written contract, and then cancelled your service during the first month.   You were charged only the set-up fee, as agreed, five days after sign up.  This gave you a chance to cancel without charge during those first five days.   You did not cancel during the first five days, but rather 7 days after sign up.  This was your choice and we had no option but to discontinue work on your case.  You neglect to mention that we were not successful in our billing as your bank declined us for lack of funds available.  We are still owed this $49.95, as you did not cancel during the grace period and we had spent our time and labor and infrastructure on your case, and you agreed in writing to pay for this.   We are legally entitled to the money you agreed to pay us. Yet you did not make any payments at all. We retain a chat transcript, where all of this is discussed.   During that discussion you pretended you did not know about the charge, but we have an earlier call where you discussed billing dates, and of course there is the contract you signed which clearly states we will charge and additional 19.95 for missed payments.   You were also informed during that chat, after you became discourteous to our agent, that we were going to simply waive the charge as a customer service gesture, and take a loss on this arrangement.  This was extremely kind of the agent to make this offer to you.  You knew at that point we had completely resolved your issue, in your favor, and at a loss to us.  You even threatened the agent that it would not stop you from speaking ill about us.  Yet we did nothing but work on your behalf, then excuse you from obligation, waiving all fees for you.  You also demand we now make corrections to your credit report.  This is not possible as you cancelled the service that was for that very purpose.  Thanks,Kristine G[redacted] | Managing Executive Assistant, Lexington Law FirmStatement of Confidentiality: The contents of this e-mail message and any attachments are confidential and are intended solely for the addressee. discount on the first fee he would pay to Lexington, but would then continue Lexington’s service by paying the normal monthly service fee based on the level he chose. Lexington bills in accordance with the Credit Repair Organizations Act and only collects payments after services are provided, not when results are obtained. Lexington is unable to guarantee results or collect payments based on results. Upon receiving Mr. [redacted]’ Complaint, an attorney from Lexington contacted him to discuss his concerns and come to a resolution. [redacted] opened his service with Lexington Law on December 2, 2016, and closed it on May 19, 2017. During these 5 1/2 months, Mr. [redacted] saw 12 negative items removed from his credit reports. Mr. [redacted] may be confused by the billing because of how frequently his payments to Lexington declined. On at least 7 different days, payments for services already rendered were declined. Due to this, payments were often collected on days outside of the normal billing date. In fact, on the day Mr. [redacted] closed his case, his account with Lexington was past due by $225, which was never collected. Lexington attempted to communicate with Mr. [redacted], but no calls were returned. services, Ms. [redacted] entered into the engagement agreement and became a client. The engagement agreement sets forth the services Lexington will provide as well as the client’s rights and payment obligations for as long as she remains a client. During this same phone call, Ms. [redacted] was offered a lower price off her first payment if she knew of anyone else who would want to become a client as well. Ms. [redacted]’s daughter decided to become a client and also signed the engagement agreement. An attorney from Lexington has reviewed this call and verified that Ms. [redacted] allowed her payment information to be placed on her daughter’s case as well. Because her payment information was on two cases, the amount for each case was drafted in accordance to when each client decided to make monthly payments. An attorney from Lexington has contacted Ms. [redacted] by phone and email to inform her of why multiple payments were made from her card. Lexington has also taken steps it feels should resolve her Complaint. These steps have been communicated to Ms. [redacted] via voicemail and email. This is Lexington Law Firms Response to Ms. [redacted]’s Rebuttal to the original Response to her Complaint. Lexington reaffirms that which it stated in its initial Response and again regrets to hear of any negative experience Ms. [redacted] had with the third party that referred her to Lexington. Lexington does not own or have any control over the actions of that company, and thus cannot speak directly as to what did or did not occur between it and Ms. [redacted]. Ms. [redacted], and any potential client, are free to consider all factors when deciding to engage Lexington to represent them in credit repair. Lexington assists those who need help repairing their credit independent of any interactions with other companies. Lexington gives each client a five day right of rescission window within which a client may terminate representation at any time without being charged their first fee. This is two days more than is required under the Credit Repair Organization Act and allows each client to evaluate whether Lexington’s services are a good fit for them. Ms. [redacted] has already received a refund for the one-time payment she made of $14.99 to obtain her credit report and has not made any other payments as she terminated representation within five days. If any representatives from Lexington exhibited rude or demeaning behavior then it apologizes and will be dealt with internally. client was unsatisfied for any reason. In this case, Ms. [redacted] entered our representation on May 19, 2015. Ms. [redacted] was thereafter billed in accordance with the agreed upon billing policies through the last payment she made on August 26, 2015. The following day on May 27, 2015, Ms. [redacted] called in and canceled her case. She was not billed again. Nevertheless, an attorney with Lexington Law Firm has contacted Ms. [redacted] and the two parties have come to a mutual resolution. single client was unsatisfied for any reason.In this case, Ms. [redacted] admits that she entered our representation. On the day that Ms. [redacted] entered our representation she agreed to pay her first bill of $99.95 on December 2nd. As agreed, Lexington Law Firm attempted to draft the payment, but was declined. Thereafter, a reprocessing fee was assessed in the amount of $19.95. Lexington Law Firm sent numerous emails informing Ms. [redacted] of the declined payments and after several additional attempts, was forced to close her case due to non-payment. Eventually on December 29, 2015 we were able to draft only the reprocessing fee of $19.95. As of this date, Ms. [redacted] has failed to pay the original bill of $99.95.In Ms. [redacted]'s complaint she requested a call from Lexington Law Firm. An attorney with Lexington therefore obliged her request and called her on December 30, 2015. During this conversation, the attorney explained to Ms. [redacted] the aforementioned facts. law firm that specifically represents its clients in ensuring the items on their credit report are an accurate portrayal of their credit history. The amount owed on a debt and the reporting of that debt on credit reports are two separate and distinct things. Lexington does not settle, negotiate, or represent clients in court based on debt they may have. The engagement each client signs to become a client outlines what services Lexington will provide for each client. Lexington began representing Mrs. [redacted] onNovember 29, 2017in order to assist her with credit repair. Lexington sent challenges to the credit bureaus and letters to creditors each month Mrs. [redacted] decided to have Lexington continue with representation. Based on the first conversation with Mrs. [redacted], Lexington did not agree to represent her in court or in reference to the amount of debt she may owe. Lexington only agreed to represent her within the scope of credit repair to try and have negative items removed from her credit reports. Upon receiving this Complaint, an attorney from Lexington reviewed the details of her Complaint and her case with Lexington, including her initial conversation over the phone when she engaged Lexington to represent her. Lexington has tried to contact Mrs. [redacted] twice by phone and with an email in an attempt to discuss her concerns. As of the time of this Response Lexington has not received any response to Lexington’s correspondence. reports are a fair, accurate, and substantiated portrayal of their credit history. Upon engaging Lexington, a client may choose from several different levels of service based on their circumstances and budget. These service levels, and exactly what they entail, are included in the engagement agreement each individual signs before becoming a client. In reviewing Mr. [redacted]’s case, he initially engaged Lexington on a level that included challenging negative items on his credit reports. Lexington proceeded to challenge items directly with the credit bureaus and send letters to creditors on his behalf. Mr. [redacted] also had access to online budgeting and credit tools, Identity theft protection, and identity theft insurance. After one month of this service level, Mr. [redacted] decided to change to a level that only has credit monitoring and Lexington accordingly provided a TransUnion credit report and FICO score every three months as the Engagement agreement indicates the firm would do. After reviewing his case, an attorney from Lexington contacted Mr. [redacted] to speak with him about his case and the details of his Complaint. Lexington has also offered to send copies of services performed to Mr. [redacted]. Be weary of anyone who says they  can repair your credit. I did not agree with the attorney I spoke with in regards to work done & the results. Moving forward we were able to agree to disagree I accepted a partial refund so we both can move on.

