attention.
Mr. [redacted] received a membership card in the
mail, not a credit card.  As the complaint suggests, mailing of
unsolicited credit and debit cards is an illegal...

practice.  National
Funding has never sent such an offer.  While there are design similarities,
the differences between what we mail and a credit card are significant: 
The National Funding marketing piece contains no association logo (Visa,
Mastercard, etc.), and there is neither a magnetic strip nor a signature strip
on the back of this card.  Furthermore, the card specifically states that
it is a ‘membership card, not a credit card.’  The package is designed to
gain interest in our financing services, and is a commonly used format in the
financial services industry.
[redacted]’s business was prequalified for our
membership card based on the business information provided to us by [redacted] and
[redacted].   To activate the account, additional information would
have been required from [redacted] Publications.  We also check additional
business sources, such as the Secretary of State.
We apologize for any concerns that our
marketing piece may have caused Mr. [redacted] and we appreciate the opportunity to
address them. We will ensure [redacted] is removed from our system.

Attached you will find the following: EFA #1 with the higher payment. I would like to call your attention to a couple different things.1. Please notice the language outlined on the cover page that talks about additional fees and site inspection fee is listed. 2. Please notice the payment on the front of the EFA $553.933. Please Notice the last 2 sentences of page 3 section 1 where it clearly explains interim.4. Please notice section 5 where it talks about our ability to do a site inspection5. Please notice Equipment exhibit A lists the original vendor Power Protection Services Customer paid for the equipment after this set went out because the private party, that he chose to work with, was requiring that we cut a check to him personally. His personal name was not listed on the title so we could not cut a check to him personally. The only entity we could cut a check to was the legal owner on the title which was the business. EFA #2 with lower payment. 1. Please notice the language outlined on the cover page (AGAIN) that talks about additional fees and site inspection fee is listed. 2. Please notice the payment on the front of the EFA $521.593. Please Notice the last 2 sentences of page 3 section 1 where it clearly explains interim.4. Please notice section 5 where it talks about our ability to do a site inspection5. Please notice Equipment exhibit A lists the original vendor as the customer. EFA Final setThis is the set that was countersigned by us and fully executed by both parties. Cover letter that was sent out with customers set of fully executed docs.Please notice the section on this letter that also references interim and any charges associated with the finalizing of this deal. This customer was put on notice of all the amounts due twice with the first set of docs, twice with the second set of docs, and again once the deal funded and the final copies were sent out to him. We then followed up with an invoice that broke down the fees that were due and the dates they were due. Once you have reviewed all these items please let me know if you need any additional information. Thank youNational Funding, Inc.

I have received a solicitation from this company and do NOT think that there is anything wrong with their advertising in the form that they currently use. The card they sent says that "Your Account Has Been Established". This is done to get you to call. You should know this because it also says that you have been pre qualified and to confirm your card.
As we know, there are no guarantees on anything. I have called the Attorney General's office to make sure that this company is real. After being on hold for the AG's office for an hour, I decided to hang up.

Good Morning,
Mr. [redacted] called in off a marketing piece in June and applied for a loan. We were unable to approve him for that loan due to low annual gross sales which we explained to Mr. [redacted] at that time. Our marketing pieces are generated weeks before they are actually sent out so...

it appears that prior to the decline another piece went out to Mr. [redacted]. Unfortunately, we are still unable to complete a loan for Mr. [redacted]. We apologize for any confusion the second marketing piece may have caused.

The previous owner of my home had a business - possibly a sham business as I'm finding out to maybe evade taxes. I received a mailing from National Funding with what looks like a credit card account qualifying my name connected with this sham business for up to $150k credit. I consider this to be deceptive business practices since this is NOT MY BUSINESS and my name should not be connected to it. I will also request that any data gathered by them - which is horrendously inaccurate - be removed from their database. Anyone interested in looking into a class action lawsuit? This is slimy business skimming at it's worst.

We are responded to the consumer's complaint of Ms. [redacted]:We have ensured that Ms. [redacted]'s record has been removed from our list, however, total removal may take 60-90 days. After this time, Ms. [redacted] will no longer receive mailings. Our financial solicitations are not credit card offers, and there is no risk of identity theft, as additional business information is required from the business owner to obtain a business loan or equipment lease. Business information is publicly provided by [redacted] and the Secretary of State. We encourage Ms. [redacted] to contact these agencies if she wishes her business to be placed on a Do Not Solicit list to ensure she no longer receives these offers from any other companies, as this is a common practice in the financial industry, and is not illegal.Thank you,National Funding, Inc.

As with any attempt to obtain credit from a company there will be several factors taken into account and not everyone can be approved. We notified [redacted] as soon as we were aware he would not qualify for a lease and gave him additional options to try to qualify him. We feel we made every effort to help [redacted] but in the end were unable to.

My loan agent is very helpful; sincere and honest to my knowledge. I got my loan funded very quick within 2-3 days of the approval. And the procedure is very simple. I highly recommend National Funding to anyone who needs a business loan.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
National Funding claims that the contract states that [redacted] owed them $389,999.36.  However the contract very clearly states the Total Repayment Amount is $386,999.36 and they admit to taking $389,999.36.  If the origination fee was additional, it should state that somewhere in the contract.  National Funding has not been able to provide anywhere in the contract that states that the origination fee is not part of the of Total Repayment Amount.  Safe Haven will not be satisfied with any answer other than a refund of the $3,000 overpayment which National Funding withdrew from our account.
