It seems there is some confusion on whom Mr*** was speaking with as *** is an administrative assistant and does not converse with anyone on the phone. She is also a female and not a male. This raised the initial concern of accusations towards our company. After a review
of the phone calls to whom Mr*** did speak with there is some concern in regards to the professionalismIn which has been address by our compliance department. Mr*** please feel free to contact *** *** the VP of Collection Operations at your earliest convince to resolve the outstanding matter

Attached are both recordings of the conversation with Mrs*** and the actual rep as we have no one by the name of *** in our employMrs*** is not only stretching the truth as you will be able to decipher from the recordings she is also mis representing the factsShe listed her work
information with the original creditor and all documents from this loan were factually emailed from the original creditor and that is the only way the money was directly deposited into her accountFurther a letter was mailed to her address of record in April and the disputing period has expiredwhe was using profanity and making demandswe never told her we would be speaking to her employer as you can see in the recordingwe told her that we would speak to her tomorrow as she was calling our rep a piece of s---ion closing this loan went into default within days of the funds being deposited into her account and this type of action and mis representations is clearly nothing more than smoke in mirrors to attempt to avoid paying her obligations

At no point in time was contact established by outgoing call from our officesCalls to Place of employment as well as every other number only resulted in messagesOn October at 08:am pacific time an incoming call from *** spouse was received by our officesShe was given every form
of repayment option and declined every one and ultimately hung up yelling neither her nor Akil had any intention of resolving the obligationAt no point prior the October 2nd was any contact made either verbal or written let alone requesting no calls to any phone numbersAs I consider this complaint such a request, all phone numbers have been removed and our efforts will center around written correspondence

I am rejecting this response because:The actions taken by the employees of this company during our phone call broke the law as declared by the Fair Credit Debt Collections Practices Act "No debt collector may shame or harass" a customer I was harassed by *** during our phone call His comments and tactics were bullying, shaming and harassing.I do not agree with their response to my complaint.Regards,*** * ***

I am just about done attempting to resolve this unreasonable complaintThe consumer was abusive to us on the phone and factually she got what she wantedwe are not calling her work and sine the most recent detail, I have taken the other number out as wellIronically not only did she supply the main number to her place of employment she also used her business domain as the email for the electronic documentsI have no idea how the phone system works at the number ending in however this was the number we called and the only other number we did locate ending in was believed to be her direct lineSo in closing she applied for a loan, listed the main line as her place of employment number and use her business domain and yet she is up in arms because we are attempting to contact her with the information given to the lenderfurther I am attaching the VOD that was sent the same day as that final call that was mailed to the address also listed from the lendershe is claiming to have received nothingthat was mailed via us postal mail and by supreme court ruling, if we mail it and it does not come back, she received itI am sorry if the information given to the original was not intended to use should the consumer be delinquentIf there is anything else the Revdex.com would like to review, I will be more than happy to share, however this is my last response as it is obvious to me that this is nothing more than a stall tacticAll our calls are recorded, all our documents are in order and we have not broken any law

received on that particular account as the responsible party was reported to us as deceased by the doctor's office prior to any calls being madeAdditionally there were no payments processed or sent to us with your address, phone number, name or combination of on any account in our systemsIf you have any information or receipts to show when, how much and to whom any payments were made I will research the matter further and ensure credits are applied appropriately in an expeditious manner

I am rejecting this response because:1) There was no mention of the fourth (4th) and final call to my place of business, where *** *** huon the ReceptionistI work for a local government entity, this is 2) Once I informed *** *** that I was disputing that the account was mine, that I could not discuss it at my place of business, did not want to be contacted at my place of business, and to contact me by mail, *** *** should have not proceeded to aggressively demand answers to various questions (all while speaking over me, which forced me into an aggressive tone)I'd like to add, once a debtor asks a collection company not to call their place of business, they are required by federal law to stop*** *** called me at my place of employment, but then made subsequent calls within minutes (to the exact same number) presumably in an effort to verify my employment (at the same number she just reached me at)Obviously, if you just called a local government agency, were transferred to my extension, I pick up the call, we talk, there's a good chance that I work there.3) Attempting to verify employment prior to a court order - which is required in the State of California - before any levy, etccan be enforced, is presumptuous.4) *** *** claimed during her call to be calling in an attempt to collect a debt on behalf of Spotloan, however, I contacted Spotloan following her call, and have an email from this business stating that Nationwide Debt Management Solutions, LLC was not acting on behalf of them, as they do not work with collections companiesInstead, Nationwide Debt Management Solutions, LLC may have purchased one of their default loans.5) I have also submitted a formal complaint about Nationwide Debt Management Solutions, LLC to the Consumer Financial Protection Bureau