Lexington began sending challenges to the credit bureaus and letters to creditors on her behalf and continued to do so until Ms. [redacted] terminated the representation on June 15, 2017. Over the course of the four months Lexington represented her, Ms. [redacted] was able to see 13 negative items removed from her reports. Upon engaging Lexington’s representation, a client chooses the service level that fits both her needs and budget. Lexington, in adherence with the Credit Repair Organizations Act, then collects payments for the services rendered after they have been completed. When a client closes her case, she should expect a final payment for the work that has been completed up to that point. This final payment on Ms. [redacted]’s case was drafted as it was for work that had previously been completed for her. After receiving this Complaint from Ms. [redacted], an attorney from Lexington reviewed her case and contacted Ms. [redacted] to discuss the details of her Complaint. I am rejecting this response because:I did not receive a phone call which admittedly may be the work of our phone system which recently seems to be acting up.  I also did not receive an email as indicated in their response.  I would be willing to hear from Lexington and encourage them to respond via my email as listed in the complaint.

I am rejecting this response because:I called Lexington law on August 8, to inform them that I want to close my account with them effect September 2016. Even though my credit card was debited for the month my case status was suspended. I called and was told by a supervisor that no information could be given because it was in the attorneys hands. Today August 10,I once again tried to sign in and my account is still suspended. In regards to the disputed Experian I was told by an supervisor that the firm sent out one dispute every180 days, they only sent the dispute for only one item and not all 3 disputed items. He apologized and state he sent the other 2 items on 8/1/2016. He said he would sent me letters to be notorized to escalate my accounts. As of today I have not received the letter and my accounts is still suspended. I would like a refund for the month of August due to non service.

enroll as well. Lexington offers half off the first fee each client must pay when two individuals enroll together. This discount is only for the first fee and not for each monthly payment thereafter. It seems that this was not clear when Mrs. [redacted] enrolled. Upon receiving Mrs. [redacted]’s Complaint an attorney with Lexington reviewed her case and reached out to her in order to address her concerns. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is MORE THAN satisfactory to me.   I never requested that my first two payments of $99.95 be refunded; in fact I wrote that I was very happy to pay the first two payments if for no other reason, that I discovered that I had no negative entries on by bureaus.  Nonetheless, I accept LLF's very generous offer and I will very gladly recommend them to my friends and family.  If I ever need to investigate my bureaus in the future, I will certainly feel very positive about LLF!  Please let LLF know that they have made a customer for life.
