outlined in the complaint. As the client stated, the client hired Optima Tax Relief to represent him before the IRS due to an outstanding tax liability. Prior to engaging Optima Tax’s services, the client was provided with a breakdown of the services to be provided and the cost associated with such service. Thereafter, the client made the voluntary decision to utilize IRA funds to pay for Optima Tax’s services. Although the client may have incurred additional penalties for early withdrawal of retirement funds, Optima Tax did not require the client to use IRA funds.   Although we understand and appreciate the client’s concerns, at no point did Optima Tax delay providing our services on the client’s case. While the client was enrolled in Optima Tax’s services, Optima Tax informed the client that we had to wait for the IRS to process certain documents that had been filed. As a result of the client’s tax circumstances, the processing of these documents by the IRS would take several months to be completed. Optima Tax conveyed this information to the client on numerous occasions, and informed the client that we were preparing options to protect the client from continued collection activity from the IRS in the interim while the documents processed.   Moreover, the client’s statement that Optima Tax “scared and bullied” the client is false. Optima Tax’s respoinsibility is to fully inform our client’s of the various actions the IRS can and will take to collect on any outstanding tax liability. As an example and as the client stated in the complaint, the IRS can place a lien against a tax payer to secure their interest in the debt. Therefore, the client’s claim that we were using scare tactics in order to persuade the client to entering our services is false. Optima Tax merely provided the client with all relevant information in order for the client to make an informed decision about engaging our services.   Optima Tax employs numerous tax professionals, whom represent our client’s before the IRS and establish tax resolutions. In addition to our tax professionals, each client is provided a Case Manager, who acts as the liaison between the client and the tax professional. This provides our tax professionals with the efficiency to review the case and establish the best resolutions for our clients. Therefore, although the client was not able to directly meet with the Tax Professional, Optima Tax was more than accommodating to arrange in-person meeting between the client and the Case Manager..   In conclusion, we fail to see how the client determined that there was any misrepresentation. Our advertisement is clear as well as our contract. To ensure that there is a complete understanding to the services our clients sign up for, each client will go through a voice recorded Verification Call. In this particular case, the client went through the Verification process that covers the contracted services as well as various legal disclosures with each disclosure requiring a “yes” answer before moving forward. After reviewing the Verification Call the client answered “yes” to each disclosure and gave us a 10 rating to their level of understanding of the contracted services with 10 being the highest rating a client can give.     At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. response up until January 31, 2018. Upon enrolling into our Resolution Services on October 17, 2017, the case was immediately assigned to a servicing team. The assigned team had made multiple attempts to establish communication, but the client was not responsive. When the client did respond, the client advised us that she would work on the requested documents and confirmed that she works long hours, which is the cause of her delay in responding.   Shortly after enrollment, the client unfortunately stopped making payments towards our service fee. We’ve attempted to get in contact with the client to see what, if any, assistance is needed to get their case moving forward as outlined in the agreement. During those attempts, the client expressed that affordability was an issue. We did our best to work within the client’s budget, but Optima made no promises to restructure the payment. Unfortunately, we could not accommodate the client’s demands.   At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. Optima Tax’s management has attempted to contact the client to
discuss their concerns as outlined in the complaint. Unfortunately the client
has not responded to us and we have not been able to properly evaluate their
allegations. Here at Optima Tax, we understand our client’s desire to have their
tax liability reduced or eliminated entirely and therefore we diligently work
to obtain this goal. However, although we have had success in obtaining tax
liability reductions, we do not make any guarantees that a reduction will be
granted by the IRS. Based off the signed agreement, Optima Tax has performed its
contractual duties as outlined in the agreement. Furthermore, based on the work
that Optima Tax has performed, there is a high probability that some of the
penalties that the client accrued may be waived completely. We advised the
client, and at their discretion, to submit the paperwork that Optima Tax
drafted to abate any penalties after 26 months to maximize the overall
reduction. This paperwork can definitely be submitted today and, if granted by
the IRS, it will reduce their debt. However, by submitting it now there is a
possibility that the IRS may decline the request and the client could accrue
more penalties due to the outstanding balance.
 