I have reviewed the calls and longs related to this accountFor the time being I have assigned a different representativeAt no time in any of the calls reviewed was a representative asked to not call the place of employmentThe calls did however either result in a message taken asking for a call
back or disconnected abruptly after being transferredIt was not until May that an representative finally spoke to *** *** at which time w were asked not to call the POEAs to the continuous calls from 8am eastern to 9pm easterWhile we do maintain extended ours in our California office nobody is present at 5am to make any callsThe earliest scheduled employees do not begin their work day until 7am Pacific, which is 10am easternI can only surmise others are calling for *** ***, others that can operate during such hoursWe do however have a voice mail system that would easily take a message from *** *** to pass along a best time and number to call

All our phone calls are recorded and if Mr. [redacted] chooses to go to court we understand and his false accusations will come out at that time.  At this time we have closed the account and sent it back to our client as disputed. Tell us why here...

Thank you for the follow up and opportunity to rebut the statements made by the above company.I want to first state that I have performed debt collections for the Federal Government before I retired last year. Other colleagues who work in debt collections have told me that it is unethical and very inappropriate for any debt collection agency (or its employees) to communicate with a debtor via fax or email. Given that both of these types of communication are electronic means, it stands to reason that debt collectors should not text either.Furthermore, it is very inappropriate for a debt collector to leave an answering machine message or voice mail message that identifies whom the message is for and the fact that the company is a debt collection agency. Even if there is a disclaimer up front to ignore the call. There are people who share residences and phone lines these days. This is common place throughout the United States.Given the amount of identity theft in our current times, it behooves all companies to be very mindful of protecting information. Cell phones can be hacked and this has been proven. In the current age of Voice Over Internet Protocol(VOIP), any electronic format is at risk.In any event, I have NOT received an initial letter from the company which is required by law.I do wish to point out that the first attachment is an affidavit from the debtor who caused the debt along with a third party. As she stated, she accepts full responsibility and understands the consequences of admitting such responsibility.

Yes we are not pursuing the matter with you any longer in any collection manner.  As stated we understand that mistakes happen and this definitely seems to be one of those situation.  You have advised our attorney and you can disregard that letter received.

I am rejecting this response because: the company is not telling the truth.  All calls are recorded and the agent from the company told me I was going to be arrested for fraud,  which I didn't do and their threat is against the law as 3 other things they have done.  I am represented by an Attorney and the company is being sued for breaking the law.  This is going to court because the company is a fraudulent business which is the reason for this Revdex.com complaint.  The only resolution is absolving the fake debt.  Short of this reasonable outcome, legal action will continue and all must know the lies and illegal tactics the use to hurt Americans that really do not owe the fake debts the company claims.

What Mr. [redacted] is being told by his prior colleagues as to our business practices is not our concern whether they feel they are unethical or inappropriate. We respect everyone’s opinion however we follow the laws in our industry.  Please also understand we want to re-iterate we did not text Mr. [redacted].  Though it is allowed by state law this is not a practice we take part in.  From his document provided you can see he has a Voice Writer Service for his messages.  This was a voice message left, we have never text message Mr. [redacted]. We leave the messages as stated by the law in the Foti Case Law inacted in 2006.  We appreciate that information provided by Mr. [redacted] and [redacted] who are both the responsible parties.  In which the affidavit states that Mr. [redacted] was on title and the circumstances that arrived.  Unfortunately two responsible parties cannot just exonerated a party because they choose to.  It is unfortunate the parties failed to properly notify the state as they are required to do by law to prevent this type of situation.  If Alyce would like to reach out to us we have not problems working with her to resolve the manner. As to Mr. [redacted]’s desired result we do not report to any credit agencies unless litigation is pursued and a judgment is obtained.  Also once again we follow all the laws in our industry regarding telephone and electronic communications.
