Complaint: [redacted]I am rejecting this response because: the business web sight is still up and running. I was suppose to be refunded my money back on March 18th.

Mr. [redacted]’s refund check # [redacted], in the amount of Seven Thousand Three-Hundred, Ninety ($7,290.00) Dollars & 00/100’s was cut and mailed on 01/06/2016.There is nothing further to do in this matter.

Mr. [redacted]'s Order Shipped on 11/25/15.

Mr. [redacted] order is being shipped today. He will be provided with a tracking number when the package is loaded onto the delivery truck.I hope this resolves the issue. Regards,Amelia

Mr. [redacted]’s shipment was delivered on 12/09/15 and signed for by Mr. [redacted] at 2:50 PM.I left a message on Mr. [redacted]’s answering machine today 12/15/15 at 9:33 AM to confirm his satisfaction with the order as received.Pending his response (if any), there is nothing more for NWTM to do in this matter.

Dear [redacted], Of 5 total orders, Mr. [redacted] kept the first three orders he made and stopped payment on the checks for two remaining orders when he could not speak to anyone about his concerns about making additional orders without having received his first three (following his receipt of the...

first delay notices).  He liquidated his position on the two most recent orders.I spoke with Mr. [redacted] this morning, November 30, 2015 at 10:50 AM and he is patiently waiting his shipments.His remaining three orders are scheduled to ship, to wit:I spoke with our bullion department on 11/30/15  and Order#[redacted] will ship on 12/04/2015;30-Day Delay notices will be sent for Order#[redacted] on 12/04/15 and Order #[redacted] on 12/11/15.I will continue to follow-up with Mr. [redacted] about his two remaining orders throughout the 30-Day Delay timeframe anticipated for each.

Mr. [redacted] incorrectly states both the law and the facts. Once he started the check out process on his order, he had 10 full minutes to review our terms and conditions before placing the order. Our shipping times are prominently displayed multiple times before the check out process is completed....

Unfortunately, other than requiring customers to click an acknowledgment that they've read our terms and conditions before placing their order, we cannot force customers to do read them carefully. At this point, NWTM is within our quoted shipping time frame. If Mr. [redacted] would like to cancel his order, he will be assessed with a liquidation fee and any market loss that may have occurred. back to me. As they have no intention to purchase the item from me. In addition, the P.O. stated "payable on receipt" and the USPS tracking showed they have well received the item on March 11.

Mr. [redacted] admits to purchasing bullion from us online on 08/11/2015;
In the check-out process he was required to confirm that he...

had read the “buying bullion” policies prior to completing his transaction;
‘PRODUCT INFORMATION’ https://bullion.nwtmint.com/buyingbullion.php is what we ask customers to review before they lock in pricing. If they are purchasing online they have to check a box saying that they have read, understand and agree to the terms – if they are on the phone we ask if they have and won’t move forward if they say they have not;
Under each product’s order confirmation page, prior to purchase, the following language appears:
“We ship within 8-10 weeks of good funds… Please note that we must receive payment in full before we ship your product.”
Within these sections of our policies, it states clearly that (1) expected delivery time is between 8-10 weeks from the receipt of payment and (2) there is a ten (10) day hold on all personal or business checks;
Mr. [redacted] admits to mailing a check for the purchase amount of $2525.45 on 08/17/2015;
Mr. [redacted] admits to receiving an email stating his funds were cleared on 08/28/2015;
In his complaint filed with the Revdex.com on 08/31/2015 (3 days after his funds cleared), Mr. [redacted] has made false statements to wit:
1.       misrepresenting  policies conveyed by NWTM Bullion Manager, Erin R[redacted], “should have been informed” was actually “you were informed” prior to your online purchase; and
2.       misrepresenting the policies conveyed by NWTM Vault Manager, Diane E[redacted], in that his order was not yet due to be shipped and no notice of delayed shipping was applicable to the order 72 hours after cleared funds.
Mr. [redacted] knew at the time of purchase:
1.       Funds would clear ten (10) days from receipt to clear based on his method of payment;
2.       Our shipment window for his purchase was between eight to ten (8-10) weeks from cleared funds; and
3.       He was entering into a legally binding contract with Northwest Territorial Mint;
At the time of Mr. [redacted] complaint to the Revdex.com, he knew:
1.       The price of silver has dropped since his initial purchase on 08/11/2015;
2.       His Revdex.com complaint is unfounded under the terms of the contract;
3.       His Revdex.com complaint is a frivolous attempt to breach his contract after the price of silver dropped; and
4.       His Revdex.com complaint includes proof of his attempt to profiteer in his own Customer’s Statement of the Problem, wherein he refuses to accept the buy-back terms he agreed to at the time of purchase (at the current (i.e., reduced) market price.
Mr. [redacted] Desired Settlement terms are in conflict with the binding contract in existence between [redacted] and NWTM, to wit:
1.       He continues to refuse the terms of our buy-back clause (at the current market price of silver);
2.       He is not entitled to an IMMEDIATE refund of the full purchase price; and
3.       He is not entitled to IMMEDIATE shipping.
Therefore, his order will be shipped under the terms of the contract or refunded at the current market price.
Further, inasmuch as Mr. [redacted] knows his complaint is excessively premature under the terms of the contract in existence between himself and NWTM, we request that it be removed in its entirety from our Revdex.com record and he be admonished for attempting to file a false Revdex.com claim.

