Considering there have been numerous similar complaints in the past and yet you continue to ignore 'do not solicit' instructions

Regards,
[redacted] needs to send in the recorded conversation of there selling tactics that lead you to believe your car has people INTERESTED IN BUYING YOUR VEHICLE not just having 500 plus people look at your marketing material!! I don't care if he sent the recording in of me stating that I had 45 to get a refund or not!  The only reason I signed up with this company as it was stated by representative they had BUYERS interested in my vehicle already NOT LOOKY LOOS!!  That is there fraud sales tactic to get you wrapped into signing up with them.  I also tried to cancel this in the 45 days but [redacted] kept telling ME TO GIVE IT MORE TIME, CHANGE THE PRICE ITS TOO MUCH etc! Pull those phone records.  I can send the records of EVERFY SINGLE time I called this company to complain about no movement of the car AND  I HAD THE RIGHT TO CANCEL [redacted] drug it out making sure I got past the 45 days they so want to try and stand BY!!  I have sent email records already proving my complaint issues.
TITLE 48 MONOPOLIES AND TRADE PRACTICESCHAPTER 6 CONSUMER PROTECTION ACT48-603.  Unfair methods and practices. (11) Making false or misleading statements of fact concerning the reasons for, existence of, or amounts of price reductions; also to make note, I didn't need to threaten to call my credit card company its a fact I will do so if necessary.  I am making it very clear to this company how they are in the wrong!  This account needs to be refunded asap.

After reviewing Mr. [redacted] account with Once Driven, it has been determined that (in a good faith effort) Once Driven will accept Mr. [redacted] refund request due to lack of response from its potential buyers.  A refund of $189 will be issued once a card number is provided by the...

customer to perform the refund.  The card account used to pay for Mr. [redacted] listing (card ending with [redacted]) is showing as an invalid card.  If Mr. [redacted] can provide Once Driven with the card information, we will process his full refund immediately.Sincerely,[redacted]Quality Assurance Manager

I have provided proof of sale of the vehicle several times to the business including a notice of transfer and release of liability that the dealership gave me when I sold them the vehicle, I have attached the file above, this file was faxed and emailed to them on three occasions

You have in fact called me on the listed nimber bout a year ago when I was selling my supercharged xterra, you called me two weeks ago at [redacted], and you had previously called me at [redacted].  They constantly violate solicitation agreements through craigslist. The most recent xterra was only advertised on there. Not only do I check the "do not contact me with solicitation" box. I also include in my ads that I do not need help selling the vehicle, nor do I accept Pay Pal. This company contacted me and left me a voicemail which I still have and I could easily provide to you guys. Fake call Via a blocked number, and anything they say contradictory to that is obviously a lie as I have the voicemail and call log showing it.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved.

Once Driven has read Mr. [redacted] complaint and appreciates the opportunity to respond.  Mr. [redacted] stated that the guarantee was in "fine print".  Before Mr. [redacted] payment was processed, the Once Driven 45-Day Guarantee was explained in detail and Mr. [redacted] clearly agreed to the terms...

before his credit card was processed.  In addition, Mr. [redacted] was sent a confirmation email which has a direct link to its refund policy.  Considering the only contact Mr. [redacted] has had with Once Driven was to set up (and pay) for his listing with Once Driven on 8/12/2016, I am not quite sure where his assertion that Once Driven is a scam arrived.  When Mr. [redacted] spoke with Once Driven on 8/17/2016, his refund request was denied due to him agreeing to the 45-Day Guarantee on 8/12/2016.  After it was explained that he was not eligible for a refund, Mr. [redacted] then stated that he had already started the charge back process with his bank.  In light of those comments, Once Driven will not be processing a refund of Mr. [redacted] payment since his bank will most likely make his funds available. If Mr. [redacted] does change his mind about charging back his payment, and sells his Yamaha to a buyer not provided by Once Driven within the first 45 days, he would be eligible for a refund of $189 minus the $29 processing fee that he agreed to on 8/12/2016.On behalf of Once Driven, we wish Mr. [redacted] the best of luck in selling his MotorcycleSincerely,[redacted]Quality Assurance Manager

Per Mr.[redacted] request, Once Driven has issued a 50% refund of $95 back to his original method of payment.  Mr.[redacted] will need to allow 3-5 business days for the refund to appear back to his original method of payment.Sincerely,[redacted]Customer Service Manager

The phone number associated with Mr. [redacted] complaint was added to the Once Driven Do-Not-Call database on 10/13/2016 at 5:32 P.M. EST and will not be contacted again.  On behalf of Once Driven we apologize for any inconvenience to Mr. [redacted].Sincerely,[redacted]Quality Assurance Manager

