Upon receiving this Complaint, an attorney has reached out to Ms. [redacted] via email and has taken steps it feels should resolve her Complaint. If Ms. [redacted] has any additional questions or request Lexington can address, the firm would urge her to contact Lexington directly as indicated in the email to her.

I would like them to fix my problem( at there cost)...they
changed the wrong part....because they put the wrong information in their
computer..and it  said to change another
part....I told them the o2 sensor 1 bank 1  is what was comming up on my computer  and the [redacted]....I said for them to check it on there computer  .....when I pick it up  I see they changed the wrong part...on the invoice and I asked if that was a typo....he said ,,, [redacted]  the owner / manager that is what comes up on the computer.....and 5 days later the check engine light came back on....so I went right to [redacted] and they confirmed that it was o2 sensor 1 bank1...so when I went back and asked whats up...that they changed the wrong part.....he said  well that part must of just went bad now......so I went home pissed....to calm down and then  looked at my invoice and seen they put the wrong info about my truck on invoice...so im asumeing they put the wrong info in there computer to see what part needs changing.....they put in that I have a V-8.........but I really have a V-6....and what upset me the most was........it has been in the shop many times before that time  and they dont even know wehat there working on.....so I would like them to put in the correct part...at there cost.....thank you for your assistance
