Re: #[redacted] We are in receipt of the complaint filed by [redacted].  We apologize that our sales staff...

did not communicate with [redacted]the “bird dog” process correctly. “Bird dog” fees are paid when a customerrefers a friend or relative and they in turn purchase a vehicle from MidwayNissan.   The fee is paid to the referring customer when the deal is completely funded from the lending institution.  [redacted]’s referral purchased their vehicle on January 25, 2015.   The financial papers were sent to the lender on February 9, 2015. We are currently waiting for the funds to be received, as well as the down payment check from the customer to clear the bank. This is our standard procedure for all “bird dog” fee payments.  [redacted] will be contacted by our Customer Service Director, [redacted] when all of the bank requirements have been met.  Prior to that if [redacted] has any questions he can contact Mr. Hendizadeh directly at the dealership.Again, we apologize for the inconvenience this has caused [redacted]. Thank you for the opportunity to respond to this complaint. Patti StephanyCompliance Director Midway Nissan

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I have verified the refund has been received by [redacted].  Thank you.  However, I take exception to the inference that I was informed that I gave consent to or was informed that I was being video and audio recorded.

Regards,

My husband and I have purchased 3 vehicles from midway and have had great service. Johnathan was our sales person for the most recent vehicle we purchased. We had a great experience overall and he was very knowledgeable, helpful and patient :) we will continue doing business there.

My experience was the best ever after searching for a car through other places for 2 months with no luck... Midway Nissan is the place to go!!! Vanessa Valadez was extremely helpful from start to finish & made sure I got what I wanted. Miguel the internet manager went above and beyond, he followed up during the process and made sure I was well taken care of. I recommend asking for Vanessa if you decide on getting a new car through Midway Nissan !

I just bought my car here, and I had a great experience. My sales rep was Ken and he was awesome! He stayed late to help me and went out of his way to make sure I got what I needed. He was extremely friendly and helpful. As was everyone else there I encountered. I am definitely happy with purchase and experience here.

Best experience I have ever had buying a car, friendly fast service.

I was treated so well here that I will not shop anywhere else for a vehicle for the rest of my life. I will referr midway nissan to everyone that I know. I honestly have nothing bad to say about this company and its employees

I just bought my 3rd car from Midway Nissan. I got to work with Victor on this latest purchase. He had amazing knowledge of the vehicles and was very kind and patient and helping me find the right car and the right deal for my budget. I would highly recommend him and Midway Nissan. Their staff is amazing!

I can understand why Midway Nissan is rated the best dealership in AZ - they did a great job. I would like to thank Adam for being patient with us - he is also very knowledgeable and personable. We did end of leasing a 2016 Rogue. Thanks to a great team at Midway!

I was extremely happy with our service.. Ken was very helpful..I'm very pleased with everything he did for us..we need more customer service like his..He was great!!Thank You Ken and Midway Nissan..

They know what automobile they purposely got us to drive all the way from Chino Valley to Phoenix for.  They said my 835 credit report did not qualify me for their internet deal when [redacted] Or [redacted].(I'm not at home now to check his name) but the internet man who had set a 9:45 appointement with us & then "jacked" us on to another agent who HIGH pressured us for 3 HOURS.  Plus the illegal manner in which they take a persons auto keys so you can't leave.  And especially when there were other keys they legally had no right to on the key chain.  Home & business keys.  This is the general practice of AUTO dealoers as my freind who recently purchased an auto, the dealer did the same to him,  They are covering over an internet scam they more than likely due to anyone who goes on the internet to buy a vehicle from them.  If yu beleivethem, then it like [redacted] phrase,(WHAT DIFFERENCE DOES IT MAKE) WHICH CAN APPLY TO ANYTHJING THAT GOES ON.    It's really up to you to decide what action you want tio take.  There are dishonest practi9ces going on here & if you don"t want to list them as  auto scammers., then don't.  I'm done with this, especially since you do not want to act on what I sent now & before.  I suspected as much.

Hadi was the person who sold me new 2016 Nissan Sentra and he was extremely helpful and got me the deal I wanted! What an awesome genuine guy I would recommend him to everyone!

By far the best car buying experience I've had. My salesman Hector G[redacted] understood my situation and bent over backwards to get me the kind of deal I could manage. Also Van Hill in financing, awesome job in finding the best APR I've ever seen! So happy with my experience and my new Nissan!

Worked with Freddie and purchased a new 2016 Nissan Sentra. Freddie was great to working with, no pressure sales stuff, extremely knowledgeable about the Nissan cars, and a nice guy as well.