Although I have received my refund (after more than 4 months) and my other order, I am rejecting this response. Northwest Territorial Mint has a very clear pattern of poor service and failure to ship the product advertised. This is not based solely on my experience, but the experience of dozens, if not hundreds, of other unsuspecting customers who entrust NWTM with their money and are counting on delivery of their purchase. The business model of NWTM has no regard for customer satisfaction and focuses only on their bottom line. I know the word is spreading about NWTM shady business practices and I hope that this complaint will help spread the word even more. Shame on NWTM for doing what they do to the small consumer... shame on you. I believe when the FTC and the WA Attorney General get tired of the numerous complaints against this company, they will run them out of Dodge. Rightfully so.Sincerely,[redacted]

The above information provided from NWTM states that there is a ten day hold on purchases made by personal check.  Under part two, section 10 Shipping time, NWTM states that orders ship promptly after proper payment.
NWTM:
Within these sections of our policies, it states clearly that (1) expected delivery time is between 8-10 weeks from the receipt of payment and (2) there is a ten (10) day hold on all personal or business checks;

There is no indication that delivery is 8-10 weeks in these sections as NWTM claims.

2.       His Revdex.com complaint is unfounded under the terms of the contract; CONTRACT TERMS STATE PRODUCT WILL SHIP PROMPTLY.
3.       His Revdex.com complaint is a frivolous attempt to breach his contract after the price of silver dropped; and [redacted]SEE BELOW

I am asserting that NWTM is engaging in deceptive marketing and business practices and cannot deliver the products it has sold to me.  I have paid for the product with good and cleared funds.  NWTM’s own policy states that products will ship promptly after cleared funds.  I assert that 12 weeks after cleared funds (NWTM’s estimated delivery) is not considered “prompt delivery” in any industry.
I also believe that my claim has merit and substantiation as evidenced by the 142 other Revdex.com claims against this company in the past 12 months.
I extended an offer to NWTM to cancel my order and refund my money if they cannot produce the product or delivery the product promptly.  Neither of which they are intending to do.  It is my contention that NWTM is deceiving customers and cannot deliver the product.Sincerely,[redacted]

or producing the silver.. we consider these actions as felonious  obtaining money under false pretenses,  and fraudulent this has been going on for over two years,, clearly in violation of all regulations,  rosses employees took an active  roll in this deception and this should have been resolved long before any law suits againsyt him and the company were ever filed or acted on.. this is felonious in the greatest degree with malice and forethought, also there are numerous players,, our rights should be at the front of any settlements.Sincerely,[redacted]