The
client also mentioned that their monthly payments to the IRS have doubled. This
is unfounded given the investigation that we conducted and the information that
the client supplied to us. Per our compliance call to the IRS, the client was
never in any type of agreement with them until the client hired Optima Tax.
This is something that we will seek clarification on once the client responds
to us. We cannot provide exact details of the client’s status; however, we have
completed our contractual duties. More importantly, we were able to establish a
resolution that will protect the client from future collection activity. Once
we do make contact with the client, we will thoroughly inform the client about
the services that were provided.

After reviewing the case we have documented confirmation on file that the Power of Attorney was revoked on February 23, 2018. Upon receiving the complaint Optima Tax sent another revocation letter to the IRS on April 11, 2018. Per the clients request we sent confirmation that the Power of Attorney letter has been revoked on April 17, 2018.   .

investigate the cause of the tax liability and present him with a formulated strategy to help resolve his case in the Resolution Phase. The client was thoroughly informed that there will be additional costs if he decided to move forward with the Resolution Phase, after he had been presented with Optima Tax’s strategy to resolve the case. Once the client is present with the strategy to resolve the case, the client has the option of signing up for the Resolution services or part ways with the information presented to the client by the Tax Associate.   Although there was a small delay in presenting our findings to the client, the findings were presented to the client within a reasonable timeframe. Therefore, Optima Tax fulfilled its obligations in accordance with the contract. Ultimately, the client decided not to sign up for our services, which is within their right not to do so. Based off our records there have been multiple
attempts to establish communication with the client. The email the
client attached in the client’s rebuttal was received by Optima Tax Relief on
March 1, 2018. The assigned representative replied to that email on March 5,
2018, acknowledging the email and again asked when the client would be
available to discuss the client’s concerns verbally. Thereafter, multiple calls
were placed in an effort to address the concerns directly.
 
As
stated in our initial response, the client has open audits for multiple years.
The assigned team requested various documents that the client could not provide
in full. We have emails and call recordings to support our position. Moreover,
Optima Tax is confident that the assigned team was diligently trying to obtain
the necessary documents from the client in order to perform the services on the
client’s behalf. Unfortunately the failure to provide the necessary documents
delayed the client’s case and hindered our ability to represent the client
during the audit portion of our services.

Optima Tax's management has made contact with the client to
discuss his concerns as outlined in the complaint. As part of our services, Optima
Tax will perform a thorough review of every client’s file in order to determine
whether they will qualify for a reduction in their tax liability. Our review
process can take up to a week in order to determine whether the client meets
the eligibility requirements. Based on our review, it appears that there was a
misunderstanding between the client and our Associate, on the timeline of this
process. If, after our review, we determine the client is eligible, the process
can take up to 12 months. Since he did not qualify, we informed him the affordable
payment plan we established was the best option to avoid any collection
enforcement by the IRS. After discussing these items with the client, we are
pleased to say that we have come to a mutual agreement with the client that
satisfies all parties involved and we consider this matter closed.

I had tried multiple times to correct the issues I had with the IRS myself but was unsuccessful. The professionals at Optima walked me through the process, took care of any contact that needed made with the IRS, kept me updated, and ultimately helped me reach a compromise with the IRS that I would never have been able to do myself. I'm extremely grateful to Optima for helping me put this issue behind me.

Per our records, the refund was initiated at the time of the client’s request and the funds were deposited into the account we have on file on February 16, 2018. Prior to receiving the complaint, an Optima Tax associate provided an accounting breakdown showing that the funds were transferred on...

February 16th. Optima Tax does not have control over the client’s bank account and in some cases, if the bank does not recognize the transaction the consumer would need to contact the bank to have the funds released. Since receiving the complaint, the client has yet to return our calls or reply to any of our email correspondence to discuss this matter.

presented the same claim that he would have not moved forward if he didn’t receive a significant reduction. Although Optima Tax is very successful in reducing a tax payer’s liability we do not insinuate, promise or guarantee that any type of reduction would be achieved. We make it very clear to our clients the fact that ultimately the IRS makes the decision to reduce balances and although we will ensure we strive to achieve the best possible outcome for the client, there is no promise or guarantee of a specific outcome.   Furthermore, after thorough review of the client's file and all surrounding facts, there is no evidence that such promises or guarantees were ever made to the client.  We did advise the client to provide us with any documentation that would show in fact such promises were made; however, we have yet to receive any such correspondence from the client.   During the initial conversations prior to and leading up to the client's enrollment with Optima Tax the client was thoroughly informed of the services that Optima Tax will provide. The Client Services Addendum the Client was provided clearly outlines the services Optima Tax would perform. Those services include but not limited to, IRS Representation, IRS Compliance and establish an Installment Agreement. The client had been presented this information before services commenced. After receiving the agreement which clearly and conspicuously contained language explaining that no specific outcome was promised or guaranteed, including a reduction, the client signed the agreement and moved forward with Optima Tax.   As such, it is our position that Optima Tax performed the services as outlined in the agreement. Optima Tax represented the client on behalf of the IRS and ultimately set him up on an affordable Installment Agreement. We also prepared certain documentation in an effort to reduce the client’s liability. The client has yet to contact Optima Tax to confirm if the IRS accepted our proposal. We will continue our efforts with the client in hopes of coming to an amicable resolution.