I went in on August 21st to buy my first car. I found a Toyota Corolla that I really liked with Midway Nissan. I test drove it and I decided I would get it. My cosigner and I signed all the paperwork. When we went to finance we had a guy named Alex who was very nice at first, he then offered me some insurance for my car that I declined. He continued to try and get me to get it, I told him I was sure I didn't want it. Once I declined he became a rude person. I know they are gonna try to sell things after but I didn't expect for him to be rude after. Once everything was signed he said we had to come back on Friday to sign paperwork from the bank so the sale could be finalized. We made an appointment for Friday at 6pm.

On Friday I left work and drove to Midway Nissan, which is an hour away. I get there and I ask for him but he doesn't come out. We waited like 40 minutes for someone to come and speak to me and finally a gentleman named Eric came out. He told me the contract wasn't ready. At this point I became aggravated because not only have I wasted my time but my cosigner has wasted her time too. I let him know I was upset and that they could at least have called me to cancel my appointment due to us living far from them. He was very nice and apologized. He then told me that when the contract was ready they would call me and if for some reason I couldn't make it they would come to me. My cosigner was very upset because she had other things to do. On Wednesday I get a call around 5 pm from Alex letting me know the contract is ready and I have to go NOW. I let him know I was working and would be unable to go. I work in the medical field and I cannot just leave whenever they need me to. He said my cosigner and I could go different times but that we both had to go in to sign. I told him I would get back to him in a few minutes, I had to call my cosigner. I called her and she said she was getting her tires fixed because she had gotten a flat and would be unable to go today.

I called Alex back but he didn't answer.

I get a call at 8:40 from the girl who sold me the car and she's asking me when I can go. I told her I would be able to make it the next day after work because I would get out early. She said that was fine. When we hung up I had a voicemail from Alex who called me at the same time that the sales girl called. The voicemail said I had 20 minutes to get there to sign. Since the other girl told me it was fine if I went the next day I didn't call him back and because I live an hour away there was absolutely no way that I could make it there before they closed.

The next day my cosigner calls me when I'm at work and tells me she was going to go sign but Alex told her not to go because the deal was off and I would not be able to keep that car, she as well mentioned that he was very rude about it all. I immediately called Alex who was not answering. I then get a call from another guy who says he works with Alex, I asked him about it and he said we should be fine and could still sign. I told him I wanted a call back from Alex.

A few minutes later Alex calls me back and told me that because I didn't go sign yesterday the deal was off and I had to return the car. He said he would have other cars there waiting for me so I could pick a new one. I told him I didn't want any other car besides that one. I'm pretty set on the car I was looking for. He said I couldn't have the Corolla but I could get another one. I told him that if I had to return the car I would prefer to get my down payment back instead. He said that was fine.

I left work and on my way to the dealership I get a call from the sales girl, she asked me when I could go sign the papers, I told her I was on my way there and that I was actually going to return the car because Alex said I had to. She said that was weird because I still had a few more days to sign and that she was gonna look into it.

When I get there The sales girl is there with a manager, they approach me and I told him what was going on. He apologized and was telling me they were gonna fix this.

So they took me to a room and about three other guys went in there, managers. They told me they felt bad about what happen and would take care of it. One of the managers said that the deal with the bank didn't go through and I wasn't approved so I had to return the Corolla but that the bank did approve me for a new car. A 2016 Nissan Sentra. It doesn't even make sense!!! I was approved Wednesday but Thursday I wasn't?! He tried to explain to me everything but it just doesn't make sense to me. I let him know I wanted a Toyota Corolla not a Nissan. He tried to persuade me to purchase that Nissan but I told him my mind was set and I would like my down payment back. Every guy who went in tried to sell me that Nissan and tell me why it was better for me to buy a new car. I told each one that my mind was set and I wanted my money back.

Alex came in and "apologized" for the way he made me feel but he said he was only doing his job. He then said he called me with enough time to get there to sign. He showed me the notes he made on the computer which said he called me at 8:30 or so, but I have the voicemail as proof that he didn't call me at that time. I told him I didn't want to speak to him and would just like to get my money so I could leave.

They asked me for the keys, I only had one due to me being at work and not expecting to have to return my car when I left home that morning.

I told them I could bring the key back the next day if they allowed me to but they said no and that I would leave without my deposit. They would not provide a ride for me to go get it and would not let me drive the car to go pick it up because it's company policy.

So I call my mom and asked her to come drop the keep off to me halfway from home and I asked my cousin to give me a ride to them. I picked up the key and brought it back. Once I gave them the second key they did return my deposit.

I was honestly scared they would screw me over some how.

This has been one of the worst and most humiliating experiences of my life.

I don't understand why I was approved one day then the next day I wasn't?!

When I was speaking to the sales girl she told me that to her knowledge I had two more days to sign.

I honestly think it was a way to try to get me to buy a new car and not only that but a Nissan. I am very upset about everything. Now I am car less and have to start from square one again. Very horrible experience.