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.the online refund procedure requires a number of unnecessary steps in order to remain eligible for a refund, I followed every single step, EXACTLY as requested and did everything as I was asked to do. This included the proof of sale. the vehicle was sold on [redacted] back in February and shipped to a gentleman named [redacted] who lives in [redacted]. At that time I sent over the [redacted] item number, the [redacted] submitted deposit information and the several other supporting documents that I was able to screenshot and submit.     That was nearly 6 months and now and unfortunalty [redacted] doesn't preserve data from sales made that long ago. The bottom line is, I payed for your lousy service. then I sold my vehicle without any help from you or your staff. they never even called me a single time with a lead or an interested buyer. NOW I deserve a refund. whatever you need to do to verify the sale. YOU NEED TO DO! is your business doing that bad that you want to rob innocent people of their hard earned money? its bad enough I have to pay for a processing fee... you people did absolutely NOTHING to help me get that car sold.Regards,[redacted]

I would like personal contact from the business owner. Not a copy and pasted form letter. They contacted me from a [redacted] ad which specified "do not contact me with unsolicited offers".In talking with their representatives its obvious this is a common practice. It was also obvious that the people answering the phone did not care, and would actively prohibit me from escalating this situation.I would like to know what measures they have put in place to stop this practice of harassment from continuing.Anything short of this and I will continue to pursue legal options via representation.

I have responded to an email that Mr. [redacted] sent to me Friday afternoon via my email account ([redacted]).  In the meantime,  I have asked Mr. [redacted] for any additional phone numbers that he may have called from to Once Driven to thoroughly research his claim of no returned...

phone calls.  Once a reply is returned to me from Mr. [redacted], I will respond accordingly.Sincerely,[redacted]Customer Service manager

If Ms. [redacted] sells her Mustang to a source not delivered by Once Driven, she will be eligible for a refund minus the $29 processing fee.Once Driven has delivered the service that Ms. [redacted] purchased on 6/1/2016.  Once Driven will continue to proactively market her vehicle to assist her with...

the sale until she has sold her car.  Unfortunately, a repossessed vehicle does not constitute an actual sale, and would result in Ms. [redacted] not being eligible for a refund due to a Title Transfer not transpiring.Again, Once Driven's intent is to help Ms. [redacted] sell her vehicle before a repossession may be necessary.Sincerely,[redacted]Quality Assurance Manager

The last paragraph of my previous response clearly stated the issues I have with this company and being refunded if my car was repossessed was only one of the problems.  The issue is not only the false information given to me by two employees regarding a refund if my vehicle was repossessed but my car wasn't even posted for sale until I complained.  I haven't had even one person referred by Once Driven contact me but again I was assured during the first call that my car would likely sell in a few days.  As I mentioned in my previous message, Once Driven has failed to provide even the most minimal service.  I had to call and email several times to get a response at all from my contact there and when she did finally contact me it was because I told her I'd filed a complaint with the Revdex.com and sent her the complaint number.  I was then told that my account was being turned over to the "Refund Department" which would lead any reasonable person to believe that they will likely receive a refund.  When I sent an email requesting contact information for the Refund Department I received no response.  Instead Once Driven immediately responded to my complaint. Given the reputation of the company and the numerous complaints against them it's not at all unlikely that they would fail to provide the services paid for.  Given the number of complaints filed with the Revdex.com it seems that I am a far more reliable source of information or services they provide than they are.  As I said before, I would like a refund.  Feel free to keep the $29 but I am entitled to receive the rest of my money back since the company gained my business under false pretenses and has failed to live up to expectations of service they offered.

Once Driven fails to distinguish between title transfer and registration. In the state of [redacted], those are two separate events. we transfered title [redacted] a long time ago. The fact that he didn't register the vehicle under his name for plates, etc. should have no bearing on my refund. In fact, your sales person clearly said it doesn't matter to whom or how I sell the car too ("even you ould donate it").
In any case, the title is attached. Still, either you need to change the refund requirements, or you need to train your sales people to explicitly explain that you make the determination based on registration, not the title transfer. Again in the state of [redacted] these are two independent events and one doesn't predicate the other!

Per the 45-Day Guarantee that Mr. [redacted] agreed to on 5/12/2016, Once Driven will continue to market Mr. [redacted]'s Honda for him until it is sold at no additional fee.  For Mr. [redacted]'s convenience, I have included a direct link (below) to the Once Driven 45-Day guarantee that explains the...

refund eligibility requirements that were not met by Mr. [redacted].  [redacted]This is the same guarantee that was read to Mr. [redacted] before his payment for services was processed on 5/12/2016.Sincerely,[redacted]Quality Assurance Manager

[redacted]    I understand most people know how to upload pictures, but I didn't know how to start this process and that is why I did call back within a 2 week period. The first  time I gave a message with someone  to give to [redacted]...then I called back within 3 days and left a message with [redacted]. I asked if someone could call me back. I  feel this amount of money would be a good investment for my purposes, because of needing help with uploading photos. I am discouraged with these types of services, as  I do feel taken advantage of...thank you for your response, [redacted]

The phone number listed with Mr. [redacted]'s complaint was added to Once Driven's Do-Not-Call database on 6/4/2015 and will not be contacted again.  Once Driven apologizes for any inconvenience to Mr. [redacted].Sincerely,[redacted]Customer Service Manager