Thought all the commercials were hype but needed to take care of my IRS problems. I researched for assistance & made a decision to go with Optima. I was skeptical and was ready to cut them loose if they didn't perform. They took care of business and now I'm no longer afraid of checking my bank accounts and finding out that the IRS has drained my accounts. I'm also in a position where I see the end of my problems with the IRS.

Optima Tax’s management has reviewed the case and we feel that
there may be a misunderstanding to the end result of our investigation of the
client’s tax liability. Although the IRS may have yet to assess an ending
balance of the client’s tax liability, based off what was reported to the IRS
it appears that there may have been errors in the client’s tax reporting which
would subsequently delay the IRS’ reporting of the client’s ending balance.
Thus, when proper reporting is completed we are confident a true and correct
balance will be reflected. As the client stated, this cannot be determined
until his 2014 tax year is filed along with any scheduled write offs. Taking
all things into consideration we feel that we have done a fair assessment with
the information given to us by both the IRS as well as the client and we are
confident that we may continue to assist the client.
 
Although
there may have been initial issues with communication attempts with the IRS,
Optima Tax nonetheless obtained all the necessary information from the IRS
agent on March 10, 2016. As we previously offered to the client we are more
than happy to provide the client with the details pertaining to the exact IRS
agent we communicated with along with additional information to solidify our
efforts made on behalf of the client. Furthermore, we have also attempted and
will continue to attempt to provide the client with further details outlining
our formulated strategy that was presented to the client in an effort to
resolve their liability. Solutions were presented to the client to solve any
initial communication issues that may have arisen with the IRS and we are
confident that these issues will be fully resolved, if they have not already
been resolved.
 
As the
client mentioned in their complaint, their tax balances have yet to be assessed,
and this is a direct result as to why he has yet to receive a payoff amount
letter. However, as explained to the client, once his complete and correct
information is received by the IRS he will receive multiple letters from the
IRS until the balance is paid in full.

Waiting on resolution. They kind of hurt me by contacting the IRS on June 20th on a pay off and have a letter from IRS stating they accepted and expect me to pay 14k on Aug 19.  After Aug 19 when the IRS does not get their pay off I feel won't be good for me. I have hired a Tax attorney and waiting Optima to issue you me a refund to get this attorney started

Once they realized that my complaint amounted to a misunderstanding or simple miscommunication they went above and beyond my expectations. Not many  companies these days that take customer satisfaction that seriously. They do!!!!

As I have previously stated, this company used dishonest and harassing sales tactics. They send me advertising as spamming emails. Their email provided what was described as a removal link, to tell them that I wished to be removed from their emails and prevented from receiving any more advertising...

from them. When I clicked on this link, in fact it was a bogus link not providing me any way of no longer receiving advertising as was stated. This link took me to a page where I was then taken to the next step with questions to proceed with their offer for their services. All this, when I was led to believe I was being provided a means to be removed from their advertising spamming emails. This was deceptive and fraudulent.

Unfortunately before we had an opportunity to discuss all of these matters, he abruptly ended the call. Thereafter, the client became non-responsive to the many attempts we’ve made to contact him. Contrary to the client’s allegations, Optima Tax immediately went to work upon the client engaging our services. Unfortunately, the IRS has placed a Revenue Officer on the client’s case, which means it’s in the highest level of collections. As such, our staff immediately made multiple attempts to reach the Revenue Officer so that we could prevent any collection activity. However, the Revenue Officer proved to be unresponsive to all of our attempts. We are disappointed that the client feels as though we have not performed a service for him. We will continue our efforts in making contact with the client to explain the actions we have taken and more importantly, come to a mutual resolve.  At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy.
